Number 2002-166
"Speed Limit By-law"
A by-law to regulate the speed of motor vehicles in the Town of New Tecumseth
Whereas Section 128 of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as
amended, authorizes the council of a municipality by by-law to prescribe a speed limit of
40, 50, 60, 70, 80, 90 or 100 kilometres per hour for motor vehicles driven on any
highway or portion of highway under its jurisdiction;
And Whereas Council of The Corporation of the Town of New Tecumseth
deems it necessary and expedient to regulate the speed of motor vehicles on certain
highways in the Town of New Tecumseth;
Now Therefore the Council of The Corporation of the Town of New Tecumseth
enacts as follows:
1.
DEFINITIONS
1.1
In this by-law the following definitions shall apply:
1.1.1 "highway" includes a common and public highway, street, avenue,
parkway, driveway, square, place, bridge, viaduct, trestle, or an unopened
and unassumed highway, any part of which is intended for or used by the
general public for the passage of vehicles and includes the area between
the lateral property line thereof.

2.
GENERAL REGULATIONS
2.1
When any highway or portion of highway set out in Schedule "A" attached
hereto and forming part of this by-law, is marked in compliance with the
regulations under the Highway Traffic Act, the maximum rate of speed
thereon shall be set out in the said Schedule "A".
3.
PENALTY
3.1
That every person who contravenes any of the provisions of this by-law is
guilty of an offence and on conviction is liable to a penalty as provided for
in the Highway Traffic Act.
4.
SEVERABILITY
4.1
Should any section, subsection, clause, paragraph or provision of this by-
law, including any part of schedules be declared by a court of competent
jurisdiction to be ultra vires, invalid or illegal for any reason, the same shall
not affect the validity of the by-law as a whole.
5.
CITING
5.1
That this by-law shall be cited as the "Speed Limit By-Law".
6.
ENACTMENT
6.1
By-Law 99-109 is hereby repealed.
6.1
That this by-law shall come into force and take effect when signed in
accordance with the Highway Traffic Act.
6.2
Notwithstanding subsection 6.1 of this by-law no speed limit for any
highway designated as a connecting link pursuant to the Public
Transportation and Highway Improvement Act in the Town of New
Tecumseth shall become effective until approved by the Ministry of
Transportation.
