- Amending Bylaws 2002-23 2002-47 2003-42 2009-14 2010-16 2020-41 2021-8 2021-11 2021-29 2021-30 2021-31 2021-33 2021-36 2021-53 Amended to Bylaw 2021-53 Parking Bylaw Office Consolidated Version October 12, 2021 - 2- THE CORPORATION OF THE TOWN OF MONO BYLAW NUMBER 2000 - 12 A BYLAW TO PROVIDE FOR THE REGULATION OF TRAFFIC IN THE TOWN OF MONO WHEREAS, the Municipal Act, R.S.O. 1990, c.M.45 s. 210 provides that every Council may pass such by-laws regulating traffic; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF MONO ENACTS AS FOLLOWS: DEFINITIONS 1. In this By-Law. a. "Heavy Truck" means a commercial motor vehicle having a weight, when unloaded, of 2,700 kilograms or more or when loaded of 4,500 kilograms or more, but does not include a passenger vehicle, an ambulance or any vehicle of the police or fire department; b. "municipal law enforcement officer" means a person duly appointed by the Corporation of the Town of Mono for the purpose of enforcing the parking provisions of this by-law; c. the definitions provided in Section 1, (R.S.O. 1990, Chapter H.8, as amended) of the Highway Traffic Act shall extend and apply to this by-law; OBEDIENCE TO TRAFFIC REGULATIONS 2. The Municipal Law Enforcement Officer and the Ontario Provincial Police may enforce the provisions of this By-Law GENERAL STOPPING AND PARKING REGULATIONS 3. No person shall stop a vehicle on a highway in any of the following places: a. on or above a sidewalk; b. on front of or within 1 metre of a public or private driveway; c. within 3 metres of a fire hydrant; d. within an intersection; e. on or within a designated pedestrian crossover; - 3- f. within 9 metres of any corner of any intersection; g. on the roadway alongside of any vehicle stopped or parked at the curb or edge of a shoulder; h. upon any bridge or other elevated structure upon a roadway; i. on any highway in such a manner as to obstruct traffic; j. on any highway in such a manner as to leave the left wheels of the vehicle further than 0.6 metres onto the roadway; k. on any highway for a period of longer than 48 consecutive hours; l. on any highway to load or unload merchandise where there is a lane at the rear or side of a business premise; m. on any boulevard or centre strip; n. on any roadway having an overall width of less than 6 metres; o. on any highway for a longer period of time than three hours between the hours of 12:00 midnight and 7:00 a.m. p. on any highway that has been ordered closed by an authority that is authorized to issue such order. 4. No person shall park a heavy truck on any highway between the hours of 1:00 a.m. and 6:00 p.m. of the same day for a period of time longer than 1 hour other than upon a section of highway under construction. 5. No person shall park or stop a vehicle, which does not bear valid licence plates, on any highway. 6. Where signs in accordance with the Regulations of the Highway Traffic Act are erected and are on display, no person shall, on any highway, park any vehicle: a. within 15 metres upon the approach to any flashing beacon, stop sign, yield sign or traffic control signal located at the side of a roadway; b. within 8 metres of any fire hall on the side of the highway on which the fire hall is located or within 30 metres of such fire hall on the opposite side of the roadway; c. within a turning basin; d. between 8:30 a.m. and 4:30 p.m. upon that side of a highway adjacent to any school property. OBSTRUCTING ROADS - 4- 7. No person shall deposit snow or ice on a highway. ILLEGAL PURPOSES FOR STANDING OR PARKING 8. No person shall stand or park a vehicle upon a highway for the purposes of: a. displaying it for sale; b. washing, greasing, repairing such vehicle, except for repairs necessitated by emergency; c. unloading or transferring of materials of any kind except in cases of emergency; d. advertising or the selling of goods; NO PARKING ZONES 9. Where signs in accordance with the Regulations of the Highway Traffic Act are erected and are on display establishing a "NO PARKING" zone, no person shall park within such zone as designated by Schedule 1 to this By-law. 10. Where signs in accordance with the Regulations of the Highway Traffic Act are erected and are on display no person shall park within the zone established by Schedule 2 to this By-Law. WINTER PARKING 11. No person shall park a vehicle on a highway between the hours of 2:00 a.m. of any day and 6:00 a.m. of the same day, commencing November 15 of each year until April 15 of the following year. FIRE ROUTES 12. Where signs in accordance with the Regulations of the Highway Traffic Act are erected and are on display no person shall park a vehicle on any highway designated as a "FIRE ROUTE" by schedule 3 of this By-Law. PUBLIC PARKING LOT RESTRICTIONS 13.a. No person shall park a heavy truck, trailer unit or recreational vehicle in a public parking lot. 13.e. No person shall park a passenger car in a public parking lot for a period longer than 24 consecutive hours. - 5- 14.a. The Works Superintendent, the Fire Chief, and their designates, are hereby authorized and directed to erect or place temporary "No Parking" signs on any highway. 14.b. Without limiting the generality of subsection (a), such signs shall be erected in the event of fires or fire alarms or parades, or while large assemblies are in an auditorium or otherwise, for a reasonable period of time during or after fires or fire alarms or immediately preceding and following parades or assemblies, provided however, the "No Parking" signs shall be erected one hour or more before such parades or assemblies. 14.c. Without limiting the generality of subsection (a) such signs shall be erected to facilitate the removal of snow or ice, street cleaning, tree trimming or construction or repair to roads, curbs or gutters, sewers or water mains, provided however, that such "No Parking" signs shall be erected one hour or more before such works are to commence. 14.d. Any such sign erected or placed under this section shall be deemed to be a traffic control device or sign for the purposes of this By-Law and no person shall park a vehicle on any highway that has been designated as a temporary "No Parking" zone. EMERGENCY VEHICLES 15. The provisions of this By-Law shall not apply to authorized emergency vehicles or any vehicle owned by the Corporation of the Town of Mono. ENFORCEMENT AND PENALTY 16. Any vehicle parked in violation of any section listed above may be removed by order of a Police Officer or a Municipal Law Enforcement Officer appointed by the Town of Mono, and taken and placed or stored in a suitable location and all costs and charges for moving, care and storage thereafter, if any, shall be a lien upon such vehicle and may be enforced in the manner provided by section 52 of the Mechanics Lien Act of Ontario or any successors thereto. 17. Every person who contravenes any provision of this by-law is guilty of an offence and on conviction is liable to a fine in accordance with the Provincial Offences Act, R.S.O. 1990, Chapter p. 33, as amended. 18.
