The Corporation Of The City Of North Bay
By-Law No. 2014-38
Being a By-Law to Regulate Traffic on Highways in the City of North
Bay and to Repeal By-Law No. 2002-01, As Amended.
Whereas section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides
that a municipality has the capacity, rights, powers and privileges of a natural person for
the purpose of exercising its authority under that Act or any other Act.
And whereas section 10(1) of the Municipal Act, 2001 provides that a single-tier
municipality may provide any service or thing that the municipality considers necessary
or desirable for the public;
And whereas section 10(2) of the Municipal Act, 2001 provides that a single-tier
municipality may pass by-laws respecting: in paragraph 5, social and environmental
well-being of the municipality; in paragraph 6, health, safety and well-being of persons;
in paragraph 7, services and things that the municipality is authorized to provide under
section 10(1); in paragraph 8, protection of persons and property; and in paragraph 10,
structures, including signs;
And whereas the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, authorizes a
municipality to pass by-laws regulating traffic on highways;
And whereas it is deemed expedient to regulate or prohibit certain traffic within the
limits of the City of North Bay;
Now therefore the Council of The Corporation of the City of North Bay hereby
enacts as follows:
Part 1 - Interpretation And Application
1.1
Short Title
This by-law may be cited as the "Traffic By-Law".
1.2
Application
This by-law applies to all highways in the City which are under jurisdiction of the
City and/or maintained by the City.
1.3
Schedules
The Schedules referred to in this by-law form an integral part of it. Each entry in
a column of a Schedule is to be read in conjunction with the entry or entries
across from it.
1.4
Ontario Traffic Manual
The Ontario Traffic Manual is hereby adopted as it applies to the provisions of
this by-law.
1.5
Severability
If any provision or part of a provision of this by-law is declared by a court of
competent jurisdiction to be illegal or inoperative in whole or in part, or
inoperative in particular circumstances, such provision or part of the provision
shall be deemed to be severable, and the balance of the by-law, or its application
in other circumstances, shall not be affected and shall continue to be in full force
and effect.

Part 2 - Definitions
2.1
For the purposes of this by-law:
"Authorized Sign" means any sign, device, or barricade placed or erected by
the City on a highway for the purpose of regulating, warning, guiding or
prohibiting traffic. Authorized sign includes any official sign placed or erected by
the City on a highway.
"Boulevard" means the area:
(1) between the outer edge of the shoulder of a roadway and the sidewalk
or property line; or
(2) where there is a curb, between the curb and the sidewalk or property
line.
"Chief of Police" means the Chief of Police of the North Bay Police Service.
"City" means The Corporation of the City of North Bay.
"Commercial Motor Vehicle" means a motor vehicle having permanently
attached thereto a truck or delivery body and includes ambulances, hearses,
casket wagons, fire apparatus, buses and tractors used for hauling purposes on
the highways.
"Community Safety Zone" means a highway or portion of a highway
designated by Council as a community safety zone for the purposes of section
214.1 of the Highway Traffic Act.
"Corner" means the point of intersection of the improved limit of intersecting
roadways.
"Council" means the municipal council of The Corporation of the City of North
Bay.
"Crosswalk" means:
(1) that part of a highway at an intersection which is included within the
connection of the lateral lines of the sidewalks on opposite sides of the
highway measured from the curbs or, in the absence of curbs, from the
edges of the roadway, or
(2) any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs or by lines or other markings
on the surface.
"Curb" means the raised edge at the outer limits of the travelled portion of the
road.
"Emergency Vehicle" means police vehicles, fire department vehicles,
ambulances, civil defence vehicles, and public utilities emergency vehicles.
"Gross Weight" means the combined weight of the vehicle and load.
"Heavy Vehicle" means a commercial motor vehicle for which the gross vehicle
weight as shown on the registration permit issued under the Highway Traffic Act
exceeds 3,000 kilograms.
"Highway" includes a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle designed and intended for or
used by the general public for the passage of vehicles and includes the area
between the lateral property lines thereof.
"Highway Traffic Act" means the Highway Traffic Act, R.S.O. 1990, c. H.8, and
amendments thereto.

