A BY-LAW TO REGULATE TRAFFIC ON ROADS UNDER THE
JURISDICTION OF THE TOWN OF NEWMARKET
WHEREAS Section 11 of the Municipal Act, 2001, authorizes municipalities to
enact by-laws respecting matters within the sphere of jurisdiction of highways,
including traffic on highways, in conjunction with the Highway Traffic Act.
THEREFORE BE IT ENACTED by the Municipal Council of the Corporation of
the Town of Newmarket as follows:
DEFINITIONS
1.
In this by-law:

1.1
"all-terrain vehicle" is an off-road vehicle that:
a) has three (3) or four (4) low-pressure tires of all of which are
in contact with the ground;
b) has steering handlebars;
c) has a seat that is designed to be straddled by the driver;
d) is designed to carry a driver only and no passengers;
1.2
"authorized sign" means:
e) any sign;
f)
any roadway; curb or sidewalk marking;
g) radar speed display trailer;
h) any other device;
placed or erected on a road under the authority of this by-law for the
purpose of regulating, warning or guiding traffic and pedestrians;
1.3
"bicycle" is a device propelled solely by human power, upon which a
person may ride either on or astride a regular seat attached thereto,
including a tricycle and unicycle, but excluding children's bicycles or toy
vehicle;
1.4
"bike lane" is a portion of a roadway designated by signs and/or
pavement markings for the preferential use of bicycles, children's
bicycles, power-assisted bicycles, motor-assisted bicycles, and
mopeds;
1.5
"boulevard" is that portion of the highway located between the edge of
the roadway and the property line of the highway which may include the
untraveled portion of any highway, grassed/gravelled or paved area,
ditches, sidewalks and paved paths;
1.6
"children's bicycle" is a device propelled solely by human power, upon
which a person may ride either on or astride a regular seat attached
thereto, including a tricycle and unicycle that has a total wheel diameter
of 61 cm or less;
1.6.1 "Community Safety Zone" means a designated section of roadway,
recognized under provincial legislation and marked with community
safety zone signs allowing the doubling of fines associated with traffic
violations including speeding and, through the applicable sections of Bill
65, Safer School Zones Act, 2017. The Community Safety Zones
designation in Schedule XII of this by-law, are in effect 24 hours each
day, 7 days a week throughout all 12 months of each calendar year;
1.7
"emergency vehicle" includes an ambulance, fire department vehicle
and police department vehicle as defined under their respective Acts;
1.8
"footpath" is part of a highway not being part of the roadway that has
not been improved and consists of dirt or gravel for pedestrian traffic;
1.9
"heavy truck'; is a commercial motor vehicle having a· weight of three
(3) tons or · more;
1.10 "highway" includes a common and public highway, street, avenue,
parkway, driveway, road, boulevard, run, gardens, circle, court, trail,
hollow, crescent, way, lane, loop, square, place, bridge, viaduct or
trestle, designed and intended for, or used by, the· general public for
the passage of vehicles and includes the area between the lateral
property lines thereof;

