THE CORPORATION OF THE TOWNSHIP OF MINDEN HILLS BY-LAW No. 15-168 A BY-LAW TO REGULATE PARKING WHEREAS the Municipal Act, 2001, as amended authorizes municipal councils to pass by-Iaws respecting the parking of motor vehicles on municipal highways and on other municipal Iands, including by-laws to designate parking spaces for the exclusive use of certain motor vehicles, and to impose fees for parking. AND WHEREAS The Act also authorizes municipal councils to pass by-Iaws regulating the parking of motor vehicles on private parking lots, with the written consent of the owners of those private parking Iots. NOW THEREFORE Council hereby enacts as follows: ffl'ss?Msb'l l'l='0'l-1 s%"Ms.NIM@H S % M # ! l h;'?-w {l W X * W ?? ? s,,ssogs ,,. 1.01 Definitions: In this by-Iaw, "abandoned vehicle" means a vehicle without valid number plates issued by the Ministry of Transportation or by a jurisdiction other than Ontario, that appears to have been abandoned; "authorized sign" means any sign, as defiried tri this by-law, which is authorized by this by-law and, where applicable, complies with the requirements of the regulations made under the Highway Traffic Act; "boulevard" means the part of a highway that Iies between the shoulder or curb and the boundary of the adjoining property; "business day" means any Monday, Tuesday, Wednesday, Thursday or Friday other than a public holiday; "Chief Building Official/Municipal Law Enforcement Officer/Planning Supervisor" means the employee who holds that position arid his or her delegate(s) or, in the event of organizational changes, another employee designated by Council; "Council" or "Township Council" means the Council of the Township of Minden Hills; "cross walk" means any portion of a Roadway at an intersection or elsewhere that is distinctly identified as a pedestrian crossing by signs or by lines or other markings on the surface of the Roadway; "curb" means the edge of the Roadway of a highway; "Director of Community Events" means the employee who holds that position, his or her delegate(s) or, in the event of organizational changes, another employee designated by Council; "entrance" means an improved surface within a highway that is used for motor vehicle access to or from one or more adjoining properties over that highway; "Environmental & Property Operations Manager" means the employee who holds that position and his or her delegate(s) or, in the event of organizational changes, another employee designated by Council; "Fire Chief" means the employee who holds that position, his or her delegate(s) or, in the event of organizational changes, another employee designated by Council; A BY-LAW TO REGULATE PARKING Definitions: In this by-law, cont'd: "fire lane" or "fire zone" means a highway, as identified by authorized signs, that needs to be kept clear at all times for the use of fire department vehicles; "fire route" means a route across private property, as identified by authorized signs, that needs to be kept clear at all times to provide access by fire department vehicles to or from a building or structure; "highway" means a common and public highway or a portion of a common and public highway,-any part of which is used by the general public for the passage of vehicles, and includes ariy bridge, causeway, tunnel or uriderpass that forms part of the highway and all Iands between its Iateral boundaries; "intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary Iines of two or more highways that join one another at an angle, whether or not one highway crosses the other; "median strip" means the portion of a highway that separates traffic traveling in one direction from traffic traveling in the opposite direction by means of a physical barrier or a raised or depressed paved or unpaved separation area that is not intended to allow vehicular traffic to cross it; "motor vehicle" includes an automobile, bus, truck, motorcycle and any other vehicle propelled or driven other than by muscular power, but does not include a wheelchair or motorized snow vehicle; "municipal law enforcement officer" means a person appointed by Council urider the Police Services Act to enforce the by-Iaws of the Township; "municipal parking lot" means Iand owned or occupied by the Township that is used, wholly or partly, for the parking of motor vehicles by the general public; ?occupied" means being in possession of a property or part of a property, for example, as a result of a leasehold agreement; "park" or "parking" means the standing of a vehicle, whether occupied or riot, except when standing temporarily for the purpose of and while actually engaged in Ioading or unloading passengers or goods; "police ofiicer" means a chief of police or any other police officer in a police service which is responsible for enforcing the by-laws of the Township; "private Road" means any privately-owned Road, Iane, ramp or other means of vehicular access to or from