Municipality of Middlesex Centre
By-Law 2018-092
BEING A BY-LAW TO REGULATE TRAFFIC AND THE PARKING OF MOTOR
VEHICLES IN THE MUNICIPALITY OF MIDDLESEX CENTRE.
WHEREAS subsection 10(2) paragraph 7 of the Municipal Act, 2001 , S.O. 2001 , c. 25,
("Municipal Act") as amended, provides that a municipality may pass by-laws to provide
any service or thing that the municipality considers necessary or desirable to the public;
AND WHEREAS subsection 5(3) of the Municipal Act provides that a municipal power
shall be exercised by by-law.
AND WHEREAS section 128 of the Municipal Act, 2001 provides that a local municipality
may prohibit and regulate with respect to public nuisances, including matters that, in the
opinion of Council are or could become public nuisances;
AND WHEREAS in the opinion of Council for the Municipality of Middlesex Centre , the
act of parking, standing or stopping a vehicle on a front yard, side yard or boulevard is or
could become a public nuisance;
AND WHEREAS section 425 of the Municipal Act, 2001 establishes that any person who
contravenes any by-law of the municipality is guilty of an offence;
AND WHEREAS section 439 of the Municipal Act, 2001 provides that the owner of a
vehicle is guilty of an offence even if the owner is not the driver of the vehicle, where a
vehicle has been left parked, stopped or standing in contravention of a by-law;
AND WHEREAS the Municipal Council for The Municipality of Middlesex Centre enacted
By-law No. 2006-052 on June 7, 2006 to regulate and control parking of motor vehicles
within then Township of Middlesex Centre.
AND WHEREAS it is deemed expedient to repeal By-law No. 2006-052 and all of its
amendments and replace it with a new by-law to regulate traffic and the parking of motor
vehicles in the Municipality of Middlesex Centre.
THEREFORE the Council of the Municipality of Middlesex Centre enacts as follows:

1. Definitions
In this by-law, unless a contrary intention appears,
"boulevard" means that portion of every road allowance within the limits of the
Municipality of Middlesex Centre which is not used as a sidewalk, driveway access,
traveled roadway or shoulder;
"bus" means a motor vehicle designed for carrying ten or more passengers and used for
the transportation of persons;
"bicycle" has the same meaning as in the Highway Traffic Act,
"Refreshment Vehicle" means a vehicle or trailer, which is no greater than 10 metres
(33 feet) in length, and 2.6 metres (8.5 feet) in width, from which food products are sold
from a location on Municipality owned property and where the food products are prepared
on the vehicle or trailer;
"Municipal Engineer" means Director, Public Works and Engineering or any employee
or agent of the Municipality designated by the said Director, Public Works and Engineering
to act on his or her behalf;
"commercial motor vehicle" means any motor vehicle having permanently attached
thereto a truck or delivery body, and includes ambulances, hearses, casket wagons, fire
apparatus, motor buses and tractors used for hauling purposes on the highways;
"Council" means the Municipal Council of The Municipality of Middlesex Centre;
"crosswalk" means
i.
that part of a highway at an intersection that is included within the connections of
the lateral lines of the sidewalks on opposite sides of the highway measured from
the curbs, or in the absence of curbs from the edges of the roadway, or
ii.
any portion ·Of a roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by school crossing signs (as per the Ontario Traffic Manual
Book 5 Regulatory Signs) or by lines or other markings on the surface thereof;
"curb" includes the edge of the traveled portion of a street or roadway;
"designated parking space" means a parking space designated under this by-law for
the exclusive use of a vehicle displaying a disabled parking permit in accordance with the
requirements of the Highway Traffic Act, as amended, the regulations made thereunder
and this by-law;
"Disabled parking permit" means a permit which is issued under the Highway Traffic
Act and is currently valid or a permit or other marker or device which is issued by another
jurisdiction that is currently valid and recognized under the Highway Traffic Act and the
regulations thereunder;
"double parking" means the parking of a vehicle on any roadway, beside another
vehicle that is legally parked adjacent to the curb of the roadway or edge of the roadway,
so that vehicles are side by side or any part of the vehicles is side by side;
"driveway access" means the portion of a street which is improved to permit the passage
of vehicles between the adjacent roadway and the abutting property;
"Electric Vehicle" means any vehicle that is partially or entirely powered by electricity and
plugs in to recharge into an Electric Vehicle Charging Station and includes buUs not limited
to a plug-in electric vehicle and a plug-in hybrid vehicle;
"Electric Vehicle Charging Station" means any facility, equipment or infrastructure that
supplies electric energy for the recharging of an Electric Vehicle;
"Electric Vehicle Parking Space" means any parking space designated for the use of
Electric Vehicles as indicated by a sign in the form set out in Schedule 15 to this By-Law;
"gross weight" means the combined weight of vehicle and load;
"heavy truck" means
i.
