THE CORPORATION OF THE TOWN OF MARATHON

BY-LAW NO. 1885
Being a by-law to consolidate, repeal and
replace the by-laws that regulate traffic and
parking on highways, in parking lots, on
municipal and private property within the
municipal boundaries of the Town of
Marathon.
WHEREAS Section 9 of the Municipal Act, 2001, S.O. 2001, C.25
provides that a municipality has the capacity, rights, powers and privileges of a
natural person for the purpose of exercising the authority under the Act;
AND WHEREAS Section 10 subsection (1), of the Municipal Act, 2001,
S.O. 2001, C.25 provides that a single-tier municipality may provide any service or
thing that the municipality considers necessary or desirable for the public;
AND WHEREAS Section 100, of the Municipal Act, 2001, S.O. 2001,
C.25 provides that a municipality may, in respect of land not owned or occupied by
the municipality that is used as a parking lot, regulate or prohibit the parking or
leaving of motor vehicles on that land without the consent of the owner of the land or
regulate or prohibit traffic on that land if a sign is erected at each entrance to the land
clearly indicating the regulation or prohibition
AND WHEREAS Section 100.1 subsection (1) of the Municipal Act,
2001, S.O. 2001, C.25 provides that a municipality may, in respect of land not owned
or occupied by the municipality, regulate or prohibit the parking or leaving of motor
vehicles without the consent of the owner of the land;
AND WHEREAS Section 102 subsection (2) of the Municipal Act, 2001,
S.O. 2001, C.25 provides that a municipality may require the owners or operators of
parking lots or other parking lots or other parking facilities to which the public has
access, whether on payment of a fee or otherwise, to provide designated parking
spaces for vehicles displaying an accessible parking permit and if it does so, the
municipality shall prescribe the conditions of use of the accessible parking permit and
shall prohibit the improper use of the permits;
AND WHEREAS pursuant to Section 214.1 of the Highway Traffic Act,
R.S.O., 1990, c.H.8, as amended authorizes the council of a municipality to
designate by by-law, a part of a highway under the jurisdiction of the municipality as a
community safety zone.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWN OF MARATHON HEREBY ENACTS AS FOLLOWS:
1.0
Short Title
1.1
This by-law may be cited as the "Parking and Traffic By-law".
2.0
Interpretation
2.1
In this by-law:
(a)
words importing the singular number only, include more persons,
parties or things of the same kind than one and the converse;
and
(b)
a word interpreted in the singular number has a corresponding
meaning when used in the plural;

(c)
"may" shall be constructed as permissive;
(d)
"shall" shall be constructed as imperative;
(e)
"includes": the words - "include - includes - including and
included" are not to be interpreted as restricting or modifying the
words or phrases which precede them.
2.2
It is declared that if any section, subsection or part or parts thereof be
declared by any Court of Law to be bad, illegal or ultra vires, such
section or part or parts shall be deemed to be severable and all parts
hereof are declared to be separate and independent and enacted as
such.
2.3
Unless specifically modified or changed herein, words or expressions
used by this by-law have the same meaning as given or used in the
Highway Traffic Act, Chapter H.8 R.S.O. 1990, as amended.
2.4
The schedules referred to in this by-law form an integral part of it. Each
entry in a column of a schedule is to be read in conjunction with the
entry or entries across from it.
2.5
Where the expression of time occurs, the time referred to is intended to
be the system of time keeping in force in the municipality at the time of
the by-law.
2.6
All words and personal pronouns relating to words contained in this by-
law include the male and female.
2.7
Article, section and paragraph headings are inserted solely for ease of
reference.
2.8
References within this by-law to the titles of the Corporation's
employees are references to the positions that held those titles at the
time this by-law was enacted. Where a corporate restructuring has
occurred such that there is no longer a person within the organization
who holds a referenced title, the reference is to the person who
undertakes the duties of the title holder at the time this by-law was
enacted. In any case of doubt, the Chief Administrative Officer for the
Corporation shall delegate the authority to the appropriate person and
direct this by-law be amended to reflect the new title.
3.0
Definitions
For the purpose of this by-law:
Accessible Parking Permit - means
a) A current and valid parking permit for a person with a disability as
issued by Service Ontario under the provisions of the Highway Traffic
Act; or
b) A current and valid permit, number plate or other marker or device
bearing the international symbol of access for people with disabilities
which has been issued by a legally recognized jurisdiction outside
Ontario.
Accessible Parking Space - means a parking space provided under this by-
law in accordance with the Town of Marathon Zoning By-Law as amended

(Refer Appendix 1), and identified by an Accessible Parking Permit Sign (refer
Appendix 1A) for exclusive use of a vehicle displaying an Accessible Parking
Permit in accordance with the requirements of the Highway Traffic Act.
Authorized Parking Sign - means any sign, pavement markings or other
device which has been placed, installed or erected on a highway, private
property or municipal property by the Town or by another party acting under
the direction or authority of the Town, to designate, regulate and/or enforce the
provisions of this by-law as amended.
Boulevard - means public property as part of the highway, between the private
property line and the edge of the travelled roadway and may or may not
contain a sidewalk or driveway.
Bicycle - means a vehicle operated by muscular power having wheels of more
than 43 centimetres in diameter, and include a unicycle and a power assisted
bicycle, but does not include a motor assisted bicycle.
Bicycle Lane - means that portion of a road not normally used for motorized
vehicular traffic, but paved for use of bicycles as a separate bicycle lane or
route or shared use lane.
By-law Enforcement Officer - means a duly authorized person appointed by
the Council of the Town of Marathon for the purpose of enforcing the
provisions of this by-law.
Commercial Loading Zone means that part of the roadway adjacent to the
travelled portion thereof which is designated for the exclusive use of
commercial motor vehicles which are engaged in the loading and unloading of
persons or freight.
Community Safety Zone means a highway or part of a highway where public
safety is of special concern, fines have been increased for certain traffic
violations and is identified by "Community Safety Zone" signs as prescribed in
regulations under the Highway Traffic Act.
Corporation - means the Corporation of the Town of Marathon.
Corner - means the point of intersection of curbs or edges of the portion of the
highway for vehicular traffic.
Crosswalk - means:
a) that part of a highway at an intersection that is included within the
connections of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs, or, in the absence of curbs, from the
edges of the roadway, or
b) any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs or by lines or other markings
on the surface.
Curb - means the concrete or asphalt edge of a roadway or the division point
between the roadway and a boulevard or sidewalk.
Designated Parking Space - means a parking space designated under this by-
law and marked by a sign, for the exclusive use of a vehicle displaying an
accessible parking permit in accordance with the requirements of the Highway
Traffic Act and the regulations made thereunder and this by-law as amended.