"Intersection" means the area embraced within the prolongation or connection
of the lateral curb lines or, if none, then of the lateral boundary lines of two or
more highways that join one another at an angle, whether or not one highway
crosses another.
"Managing Director of Engineering, Environmental Services and Public
Works" means the Managing Director of Engineering, Environmental Services
and Public Works for The Corporation of the City of North Bay, or his or her
designate.
"Ministry of Transportation" means the Ministry of Transportation of Ontario.
"Motor Vehicle" includes an automobile, a motorcycle, a motor-assisted bicycle
unless otherwise indicated in this by-law, and any other vehicle propelled or
driven otherwise than by muscular power, but does not include a street car or
other motor vehicle running only upon rails, a power-assisted bicycle, a
motorized snow vehicle, a traction engine, a farm tractor, a self-propelled
implement of husbandry or a road-building machine, as those terms are defined
in the Highway Traffic Act.
"Motorized Wheelchair" means a chair mounted on wheels, propelled or driven
otherwise than by muscular power, and used for the carriage of a person who
has a disability.
"Official Sign" means a sign approved by the Ministry of Transportation.
"One-Way Street" means a highway or portion of a highway upon which
vehicular traffic is limited to movement in one direction.
"Ontario Traffic Manual" means the Ontario Traffic Manual as produced by the
Ministry of Transportation for use by municipalities in Ontario, consisting of a
series of manuals numbered sequentially and referred to as "Books", as
amended from time to time. The Ontario Traffic Manual provides guidelines and
best practices for the design, application, and operation of traffic control devices
and systems in the Province of Ontario.
"Park" or "Parking" means the stopping or standing of a vehicle, whether
occupied or not, with or without the engine activated.
"Pedestrian" means a person afoot or in a wheelchair, or a child in a carriage .
"Police Officer" means a sworn member of a police service.
"Power-Assisted Bicycle" means a bicycle that,
(1) is a power-assisted bicycle as defined in subsection (2)(1) of the Motor
Vehicle Safety Regulations made under the Motor Vehicle Safety Act
(Canada),
(2) bears a label affixed by the manufacturer in compliance with the
definition referred to in subsection (1),
(3) has affixed to it pedals that are operable, and
(4) is capable of being propelled solely by muscular power.
"Road" means a highway as defined in this by-law.
"Road Service Vehicle" means a vehicle while it is being used for highway
maintenance purposes by or on behalf of the City or other authority with
jurisdiction and control of the highway.
"Roadway"
means the part of the highway that is improved, designed or ordinarily used for
vehicular traffic, but does not include the shoulder, the boulevard or the sidewalk

and, where a highway includes two or more separate roadways, the term
"roadway" refers to any one roadway separately and not to all of the roadways
collectively.
"Schedule" means a Schedule attached to and forming part of this by-law,
unless otherwise indicated.
"Segway" means a device known as the Segway Personal Transporter or the
Segway Human Transporter that is manufactured by Segway Inc.
"Sidewalk" means that portion of a highway between the curb lines or the lateral
lines of a roadway and the adjacent property lines, improved by paving, concrete
or other means for the use of pedestrians.
"Stand" or "Standing" means the halting of a vehicle, whether occupied or not,
except for the purpose of and while actually engaged in receiving or discharging
passengers.
"Stop" or "Stopping" when prohibited, means the complete cessation of
movement of a vehicle, even momentarily, whether occupied or not, except when
necessary to avoid conflict with other traffic or in compliance with the directions
of a police officer or of a traffic control sign or signal.
"Street" means a highway as defined in this by-law.
"Traffic" includes pedestrians, ridden or herded animals, vehicles, and other
conveyances, either singly or together, while using any highway for the purpose
of travel.
"Traffic Control Signal" means that part of a traffic control signal system that
consists of one set of no less than three coloured lenses, red, amber and green,
mounted on a frame, and placed or erected by the authority of Council or the
Ministry of Transportation.
"Traffic Control Signal System" means all of the signal equipment making up
the installation at any location, placed or erected by the authority of Council or
the Ministry of Transportation.
"Truck Route" means a highway or portion of a highway designated for use by
heavy vehicles.
"U-Turn" means the turning of a vehicle within a roadway so as to proceed in
the opposite direction.
"Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-
building machine, bicycle, power-assisted bicycle and any vehicle drawn,
propelled or driven by any kind of power, including muscular power, but does not
include a motorized snow vehicle or a street car.
Part 3 - Traffic Regulations
3.1
General Traffic Restrictions
(1)
The driver of a vehicle emerging from a lane, approach, driveway, lot or
building shall stop the vehicle immediately before entering any part of the
highway, and shall yield the right of way to pedestrians and other traffic as
may be necessary to avoid a collision.
(2)
No person shall operate a vehicle so as to strike the rear of another
vehicle in front of such person.

