THE CORPORATION OF THE TOWNSHIP OF NORTH FRONTENAC BY-LAW #44-09 BEING A BY-LAW TO REPEAL BY-LAW #23-98 AND TO ESTABLISH LOAD RESTRICTIONS ON ROADWAYS IN NORTH FRONTENAC TOWNSHIP; WHEREAS Section 122 subsection 7 of the Highway Traffic Act, R.S.O. 1990 c.H8, as amended provides that the municipal corporation or other authority having jurisdiction over a roadway may by by-law designate the date on which a reduced load period shall start or end and the roadway or portion thereof is jurisdiction to which the designation applies; AND WHEREAS the reduced load period is deemed necessary for the protection of certain roadways in the Township of North Frontenac; THEREFORE the Council of the Corporation of the Township of North Frontenac enacts as follows: THAT By-law #23-98, being a By-law to establish load restrictions on roadways in the Township of North Frontenac is hereby repealed in its entirety; AND THAT the provisions of subsection 1, 2, 3, and 4 of Section 122 of the Highway Traffic Act, R.S.O. 1990 c.H8, as amended apply to all roads within North Frontenac Township during the period from the 1st day of March to the 15th day of May inclusive each and every year, or at the discretion of the Public Works Manager (depending on weather conditions). AND THAT any person violating the provisions of this by-law shall be subject to the penalties provided in Section 125 of the Highway Traffic Act, R.S.O. 1990 c.H8, as amended, and all such penalties shall be recoverable under the Provincial Offences Act. AND THAT this by-law shall not become effective until appropriate signs have been erected in accordance with the regulations under the Highway Traffic Act, R.S.O. 1990, c.H8, as amended. AND THAT all resolutions, by-laws or parts of by-laws which are contrary to or inconsistent with this by-law are hereby repealed. AND THAT this by-law shall take effect immediately upon the passing hereof. READ a first and second time this 14th day of May, 2009.