1.11 "in-line skating" includes roller skating, and in-line skates and in-line
skater shall have a corresponding meaning;
1.12 "intersection" is the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of the lateral
boundary lines of two or more highways that join one another at an
angle, whether or not one highway crosses the other;
1.13 "Iow-speed vehicle" is a vehicle that:
a) is designed for use primarily on streets and roads where
access and the use of other classes of vehicles are controlled
by law or agreement;
b) travels on four (4) wheels;
c) is powered by an electric power train (an electric motor and,
if present, a transmission) that is designed to allow the
vehicle to attain a speed of 32 km/h but not more than 40
km/h in a distance of 1.6 km on a paved level surface;
d) does not use fuel as an on-board source of energy; and,
e) has a gross vehicle weight rating of less than 1361 kg;
1.14 "moped" is a motor-assisted bicycle fitted with pedals that can be
operated at all times and has a maximum speed of fifty (50) km/h;
1.15 "motor assisted bicycle" is a bicycle:
a) that is fitted with pedals that are operable at all times to propel
the bicycle;
b) that weighs not more than 55 kg (121 lbs.);
c) that has 110 hand or foot operated clutch or gearbox driven
by the motor and transferring power to the driven wheel;
d) that has an attached motor driven by electricity or having a
piston displacement of not more than 50 cubic centimeters;
e) that does not have sufficient power to enable the bicycle to
attain a speed greater than 50 km/h on level ground within a
distance of 2 kilometers from a standing start;
f) that does not include a motorcycle or pocket bike;
1.16 "motorcycle" is a self-propelled vehicle having a seat or saddle for the
use of the driver and designed to travel with not more than three (3)
wheels in contact with the ground, and includes a motor attached and
includes a motor scooter, but does not include a motor assisted bicycle
or pocket bike;
1.17 "motor vehicle" includes an automobile, motorcycle, a low-speed
vehicle, a motor assisted bicycle, and any other vehicle propelled or
driven other than by muscular power; but does not include a road
building machine, power assisted bicycle or a motorized snow vehicle;
1.18 "motorized snow vehicle" is a self-propelled vehicle designed to be
driven exclusively on snow or ice or both,
1.19 "non-motorized scooter'' is a horizontal platform on small wheels with a
handlebar that extends upwards from the base for steering purposes,
and which is propelled by muscle power;
1.20 "municipal service vehicle" is a vehicle operated by or on behalf of the
Town while the vehicle is being used for the repair or maintenance of
highways, the collection or transportation of waste, or other municipal
purpose for which heavy equipment is required;

1.21 "official sign" includes any authorized sign approved by the Ministry of
Transportation of Ontario and the Town;
1.22 "pedestrian" includes a person on foot, and a person in personal mobility
device, carriage, or stroller;
1.23 "pedestrian crossover" means any portion of a roadway at an
intersection or elsewhere, distinctly indicated for pedestrian crossing by
signs and lines or other markings on the surface of the roadway;
1.24 "personal mobility device" is a compact, motorized, transportation
device to allow greater freedom of movement. Personal mobility devices
include forms like motorized wheel chairs, motorized mobility scooters,
and Segways;
1.25 "pocket bike" is a miniature motorcycle with a 39cc to 50cc two-stroke
engine with. a maximum of 17-18 horsepower to turn the rear wheel via
a chain. The typical size is less than 50cm in height and 1 meter in
length and the maximum speed varies between 30 to 90 km/h;
1.26 "police officer" is a police officer appointed by the York Regional Police,
Ontario Provincial Police or the Royal Canadian Mounted Police;
1.27 "power-assisted bicycle" means a vehicle that:
a) has steering handlebars and is equipped with pedals;
b) is designed to travel on not more than three (3) wheels in
contact with the ground;
c)
is capable of being propelled by muscular power;
d) has one or more electric motors that have, singly or in
combination, the following characteristics;
i.
it has a total continuous power output rating,
measured at the shaft of each motor, of 500
W or less,
ii.
if it is engaged by the use of muscular
power, power assistance immediately
ceases when the muscular power ceases,
iii.
if it is engaged by the use of an accelerator
controller, power assistance immediately
ceases when the brakes are applied, and
iv.
it is incapable of providing further
assistance when the bicycle attains a speed
of 32 km/h on level ground,
e)
bears a label that is permanently affixed by the
manufacturer and appears in a conspicuous location
stating, in both official languages, that the vehicle is a
power-assisted bicycle as defined in this subsection and
f)
has one of the following safety features:
i.
an enabling mechanism to turn the electric
motor on and off that is separate from the
accelerator controller and fitted in such a
manner that it is operable by the driver, or
ii.
a mechanism that prevents the motor from
being engaged before the bicycle attains a
speed of 3 km/h;
1.28 "roadway" is that part of the highway that is improved, designed or
ordinarily used for vehicular traffic, but does not include the shoulder;
and where a highway includes two or more separate roadways, the term
"roadway" refers to any one roadway separately and not to both or all
of the roadways collectively;
1.29 "schedule" is a schedule referred to in the by-Law and forming part of