any commercial motor vehicle which has a registered gross vehicle weight
exceeding 5 tonne (5,000 kilograms or 11,023 pounds) according to the current
permit or vehicle registration which has been issued under the Highway Traffic Act,
or its foreign equivalent for such vehicle, regardless of the actual weight of such
vehicles, or
ii.
a trailer that has a manufacturer's gross weight rating exceeding 1,360 kilograms,
regardless of the actual weight of such trailer, but does not include a vehicle
operated by or on behalf of the Municipality or a school bus which is in the course
of transporting children or mentally challenged adults to and from school;
"holiday" means New Year's Day, Family Day, Good Friday, Easter Sunday, Victoria
Day, Canada Day, Civic Holiday (first Monday in August), Labour Day, Thanksgiving Day,
Christmas and Boxing Day; if New Year's Day or Canada Day falls on a Saturday or
Sunday then the following Monday is also a holiday; if Christmas Day falls on a Friday
then the following Monday is also a holiday; and if Christmas Day falls on a Saturday or
Sunday then the following Monday and Tuesday are also holidays;
"identifying marker", when used with respect to parking for disabled persons means the
disabled persons parking permit issued by the Ministry of Transportation pursuant to the
provisions of the Highway Traffic Act, as may be amended from time to time;
"intersection" means the area embraced within the prolongation or connection of the
lateral curb lines, or if none, then of the lateral boundary lines of two or more highways
which join one another at an angle, whether or not one highway crosses the other;
"loading" means the physical activity of moving merchandise from or to a property or
another vehicle and the physical activity of passengers entering or departing a vehicle;
"motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless
otherwise indicated in this by-law, and any other vehicle propelled or driven otherwise than
by muscular power, but does not include a street car, or other motor vehicles running only
upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled
implement of husbandry or road building machine within the meaning of the Highway
Traffic Act;
"Municipality" means the municipality of the Municipality of Middlesex Centre;
"non-recreational vehicle" means an automobile or motorcycle but does not include
commercial motor vehicle, mobile home or trailer;
"official sign" means a sign approved by the Ministry of Transportation and/or the
Municipality;
"Officer" means an area Police Officer and/or a Municipal By-Law Enforcement Officer;
"one-way street" means a street upon which vehicular traffic is limited to movement in
one direction;
"Overnight Parking Pass" means a parking pass issued by the Municipal Engineer
under section 9(4) of the By-law;
"park" or "parking", when prohibited, means the standing of a vehicle whether occupied
or not, except when standing temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
"parking space" means a portion of the surface of the roadway or public parking
lot/facility designated by suitable markings;
"pedestrian crossover" has the same meaning as in the Highway Traffic Act;
"person" includes any person, firm, partnership, association, corporation, company or
organization of any kind;

"private roadway", when used with reference to a fire route, means any private road,
lane, ramp or other vehicular access to or egress from a building or structure and it may
include part of a parking lot;
"police officer" means a member of the police force of the Ontario Provincial Police;
"public parking lot or facility" means an off-street parking lot or other parking facility to
which the public has access whether on payment of a fee or otherwise;
"restricted parking" means
i.
a street or part of a street; or
ii.
off-street parking facility.