a building or structure; "public authority" includes Federal, Provincial, County or Municipal agencies, including any commission, board, authority or department established by such agency and for the purposes of this By-Iaw shall include any hydro, telephone or telegraph company. "public authority staff member" includes an agent as well as an employee of the public authority. "public holiday" includes a holiday as defined in the Retail Business Holidays Act and any other public holiday that is declared; "public parking" means the parking of vehicles by members of the gerieral public, either free or for a fee; "recreational trail" means a trail that is open to the public for a variety of recreational uses; "Road Superintendent" means the employee who holds that position and his or her delegate(s) or, in the event of organizational changes, another employee designated by Council; "Roadway" means the portion of a highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder; A BY-LAW TO REGULATE PARKING Definitions: In this by-Iaw, cont'd: "shoulder" means the portion of a highway between the edge of the Roadway and the boulevard; "sidewalk" means the portion of a highway between the curb or shoulder and the boundary of the adjoining property that is set aside for the use of pedestrians; "sign" includes any sign, marking on a Roadway, curb or sidewalk, or other appropriate device that identifies a parking regulation; and "stop" or "stopping" means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or of a traffic control sign or signal. "Township", "Township of Minden Hills" or "Minden Hills" means The Corporation of the Township of Minden Hills; "Township staff member" includes an agent as well as an employee of the Township; 1.02 Interpretation: (a) The regulations established by this by-Iaw respecting the parking and stopping of motor vehicles apply only to the Village of Minden as shown in Schedule 1 attached. (b) The regulatioris established by this by-law respecting the parking and stopping of motor vehicles on highways do not apply to provincial highways. (c) The regulations established by this by-Iaw respecting the parking and stopping of motor vehicles do not apply to Township or other public authority staff members and police officers who are carrying out their duties. (d) The attached Schedules form part of the by-law and are enforceable as such. (e) A trailer or other vehicle that is drawn by a motor vehicle forms part of that motor vehicle for the purposes of this by-law. (f) The words "include" and "including" are not to be read as Iimiting the meaning of a word or term to the phrases or descriptions that follow. 1.03 Statutes: References to Iaws in this by-Iaw are meant to refer to the statutes, as amended from time to time, that are applicable within the Province of Ontario. 1.04 Severability: If a court or tribunal of competent jurisdiction declares any portion of this by-Iaw to be illegal or unenforceable, that portion of this by-law shall be considered to be severed from the balance of the by-law, which shall continue to operate in full force and effect. "{l H"d @@l 2.01 Lawful Parking: No person shall park a motor vehicle on a highway on which parking is permitted except on the right-hand side, according to the direction in which the motor vehicle was lawfully proceeding, and no person shall park a motor vehicle on the Ieft-hand side of a highway except in accordance with Section 2.02 2.02 0ne-Way Streets: No person shall park a motor vehicle on the Ieft-hand side of a highway, according to the direction in which the motor vehicle was Iawfully proceeding, except on a highway on which parking is permitted that has been designated for one-way traffic. 2.03 Angle Parking: No person shall park a motor vehicle at an angle on a highway except on highways where angle parking is expressly permitted, and except with the front of the motor vehicle facing the side of the highway on which it is parked. A BY-LAW TO REGULATE PARKING Parking on Municipal Highways, cont'd: 2.04 Parking Spaces: If parking spaces are identified by Iines or markings, no person shall park a motor vehicle on that highway except entirely within the lines or markings that identify an individual parking space, and no person shall park a motor vehicle with its wheels across or outside those Iines or markings. 2.05 Exception for Long Vehicles: Section 2.04 does not apply to a motor vehicle that is too Iong to be parked entirely within an individual parking space. 2.06 0ne Vehicle per Parking Space: With the exception of motorcycles, no more than one motor vehicle shall be parked within an individual parking space that is identified by lines or markings. 2.07 Specific Time Lirnits: No person shall park a motor vehicle on any highway for lo-nger than the maximum number of hours permitted on that highway, where such Iimits are identified by authorized signs. 