this by-law;
1.30 "school crossing" is a crosswalk marked by authorized sign and
pavement markings designating it as a school crossing location;
1.31 "Segway" is a motorized personal vehicle having two wheels on one
axle that balances itself using gyroscopes and tilt sensors;
1.32 "sidewalk" is part of a highway not being part of the roadway that has
been improved by paving or other means for pedestrian traffic;
1.32.1 "Multi-Use Path" (MUP) is part of a highway not being part of the
roadway that has been improved by paving or other means and
designed with sufficient width for both pedestrian and bicycle use.
1.33 "signalized intersection" is an intersection where traffic control signals
are installed for the regulation or control of vehicular or pedestrian traffic;
1.34 "skateboard" is a horizontal platform on small wheels which is propelled
by muscle power;
1.35 "time" any hour or other period of time refers to standard time when
standard time is in effect and daylight saving time when daylight saving
time is in effect;
1.36 "Town" is the Corporation of the Town of Newmarket;
1.37 "toy vehicle" is a vehicle that seats not more than two (2) children
which is either motorized or powered by muscle that has a top speed
of 8 km/h;
1.38 "traffic circle" is a form of intersection that accommodates traffic flow
in a circular counter-clockwise direction around a centre island;
1.39 "traffic control signal" means that part of a traffic control signal
system that consists of one set of no less than three coloured lenses,
red, amber and green, mounted on a frame and commonly referred
to as a signal;
1.40 "U-turn" is the turning of a vehicle within a roadway, or where a
highway is divided the turning of a vehicle from one roadway to
another roadway, so as to proceed in the opposite direction;
1.41 "vehicle" includes a motor vehicle, trailer, traction engine, farm
tractor, road-building machine, bicycle and any vehicle drawn,
propelled or driven by any kind of power, including muscular power,
but does not include a motorized snow vehicle.
SCOPE OF BY-LAW
2.
This by-law provides for the regulation of traffic within the Town
whether on highways or roadways.
PLACING OF AUTHORIZED SIGNS
3.
The Director of Engineering Services is authorized to approve any
signs required to give effect to the provisions of this by-law; and the
Director of Public Works Services is authorized to place and maintain
those signs which the Director of Engineering Services approves.
IMITATIONS OF AUTHORIZED SIGNS PROHIBITED

4.
No person shall place, maintain, or display upon, or in view of, any
roadway any sign, marking or device which purports to be, or is an
imitation of, or resembles, an authorized sign or which conceals from
view, or interferes with the effectiveness of, an authorized sign.
DIRECTIONS OF POLICE OFFICER
5.
The lawful directions of a police officer for the regulation of traffic on a
highway shall be obeyed notwithstanding any provisions of this by-law,
and nothing in this by-law shall affect the powers to regulate traffic
held by the Regional Municipality of York Police Services Board.
STOP AND YIELD RIGHT-OF-WAY TO PEDESTRIANS
6.
The driver or operator of a vehicle emerging from a driveway, laneway
or building or bus loop onto a highway shall bring the vehicle to a full stop
immediately before driving onto a sidewalk or footpath, and prior to
proceeding shall yield the right-of-way to pedestrians upon the sidewalk
or footpath.
U-TURNS
7.
Where U-turns are not prohibited under the provisions of Section 18,
such a turn shall be made only where it can be made in safety and
without interfering with other traffic.
FUNERAL OR OTHER PROCESSIONS
8.
No person shall, except under the direction of a police officer, drive a
vehicle on a highway between the vehicles comprising a funeral or other
procession recognizable as such by the display of pennants or other
identifying insignia while the vehicles in such procession are in motion.
DRIVING ON SIDEWALKS, FOOTPATHS AND CURBS PROHIBITED
9.1
No person shall drive a motor vehicle upon a sidewalk or footpath on a
highway other than for the purpose of directly crossing the sidewalk or
footpath, except emergency and municipal service vehicles.
9.2
No person shall drive a motor vehicle over a raised curb other than at a
place whe.re there is a ramp, except emergency and municipal-service
vehicles.
PEDESTRIANS TO YIELD RIGHT-OF-WAY TO VEHICLES WHERE NO
CROSSOVER
10.
Except where traffic control signals are in operation or where traffic is
being controlled by a police officer, a pedestrian crossing a highway at a
place other than a pedestrian crossover shall yield the right-of-way to all
vehicles upon the roadway, but nothing in this section shall relieve the
driver of a vehicle from the obligation of taking all due care to avoid an
accident.
PROCEEDING OVER BARRIERS ON SIDEWALK PROHIBITED
11.
No pedestrian shall proceed over or go under or around a barrier
installed on a sidewalk.
PLAYING ON ROADWAYS PROHIBITED
12.1 No person shall play or take part in any game or sport upon a roadway
or designated bike lane.

