THE CORPORATION OF THE TOWNSHIP OF MUSKOKA LAKES
BY-LAW NUMBER 2021-087

A By-Law to Regulate Traffic on Township Roads
in the Township of Muskoka Lakes
Whereas pursuant to the Municipal Act, 2001, S.O. 2001, c.25 and the Highway Traffic
Act, R.S.O. 1990, c. H.8 municipalities may pass by-laws to regulate traffic on
highways, and municipal property;
THEREFORE the Council of the Corporation of the Township of Muskoka Lakes
enacts as follows:
DEFINITIONS
1. In this by-law,
1) "authorized sign" means a sign or other device placed or erected on a
highway or elsewhere pursuant to this by-law and includes official signs;
2) "boulevard" means all parts of a highway except any roadway, shoulder
or sidewalk;
3) "Director" means the Township's Director of Public Works or designate;
4) "emergency vehicle" has the same meaning as in section 144 of the
HTA;
5) "highway" has the same meaning as in subsection 1(1) of the HTA and
includes unopened and unassumed road allowances;
6) "HTA" means the Highway Traffic Act, R.S.O. 1990, c. H.8;
7) "Municipality" means The Corporation of the Township of Muskoka
Lakes or the geographic area of the Township as the context requires;
8) "Municipal property" means property of the Municipality or any board of
the Municipality;
9) "Officer" means a police officer as defined in subsection 2(1) of the
Police Services Act, R.S.O. 1990, c. P.15 or a municipal law
enforcement officer appointed by the Municipality pursuant to
subsection 15(1) of the Police Services Act to enforce the provisions of
this by-law;
10) "pedestrian" means a person on foot, in a wheeled chair or baby
carriage;
11) "shoulder" means that part of a highway immediately adjacent to the
travelled portion of the roadway and having a surface that has been
improved with asphalt, concrete or gravel for the use of vehicles;
12) "sidewalk" means the part of the highway specifically set aside or
commonly understood to be for pedestrian use, typically consisting of a
paved surface but does not include crosswalks, medians, boulevards,
shoulders or any part of the sidewalk where cleared snow has been
deposited;
INTERPRETATION
2. This by-law applies to all highways under the jurisdiction of the Municipality
and, where applicable, to Municipal property except as otherwise provided for
in the by-law.
3. This by-law shall not apply to:
1) emergency vehicles or public utility vehicles;
2) vehicles actually engaged in essential works undertaken for or on behalf
of any municipal corporation; or
3) vehicles actually forming part of a funeral procession for as long as may
reasonably be required for the purpose of such funeral.
4. In this by-law, unless otherwise specified,
1) "bicycle", "bus", "crosswalk", "intersection", "official sign", "park" or
"parking", "roadway", "stop" or "stopping", "through highway" and
"vehicle" have the same meanings as in subsection 1(1) of the HTA;
2) where any expression of time occurs or where any hour or other period
of time is stated, the time referred to shall be standard time except in
periods when daylight saving time is in effect, in which periods it shall
be daylight saving time;
3) a grammatical variation of a word or expression defined has a
corresponding meaning;
4) each entry in a column of a Schedule shall be read in conjunction with
the entry or entries across from it;
5) references to sections, subsections, clauses and Schedules are
references to sections, subsections, clauses and Schedules in this by-
law; and
6) reference to any Act, Regulation or By-law is reference to that Act,
Regulation or By-law as it is amended or re-enacted from time to time.
7) This by-law shall be read with all changes in gender or number as the
context requires.
8) If a court of competent jurisdiction declares any section, or any part of
any section, of this by-law to be invalid, or to be of no force or effect, it
is the intention of the Municipality that every other provision of this by-
law be applied and enforced in accordance with its terms to the extent
possible according to law.
5. All schedules attached hereto form a part of this by-law.
6. The following Schedules are attached to and form part of this by-law:
1) Schedule 1- Through Highways
2) Schedule 2- Stop Signs
3) Schedule 3- Yield Right-of-way Signs
4) Schedule 4 - Maximum Rate of Speed on Highway
5) Schedule 5 - Maximum Rate of Speed Passing Over a Bridge
6) Schedule 6- Community Safety Zones
7) Schedule 7- Highways Exempt from Weight Restrictions
8) Schedule 8- Commercial Vehicles Prohibited Highways
9) Schedule 9- Bicycle Lanes
7. The Director is hereby authorized to obtain, erect and maintain such official
signs as are necessary in order to give force and effect to the provisions of this
by-law.
8. No person shall place, maintain or display on any highway, any sign, marking
or device, which purports to be or is an imitation of or resembles an authorized
sign or an official sign.
TRAFFIC CONTROL MEASURES
9. Through Highways
1) The highways set out in Schedule 1 are designated as through highways
for the purposes of the HTA.