"road allowance" means all allowances for roads, except in so far as they have been
stopped up according to law, made by the Crown surveyors, all highways laid out or
established under the authority of any statute, all roads on which public money has been
expended for opening them or on which statute labour has been usually performed, all
roads dedicated by the owner of the land to public use, and all alterations and deviations
of and all bridges over any such allowance for highway or road;
"roadway" means that portion of a highway that is improved, designed or ordinarily used
for vehicular traffic, but does not include the shoulder, and where a highway includes two
or more separate roadways, the term "roadway" refers to any one roadway separately and
not to all of the roadways collectively;
"roundabout" means a form of intersection that accommodates traffic flow in a counter
clockwise direction around a central island;
"school bus" means a chrome yellow bus that is used for the transportation of:
i.
children; or
ii.
disabled people to or from a training centre.
that bears on the front and rear thereof the words "school bus" and on the rear thereof the
words "Do not pass when signals flashing";
"school vehicle" means a vehicle that is used for the transportation of:
i.
persons to or from school, or
ii.
disabled people to or from a training centre
and shall only include the following:
i.
a school bus
ii.
a bus, and
iii.
a vehicle that is designed to carry less than ten passengers and is used for the
transportation of persons and which is identified by public vehicle plates and/or
school safety stickers;
"shoulder" means that portion of every street which abuts the roadway and which is
designed and intended for passage or stopping of motor vehicles but which extends no
more than 3.6 metres in width from the limit of the roadway;
"sidewalk" means any municipal walkway, or that portion of a street between the curb
line or the lateral line of a roadway and the adjacent property line, primarily intended for
the use of pedestrians;
"stand" means the halting of a vehicle, whether occupied or not, except for the purpose
of and while actually engaged in receiving or discharging passengers;
"stop", when required, means the complete cessation of movement;
"stop" or "stopping", when prohibited, means the halting of a vehicle, even momentarily,
whether occupied or not, except when necessary to avoid conflict with other traffic or in

compliance with the directions of a constable or other police officer or of a traffic control
sign or signal;
"street" or "highway" includes a common and public highway, street, avenue, parkway,
driveway access, square, place, bridge, viaduct or trestle designed and intended for or
used by the general public for the passage of vehicles and includes the area between the
lateral property lines thereof;
"through highway" means any highway or part of a highway designated as such by by
law of the municipality and all intersecting highways are marked by a stop sign or yield
sign in compliance with the applicable regulations of the Ministry of Transportation;
"time" means, where any expression of time occurs or where any hour or other period of
time is stated, standard time or daylight saving time, whichever is in effect in the
Municipality of Middlesex Centre pursuant to the Time Act;
"tractor-trailer unit" means the combination of a commercial motor vehicle and a trailer
or semi-trailer;
"traffic" includes pedestrians, ridden or herded animals, vehicles and other conveyances
either singly or together while using any street for the purposes of travel and permitted by
the applicable Municipal By-laws;
"Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle,
except an implement of husbandry, a mobile home, another motor vehicle or any device
or apparatus not designed to transport persons or property, temporarily drawn, propelled
or moved upon such highway, and except a side car attached to a motorcycle, and shall
be considered a separate vehicle and not part of the motor vehicle by which it is drawn;
"traffic control device" means any sign or other device erected or placed for the purpose
of guiding, directing or regulating traffic;
"traffic signal" means any device manually, electrically or mechanically operated for the
regulation of traffic;
"Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle,
except an implement of husbandry, a mobile home, another motor vehicle or any device
or apparatus not designed to transport persons or property, temporarily drawn, propelled
or moved upon such highway, and except a side car attached to a motorcycle, and shall
be considered a separate vehicle and not part of the motor vehicle by which it is drawn;
"U-turn" means to turn a vehicle upon a highway so as to proceed in the opposite
direction;
"Unlicensed Vehicle" means a motor vehicle that does not have a number plate
displayed or does not have current validation of a vehicle permit affixed to the number
plate, in the manner prescribed in the Highway Traffic Act and the applicable regulations
as may be amended from time to time;
"vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building
machine and any vehicle drawn, propelled or driven by any kind of power, including
muscular power, but does not include a motorized snow vehicle, the cars of electric or
steam railways running only upon rails;
"vehicle of a disabled person" means any vehicle displaying an identifying marker in
accordance with section 41 of this by-law.
2. Enforcement of By-law
(1)
This by-law may be enforced by an Officer appointed by the Council
(2)
Where contravention of this by-law is found, an officer shall complete and
place upon or attach to the vehicle a Traffic and Parking Infraction Notice
stating:
a. the licence number of the vehicle and the month of the validation sticker;

b. a description of the alleged offence;
c. the signature of the issuing officer;
d. the date, time, and location of the alleged offence; and
e. the set fine for the alleged offence.