(3)
No person shall reverse a vehicle into an intersection or over a crosswalk
and no person shall, in any event or at any place, reverse a vehicle unless
such movement can be done safely.
(4)
No person shall drive a vehicle, other than a road service vehicle or
motorized wheelchair:
(a)
upon a sidewalk except for the purpose of directly crossing a
sidewalk; or
(b)
over a curb except at a place where a ramp has been provided.
(5)
No person shall drive a vehicle over an unprotected fire hose extended for
firefighting purposes.
(6)
No person shall drive a vehicle on any part of a highway which is marked
as being closed to traffic for the time being, by an authorized sign erected
or placed by the City.
(7)
No person shall stand, sit or ride on or in any portion of a vehicle not
designed for carrying passengers, and no person shall operate a vehicle
while any person is standing, sitting or riding on a portion of a vehicle not
designed for carrying passengers.
(8)
No person shall interfere with an authorized sign, traffic control signal, or
traffic control signal system, erected or placed on a highway by the City.
3.2
Processions
(1)
No person operating a vehicle shall intersect a funeral, parade or other
procession authorized by the Chief of Police while it is in motion except
under the direction of a police officer.
(2)
The driver of a vehicle in a funeral, parade or other procession shall follow
the vehicle ahead as close as is practicable and safe.
3.3
Bicycles
(1)
Every person riding a bicycle shall ride:
(a)
in single file only; and
(b)
as close as possible to the right hand curb, except that on a one-
way street a person riding a bicycle may also ride as closely as
possible to the left hand curb.
(2)
No person shall ride a bicycle upon a sidewalk or boulevard except for the
purpose of directly crossing a sidewalk or boulevard.
3.4
Segways
(1)
Notwithstanding the provisions of section 3.1(4), a person may operate a
Segway on a sidewalk if:
(a)
he or she is 14 years of age or older;
(b)
his or her mobility is limited by one or more disabilities, conditions
or functional impairments; and
(c)
he or she possesses and produces for inspection forthwith, upon
demand of a police officer, a medical certificate from a doctor to
certify that his or her mobility is limited.

(2)
No person shall operate a Segway on a sidewalk except during the period
commencing May 1 to October 14 of each year.
(3)
No person under 18 years of age shall operate a Segway while on a
sidewalk unless the person is wearing a helmet that complies with the
regulations under the Highway Traffic Act, and the chin strap of the helmet
is securely fastened under the chin.
(4)
No parent or guardian of a person under 16 years of age shall authorize or
knowingly permit that person to operate a Segway on a sidewalk unless
the person is wearing a helmet that complies with the regulations under
the Highway Traffic Act, and the chin strap of the helmet is securely
fastened under the chin.
(5)
No person shall operate a Segway on a sidewalk unless it is equipped
with a bell or horn, which shall be kept in good working order.
(6)
Every person operating a Segway on a sidewalk shall sound its bell or
horn whenever it is reasonably necessary to notify pedestrians or others of
its approach.
(7)
Every person operating a Segway on a sidewalk:
(a)
shall give way to pedestrians or bicycles by slowing or stopping if
there is insufficient space to pass;
(b)
shall not operate at a speed that is markedly greater than the speed
of pedestrians who are proximate to the Segway; and
(c)
shall not operate it in such a manner that it may harm, injure or
damage, either directly or indirectly, any person or property.
(8)
Every person operating a Segway on a sidewalk at any time from one-half
hour before sunset to one-half hour after sunrise and at any other time
when, due to insufficient light or unfavourable atmospheric conditions,
persons and vehicles are not clearly discernible at a distance of 150
metres or less:
(a)
shall carry a lighted lamp displaying a white or amber light at the
front of the Segway and a lighted lamp displaying a red light at the
rear of the Segway; and
(b)
the lamps shall be attached to the Segway or shall be carried or
worn by the operator on his or her person.
(9)
No person shall operate a Segway on a sidewalk while carrying a
passenger.
(10)
No person shall operate a Segway on a sidewalk while towing another
person, vehicle, or device.
(11)
Any person operating a Segway on a sidewalk shall stand at all times
while the Segway is in motion.
(12)
No person shall operate a Segway on a sidewalk, unless the Segway is in
good working order.
3.5
Pedestrians
(1)
No pedestrian shall obstruct a highway in such a manner as to interfere
with the movement of vehicles.