12.2 Where there are sidewalks or paths, no person shall ride or by means
of any roller skates, in-line skates, scooters, skateboards, toy vehicles
or similar device shall go upon a roadway or designated bike lane except
for the purpose of crossing the road, and when so crossing such person
shall have the rights and be subject to the obligations of a pedestrian
under this by-law.
MOTORIZED SNOW VEHICLES
13.1 No person shall drive a motorized snow vehicle upon a sidewalk or
bicycle lane in the Town except for the purpose of directly crossing such
sidewalk or bicycle lane.
13.2 No person shall drive a motorized snow vehicle upon a highway in the
Town of Newmarket during any day between the hours of 11:00 p.m. and
7:00 a.m.
13.3 This section does not include any such motorized snow vehicle
operated by the servants, agents and employees on behalf of the Town.
RADAR SPEED DISPLAY TRAILERS
14.1 No person shall operate a vehicle with the intent of altering radar speed
board information;
14.2 No person shall stop or park within five (5) metres of the Radar Speed
Display Trailers.
SIDEWALK USE
15.
Sidewalks
are
reserved
for
pedestrians,
children's
bicycles,
skateboards, in-line skates, non-motorized scooters, toy vehicles and
personal mobility devices
ONE-WAY TRAFFIC
16.
The highways set out in Column 1 of Schedule I of this by-law, between
the limits set out in Column 2 of the said Schedule, are hereby
designated for one-way traffic only in the direction set out in Column 3 of
the said Schedule.
DESIGNATIONS EFFECTIVE UPON ERECTION OF AUTHORIZED SIGNS
17.
Each designation made by section 16 shall be effective upon the
erection of authorized signs indicating such designation.
PROHIBITED TURNS
18.
When an authorized sign is displayed, no vehicle in any intersection or
portion of highway set out in Column 1 of Schedule II to this by-law,
proceeding in the direction or emerging from a property set out in
Column 2 of the said Schedule, shall be turned in the direction set out in
Column 3 of the said Schedule, during the times or days set out in
Column 4 of the said Schedule.
STOP SIGNS
19.
The erection of stop signs is hereby authorized at each of the
intersections set out in Column 1 of Schedule Ill of this by-law for the
control of traffic entering the intersection from the highway or portion of
highway set out in Column 2 of the said Schedule.

YIELD SIGNS
20.
The erection of yield right-of-way signs is hereby authorized at each of
the intersections (Column 1) for the control of traffic entering the
intersection from the highway or portion of highway (Column 2) as set
out in Schedule IV.
TRAFFIC CIRCLES
21.
No person shall drive or ride any animal, vehicle, motor assisted vehicle
or bicycle otherwise than in a counter clockwise direction in any traffic
circle or a traffic circle of a cul-de-sac.
BICYCLE LANES
22.
The lanes or portions of lanes on roadways listed in Schedule XI are
hereby established as bike lanes.
22.1 When authorized signs have been erected, no person shall:
a) drive or be permitted to drive any vehicle, other than a bicycle,
power assisted bicycle or motor assisted bicycle on any lane
or part of lane established as a reserved lane;
b) park any vehicle on any lane or part of lane established as a
bicycle lane;
22.2 Subsection 22.1 shall not apply to prevent:
a) a vehicle making a right-hand turn, or a left hand turn from a
one-way roadway, provided the vehicle does not enter the
bicycle lane at a point farther from the point of making the right-
hand tum or left-hand turn that the distance set out in Schedule
XI opposite such bicycle lane;
b) the driver of any vehicle from stopping for a period of not more
than forty-five (45) seconds for the purpose of and while in the
process of receiving or discharging passengers or goods,
provided that such vehicle shall not be stopped in a lane in such
a manner as to interfere with the movement of a bicycle;
c) the stopping of a motor vehicle for the purpose of and while
actually engaged in receiving or discharging a physically
disabled person, provided that:
i. such motor vehicle has a valid disability parking
permit displayed upon its dashboard or on the sun
visor in accordance with the provisions of the
Highway Traffic Act; or
ii. a public transit motor vehicle or designated school
vehicle for load or off loading of passengers;
d) a vehicle pulled over for emergency purpose or repairs.
BICYCLES, POWER ASSISTED MOPEDS, AND MOTOR ASSISTED
BICYCLES
23.1 A person driving a bicycle, power assisted bicycle, moped or motor
assisted, bicycles upon a roadway shall:
a) where practicable, drive in the right-hand lane when available
for traffic or as close as practicable to the right-hand curb or
edge of the roadway;
b) exercise due care when passing a parked, stopped, or standing
vehicle or one proceeding in the same direction;