3. Penalties
(1)
Any person who contravenes any provision of this By-law is guilty of an
offence and upon conviction is liable to a fine as provided for in the
Provincial Offences Act, and in the Approved Set Fine Tables.
PART 1 - TRAFFIC
4. Erection of Control Devices
(1)
Traffic control devices for the purpose of guiding, directing and regulating
traffic shall be erected as authorized and directed by the Council.
(2)
No person shall place or exhibit any unauthorized device, sign, standard or
other marking upon any street attempting or purporting to guide, direct or
regulate traffic or the parking of vehicles on a street.
(3)
No unauthorized person shall give any signal or direction attempting or
purporting to direct traffic unless in an a situation that is considered to be
an emergency to direct traffic including but not limited to the scene of an
accident, obstacle impeding traffic, excavation, debris, glass or any other
hazard.
5. Manner of Parallel Parking
(1)
No person shall park a vehicle on any street except upon the right-hand
side of the roadway, having regard for the direction in which the vehicle is
required to proceed, and when parked on a roadway, the right front and
rear wheels or runners of the vehicle shall be parallel to and distant not
more than 0.3 metres from the right-hand edge of the roadway adjacent to
which such vehicle is parked.
(2)
Subsection (1) shall not apply where angle parking is authorized by this by
law, or upon one- way streets as authorized by this by-law.
6. Manner of Angle Parking
(1)
Where angle parking is permitted,
a. no person shall park a vehicle except within the limits defined by pavement
markings; or
b. if no pavement markings are visible, no person shall park a vehicle except
at an angle not exceeding sixty degrees with the permitted direction of
travel, unless signed otherwise;
and in all cases so that the front end of the vehicle is nearest to the curb or the edge of
the street.
(2)
Notwithstanding subsection (1 ), no person shall park a vehicle at an angle
if:
a. the load being carried extends beyond the rear of the vehicle; or
b. the vehicle has attached to it a trailer as defined by the Highway Traffic Act;
or
c. such vehicle obstructs or interferes with traffic in any way while so parked.
7
7. Manner of Parking on One-Way Street
(1)
Subject to subsection (2), all persons may park vehicles on both sides of a
one-way street in the permitted locations and facing in the direction in which
the vehicle is required to proceed.
(2)
Unless otherwise regulated, when parked on the left hand side of the
roadway, as determined by the permitted direction of travel, the left front
and left rear wheels or runners of the vehicle shall be parallel to and distant
not more than 0.3 metres from the edge of the roadway adjacent to which
such vehicle is parked.
8. No Stopping (Schedule 1)
(1)
No person shall stop a vehicle in a manner known as "double parking" or
in any traffic lane other than the curb lane.
(2)
No person shall stop a vehicle or any part of a vehicle upon the streets set
out in Column 1 of Schedule 1 of this by-law, the side or sides of streets
set out in the corresponding line or lines in Column 2, between the points
set out in Column 3 and the points set out in Column 4, and during the
prohibited time or times set out in Column 5, when "No Stopping" signs
have been erected and are on display and indicate the prohibited time or
times.
(3)
Subsection (2) does not apply to a school vehicle engaged in the
transportation of persons when such vehicle is stopped to discharge or pick
up passengers,
(4)
No person shall stop a vehicle on any highway within 20 metres of
crosswalk when an official sign designating "No Stopping Zone" and an
official sign designating "School Crosswalk" have been erected and are on
display.
(5)
No person shall stop a vehicle on any highway within 20 metres of a
Pedestrian Crossover when an official sign designating "No Stopping Zone"
has been erected and is on display.
9. No Parking In Unposted Locations
(1)
No person shall park a vehicle in any of the following places during the
specified times:
a. at any time in such a manner so that any part of the vehicle is situated upon
or over or obstructing a sidewalk;
b. at any time between a sidewalk and the adjacent roadway where the
shortest distance between the sidewalk and the roadway is less than 5.5
metres;
c. on any boulevard at any time, except where authorized by by-law enacted
under the Municipal Act;
d. on a roadway or shoulder in front of a public or private driveway access or
lane at any time;
e. within an intersection at any time;
f.
within 3 metres of a fire hydrant or where the hydrant is set back from the
edge of the roadway, within 3 metres of the point at which the prolongation
of the centre line of the hydrant at right angles to the edge of the roadway
intersects such edge at any time;
g. on a crosswalk or obstructing a crosswalk at any time;
h. within 12 metres of the nearest crosswalk at an intersection at any time;
i.