2) Any designation under subsection (1) shall not include any intersection
where the highway intersected is a District of Muskoka highway, a King's
highway or where traffic control signals are installed.
10. Stop Signs
1) The erection of stop signs is authorized at each of the intersections set out
in Column 1 on the highway approaches as identified in Column 2 of
Schedule 2.
11. Yield Signs
1) The erection of yield right-of-way signs is authorized at each of the
intersections set out in Column 1 on the highway approaches as identified
in Column 2 of Schedule 3.
RATE OF SPEED
12. Rate Of Speed
1) No person shall drive a vehicle at a rate of speed greater than 80 km/h
unless otherwise posted.
2) Where any highway or portion of highway set out in Schedule 4 is signed in
compliance with the regulations under the HTA, the maximum rate of speed
thereon shall be the rate of speed prescribed in Schedule 4.
13. Maximum Rate of Speed Passing Over a Bridge
1) No person shall pass over a bridge identified in Column 1 at a rate of speed
greater than that set out in Column 2 of Schedule 5.
14. Community Safety Zones
1) The highways or portions thereof set out in Column 1 of Schedule 6
between the limits set out in Column 2 of Schedule 6 and during the times
set out in Column 3 of Schedule 6 are designated as community safety
zones.
15. Processions
1) Except pursuant to the directions of a police officer, no person shall operate
a vehicle so as to join a funeral or other authorized procession while it is in
motion.
2) All vehicles in a funeral or other procession shall be driven as near as
practicable to the right hand edge of the roadway and shall follow the
proceeding vehicle as close as is practicable and safe.
LOADS ON HIGHWAYS
16. Reduced Load Highways
1) For the purposes of Section 122 of the Highway Traffic Act all highways
under the jurisdiction of the Corporation of the Township of Muskoka
Lakes shall be designated highways for the purposes of the Act.
2) The reduced load period shall commence on March 1st of each year and
end on May 15th of each year or as established by the Director.
3) The highways or portions thereof set out in Schedule 7 are exempt from the
reduced load restriction.
17. Heavy Traffic
1) No owner of a commercial motor vehicle with a registered gross weight in
excess of 5 tonnes shall permit said vehicle to be operated on any street
identified in Column 1 between the limits set out in columns 2 and 3 of
Schedule 8.
i. The Director may designate temporary permissive truck
routes and temporary prohibitive no heavy truck routes, and
may erect official signs to those effects.
ii. No person shall operate a commercial motor vehicle with a
registered gross weight in excess of 5 tonnes on any street in
contravention of a temporary prohibition authorized by the
Director pursuant to subsection (1).
iii. No owner of a commercial motor vehicle with a registered
gross weight in excess of 5 tonnes shall permit said vehicle to
be operated on any street in contravention of a temporary
prohibition authorized by the Director pursuant to subsection
(1).
18. The provisions of this section shall not apply to,
1) public transit or a school purposes bus unless otherwise specified;
2) a private vehicle driven to or from the vehicle owner's residence;
3) vehicles operated by or on behalf of a municipality or other authority having
jurisdiction and control of a highway, where the vehicles are engaged in
highway maintenance, including the carriage and application of abrasives
or chemicals for use on a highway, or the removal of snow from a highway;
4) vehicles used exclusively for the transportation of milk;
5) fire apparatus;
6) vehicles operated by or on behalf of a municipality transporting waste; or
7) public utility emergency vehicles.
8) Subsections (1) to (3) shall not apply to the use of highways for deliveries
to or removals from any premises abutting thereon where no other access
or route exists.
IDLING
19. Excessive Idling
1) In this section the following definitions shall apply:
i.
"idle" means the operation of the engine of a vehicle while the vehicle
is not in motion and not being used to operate auxiliary equipment
that is essential to the basic function of the vehicle and "idling" has a
corresponding meaning;
ii.
"layover" means stopping at a point along a transit route for a
maximum of 15 minutes to allow a public transit vehicle to adjust to
service schedules;
iii.
"mobile work vehicle" means a vehicle containing equipment that
must be operated inside or in association with the vehicle;
iv.
"private transit vehicle" means transit vehicles other than public
transit vehicles, such as but not limited to school buses, tour buses
and motor coaches;
v.
"public transit vehicle" means any vehicle operated by a municipal
transit authority;
vi.
"stopover" means a scheduled delay of a maximum of 15 minutes at
a public transit vehicle terminal to allow public transit vehicles to
adjust service schedules; and
vii.
"vehicle" means a motor vehicle, trailer, traction engine, farm tractor
or road building machine as defined in the Highway Traffic Act and
any vehicle drawn, propelled or driven by any kind of non-muscular
power but does not include any electrically powered cars or electric
or diesel electric railways running exclusively upon rails.