c) at all times when riding on a highway or sidewalk, keep their
feet on the pedals and both hands on the handlebars, except for
the purposes of signaling;
d) persons operating bicycles shall ride in single file;
23.2 A person driving a bicycle, power assisted bicycle, moped or motor
assisted bicycles upon a roadway shall not:
a) ride on any roadway abreast of another except in the course of
passing;
b) park a bicycle, power assisted bicycle, moped or motor assisted
bicycle on a roadway except in such a manner as to cause the
least possible obstruction to pedestrian or vehicular traffic;
c) ride a bicycle, power assisted bicycle, moped or a motor assisted
bicycle with a wheel or wheels more than sixty (60) centimeters
in diameter upon a sidewalk on any roadway;
d) ride upon a roadway while wearing headphones, or any other
manufactured device capable of transmitting sound, over or in
close proximity to both ears, except that this prohibition shall not
apply to the wearing of a device designed and worn for the
purpose of improving the wearer's ability to hear sounds
emanating from outside the device;
e) ride upon a roadway unless equipped with a bell capable of
being used as a warning;
f) operate or ride as a passenger unless the person is properly
wearing a bicycle safety helmet that has been designated under
or complies with the standards and specifications of the
Highway Traffic Act;
g) while riding indulge in trick riding or carry any articles in their
hands or otherwise ride so as to prevent the full use of both
hands to operate or control.
23.3 A person driving a bicycle, power assisted bicycle, moped or motor
assisted bicycle upon a roadway designated for one-way traffic shall:
a) where practicable, drive in the right-hand lane when available
for traffic or as close as practicable, drive in the right-hand curb
or edge of roadway.
PERSONAL MOBILITY DEVICES
24.
The operation of personal mobility devices shall be permitted on the
sidewalk whenever one is available. Personal mobility devices must
follow the rules of the road that apply to pedestrians and drive at the
same speed as other pedestrian traffic. All personal mobility devices,
whether or not they are used for short periods on the road, must have
appropriate reflective devices to ensure that they can be seen from the
front, back and both sides in low light conditions.
POCKET BIKES
25.
The use of Pocket Bikes on sidewalks and roadways is not permitted at
any time.
ALL TERRAIN VEHICLES
26.1 The use of All-Terrain Vehicles on sidewalks and roadways is not
permitted at any time.
26.2 This section does not include any such All-Terrain Vehicle operated by
the servants, agents and employees on behalf of the Town, York
Regional Police or any vehicle responding to an emergency.