on any street in a manner that impedes or obstructs traffic at any time;

j.
in a position which prevents the convenient removal of any other vehicle
previously parked at any time;
k. on any roadway or shoulder between 2:00 am and 7:00 am;
I.
on any ramp or maneuvering area established as part of a parking
arrangement under the Municipal Act;
m. within 20 metres of any intersection where signs have been erected and
are on display, or where controlled by traffic signals;
n. on any roadway or shoulder for longer than 12 hours;
0. on any yard at any time, unless suitable hard surface has been laid.
(2)
Nothing in subsection (1) shall prohibit the proper parking of bicycles in a
bicycle rack erected by the Municipality or approved by the Municipal
Engineer under a written agreement.
(3)
Notwithstanding subsection (1) above of this by-law subsection k) does not
apply to non-recreational vehicles between the Saturday immediately prior
to Victoria Day and Labour Day inclusive.
(4)
Subsections 1 (k) and 1 (n) do not apply to a vehicle for which an Overnight
Parking Pass has been issued by the Municipality and has not been
revoked. Nothing in this subsection shall permit a person to park or stop a
vehicle in an area where stopping or parking is specifically prohibited by
any other provision of this By-law.
10. No Parking In Posted Locations
(1)
No person shall be permitted to park a vehicle or any part of a vehicle in
the following locations when signs authorized by the Municipality have
been erected and are on display:
a. in front of the entrance to an office building;
b. within 20 metres of any intersection;
c. within 8 metres of the location of a fire hall and the premises used in
connection with a fire hall on that side of the street on which a fire hall is
located, or on the opposite side of the street within 8 metres of a point
opposite the centre exit of a fire hall;
d. upon the same side of the street and immediately adjacent to any school
property;
e. upon the same side of the street and immediately adjacent to the frontage
or flankage of any service station providing fuel for motor vehicles or a retail
fuel outlet;
f. within 30 metres of any intersection controlled by traffic signals.
g. within 30 metres of any railway level crossing.
h. within the limits of a roundabout and within 20 metres on any approach
street to a roundabout.
i.
immediately adjacent to an inner curb within a cul-de-sac, where a cul-de
sac is constructed with an inner and outer curb.
j.
within any part of a reserved lane for bicycles
k. within 1 metre of a sidewalk where it intersects a roadway or shoulder.
(2)
Nothing in subsection (1) shall prohibit the proper parking of bicycles in a
bicycle rack erected by the Municipality or approved by the Municipal
Engineer pursuant to a written agreement.

11. No Parking On Specified Streets (Schedule 2)
No person shall park a vehicle or any part of a vehicle on the streets hereinafter set out in
Column 1 in Schedule 2 of this by-law, the side or sides of streets set out in the
corresponding line or lines in Column 2, between the points set out in Column 3 and the
points set out in Column 4, during the prohibited time or times set out in Column 5, when
appropriate signs have been erected and are on display, and authorized by this By-law.
12. Parking During Emergencies and Special Events
(1)
Notwithstanding any other provisions of this by-law to the contrary, in case
of fire, a parade, an assembly of persons, a congestion of traffic, a
construction project or an emergency, parking may be restricted or
prohibited by the Municipal Engineer or his authorized representative or the
Chief of Police acting through police officers, in his/her sole discretion and
no person shall park a vehicle in contravention of such restrictions or
prohibition.
(2)
For the purposes of this section, "emergency" includes but is not limited to
a snow fall or other act of God that hinders, restricts or prohibits movement
of vehicles or pedestrians on a highway.
13. Angle Parking Permitted On Specified Streets (Schedule 14)
No person shall park a vehicle except at any angle, in a manner as described in section
6, on any of the streets set out in Column 1 in Schedule 14 of this by-law, on the side or
sides of streets set out in Column 2, between the streets or parts thereof set out in
Columns 3 and 4.
14. Prohibited Times of Loading and Unloading
On any roadway where stopping is specifically prohibited between specified hours, as set
forth in Schedule 1 to this by-law, the following shall apply:
a. No person shall, between the hours identified, in Schedule 1, for the
purpose of loading or unloading merchandise, stop any vehicle or a part
thereof on the roadway at an angle to the curb or the edge of the traveled
portion of the roadway or in such a manner as to obstruct or impede, in any
degree the movement of traffic.
