<!-- image --> ## BY-LAW NUMBER 2007-8 ## BEING A BY-LAW TO PROHIBIT HEAVY TRAFFIC ON MUNICIPAL STREETS AND HIGHWAYS WHEREAS Section 11 (1) of the Municipal Act, 2001, Chapter 25, S.O. 2001, authorizes municipalities to pass by-laws respecting matters within its spheres of jurisdiction; AND WHEREAS highways, including regulating traffic on highways is within the sphere of jurisdiction of the Township of Nairn and Hyman; NOW THEREFORE the council of the Corporation of the Township of Nairn and Hyman HEREBY ENACTS AS FOLLOWS: - 1) In this by-law: 2. "Heavy Traffic" shall mean the operation of a heavy vehicle as herein defined - b) In this by-law "Heavy Vehicle" shall mean a vehicle as defined in the Highway Traffic Act which is not primarily designed to carry passengers and which the vehicle has an unloaded weight of 4.6 tonnes or more. 4. No person shall operate a heavy vehicle on the highway or highways or parts thereof set out in Schedule "A" attached hereto and forming part of this By-law. 5. The provisions of this by-law shall not extend to the use of the said highways or parts of highways for delivery and removal of goods from any premises abutting thereon, to ambulance, to police, to fire department vehicles, to vehicles primarily designed to carry passengers, to vehicles actually engaged in works undertaken by the Corporation of the Township of Nairn and Hyman or to a privately owned unloaded vehicle driven to or from the owners residence abutting thereon. - 4) Any person who contravenes any provisions of this by-law is guilty of an offense under the Provincial Offences Act. - 5) In the event any provision of this by-law shall be deemed void or invalid by a court of competent jurisdiction, the remaining provisions or parts shall be and remain in full force and effect. - 6) This by-law shall repeal By-law numbers 98-44 and 2005-6. - 7) That this by-law shall take effect upon the third and final reading thereof.