2.08 General Time Limit: On all highways on which parking is permitted, no person shall park a motor vehicle for longer than 12 hours. 2.09 No Overnight Parking in Winter: Despite sections 2.07 and 2.08, no person shall park a motor vehicle on any highway from November Istof one year to April 30th of the following year at any time between 12:00 A.M. and 8:00 A.M., or during such shorter period as is ideritified by authorized signs. 2.10 Abandoned Vehicles: No person shall park or Ieave an abandoned vehicle on a highway. 2.11 0ther General Regulations: No person shall park or stop a motor vehicle: (a) (b) (C) (d) (e) (f) (g) (h) (i) (k) (I) (m) (n) (0) (p) (q) (r) (S) on a sidewalk or footpath; on a boulevard except in areas where it is permitted; in front of or within 2.0 metres of art entrance or in a manner that prevents the use of an entrance by other motor vehicles; within an intersection; within 8.0 metres of an intersection, unless otherwise allowed by this by-Iaw; within 6.0 metres of a crosswalk that is not located at an intersection; within 1 .0 metres of a curb cut designed to accommodate wheelchairs that is not located at an intersection or a crosswalk; on a bridge or causeway or in a tunnel or underpass, or on the approaches to a bridge, causeway, tunnel or underpass, except where expressly permitted to do so; in front of or adjacent to a fire hall; in a fire Iane or fire zone; within 3.0 metres of a fire hydrant, measured from the point at the edge of the Roadway immediately adjacent to the hydrant; in a manner that obstructs or interferes with vehicular traffic; in a manner that prevents the convenient movement or removal of another parked, standing or stopped motor vehicle; alongside another parked, standing or stopped motor vehicle so as to "double park"; in a manner that interferes with the maintenance and repair of highways and utilities, or with the removal of snow; for the purpose of selling, servicing or, except in an emergency, repairing the motor vehicle; on, beside or at the end of a median strip; in the turning circle of a cul-de-sac; or on a highway on which parking or stopping has been prohibited temporarily in accordance with section 6.03. 2.12 Two (2) Hour Parking Zones: The highways described in Schedule "2" are designated as two (2) hour parking zones, and no person shall park a motor vehicle in a designated two (2) hour parking zone for longer than two (2) hours betweeri the hours of 9:00 A.M. and 6:00 P.M each day. A BY-LAW TO REGULATE PARKING Parking on Municipal Highways, cont'd: 2.13 Fifteen (15) Minute Parking Zones: The highways described in Schedule "3" are designated as fiffeen (15) minute parking zones, and no person shall park a motor vehicle in a designeited fifteen (15) minute parking zone for Ionger than fifteen (15) minutes between the hours of 9:00 A.M. and 6:00 P.M, Monday through Saturday. 2.14 No Parking Zones: The highways described in Schedule "4" are designated as no parking zones, and no person shall park a motor vehicle in a designated no parking zone. 2.15 No Parking Except Emergency Vehicles: The areas described in Schedule "5" are designated as no parking zones except for emergency vehicles and no person shall park a motor vehicle in such designated zone unless it is an emergency vehicle. 2.16 Authorized Signs: The regulations set out in sections 2.12 to 2.15 are not valid uriless authorized signs are in place to identify these regulations. If any discrepancy should occur between the location of the sign and the measurement distances as set out in the attached schedules, the location of the said sign shall prevail. f e-; =s ' 'Q "'3g'G/ l@@ !!!u 3.0'l Obstruction: No person shall park or stop a motor vehicle in a municipal parking lot in a manner that blocks or obstructs an entrance or an interior access route. 3.02 Temporary Closings: No person shall park or stop a motor vehicle in a municipal parking Iot on which parking has been prohibited temporarily in accordance with section 6.03. 3.03 No Overnight Parking in Winter: No person shall park a motor vehicle in a municipal parking lot from November 1st of one year to April 30th of the following year at any time between 12:00 A.M. and 8:00 a.m., or during such shorter period as identified by authorized signs. 3.04 Abandoned Vehicles: No person shall park or Ieave an abandoned vehicle in a municipal parking lot. 3.05 Parking Spaces: If parking spaces are identified by Iines or markings, no person shall park a motor vehicle on that parking Iot except entirely within the Iines or markings that identify an individual parking space, and no person shall park a motor vehicle with its wheels across or outside those Iines or markings. 3.06 Exception for Long Vehicles: Subject to section 3.0"l, section 3.05 does not apply to a motor vehicle that is too long to be parked entirely within an individual parking space. 