15. Manner of Parking Motorcycles
(1 )
No person shall park a motorcycle at more than an angle of forty-five
degrees to the curb.
(2)
Where parking space is designated by markings, no more than three
motorcycles shall be parked in one space.
16. Prohibited Turns (Schedule 3)
(1 )
Within 30 metres of an official sign designating "No-U-Turn" posted in
accordance with Schedule 3 of this by-law, no driver or operator of a vehicle
upon a highway shall be allowed to make a U- turn .
(2)
Where an official sign forbidding a left or right turn or both has been posted
in accordance with Schedule 3 of this by-law, every driver or operator of a
vehicle shall obey such sign.

17. Obstructing Traffic
(1)
No owner or operator of a motor vehicle shall obstruct a street or impede
the flow of traffic with a motor vehicle that becomes stalled or is otherwise
inoperative or for any reason cannot be moved by its ordinary motive
power.
(2)
Any vehicle stopped on any street shall be moved away by the owner or
operator at the direction of a police officer when traffic congestion, proximity

to a fire or any other condition renders the removal of such vehicle
expedient.
18. Entering Highway (Schedule 5)
(1)
In addition to the provisions of the Highway Traffic Act requiring stop signs
at intersections on through streets, stop signs shall also be installed facing
the traffic proceeding in the directions indicated in Column 1 of Schedule 5
of this by-law, on the streets set out in Column 2, at the intersecting streets
set out in Column 3.
19. Funeral and Other Processions
(1)
No person shall drive a vehicle so that it intersects or impedes a funeral or
other authorized procession in motion except under the direction of a police
officer.
(2)
All persons driving vehicles in a funeral or other procession shall drive such
vehicles as near to the right-hand edge of the roadway as is practicable
and safe and shall obey all traffic signs and signals unless otherwise
directed by a police officer.
20. One-Way Streets (Schedule 4)
The highways set out in Column 1 of Schedule 4 of this by-law between the limits set out
in Columns 2 and 3 are hereby designated for one-way traffic only in the directions set out
in Column 4.
21. Pedestrian Crossovers (Schedule 6)
The portion of highways set out in Column 1 of Schedule 6 of this By-law at the locations
named in Column 2 are designated as pedestrian crossovers.
22. Reduced Load Limit (Schedule 7 & 78)
(1)
The highways set out in Column 1 of Schedule 7 of this by-law between the
limits set out in Columns 2 and 3 are restricted to a reduced load limit of a
maximum weight of five (5) tonnes per axle for any vehicle traveling on the
specified highways during the period March 1 to April 30 inclusive in any
year.
(2)
The Municipal Engineer is authorized to erect such signage as is required
to properly designate and identify the highways listed in Schedule 7 of this
by-law as having reduced load limits during the period of time mentioned
in paragraph (1) of this section.
(3)
No person shall operate a vehicle that does not comply with the reduced
load limit regulations mentioned in subsection (1) of this section, on any of
the highways listed in Schedule 7 of this by-law during the period of time
mentioned in subsection (1) of this section.
(4)
The highways set out in Column 1 of Schedule 7B of this by-law between
the limits set out in Columns 2 and 3 are restricted to the same load limit
listed in section 22 (1) during the entire duration of the calendar year.
23. Use of Sidewalk
No person shall use. any sidewalk for any purpose other than pedestrian traffic, except as
specifically permitted by this or any other by-law.
24. Coasting or Sliding
No person shall coast or slide by the use of any hand-sleigh or toboggan or any other
device used for similar purposes on any street.

25. Rate of Speed (Schedules 8 & 9)
(1)
The highways set out in Column 1 of Schedule 8 of this by-law, between
the limits set out in Columns 2 and 3, are hereby restricted to the maximum
rates of speed as set out in Column 4.
(2)
The highways set out in Column 1 of Schedule 9 of this by-law, between
the limits set out in Columns 2 and 3, are hereby restricted to maximum
rates of speed as set out in Column 4.