Disability - means:
a) any
degree
of
physical
disability,
infirmity,
malformation
or
disfigurement that is caused by bodily injury, birth defect or illness and,
without limiting the generality of the foregoing, includes diabetes
mellitus, epilepsy, a brain injury, any degree of paralysis, amputation,
lack of physical coordination, blindness or visual impediment, deafness
or hearing impediment, muteness or speech impediment, or physical
reliance on a guide dog or other animal or on a wheelchair or other
remedial appliance or device,
b) a condition of mental impairment or a developmental disability,
c) a learning disability, or a dysfunction in one or more of the processes
involved in understanding or using symbols or spoken language,
d) a mental disorder, or
e) an injury or disability for which benefits were claimed or received under
the insurance plan established under the Workplace Safety and
Insurance Act, 1997.
Driver - means a person who drives or has physical control of a vehicle on a
highway.
Driveway - means the part of a highway which has been improved to provide
vehicular access between the roadway and a private or public roadway,
laneway, parking area or to adjacent land.
Emergency Vehicle - means:
a) a fire department vehicle while responding to a fire alarm or other
emergency call; or
b) a vehicle used by a person in the lawful performance of his/her duties
as a police officer; or
c) an ambulance while responding to an emergency call or being used to
transport a patient or injured person in an emergency situation.
Fire Chief - means the person/officer in charge of the Marathon Volunteer Fire
Department; pursuant to Section 6 subsection (1) of the Fire Protection and
Prevention Act.
Fire Route - means an area on a highway or on a public parking lot or on
private property where authorized and properly worded signs are on display
indicating parking is prohibited in order to provide fire department and other
emergency vehicles unobstructed access to adjacent properties in responding
to a fire or other emergency.
Fire Route Sign - means a permanently installed legible sign having a
minimum size of 30 x 45 centimetres (12 x 18 inches) placed at intervals of not
more than 30 metres (100 feet) along a designated fire route which shall
display the following information by text or symbol (reference Appendix 2):
a) Fire route;
b) Parking prohibited;
c) Tow away zone.
Highway - means property owned by the Municipality of Marathon and
includes a common and public highway, street, avenue, parkway, driveway,
square, place, bridge, laneway, via duct or trestle any part of which is intended

for or used by the general public for the passage of vehicles and includes the
area between the lateral property lines thereof.
Highway Traffic Act - means the Highway Traffic Act, R.S.O. 1990, c.H.8, as
amended and the regulations made thereunder.
Intersection - means an area embraced within the prolongation or connection
of the lateral curb lines, or where curbs do not exist, the prolongation or
connection of the lateral boundary lines of two or more roadways which join
one another at an angle, whether or not one roadway crosses the other, or of
a roadway with a driveway, private road, crosswalk, sidewalk or pedestrian
pathway.
Laneway or Lane (except when referring to a traffic lane which forms part of
the roadway) - means:
a) improved land adjacent to the highway that provides access between a
highway and a parking area or other destination; or
b) property which may be owned by the Corporation or privately which is
not opened to the general public for use for vehicular traffic, but
provides, or could provide, vehicular access to the rear of certain
private properties with frontage on a highway.
Mobility Aid - means a device used to facilitate the transport, in a seated
posture, of a person with a disability.
Motor Assisted Bicycle - means a bicycle:
a) that is fitted with pedals that are operable at all times to propel the
bicycle,
b) that weighs not more than fifty-five (55) kilograms,
c) that has no hand or foot operated clutch or gearbox driven by the motor
and transferring power to the driven wheel,
d) that has an attached motor driven by electricity or having a piston
displacement of not more than fifty (50) cubic centimetres, and
e) that does not have sufficient power to enable the bicycle to attain a
speed greater than 50 kilometres per hour on level ground within a
distance of 2 kilometres from a standing start.
Municipal Law Enforcement Officer - means a person appointed by the
Council of the Corporation of the Town of Marathon.
Municipal Property - means real property owned by the Municipality other than
highways and includes recreation centres, arenas, park lots, fire station, work
and maintenance yards.
Municipality - means the Corporation of the Town of Marathon.
No Parking Zone - means an area on a highway where properly worded or
symbolized authorized parking signs are erected signifying parking is
prohibited at times indicated thereon.
Officer - means any municipal law enforcement officer, police or provincial
offences officer.
Official Sign - means any sign approved by the Ministry of Transportation
Ontario.
On Street Parking - means the use of vehicle parking on the roadway surface
on the adjacent shoulder.

