THE CORPORATION OF THE MUNICIPALITY OF MCDOUGALL
BY-LAW NO. 2024-13
Being a by-law to adopt a Tariff of Fee Schedule and to rescind By-law
2023-01.
WHEREAS Section 69(1) of the Planning Act, R.S.O. 1990, c.P.13, as amended,
provides that Council by by-law, may prescribe a tariff of fees for the processing of
applications made in respect of planning matters;
AND WHEREAS Section 51(1) of the Planning Act, R. S.O. 1990 states that the
council of a municipality may impose as a condition of approval of the subdivision of
land the conveyance of land for park or public recreation purposes;
AND WHEREAS Section 51(3) of the Planning Act, R. S.O. 1990, states that a
payment of money may be imposed as a condition in lieu of the transfer of land;
AND WHEREAS Section 53(12) of the Planning Act, R. S.O. 1990, states that a
council in determining whether a provisional consent is to be given shall have regard
to the matters under subsections 51(24), 51(26) and (27) and section 51.1
AND WHEREAS pursuant to Section 390 - 400 of the Municipal Act S.O. 2001 c.25,
a Municipality and a local board may pass by-laws imposing fees or charges on any
class of persons.
NOW THEREFORE the Council of the Corporation of the Municipality of McDougall
hereby enacts as follows:
1. The tariff of fee schedule shall be as listed in Schedule "A" attached to and
forming part of this By-law.
2. Any other costs which may be incurred beyond the normal processing costs, shall
be the responsibility of the applicant.
3. That the fees prescribed herein, do not include any functions relating to an
Ontario Municipal Board hearing.
4. That by-law 2023-01 is hereby repealed and where any by-law or resolution
passed prior to this by-law conflicts with this by-law, the terms of this by-law shall
prevail.
5. That this by-law shall take force and effect upon final passing thereof