26. Designation of Construction Zones
(1)
The Municipal Engineer is appointed for the purpose of subsections 128
(8. 1) and (10) of the Highway Traffic Act, and in accordance with those
subsections the Municipality Engineer may:
a. designate a highway or portion of a highway under the Municipality's
jurisdiction as a construction zone; and
b. set a lower rate of speed for motor vehicles driven in the designated
construction zone than is otherwise provided in the Highway Traffic Act or
in this By-law.
(3)
The speed limit set by the Municipal Engineer under this By-law shall not
become effective until the highway or portion of it affected is signed in
accordance with the regulations under the Highway Traffic Act, indicating
the maximum rate of speed, as well as the commencement and the end of
the construction zone.
27.
Heavy Truck Restrictions (Schedule 16)
(1)
In this section, prohibited street means any street or part thereof within the
Municipality set out in Schedule 16 of this by-law, and upon which there
are signs prohibiting heavy trucks.
(2)
No person shall operate a truck on a prohibited street
(3)
Subsection (2) does not apply where a heavy truck is being necessarily
operated in the usual conduct of business and proceeds by way of the
shortest route to or from any street or part thereof set forth in Schedule 16
of this by -law.
(4)
This section does apply to heavy trucks being used for deliveries to or
removals from properties being used for agricultural purposes.
(5)
No person shall park a heavy truck on a prohibited street.

29. Preparation of Parking Lots
The Municipal Engineer is hereby authorized and directed to ensure that to the best of the
ability of the Municipality, acting reasonably, the parking lots mentioned in section 28 are
in a reasonable condition for the parking of motor vehicles, including reasonable surfacing,
fencing and lighting of the parking the lot, the identification of the parking areas and traffic
lanes by painting.
30. Lawful Use of Space (Schedule 13)
Upon completion of the work mentioned in section 29 for each parking lot mentioned in
section 28 Column 1 of Table 2 ofthis By-law, no person shall park a motor vehicle beyond
the maximum number of consecutive hours mentioned in Column 4 during the times
mentioned in Column 2 on any of the days mentioned in Column 3 thereof, and during
such times on such days specified in Table 2 no person shall park a motor vehicle on any
of the parking lots except in a designated parking space.

31 . Maximum Permitted Parking
During the hours and days specified in section 30, no person shall park any motor vehicle
on any of the parking lots mentioned in section 28 for a period which at any time exceeds
the maximum limit for the particular parking lot in Column 4 of Section 30.
32. Off-hours Parking
(1)
A motor vehicle may be parked or remain parked on any of the parking lots
mentioned in section 28 at any time between 6:00 a.m. and 10:00 p.m. on
Sundays and on Holidays.
(2)
No person shall park or leave parked on any of the parking lots mentioned
in Section 28 at any time that does not occur during the hours or the days
mentioned in section 30 for the particular lot or in subsection 32 (1) of this
by-law.

33. No Long Vehicle Parking
No person shall park any motor vehicle in excess of 6.1 meters in length in any of the
parking lots mentioned in section 28 at any time.
34. No Parking Electric Vehicle Parking Space (Schedule 15)
(1 )
No person shall park a vehicle or any part of a vehicle in an Electric Vehicle
Parking Space where such vehicle is classified as an Electric Vehicle.
(2)
No person shall park a vehicle or any part of a vehicle in an Electric Vehicle
Parking Space where such vehicle is not connected to an Electric Vehicle
Charging Station and in the process of charging.
PART 3 - FIRE ROUTES
35. Official Sign (Schedule 11)
(1 )
In this part, "official sign" means a fire route sign in the form set out in
Schedule 11 to this by- law.
36. Establishment of Fire Routes
A private roadway along which approval has been given by the Municipality for the erection
of official signs is a fire route. Fire routes are established by site plan agreements for
development and/or Fire Chiefs order.
37. Tampering With Signs
No person shall move, remove or interfere with an official sign along a fire route or obstruct
a view of an official sign along a fire route.
38. Conflicting Signs on Fire Routes
No person shall erect or maintain along a fire route any sign which may conflict or be
confused with an official sign.
39. Unauthorized Use of Signs
No person shall erect or maintain a facsimile of an official sign along any private roadway
whether a fire route or not.
40. No Parking On Fire Route
(1) No personal shall park a vehicle along a fire route.
(2) No person shall obstruct or impede a fire route.
PART 4 - OFF-STREET PARKING FOR THE DISABLED
41. Official Sign (Schedule 12)
In this Part, "official sign" means a sign in Schedule 12 of this by-law.