Operator of a Parking Lot - means the owner of a parking lot or any person
who manages or controls the parking lot on behalf of the owner.
Owner - means:
a) a person with legal title to real or personal property;
b) the spouse of person in (a);
c) a person authorized in writing by the legal title holder to act on his/her
behalf to enforce or to request the enforcement of this by-law;
Owned has a corresponding meaning when describing property.
Park or Parking - means the act of leaving a vehicle standing, whether
occupied or not, except when stopped or standing temporarily for the purpose
of and while actually engaged in loading or unloading merchandise or
passengers.
Parking Control Sign - means a sign which identifies the times of day and
days of the week parking, stopping or standing restrictions are in place on the
section of highway adjacent to the sign.
Parking Lot (public or private) means any open area or portion of a structure
other than a street or highway intended for the temporary parking of vehicles.
Parking Space - means a part of a highway, municipal property or private
property the use of which is designated by signs or posts or lines or other
markings on the highway or any other area used for the purpose of parking a
vehicle.
Parking Space Marking - means markings intended to inform drivers where
they are permitted to park.
Person with a Disability - means any person who has been deemed to be
disabled by a designated medical authority and who possesses a valid
Accessible Parking Permit.
PIN - means an acronym which stands for "Parking Infraction Notice." This is
a notice, commonly referred to as a ꞌticketꞌ, which details the particulars of a
parking infraction. In particular, the PIN may indicate:
a) the licence number of the vehicle;
b) a description of the alleged offence;
c) the date, time and location of the alleged offence;
d) the set fine for the alleged offence;
e) a statement stating the owner or driver may make a voluntary payment
or pay the set fines as indicated on the PIN prior to the fifteenth day as
set out in Part II of the Provincial Offences Act;
f) that, in the event of failure to make payment, a conviction may be
registered under the Provincial Offences Act Part II;
g) the municipal address where payment can be made; and
h) the times payment can be made.

Police Officer - means a person so appointed by the Government of Ontario
as a uniformed member of the Ontario Provincial Police.
Power- Assisted Bicycle - mean a bicycle that:
a) is a powered-assisted bicycle as defined in subsection 2(1) of the Motor
Vehicle Safety Regulations made under the Motor Vehicle Safety Act of
Canada;
b) bears a label affixed by the manufacturer in compliance with the
definition referred to in clause (a),
c) has affixed to it pedals that are operable, and
d) is capable of being propelled solely by muscular power.
Private Property - means real property owned by persons, other than property
owned by the Municipality and includes real property owned by individuals,
local boards, corporations and public authorities.
Provincial Offences Officer - means a person designated under Section 1
subsection (3) of the Provincial Offences Act.
Property Line - means the lateral extremity of the highway.
Public Parking Area - means any open area or portion of a structure other
than a street or highway, intended for the temporary parking of vehicles and
on which there are accessible parking spaces, pursuant to Section 4.28 of the
Town of Marathon Zoning By-law.
Regulatory Sign - means a traffic sign advising drivers of an action they
should or must perform (or not perform) under a given set of circumstances.
Roadside Work - means construction, maintenance, or utility work that is done
on the shoulder or on the edge of the road.
Roadway - means a part of a highway, a private road, a lane or a driveway
that is improved, designated or ordinarily used for vehicular traffic, but does
not include the shoulder. Where a highway includes two or more separate
roadways, the term refers to any one roadway separately and not all the
roadways collectively.
School Zone - means a section of roadway in the vicinity of a school, with a
mandatory 40 km/h maximum speed zone.
Shoulder - means the portion of a highway between the outer edge of the
roadway and the curb, or point of intersection of the slope lines at the outer
edge of the roadway and the fill, ditch, or median slope, for the
accommodation of stopped vehicles, for emergency use, and for lateral
support.
Sidewalk - means that portion of a highway between the curb lines and the
property line of the lot abutting the highway, adjacent to the travelled roadway
which has been improved for the use of pedestrians.
Sign - means a traffic control device mounted on a fixed or portable support
which conveys a specific message by means of symbols or words, and is
officially erected under the authority of this by-law for the purpose of
regulating, warning, or guiding traffic.

Stand or Standing - when prohibited, means the halting of a vehicle, whether
occupied or not, except for the purpose of and while actually engaged in
receiving or discharging passengers.
Stop or Stopping - means the halting of a vehicle even momentarily whether
occupied or not, except when necessary to avoid conflict with other traffic or in
compliance with the directions of a police officer or a traffic control device.
Street - means an urban highway.
Temporary Conditions - means roadway and traffic control conditions related
to non-permanent construction, maintenance and utility work on any highway
open to the public.
Temporary Sign - means a regulatory, warning or guide sign intended to be
used for temporary conditions.
Town - means the Corporation of the Town of Marathon.
Traffic - means collectively, all persons and animals using the highway. The
term includes pedestrian, hidden animals, vehicles and other conveyances.
Traffic Control Device - means any sign, signal, marking or device placed,
over or adjacent to a roadway, whether permanent or temporary, under the
authority of this by-law for the purpose of regulating, warning, guiding or
informing highway users.
Turning Basin - means an enlarged area at the end of a highway or roadway
designed to permit vehicles to turn around.
Turn Lane - means a lane designed to facilitate vehicular turn movements
from the through roadway.
Vehicle - means a motor vehicle, trailer, traction engine, farm tractor, road
building machine or any vehicle drawn, propelled or driven by any kind of
power, including muscular power. The term expressly excludes; motorized
snow vehicles or the cars of railway trains running only upon rails.
4.0
Abbreviations
4.1
In the schedules to this by-law the following abbreviations, definitions
and symbols stand for the words respectively set forth opposite thereto
as follows:

5.0
Distances
5.1
Where a distance is used in this by-law as a part of a prohibition of
parking or stopping within a specified distance of an object, structure,
land or part of a highway, such distance shall be measured:
(a)
along the curb or edge of the roadway from a point in such curb
or edge of roadway opposite the nearest edge of such object,
structure, land or part of a highway, unless the context otherwise
requires; and
(b)
from such object, structure, land or part of a highway in all
directions.
6.0
Traffic Control Device Installation
6.1
The Works and Operations Manager for the Municipality or designate is
hereby authorized to place, erect and maintain or cause to be placed,
erected and maintained such traffic control devices that are required to
give effect to the provisions of this by-law.
6.2
The Works and Operations Manager or designate, notwithstanding the
other provisions of this by-law, is further authorized for the duration of
the situation, to place, erect or maintain such traffic control devices that
are not authorized by this by-law but are required for safety,
construction, road maintenance, for an activity for which the Town has
granted a permit or for reasons of emergency.
6.3
The Works and Operations Manager is further appointed for the
purpose of Section 128 subsections 8.1 and 10 of the Highway Traffic
Act, and in accordance with those subsections the Works and
Operations Manager may:
(a) designate a highway or portion of a highway under the
municipality's jurisdiction as a construction zone; and
(b) set a lower rate of speed for motor vehicles driven in the
designated construction zone than is otherwise provided in
Section 128 of the Highway Traffic Act.
6.4
The speed limit set by the Works and Operations Manager under
Section 6.3 (b) of this by-law shall not become effective until the
highway or portion of it affected is signed in accordance with the
regulations under the Highway Traffic Act, indicating the maximum rate
of speed, as well as the commencement and the end of the construction
zone.
6.5
Unless otherwise permitted, no person shall place, maintain or display
upon or in view of any highway any sign, signal, marking, or device
which conceals from view or interfaces with or distracts from the
effectiveness of a traffic control device without prior approval of the
Works and Operations Manager or designate.
7.0
Enforcement

7.1
All provisions of this by-law may be enforced by police officers
throughout the Municipality.
7.2
By-Law enforcement officers and designated provincial offences
officers shall enforce the parking and stopping provisions of this by-law.
8.0
Exemptions
8.1
The provisions of this by-law shall not, if compliance therewith would be
impractical, apply to:
(a)
an emergency vehicle; or
(b)
a vehicle registered to the Municipality or registered to a utility,
while actually performing work on behalf of the Town of
Marathon; or while responding to an emergency; or
(c)
personal vehicles of volunteer firefighters when on duty; or
(d)
when the driver or operator of a vehicle is in compliance with the
direction of a police officer or a traffic control device.
9.0
Emergency Prohibition
9.1
Notwithstanding anything to the contrary contained herein, a police
officer, fire chief, manager of works and operations or by-law
enforcement officer, during any emergency or special circumstance
may:
a) prohibit any and all parking on a highway within the area affected
by the emergency or special circumstance; or
b) authorize the erection of temporary "No Parking" signs or
barricades on any highway or portion of highway; or
c) declare that any vehicle already parked is parked illegally
regardless of the time permitted for parking such vehicle under
the provisions of this by-law.
9.2
Where possible the owner or driver of a vehicle declared to be illegally
parked under Section 9.1 (c) of this by-law may be notified by a police
officer or by-law enforcement officer that such parking has been
prohibited and shall be ordered to remove the vehicle within a time
specified.
9.3
Where the owner or driver notified under Section 9.2 to remove the
vehicle does not do so, or where the owner or driver cannot
immediately be located, the said vehicle declared to be parked illegally
may be removed forthwith by an order of those persons holding the
positions named in Section 9.1.
10.
Removal of Illegally Parked Vehicle
10.1 A police officer or by-law enforcement officer, upon discovery of any
vehicle parked or left in contravention of this by-law, may cause it to be
moved or taken to and placed or stored in a suitable place and all costs
and charges for removing, caring and storage thereof, if any, are a lien
upon the vehicle which may be enforced in the manner provided by Part
111 of the Repair and Storage Liens Act, Chapter 25, R.S.O. 1990 as
amended.

10.2 The provisions of this section also apply to the Manager of Works and
Operations or designate for purposes of enforcing Section 19.0 Winter
Parking Restrictions.
10.3 The Municipality will not be liable for any damages which may occur to
vehicles being moved under the provisions of Section 10.1.
11.
Owner Liable
11.1
Where a vehicle has been parked or stopped in contravention of this
by-law, the owner of the vehicle is guilty of an offence and is liable to
the fine prescribed for the offence unless, at the time of the offence, the
vehicle was in possession of some person other than the owner without
the owners consent.
12.
Method of Parking
12.1 No person shall park a vehicle on any highway except as follows:
a) on the right-hand side of the Highway, having regard to the
direction in which the vehicle has been proceeding;
b) with the right front and right rear wheels or runners of the vehicle
parallel to the edge of the roadway; and
c) with the right front and right rear tires not more than thirty
centimetres (30 cm) from the edge of the roadway or curb if
provided or in the absence of a curb as near as possible to the
right hand limit of the shoulder.
12.2 On municipal or private property individual parking spaces may be
defined by painted lines or other suitable marks on the surface of the
parking lot. Where such parking spaces are so defined, no person shall
park a vehicle other than within the confines of the parking spaces so
defined.
13.0 Parking and Stopping Prohibited At Any Time
13.1 No person shall park or stop, or cause to be parked or stopped, any
vehicle in any of the following places at any time of the day unless such
stopping is explicitly permitted by a traffic control device or at the
direction of a police officer:
a)
on any sidewalk;
b)
in an intersection;
c)
in a turning basin;
d)
in front of a public driveway;
e)
in front of a private driveway;
f)
within 0.75 metres (2.5 feet) of a public driveway;
g)
within 0.75 metres (2.5 feet) of a private driveway;
h)
within 9 metres (30 feet) of any intersection;

