pg. 1 The Corporation of the Municipality of Northern Bruce Peninsula By-Law No. 2026-07 Being a By-Law to Regulate Paid Parking and Control Traffic and More Particularly the Parking, Stopping or Standing of Vehicles and the Use of Municipal Parking Lots within the Municipality of Northern Bruce Peninsula Whereas the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that Section 8 shall be interpreted so as to confer broad authority on the municipality to enable it to govern its affairs as the Council considers appropriate and to enhance the municipality's ability to respond to Municipal issues; and Whereas Section 11(3)(1) of the Municipal Act, 2001, S.O 2001, c. 25, as amended, authorizes municipalities to pass by-laws regarding highways including parking and traffic on highways; and Whereas Section 137 of the Highway Traffic Act, R.S.O 1990, c. H.8 provides that the Council of a Municipality may, by by-law, provide for the erection of stop signs at intersections on a highway under its jurisdiction, and every sign so erected shall comply with regulations of the Ministry; and Whereas Section 27(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that, except as otherwise provided in this Act, a municipality may pass by-laws in respect of a highway only if it has jurisdiction over the highway; and Whereas Council deems it desirable to regulate and control traffic and, more particularly, the parking, stopping or standing of vehicles and the use of Municipal parking lots in the Municipality of Northern Bruce Peninsula; and Whereas the Municipality has identified specific areas within the Municipality where parking is to be regulated under a Paid Parking program. Now Therefore the Council of The Corporation of The Municipality of Northern Bruce Peninsula Enacts As Follows: Section 1 Application 1. The provisions of this By-law shall apply to the Municipality of Northern Bruce Peninsula Section 2 Definitions 1. For the purpose of this By-law, the following definitions shall apply: "Accessible Parking Permit" means a permit issued to an individual, which entitles the vehicle in which it is displayed to be parked in a designated accessible parking space. "Accessible Parking Space" means a space specially designated and noted with signage. "Authorized Sign" means any sign or roadway, curb or sidewalk marking or device, placed or erected anywhere, under the authority of Council for the purpose of regulating, warning or guiding traffic. pg. 2 "Boulevard" means the portion of the Municipality's property between the roadway and the sidewalk or footpath, and, in the absence of a sidewalk or footpath, means that portion of the Municipality's property located between the roadway and the "Bus" means a large motor vehicle (more than twenty-five (25) passengers designed to carry passengers, usually along a fixed route according to a schedule. "By-law Enforcement Officer" means an authorized person appointed by Council to enforce this By-law and one who has the authority to cancel an issued ticket. "Council" means the Council of the Corporation of the Municipality of Northern Bruce Peninsula. "Commercial Vehicle" means a motor vehicle having permanently attached thereto a truck or delivery body and includes, but is not limited to, an ambulance, a hearse, a casket wagon, a fire apparatus, a bus and a tractor used for hauling purposes on the highway. "Corner" means the point of intersection of curbs or edges of the roadways. "Crosswalk" means: (i) that part of the highway at an intersection that is included within the connections of the lateral lines of the sidewalk on the opposite sides of the highway, measured from the edges of the roadway, or (ii) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the road. "Driver" means a person who drives a vehicle. "Driveway" means a public or private roadway providing vehicular access to a street or highway. "Fire Department Vehicle" includes an emergency crash extrication vehicle owned and operated by a rescue organization approved by the Minister in writing for the purposes of this Act (Highway Traffic Act, R.S.O. 1990, c. H.8, as amended) and a vehicle designated in writing by the Fire Marshal of Ontario as a fire department vehicle. "Firefighter" means a fire chief and any other person employed in, or appointed to, a fire department and assigned to undertake fire protection services, including a volunteer firefighter. "Footpath" means an area adjacent to a roadway intended for the use of pedestrians where there is no sidewalk. "Heavy Truck" means a commercial motor vehicle larger than a truck commonly identified as a half-ton pickup truck or a van with a maximum half-ton cargo capacity used for the transportation of any material, animate or inanimate, greater than 5,000 kilograms. "Highway" means a common or a public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof. "Impending Conviction" means the second stage of a parking infraction and shall indicate failure to pay. "Improved Property" means a property or lot upon which a residential dwelling unit is situated. pg. 3 "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines, or if none exist, the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. "Ministry" means the Ontario Ministry of Transportation (M.T.O.). "Municipality" means the Corporation of the Municipality of Northern Bruce Peninsula. "Official Sign" means a sign approved by the Ministry or Municipality. "Paid Parking Machine" (or other means of payment provided by the Municipality) means a machine or other method (including paying by telephone or internet) which will record payment for