(2)
No pedestrian shall obstruct a sidewalk, street corner, or shoulder of a
highway so as to prevent the passage of any pedestrian.
3.6
Left Turn Restrictions - Schedule 1
(1)
The intersections and other locations set out in Schedule 1 are designated
as intersections and locations at which left turns are restricted.
(2)
Where official signs are posted, no person operating a vehicle shall make
a left turn at a location set out in Schedule 1, during the times or days as
set out in Schedule 1.
3.7
Right Turn Restrictions - Schedule 2
(1)
The intersections set out in Schedule 2 are designated as intersections at
which right turns are restricted.
(2)
Where official signs are posted, no person operating a vehicle shall make
a right turn on a red light at a location set out in Schedule 2, during the
times or days as set out in Schedule 2.
3.8
U-Turn Restrictions - Schedule 3
(1)
The intersections and other locations set out in Schedule 3 are designated
as intersections and locations at which U-turns are restricted and, where
official signs are posted, no person operating a vehicle shall make a U-
turn at a location set out in Schedule 3.
(2)
Where U-turns are not otherwise prohibited by the Highway Traffic Act or
this by-law, a person operating a vehicle may make a U-turn only where it
can be made in safety and without interfering with other traffic.
3.9
One-Way Streets - Schedule 4
(1)
The highways and portions of highways set out in column 1 of Schedule 4,
between the limits set out in column 2, are designated for one-way traffic
only in the direction set out in column 3.
(2)
Where official signs are posted, no person shall drive a vehicle on any
portion of any highway described in Schedule 4 other than in the direction
set out in Schedule 4.
3.10 Speed Limits - Schedule 5
(1)
The highways set out in column 1 of Schedule 5, between the limits set
out in column 2, are designated as highways for which the prescribed
maximum rate of speed is different from the rates set out in section 128(1)
of the Highway Traffic Act, and the prescribed maximum rate of speed
shall be the speed set out in column 3.
(2)
Where official signs are posted, no person shall drive a vehicle on any
highway or portion of highway set out in Schedule 5 at a rate of speed
greater than the speed prescribed by Schedule 5.
3.11 School Zones - Schedule 6
(1)
The highways set out in column 1 of Schedule 6, between the limits set
out in column 2, are designated as school zones.

(2)
During the period of time prescribed in columns 3 and 4 of Schedule 6, the
prescribed maximum rate of speed in designated school zones shall be
the speed set out in column 5.
(3)
Where official signs are posted, and are illuminated or actuated, or
flashing amber signals are actuated, no person shall drive a vehicle on
any highway or portion of highway set out in Schedule 6 at a rate of speed
greater than the speed prescribed by Schedule 6.
3.12 Community Safety Zones - Schedule 7
The highways set out in column 1 of Schedule 7, between the limits set out in
column 2, are designated as community safety zones during the period of time
prescribed in columns 3 and 4.
3.13 Truck Routes - Schedule 8
(1)
The highways or portions of highways described in Schedule 8 are
designated as truck routes.
(2)
Where official signs are posted, no person shall operate or park a heavy
vehicle on any highway in the City other than on the highways designated
as truck routes in Schedule 8.
(3)
Notwithstanding subsection (2), a heavy vehicle may be driven to make a
direct delivery to or collection from a bona fide destination in the City,
provided that the operator of the heavy vehicle proceeds by the most
direct route between the nearest truck route and the place of delivery or
pick up in the City, and on the completion of the conduct of business, the
heavy vehicle is returned by the most direct route to the nearest truck
route.
3.14 Load Limits on Bridges - Schedule 9
(1)
The bridges at the locations set out in Schedule 9 are designated as
bridges for which load limits are prescribed.
(2)
Where official signs are posted, no person shall drive or move a vehicle or
combination of vehicles over any bridge described in Schedule 9 where
the gross weight of the vehicle or combination of vehicles exceeds the
gross weight limits listed in Schedule 9.
3.15 Through Highways - Schedule 10
(1)
The highways designated in column 1 of Schedule 10, between the limits
set out in columns 2 and 3, are designated as through highways for the
purposes of the Highway Traffic Act, section 1, and every such highway
shall be marked by a stop sign at every intersecting highway in
compliance with the regulations of the Ministry of Transportation.
(2)
The designation of through highways by subsection (1) shall not include
any intersection where traffic control signals have been installed nor
include any intersection where the highway intersected is a Queen's
Highway.
3.16 All-Way Stop Signs - Schedule 11
The intersections set out in Schedule 11 are designated as all-way stop
intersections, and stop signs shall be erected facing the direction of oncoming
traffic on all approaches to the intersections.