i)
within a distance of 3 metres (10 feet) from the closest point on
the curb or edge of a highway nearest to any fire hydrant;
j)
within 6 metres (20 feet) of a crosswalk at an intersection;
k)
within 15 metres (50 feet) of a crosswalk on a highway;
l)
on any crosswalk;
m)
in front of the entrance to a fire station;
n)
in front of the entrance to a hospital;
o)
on any curb;
p)
on any boulevard, except when parking is otherwise permitted by
this by-law;
q)
on any highway in such a manner as to obstruct traffic;
r)
in such a position as to prevent the convenient departure of any
other vehicle previously parked or standing;
s)
upon a roadway in such a manner as to leave available less than
3 metres (10 feet) of the width of the roadway for free movement
of vehicular traffic;
t)
on the roadway side of any vehicle stopped or parked at the
edge or curb of the highway;
u)
upon a highway for the purpose of repairing, washing or
maintenance of a vehicle other than in an emergency;
v)
within 7 metres (23 feet) of the entrance to any church, public
hall, theatre or other building where public meetings are held;
w)
on any highway for the purpose of displaying a vehicle for sale;
x)
on any highway for the purpose of soliciting, vending, buying or
selling goods and/or services or otherwise conduct business of
any kind, unless permitted by this or any other by-law.
14.0 No Parking Zones
14.1 Where parking control signs establishing a "No Parking Zone" have
been erected, no persons shall park a vehicle within such zone except
when necessary to avoid conflict with other traffic or in compliance with
a traffic control device or sign, or the directions of a police officer.
14.2 Without limiting the generality of the provisions of Section 14.1 of this
by-law, authorized parking signs may be erected prohibiting the parking
of a vehicle on any highway:
a)
named or described in Schedule 'A' of this by-law, on the side or
sides of the highway set out therein, during the times and/or days
set out therein;
b)
within 15 metres (50 feet) of the termination of a dead-end
highway;

c)
in front of an emergency entrance to, or exit from a hospital,
auditorium, recreation complex or other building in which persons
may be expected to congregate in large numbers;
d)
on that side of any highway where the same abuts on the
property of any public park or public playground;
e)
where there is a school, on both sides of the highway contiguous
to the limit of land used for school purposes;
f)
within 15 metres (50 feet) on either side of an access to a multi-
use trail;
g)
within 9 metres (30 feet) of any fire hall access on the side of the
highway on which the fire hall is located; and
h)
within 15 metres (50 feet) of an intersection.
15.0 Limited Parking
15.1 When parking control signs are on display, no person shall park a
vehicle on any highway named or described in Schedule 'B' of this by-
law, except on the side or sides of the highway set out therein, during
the times and/or days set out therein, for the length of time set out
therein, for the specific class or type of vehicle set out therein.
16.0 Accessible Parking
16.1 Every owner and operator of a public parking area or other parking
facility to which the public has access shall provide accessible parking
spaces for the sole use of vehicles operated by or used to convey a
person with a disability in at least the number prescribed by the
Corporation of the Town of Marathon Zoning By-Law as amended
(Reference Appendix 1):
a)
Every owner or operator of a public parking area may voluntarily
provide a number of accessible parking spaces above and
beyond the requirements prescribed in the Corporation of the
Town of Marathon Zoning By-Law as amended.
16.2 Accessible parking spaces must be located so as to be readily
accessible to a person with a disability, whether via ramps, depressed
curbs or other appropriate means and where the public parking area is
intended to serve a particular building or complex, located within easy
access of said building or complex.
16.3 Accessible parking spaces shall be placed with sufficient clearance
around the vehicle in terms of obstacles such as, but not restricted to,
light standards or waste receptacles.
16.4 Every property owner and every person having care and control over a
property or relevant portion thereof, shall ensure no accessible parking
space or access thereto is obstructed by any object or by the moving,
placing or storage of snow;
a)
No person shall obstruct an accessible parking space or access
thereto by any object or by the moving, placing or storage of
snow.

16.5 The public parking area owner and every person having care and
control of the public parking area in which accessible parking signs are
located, pursuant to this by-law, shall be responsible for the
procurement, installation and maintenance of accessible parking signs
and for ensuing that said accessible parking signs conform to the
provisions of the Highway Traffic Act, R.R.O. 1990, Regulation 581 as
amended (See Appendix 1A).
16.6 An accessible parking permit shall be displayed on the sun visor or on
the dashboard of a vehicle so the international symbol of access for
persons with a disability, the permit number and the expiry date of the
permit are clearly visible from the outside of the vehicle.
(a)
If the vehicle is a motorcycle or a motor-assisted bicycle, the
permit shall be displayed on the top left corner of the number
plate on the vehicle.
16.7 A vehicle displaying a currently valid accessible parking permit, number
plate, other marker or device bearing the international symbol of access
for persons with a disability issued by another jurisdiction is entitled to
the same privileges as a vehicle displaying an accessible parking
permit issued under the Highway Traffic Act.
16.8 No person shall park, stop or leave a vehicle in an accessible parking
space unless:
a) A valid accessible parking permit is properly displayed upon the
vehicle ensuring the permit number and expiry date are clearly
visible; and
b) The accessible parking space is vacant of any other vehicle; and
c) The vehicle is positioned fully within the accessible parking
space; and
d) The vehicle does not encroach upon an access aisle, if any.
16.9
An officer may at any reasonable time, enter on land for the purpose of
carrying out an inspection to determine compliance with Section 16
subsection 1 through subsection 8 of this by-law.
17.0 Fire Routes
17.1 If, after inspection of any building, the Fire Chief of the Corporation is
satisfied that, in order to suppress and prevent the spread of fires, a fire
route is warranted in respect of any building, s/he shall serve or cause
to be serviced by personal service or by prepaid registered mail to the
owner of the building shown on the records of the Land Registry Office,
an order requiring the owner to comply with the provisions of the
Ontario Fire Code and/or the Ontario Building Code.
17.2 Every owner of a building having been served with an order to comply
pursuant to Section 17.1 shall conform to such order within sixty (60)
days of the date of its service.
17.3 Every owner of a building having a fire route shall erect authorized
signs indicating said fire routes (Refer Appendix 2).
17.4 Once authorized signs have been erected the owner of the property
shall be responsible for their maintenance.