3.07 One Vehicle per Parking Space: With the exceptiori of motorcycles, no more than one motor vehicle shall be parked within an individual parking space that is identified by Iines or markings. 3.08 General Limit: Subject to section 3.03, no person shall park a motor vehicle for longer than twenty-four (24) hours in any municipal parking Iot. ,, .,:.,:i ,NJ-,,?-,,: , ,. 4.01 Fire Routes: No person shall park or stop a motor vehicle on a private Road, on a portion of a private parking lot, or on any other property that has been designated as a fire route. ' % .r?s ik W M rs S S(% ?yg 5.01 Enforcement: This by-law may be enforced by every municipal Iaw enforcement officer and police officer. 5.02 0bstruction: No person shall hinder or obstruct, or attempt to hinder or obstruct, any person exercising a power or performing a duty under this by-law. 5.03 0ffence and Penalty: It is an offence for a person to contravene any provision of this by-Iaw, and every person who contravenes this by-Iaw is guilty of an offence and, upon conviction, is liable to a fine in accordance with the provisions of the Provincial Offences Act and to any other applicable penalty. 5.04 0wner's Liability: If a motor vehicle has been parked or stopped in contravention of this by-law, the owner of the vehicle, even though the owner was not the driver of the vehicle at the time of the contravention of the by-Iaw, is guilty of an offence and is Iiable to a fine in accordance with the provisions of the Provincial Offences Act or with subsection 425(2) of the Municipal Act, 2001 and to any other applicable penalty. 5.05 0ut of Court Payment: Any person to whom a parking infraction notice has been issued alleging that a provision of this by-law has beeri contravened may within five business days, excluding the day on which the notice was issued, make a voluntary, out of court payment to the Township of a reduced fine amount, as specified on the parking infraction notice. 5.06 Multiple Offences: The conviction of a person for the contravention of any provision of this by-Iaw shall not operate as a bar to the prosecution against the same person for any subsequent or continued contravention of any provision of this by-law. 5.07 Court Order: If this by-Iaw is contravened and a conviction entered, the court in which the conviction has been entered and any court of competent jurisdiction thereafter may, in addition to any other remedy and to any penalty that is imposed, make an order prohibiting the continuation or repetition of the offence by the person convicted. 5.08 lmpoundment: If a vehicle is left parked on a municipal highway or on any other Iand owned or occupied by the Township in contravention of this by-law, the Township may cause the vehicle to be removed and impounded in accordance with subsection 170(15) of the Highway Traffic Act, or to be restrained and immobilized. 5.09 Recovery of lmpounded Vehicles: If a vehicle is removed and impounded in accordance with section 5.08, its owner or another person acting with the authorization of the owner shall be required to pay all costs incurred by the Township in removing, caring for and storing the vehicle in order to recover the vehicle. 5.10 Recovery of the Township's Costs: All costs incurred by the Township in removing, caring for and storing a vehicle removed and impounded in accordance with section 5.08 are a Iien upon the vehicle that may be enforced in the manner provided by Part 111 of the Repair and Storage Liens Act. 5.11 Disposition of Abandoned Vehicles: If an abandoned vehicle that has been removed and impounded in accordance with section 5.08 is not recovered within ten business days, excluding the day on which the vehicle was removed and impounded, the Township may begin proceedings to sell or otherwise dispose of the vehicle in accordance with the provisions of the Repair and Storage Liens Act. ' y -s 'x%= SS 6.01 Authorized Signs: The installation of signs identifying the regulations established by this by-Iaw respecting the parking and stopping of motor vehicles on highways, municipal parking lots and other property owned or occupied by the Township is authorized. 6.02 Administration: The Road Superintendent and the Chief Building Official/Municipal Law Enforcement Officer/Planning Supervisor are responsible for the installation and maintenance of authorized signs which provide notice of the regulations established by this by-Iaw. 6.03 Temporary Parking Prohibition: The Director of Community Events Fire Chief, Environmental and Property Operations Manager, Road Superintendent and Chief Buildirig Official/Municipal Law Eriforcement Officer/Planning Supervisor, are authorized to impose temporary parking regulations on a municipal highway, municipal parking Iot or any other property owned or occupied by the Township during an emergency, a construction, repair or maintenance project, a special event or in other special circumstances. 6.04 EffectiveDate:ThisBy-IawcomesintoforceDecemberl0fh,2015.