2) No person shall cause or permit a vehicle to idle for more than 5 consecutive
minutes.
3) The 5 minute limitation does not apply to,
i.
police, fire or ambulance vehicles, or public transit vehicles while
engaged in operational activities, including training activities except
where idling is substantially for the convenience of the operator of
the vehicle;
ii.
vehicles assisting in an emergency activity;
iii.
mobile work vehicles while they are in the course of being used for
their basic function;
iv.
vehicles where idling is required as part of the repair process or to
prepare a vehicle for servicing;
v.
armored vehicles where a person remains inside the vehicle while
guarding the contents of the vehicle or while the vehicle is being
loaded or unloaded;
vi.
vehicles that remain motionless because of an emergency, traffic or
weather conditions or mechanical difficulties over which the driver
has no control;
vii.
vehicles engaged in a parade or race or other such event authorized
by the Municipality;
viii.
vehicles servicing as a facility for taking measurements or making
observations or conducting maintenance or construction operated by
or on behalf of a municipality;
ix.
public transit vehicles and private transit vehicles while passengers
are embarking or disembarking;
x.
public transit vehicles while at a layover or stopover location, except
where the idling is substantially for the convenience of the operator
of the vehicle;
xi.
vehicles transporting a person where a medical doctor certifies in
writing that for medical reasons, the person requires the temperature
or humidity be maintained within a certain range;
xii.
vehicles when the ambient outside temperature is more than 27
degrees Celsius (27 degrees C) or less than five degrees Celsius (5
degrees C); or
xiii.
vehicles actively used in an agricultural operation which requires the
vehicle to be operational while work is in progress.
4) Notwithstanding subsection (3), no operator of a private transit vehicle
equipped with an air-conditioning system shall cause or permit said vehicle
to idle for more than 10 consecutive minutes of engine idling time to bring
the vehicle to a tolerable temperature for the convenience of the
passengers. After a 10 minute period, the operator of the private transit
vehicle shall turn off the engine for a minimum period of 15 minutes before
restarting the engine, unless the operator is moving the vehicle forthwith.
5) No operator of a private transit vehicle not equipped with an air conditioning
system shall cause or permit the said vehicle to idle for more than 5
consecutive minutes.
NON-MOTORIZED VEHICLES
20. Bicycles
1) No person shall ride a bicycle with one wheel greater than 50 centimetres
in diameter or other vehicle however powered along or upon any sidewalk,
or parts of sidewalks and forming part of any highway or bridge, boulevard
or other place set apart for pedestrian activity but not a recreation trail within
the limits of the Municipality.
2) Subsection (1) shall not apply to persons with disabilities or other persons
requiring the use of such vehicles as may be necessary for their means of
mobility.
3) Persons operating bicycles upon a roadway shall ride in single file.
4) A person operating a bicycle upon a roadway shall ride as near to the right
hand side of the roadway as practicable and shall exercise due care when
passing a standing vehicle or one proceeding in the same direction.
5) No person riding a bicycle to carry anything thereon shall do so in such a
manner as to prevent, or interfere with, full control of such bicycle while
upon any highway.
6) No person shall leave a bicycle lying on any public sidewalk, or park, or
leave such bicycle against any window, or in front of or across any door,
stairs or entranceway to any building so as to obstruct or interfere with
ingress to or egress from such building.
ENFORCEMENT
21. Enforcement
1) The provisions of this by-law may be enforced by any Police Officer or
Municipal By-Law Enforcement Officer as applicable.
2) Every person who contravenes any provision of this by-law is guilty of an
offence and upon conviction is liable to a fine for each offence as provided
for in the Provincial Offences Act, R.S.O. 1990, c. P.33.
3) For the purposes of this by-law, where a number plate issued pursuant to
the HTA is exposed on a vehicle, the holder of the permit corresponding to
such plate shall be deemed to be the owner of that vehicle and, if such
vehicle is found in contravention of this by-law, the owner shall be guilty of
an offence unless the number plate was used without the owner's consent.
22. Application
(1) This by-law shall come into force and take effect on the date that the Chief
Judge of the Ontario Court (Provincial Division) approves set fines for
offences under this bylaw.
(2) Sections 10, 11, 12, 13, 14, 16, and 17 shall not be effective unless
authorized signs that clearly indicate the regulation or prohibition have been
erected.
(3) The provisions of this by-law are subject to the provisions of the Highway
Traffic Act and any amendments thereto.
(4) Where there is a conflict between the provisions of this by-law and any other
by-law, the provisions of this by-law shall govern
(5) The following By-laws relating to the regulation of traffic in The Township of
Muskoka Lakes be hereby repealed:
a. By-Law 1986-133 as amended.
b. By-Law 2014-030 as amended.