17.5 The owner of a property which has fire route signs erected along a
designated fire route shall not permit anything to be done which
obstructs the plain view of any authorized sign by the driver of a vehicle
along the said fire route.
17.6 The owner shall at all times keep the fire route in good repair, free and
clear of any obstruction, object or thing likely to hinder, obstruct or
interfere with the movement of firefighting apparatus or emergency
vehicles along the fire route.
17.7 No person shall move, remove or obstruct a view of an authorized fire
route sign along a fire route.
17.8 No person shall erect or maintain along a fire route any sign or facsimile
of same which may conflict or be confused with a fire route sign.
17.9 No person shall park a vehicle along a fire route or have any part of a
vehicle located within the fire route obstructing it.
17.10 No person shall move or operate a vehicle other than a police,
ambulance or fire department vehicle on any street or lane within 30
metres (100 feet) of a fire or firefighting apparatus except as directed by
a police officer, fire fighter, by-law enforcement officer or any person
designated by the senior fire fighter on scene.
17.11 No person shall drive a vehicle over a fire hose on any street or lane.
17.12 The private highways or portions of parking lots of the specified public
buildings named and described in Schedule 'C' hereto attached, are
hereby designated as 'Fire Routes'.
18.0 Stopping
18.1 Unless otherwise permitted in this by-law, no person shall stop a
vehicle on a highway:
a)
On or partly on a sidewalk or footpath;
b)
Within an intersection or crosswalk;
c)
Adjacent to, or across from, any excavation or obstruction on the
roadway in a manner which impedes the free flow of traffic;
d)
On the roadway side of any stopped or parked vehicle;
e)
Within thirty metres (100 feet) of the approach side of the
nearest rail of any level crossing of a railway;
f)
Within fifteen metres (50 feet) of the leaving side of the nearest
rail of any level railway crossing.
18.2
Where signs establishing a 'No Stopping Zone' are on display, no
person shall stop a vehicle within such zone other than a school
purpose vehicle.
18.3
Without limiting the generality of the provisions of Section 18.2 parking
control signs may be erected prohibiting the stopping of a vehicle on a
highway in any of the following places:

a)
on any of the highways or parts of highways named or described
in Schedule 'D' to this by-law, on the side or sides of highways
set out, during the times and/or days set out in the said
Schedule;
b)
within the turning basin of a highway known as a 'cul-de-sac';
c)
on any highway within fifteen metres (50 feet) of a pedestrian
crossover.
19.0 Winter Parking Restrictions
19.1 No person shall park or stand a vehicle or permit a vehicle to remain
parked on any highway under the jurisdiction of the Corporation of the
Town of Marathon between the hours of 2:00 A.M. and 9:00 A.M. from
November 01 in any year to March 31 of the following year (both dates
inclusive).
19.2 Notwithstanding any other provisions of this by-law, no person shall
park or stand a vehicle on a highway in such a manner as to interfere
with the movement of traffic or the clearing of snow from the highway.
19.3 No person shall park or stand a vehicle or permit a vehicle to remain
parked on any highway at any time when the highway is specifically
marked with signs indicating snow removal.
19.4 Notwithstanding Section 19.1, at any time of the day, where a vehicle is
parked on a municipal highway or other municipal property in such a
way as to interfere or prevent the safe and efficient winter road snow
clearing activities to continue, the owner or operator of the vehicle may
be required to move or relocate the vehicle and shall:
a)
where the owner or operator is at or near his/her vehicle and a
municipal representative verbally or by hand signal requests the
vehicle to be relocated from its parked location, the owner or
operator shall immediately move the said vehicle to a location
where it will no longer cause interference with winter snow
removal operations.
20.0 Funeral Services or Other Processions
20.1 Church and funeral parlours holding funeral services are hereby given
authority to place signs or otherwise in a manner approved by the
Municipality indicating parking, except for those attending such service,
is temporarily prohibited in the parking spaces so marked for a period of
one hour in advance of the scheduled time of such service, and during
such service. No person shall park a vehicle in contravention of such a
sign. Any person(s) disobeying the instructions of the said signs shall
be considered as violating the provisions of this part relating to parking.
20.2 No person shall drive a vehicle so that it intersects a funeral or other
authorized procession in motion except under the direction of a police
officer.
20.3 All persons driving vehicles in a funeral or other procession shall drive
such vehicles as near to the right hand edge of the roadway as is
practicable and safe.
21.0 Commercial Loading Zones

21.1 Where parking control signs are displayed, no person shall stop, stand
or park any motor vehicle in a Commercial Loading Zone as set out
respectively in Columns 1, 2 and 3 of Schedule 'E' to this by-law for any
purpose other than the expeditious unloading and delivery or pick up
and loading of materials, goods or passengers during the times set out
in Column 4 of the said Schedule.
21.2 No person shall stop, stand or park as authorized under subsection 1
above for a continuous period greater than the time set out in Column 5
of Schedule 'E'.
21.3 When signs are on display, no person shall stop a vehicle other than a
commercial motor vehicle on any of the highways or parts of highways
named or described in Schedule 'E' to this by-law, on the side or sides
of highways set out, during the times and/or days set out in the said
Schedule.
21.4 Sections 21.1 and 21.3 do not apply to the driver of a passenger vehicle
which temporarily stops in a loading zone for the purpose of and while
actually engaged in loading or unloading passengers and/or
merchandise, provided such stopping does not interfere with any
commercial motor vehicle entering or exiting such loading zone.
22.0 Through Highways
22.1 The highways or parts of highways named or described in Schedule 'M'
to this by-law are designated as 'Through Highways' except at
intersections thereon where traffic control devices or an all way stop
control are in operation.
22.2 For all highways or parts of highways designated as a 'Through
Highway', a stop sign or a yield sign shall be erected facing
approaching traffic on the highways or parts of highways intersecting
the 'Through Highway'.
23.0 Intersection Stop Signs
23.1 Stop signs shall be erected at the intersections named or described in
Schedule 'F' to this by-law, facing the traffic proceeding in the direction
specified in the said Schedule, on the highway or part of highway set
out in the said Schedule.
24.0 Intersection Yield Signs
24.1 The Corporation shall erect yield right-of-way signs at the intersections
named or described in Schedule 'G' to this by-law for the control of
traffic entering the intersection in the direction set out in the said
Schedule and from the highway set out in the said Schedule.
25.0 Lane Designation
25.1 When authorized signs or painted lane markings are on display, a
person operating a vehicle on any of the highways or parts of highways
named or described in Schedule 'H' to this by-law, proceeding in the
direction set out, at the location set out, shall make the movement(s)
set out in the said Schedule or parts of highways named or described in
Schedule 'H' to this by-law, proceeding in the direction set out, at the
location set out, shall make the movements(s) set out in the said
Schedule.