IN-LINE SKATES, SKATEBOARDS AND NON-MOTORIZED SCOOTERS
27.
The riding or use of in-line skates, skateboards and non-motorized
scooters is permitted on sidewalks within the Town of Newmarket, only
as set out in this Section.
27.1 Every person who is riding or using in-line skates, skateboards or non-
motorized scooters on any sidewalk shall, at all times:
a) exercise due care and attention to their safety;
b) travel in a manner and at a speed appropriate to the surface
being travelled upon; and
c) exercise due care and attention to the safety of all other users
of the sidewalk.
27.2 Every person riding a skateboard or non-motorized scooter on a
sidewalk shall come to a complete stop and disembark from the
skateboard or non-motorized scooter prior to entering any roadway.
27.3 No person shall ride or use in-line skates, a skateboard or a non-
motorized scooter on any sidewalk in such a manner so as to cause any
damage to public or private property.
27.4 Any person riding or using in-line skates, a skateboard or a non-
motorized scooter on a sidewalk shall:
a) travel as close as is practicable to the right-hand side of the
sidewalk, having regard to their direction of travel; and
b) at all times yield the right-of-way to pedestrians and personal
mobility devices.
27.5 Without limiting the generality of section 27, no person shall engage in
any of the following activities while riding or using in-line skates, a
skateboard or a non- motorized scooter on any sidewalk:
a) vaulting from a ramp or other object;
b) using any object to move over, under, on, in or around for a
recreational purpose;
c) dismounting from a skateboard or non-motorized scooter
in· an unsafe manner;
d) riding the skateboard or non-motorized scooter in such a
manner so as to permit or cause it to leave the ground;
e) moving erratically from side to side.
No person shall place on any sidewalk any object that is intended to be
used to ride or drive in-line skates, a skateboard or a non-motorized
scooter over, under, on, in or around.
Every person riding a skateboard or a non-motorized scooter on a
sidewalk shall ensure that such skateboard or non-motorized scooter
does not enter into the roadway.
HEAVY TRUCKS PROHIBITED
28.1 Except as provided in Section 28.2 when authorized signs to that effect
are displayed, no person shall move, drive or operate a heavy truck as
defined in Section 1 on the highways (Column 1) between the limits
(Column 2) during the times or days (Column 3) as set out in Schedule
V.

28.8 Section 28.1 shall not apply to any vehicle actually engaged in making a
delivery to, or a collection from premises which cannot be reached
except by way of a highway or a portion of highway referred to in the
said section or to prohibit the use of such vehicles for such purpose,
provided that in making such delivery or collection the said highway or
portion of highway is travelled only insofar as is unavoidable in getting
to and from such premises.
LOAD ON BRIDGES
29.
When authorized signs are displayed, no vehicle shall be driven, moved
or operated over any bridge (Column 1) that exceeds the gross weight
prescribed for such bridge (Column 2) as set out in Schedule VI.
SPEED LIMIT
30.
When any road or portion of road as set out in Column 1 of Schedule VII
to this by- law has been marked to comply with the regulations of the
Ministry of Transportation of Ontario, the maximum rate of speed
thereon shall be the prescribed maximum rate of speed in km/h as set
out in Column 2 of Schedule VII.
SIGNALIZED INTERSECTIONS
31.
Traffic Control Signals erected within the Town of Newmarket shall be
located as set out in Schedule VIII to this by-law and thereafter the
provisions of the Highway Traffic Act shall govern.
EXEMPT VEHICLES
32.
If compliance would be impracticable, Sections 7, 8, 9.1, 9.2 and 28.1
shall not apply to:
a) a motor vehicle of a municipal or volunteer fire department
answering a fire alarm;
b) a motor vehicle operated by a police officer in the performance
of his duty;
c) an ambulance answering a call for assistance;
d) a motor vehicle engaged in works undertaken for or by the
Regional Municipality of York or the Town;
e) a motor vehicle of any utility, such as a telephone, gas, water,
electric, or cable television company.

33.
Schedules I to XI, inclusive, as attached shall form part of this by-law.
Each entry in a column of a schedule shall be read in conjunction with the
entries across from that entry, and not otherwise.
PENALTIES
34.1 Every person who contravenes the provisions of Sections 4, 8, 9.1, 9.2,
11, 12.1, 12.2, 13.1, 14.2, 22.1 and 27 of this by-law shall be guilty of
an offence and upon conviction liable to a fine of $25.00.
34.2 Every person who contravenes the provisions of Sections 5, 6, 7, 10,
16, 18, 19, 20, 21, 22, 23.1, 23.2, 23.3, 25, 26.1, 28.1, 29, 30 and 31 of
this by-law shall be guilty of an offence and upon conviction be subject to
the penalty provided for such violation in The Highway Traffic Act.