42. Designation of Parking Spaces
(1)
Where in a public parking lot or facility one or more parking spaces are
intended for the sole use of a vehicle of a disabled person, the owner or
operator of the public parking lot or facility shall identify each such parking
space by erecting an official sign in such a manner that the official sign
shall be clearly visible to the operator of any vehicle approaching or
entering such parking space. The official sign shall be erected on a post
secured in the ground or on a wall. The official sign shall be at the front of
the parking space in the middle so that the bottom of the sign is between
1.2 m and 1.8 m above the parking lot surface.

(2)
Where the requirements of subsection (1) of this section are complied with,
each such parking space is for the purposes of this by-law a designated
parking space for the sole use of vehicles of disabled persons.
(3)
Notwithstanding any provision in this Part to the contrary, no designated
parking space shall be located in a fire route designated under Part 3 of
this by-law.
43. Parking Space for Persons with Disabilities
(1)
No person shall park, stand, stop or leave a motorvehicle in any designated
parking space for a disabled person save and except for a motor vehicle
that is identified by a current original identifying marker.
(2)
No person shall park, stand, stop, or leave a motor vehicle in an access
aisle for a parking space for a disabled person when "No Stopping" signs
have been erected and are on display.
PART 5 - UNLICENSED VEHICLES
44. Unlicensed Vehicles
Unless otherwise permitted in this By-law, no person shall park a vehicle on any highway
or parking space if such vehicle is an unlicensed vehicle.
PART 6 - GENERAL PROVISIONS
45. General Penalty
(1)
Except where otherwise expressly provided by this by-law or the Highway
Traffic Act, every person who:
a. contravenes any provision of this by-law; or
b. is the owner of a vehicle that is parked or stopped in contravention of any
provision of this by-law, is guilty of an offence and on conviction is liable to
any penalty as provided in the Provincial Offences Act.
(4)
Despite subsection (1), any person who contravenes sections 42 of this by
law is guilty of an offence and on conviction is liable to a fine of not less
than $300.00.
46. Illegally Parked Vehicles
Where a vehicle has been left parked, stopped or left standing in contravention of this by
law, the owner of the vehicle, notwithstanding that he was not the driver of the vehicle at
the time of the contravention of the by-law, is guilty of an offence and is liable to the fine
prescribed for the offence unless, at the time of the offence, the vehicle was in the
possession of some person other than the owner without the owner's consent.
(1)
No person shall permit a vehicle to be parked or left on Municipally-owned
or occupied land without the authorization of the Municipality.
(2)
An Officer may cause a vehicle parked or left in contravention of this By
law to be moved or taken to and placed or stored in a suitable place and
all costs and charges for removing, care and storage, if any, are a lien
against the said vehicle which may be enforced in the manner provided by
the Repair and Storage Liens Act.
47. Executive Acts Authorized
The Mayor and the Administration are hereby authorized to do all things and the Mayor
and Municipal Clerk are hereby authorized to execute on behalf and under the seal of the
Municipality any document necessary to give effect to this by-law.

48. Headings Not Part of By-law
The headings in the body of this by-law form no part of the by-law but are inserted for
convenience of reference only.
49. Deviation From Form
Where a form or words or expressions are prescribed in any Schedule to this by-law,
deviations therefrom not affecting the substance or calculated to mislead do not vitiate
them.
50. Conflict With Highway Traffic Act
In the event of conflict between the provisions of this by-law and the Highway Traffic Act,
the provisions of the said Act prevail.
51 . Short Title
The short title of this by-law is the Traffic and Parking By-law.
PART 7 - SEVERABILITY, REPEAL AND ENACTMENT
52. Validity and Severability
In the event that any provision of this by-law is declared by a court of competent jurisdiction
to be invalid, the same shall not affect the validity of the remaining provisions of this by
law.
53. By-laws Repealed
That by-law No. 2006-052, or provision or any other by-law inconsistent with this By -law,
be and they are hereby repealed upon final approval of the applicable set fines and short
from wordings for this by-law by the Chief Judge of the Ontario Court (Provisional
Division).
54. Commencement
This By -law shall come into force and take effect upon final approval of the applicable set
fines and short form wordings by the Chief Judge of the Ontario Court (Provincial Division).