26.0 Rates of Speed (km/h)
26.1
When authorized signs are on display, the maximum permissible rate of
speed on any of the highways or parts of highways named or described
in Schedule 'I' to this by-law shall be that rate of speed set out in the
said Schedule.
26.2
In accordance with the Highway Traffic Act, no person shall drive a
motor vehicle on a municipal highway at a rate of speed greater than 50
kilometres per hour unless otherwise indicated by an authorized sign.
27.0 Vehicle Movement-U-Turn
27.1
No person shall make a U-Turn:
(a)
upon any highway unless it can be done in safety and without
interfering with other traffic; or
(b)
within any intersection where stop signs are erected.
28.0 Entering Highway
28.1 The driver or operator of a vehicle emerging from a private roadway,
driveway, lane or building onto a highway shall, immediately prior to
driving onto a sidewalk, footpath or roadway, yield to all pedestrians
and vehicular traffic on that roadway.
29.0 Barricaded Highway
29.1 No person shall drive, operate or park a vehicle through or upon any
part of any highway barricaded and marked by signs indicating the
highway's use is prohibited.
30.0 Driving on Sidewalks and Boulevards
30.1 No person or operator of a vehicle shall drive upon a sidewalk or
footpath on a highway except for the purpose of directly crossing the
sidewalk or footpath.
30.2 No person or operator shall drive a vehicle over or upon a raised curb
except at a place where there is a ramp or depressed curb provided.
30.3 No person or operator of a vehicle shall drive on any boulevard within
the Town of Marathon except for the purpose of directly crossing a
boulevard at a driveway or other designated crossing.
30.4 Sections 30.1 and 30.2 and 30.3 shall not apply to:
a)
equipment operated by or on behalf of the Municipality for
the purpose of repair, snow or ice removal; and
b)
mobility aids, motorized wheelchairs, baby carriages,
tricycles or children's wagons.
31.0 Pedestrian Obstructing a Highway or Sidewalk
31.1 No pedestrian shall occupy a highway or sidewalk in such a manner as
to obstruct or impede the free passage of pedestrians or vehicles along
or across such highway or sidewalk.

32.0 Boarding or Alighting from Vehicles in Motion
32.1 No person shall board or alight from any vehicle while such vehicle is in
motion.
33.0 Coasting On Highways
33.1 No person shall coast by means of roller blades, roller skates or
whether on a sleigh, skateboard, cart, express wagon, toboggan or
other similar device upon the roadway of a highway except while
crossing said highway on foot at a crosswalk.
34.0 Mobility Aids and Wheelchairs
34.1 No person shall operate a mobility aid or wheelchair conveyance
powered either by mechanical or muscular means on a roadway.
34.2 Section 34.1 does not apply where the mobility aid or wheelchair
conveyance may be required by the operator to cross any highway at a
crosswalk as defined in this by-law.
34.3
Where there is no sidewalk the operator of a mobility aid or wheelchair
conveyance may operate the aforementioned appliances by running
parallel to the street.
35.0 Vehicles Not Equipped With Rubber Tires
35.1 No person shall drive or haul any traction engine, tractor or other heavy
vehicle not equipped with rubber tires upon any paved or hard surfaced
highway within the Municipality unless prior approval has been obtained
from the Corporation.
35.2 Where any traction engine, tractor or other heavy vehicle not equipped
with rubber tires is operating with the approval of the Corporation it shall
be operated with the adherence to any written conditions, regulations or
instructions issued by the Corporation.
36.0 Animals on a Highway
36.1 No person shall drive or ride any horse or other animal upon any
roadway of any highway within The Town of Marathon.
36.2 Any person driving or riding a horse or other animal along a highway
shall do so in a manner to not endanger or unreasonably inconvenience
any person.
37.0 Bicycle Lanes
37.1 The lanes or portions of lanes on highways listed in Schedule 'J' of this
by-law are established as bicycle lanes.
37.2
A designation as a bicycle lane under Section 37.1 shall be effective
upon the erection of authorized signs to that effect.
37.3
Subject to Section 8.0, no person shall operate a vehicle other than a
bicycle or a motor assisted bicycle in any bicycle lane except for the
purpose of:
a)
ingress to or egress from a private lane or driveway
adjacent to the bicycle lane;

b)
making a turn at a highway intersecting the bicycle lane;
c)
entering or exiting a curb lane used for parking;
d)
loading or unloading of a person with a disability, while
actively engaged in doing so;
e)
operating a school bus while actively engaged in picking
up or dropping off school children; or
f)
operating a taxicab while actively engaged in loading or
unloading of passengers
37.4
Notwithstanding Section 37.3, no person operating a vehicle in a
bicycle lane for the purposes set out in Section 37.3 shall operate said
vehicle in the lane for a distance exceeding forty-five (45) metres.
37.5
No person shall park or stop a vehicle other than a bicycle or a motor-
assisted bicycle in a bicycle lane except as set out in Section 37.3 (d),
(e), and (f).
38.0 Bicycles
38.1 A person driving a bicycle shall drive as near to the right hand side of
the roadway as practicable and shall exercise due care when passing a
standing vehicle or one proceeding in the same direction.
38.2 Persons operating bicycles upon the roadway of a highway will do so in
single file.
38.3 No person operating a bicycle shall carry any package, bundle or article
in such a manner as to interfere with proper management and control of
the bicycle.
38.4 No person riding a bicycle shall remove his/her feet from the pedals
while the bicycle is in motion.
38.5 No person shall leave a bicycle on a highway in such a manner as may
obstruct traffic.
38.6 No person over the age of ten (10) years shall ride a bicycle upon a
sidewalk.
38.7 No person ten (10) years of age or under shall ride a bicycle upon a
roadway.
38.8 When a person described in Section 38.6 takes a bicycle on a sidewalk
or a person described in Section 38.7 takes a bicycle on a roadway,
such person shall not ride on such bicycle and such bicycle shall be
carried or pushed and the person having care and control thereof while
doing so is a pedestrian and is subject to all the rights and obligations
thereof.
38.9 No more than one person shall occupy a bicycle at one time unless the
bicycle is designed for more than one rider.
38.10 Despite the provisions of the Highway Traffic Act as amended, bicycles
are permitted on paved shoulders at the locations set out in Schedule
'J'.