3.17 Yield Signs - Schedule 12
The intersections set out in Schedule 12 are designated as intersections where
Yield Right of Way Signs shall be erected facing oncoming traffic at the highways
shown in Schedule 12.
3.18 Traffic Control Signals - Schedule 13
The intersections set out in Schedule 13 are designated as intersections where
traffic control signals shall be installed and operated.
Part 4 - Administration
4.1
Managing Director - Authorizations
The Managing Director of Engineering, Environmental Services and Public
Works is hereby authorized to:
(a)
erect or place and maintain such signs as may be necessary to
give effect to the provisions of this by-law, or as required to warn or
guide traffic for the safety or convenience of the public, including,
but not limited to, official signs and traffic control devices;
(b)
erect and maintain all traffic control signals to give effect to the
provisions of this by-law;
(c)
erect or place and maintain temporary traffic signs, traffic control
devices, and barricades for the purpose of regulating or prohibiting
traffic:
(i)
where there is highway construction, repair, or painting
underway;
(ii)
for the purpose of a community event; or
(iii)
in the event of an emergency; and
(d)
remove or cause to be removed without notice any sign, signal,
device, or barricade found on a highway which resembles an official
sign or authorized sign but which is not an official sign or authorized
sign.
4.2
Oversized Vehicle Permits
(1)
The Managing Director of Engineering, Environmental Services and Public
Works may, upon application in writing, grant a permit for use of the
highway by a vehicle or combination of vehicles in excess of the
dimensional limits set out in section 109 of the Highway Traffic Act or the
weight limits set out in Part VIII of the Highway Traffic Act in order to allow
the movement of:
(a)
a load, object or structure that cannot reasonably be divided and
moved within those limits;
(b)
a vehicle that cannot reasonably be divided and moved within those
limits and that is not itself carrying a load, object or structure or
drawing or carrying a vehicle; or

(c)
a vehicle or combination of vehicles that is used exclusively to
move a load, object or structure or to draw or carry a vehicle as
described in paragraphs (a) and (b).
(2)
The permit may be general, or may limit the time and the particular
highway that may be used, and may contain conditions relating to the
protection of persons and property from injury or damage.
(3)
The Managing Director of Engineering, Environmental Services and Public
Works:
(a)
may impose an administration fee of $500.00 for an oversized
vehicle permit application; and
(b)
in addition, may require a bond or other security sufficient to cover
the cost of repairing any possible damage to the highway.
Part 5 - Exemptions
5.1
Emergency Vehicles
(1)
All exemptions and exceptions set out in the Highway Traffic Act for
emergency vehicles apply, with any necessary modifications, to the
provisions of this by-law.
(2)
Without limiting the generality of subsection (1), sections 3.1(6), 3.6(2),
3.7(2), 3.8 (1), and 3.10(2) of this by-law do not apply to emergency
vehicles responding to an emergency call, if the movement can be made
in safety.
Part 6 - Enforcement
6.1
Obstruct
No person shall hinder or obstruct, or attempt to hinder or obstruct, any
Provincial Offences Officer who is exercising a power or performing a duty under
this by-law.
6.2
Offences and Penalties
Any person who contravenes any provision of this by-law is guilty of an offence
and, upon conviction, is subject to a fine as provided in the Provincial Offences
Act, R.S.O. 1990, c. P.33.
Part 7 - Coming Into Force
7.1
Coming Into Force and Repeal of Previous By-Laws
(1)
This By-Law No. 2014-38 shall not come into force and effect until the
date that Orders made by the Regional Senior Justice of the Ontario Court
of Justice pursuant to the Provincial Offences Act, and the Courts of
Justice Act, RSO 1990, c. C.43, and regulations thereunder take effect,
approving set fines for offences under both this by-law and the City of
North Bay On-Street Parking By-Law.

Upon the coming into force of both this by-law and the City of North Bay
On-Street Parking By-Law pursuant to subsection (1), By-Law No. 2002-
01 and all amendments thereto are hereby repealed.
