## The Corporation of the Town of New Tecumseth ## By-law ## Number 2024-076 ## "Automated Speed Enforcement Program By-law" by-law to establish an Automated Speed Enforcement Program in the own of New Tecumset Whereas the Municipal Act, 2001, as amended, provides that the municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act; And Whereas the Council of The Corporation of the Town of New Tecumseth is desirous of implementing an Automated Speed Enforcement (ASE) program in the Town of New Tecumseth to increase traffic safety in community safety and school And Whereas staff provided a comprehensive overview of the ASE program requirements to Council in Report #ADMIN-2024-21 on July 22, 2024; no Whereas staff will be brinaina torward a subseauent bv-law to implemer e Administrative Penalties (AP) Proaram, in accordance with the requirements c Provincial Legislation and subject to the approval of the Minister of Attorney General's Office; Now Therefore the Council of The Corporation of the Town of New Tecumseth does hereby enact as follows: 1. hat staff be authorized to establish an Automated Speed Entorcemer roaram in accordance with Ontario Regulation 398/19 and 355/22 mad under the Highway Traffic Act. 2. That staff be authorized to enter into all necessary agreements to implement and operate an ASE program in the Town of New Tecumseth, including but not limited to, the Service Agreement with Local Authority Services (LAS) and Joint Processing Centre Agreement, all subject to the Town Solicitor's final clearance. 3. That this by-law shall be cited as the "Automated Speed Enforcement Program By-law." 4. That this by-law shall come into force and take effect on the date of final passing thereof.