39.0 Community Safety Zones
39.1
Where signs are erected or placed on highways in accordance with the
regulations of the Highway Traffic Act of Ontario, R.S.O. 1990, Chapter
H-8, as amended from time to time. The highways set out in Column 1
and limits as defined in Columns 2 and 3 of Schedule "K" shall be
defined as Community Safety Zones during the prohibited times or days
as set out in Column 4 to the said Schedule "K".
39.2
No particular provision of Section 39 subsection 1 shall become
effective until signs are erected, in accordance with the Highway Traffic
Act and the regulations, on the designated part of the highway.
40.0 School Zones
40.1
The highways or portion of highways set out in Column 1 of Schedule
'L' of this by-law on the side set out in Column 2 of the said Schedule
between the limits set out in Column 3 of the said Schedule and at the
school or institution set out in Column 4 of the said Schedule are hereby
designated as school zones.
40.2
Each of the designations referred to in Schedule 'L' shall not become
effective unless and until the highways or portions thereof affected are
marked to comply with the provisions of the Ontario Highway Traffic Act
and the regulations thereunder, as amended.
41.0 Enforcement and Penalties
41.1 This by-law may be enforced by an officer.
41.2 Where a vehicle is found parked, standing or stopped in contravention
of the provisions of the by-law, the officer finding the vehicle may
complete and place upon or attach to the vehicle a Parking Infraction
Notice. Where the contravention involves a combination of vehicles,
placement of the PIN on any one of the vehicles in combination shall be
sufficient.
41.3 The ticket shall be completed in triplicate (i.e. Parking Infraction Notice,
Certificate of Parking Infraction and Office Copy) and the issuing officer
shall attach one copy (PIN) to the vehicle (where applicable) or
otherwise serve one copy directly to the person alleged to have
committed the offence and deliver the remaining copies to the
Municipality of Marathon.
41.4 The person receiving the Parking Infraction Notice may, within five (5)
days exclusive of Saturdays, Sundays, and statutory holidays, after the
time of the alleged offence, report to the Town Hall of the Municipality of
Marathon and pay the sum designated as "Voluntary Payment Option"
on the Parking Infraction Notice.
41.5 Voluntary payment as set out in Section 41 subsection 4 is accepted as
payment in full satisfaction of the alleged offence. A receipt of the
payment shall be given to the person making the payment. Receipts
shall be sent to persons remitting payment by mail only if a self-
addressed, stamped envelope is included with the payment and the
Parking Infraction Notice.
41.6 Where a Parking Infraction Notice is not placed on a vehicle or served
on a person as required by Section 41 subsection 3, or where a Parking

Infraction Notice was placed or delivered but was dislodged, removed
or misplaced, prosecution for any offence under this by-law is not
prejudiced.
41.7 Every person who contravenes any provision of this by-law is guilty of
an offence and upon conviction is liable to a fine and any other
penalties as provided for in the Provincial Offences Act, R.S.O. 1990,
c.P. 33, the Municipal Act 2001, the Ontario Fire Code and the Ontario
Building Code, as amended, as applicable and any such successor to
each of those statutes.
41.8 The owner of a vehicle that is parked, stopped or standing in
contravention of this by-law is responsible for the infraction regardless
of whether or not s/he was the driver of the vehicle at the time of the
offence, unless the owner proves to the satisfaction of the court, that at
the time of the infraction, the vehicle was in the possession of someone
other than the owner without the owner's consent.
42.0 Repeals
Be it further enacted that the following by-laws hereinafter set forth are hereby
repealed; 41, 43, 114, 137, 200, 253, 281, 400, 437, 503, 547, 644, 673, 696,
706, 716, and all subsequent by-laws that amended by-law 716, including by-
law 1804, 1423, 1592.
THAT this by-law shall come into force on the date of its final passing.

ACCESSIBLE PARKING FOR PERSONS WITH DISABILITIES
SECTION 11
A parking space designated on Crown land or under a municipal by-law for the use of
persons with a disability or required by Ontario Regulation 919/11 (Integrated
Accessibility Standards) made under the Accessibility for Ontarians with Disabilities
Act, 2005 for the use of persons with a disability shall be distinctly indicated by
erecting an accessible parking permit sign which shall,
a) Be not less than forty-five centimetres in height and not less than thirty
centimetres in width and bear the marking and have the dimensions as
described and illustrated in the following Figure:

FIRE ROUTE SIGNS
Symbol and Wording, Colour and Numbers
Fire Route Signs shall be erected:
i.
No less than 2 metres from grade to bottom of sign;
ii.
No higher than 3 metres from grade to top of sign;
iii.
Installed so there are no obstructions within 6 metres (20 feet) of the
sign;
iv.
Parallel to the fire route;
v.
Displaying single headed arrows pointing in the direction in which the
regulation is in effect and at intermediate points throughout the
regulated area, double - headed arrows shall indicate the parking
prohibition exists in each direction.