time parked. "Paid Parking" means the requirement to pay for parking in the zones described herein. "Paid Fee" means a fee set out in the Municipality's Fees and Charges By-law. "Paid Parking Permit" means the approval given for paying for a parking space and shall include any pass issued. "Parking Infraction Notice" means a notice of violation. "Reservation" means a fully automated Parking Management System for visitor parking, which allows visitors to validate parking using a smartphone. "Required Paid Parking Time" means the established timeframe on every day of the week between the set hours as set out in Schedule K hereto and forming part of this by-law. "Resident Parking Pass" means a pass which is issued for a specific period of time to person(s) renting or leasing residentially on a full-time, year-round basis or owning improved property in the Municipality. "Non-Resident Parking Pass" means a pass which is issued for a specific period of time to person(s) who do not own, rent or lease residentially on a full-time, year- round basis or own improved property in the Municipality. A Non-Resident Parking Pass fee is applicable. "Park or Parking" where prohibited means any unlawful parking, standing, or stopping of a vehicle, whether occupied or not. "Pedestrian" means a person who goes on foot (e.g., one who walks) "Pedestrian Crossover" means any portion of a roadway designated by Municipal by-law, at an intersection or elsewhere, distinctly marked for pedestrian crossing by signs on the highway and lines or other markings on the surface of the roadway, as prescribed by the regulations. "One Way Street" means a street upon which vehicular traffic is limited to movement in one direction. "Oversized vehicle" means a vehicle which occupies more than one (1) parking space. "Regulation(s)" means a regulation(s) made pursuant to the Highway Traffic Act. "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulders, and when a highway pg. 4 includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not all of the roadways collectively. "Shuttle Bus" means a bus designed for carrying passengers (has a seating capacity for eleven (11) to twenty-five (25) persons for the purpose of moving people from one place to another between established points. "Sidewalk" means that portion of a highway between the curb lines of a roadway or the lateral edge lines of a roadway and the adjacent property lines intended for the use of pedestrians. "Snow removal" means any vehicle parked in such a position to interfere with the removal of snow from any road or sidewalk in the Municipality. The vehicle shall be ticketed and towed to a secure location at the owner's expense. "Stop or Stopping" where prohibited means the halting of a vehicle momentarily, whether occupied or not and whether the engine is running or not, except when necessary to avoid conflict with other traffic or to be in compliance with the directions of a police officer, traffic control sign or signal. "Time" where any expression of time occurs or where any hour or other period of time is stated, means Eastern Standard Time (E.S.T.), except during a period when Daylight Savings Time (DST) is in effect in the Municipality (when time referred to shall be one hour in advance of standard time). "Traffic" means the lawful vehicle or pedestrian movement on a highway. "Trailer" means any vehicle so constructed that it may be attached to a motor vehicle for the purpose of being drawn or propelled by the motor vehicle or is propelled by its power source. "Tow Away Zone" means, where signs have been posted, that the vehicle may be towed and impounded, and all costs relating to the same are charged back to the owner of the vehicle. "Vehicle" means a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or all-terrain vehicle. "Words" where any word or expression used in this By-law is not defined herein, reference shall be made to the Interpretation Section of the Highway Traffic Act, R.S.O 1990, c. H.8, as amended, or a generally accepted dictionary and the interpretation that best reflects the spirit and intent of this By-law shall be adopted. Section 3 Angle Parking 1. Where angle parking is designated in the areas described in Schedule A attached hereto, no person shall park a vehicle except at a forty-five (45) degree angle to the curb or edge of the roadway with the front right or left of the vehicle closest to the curb or the edge of the roadway. 2. No person shall park an oversized vehicle in angle parking areas unless the oversized vehicle fits completely within one parking space. Section 4 One-Way Streets 1. Where parking is permitted on both sides of a one-way street, in addition to the provisions of this Section, no person shall park a vehicle except a vehicle facing only in the direction allowed and with the right front and right rear wheels parallel to and distant, respectively not more than six (6") inches from the curb on the edge of the roadway, as set out in Schedule H attached hereto. pg. 5 Section 5 Parking Prohibited 1. Where authorized signs have been erected or are on display, no person shall park a vehicle in contravention of the directions stated on the sign. Signs may be directed by words or symbols pursuant to Ministry of Transportation-approved regulations. Prohibited parking areas are set out in Schedule B attached hereto. 2. Where parking spaces have been established by suitable marking on the road surface, no person shall park a vehicle except within the space designated by markings. 3. No person shall park a vehicle on the roadway when it is practicable to park the vehicle off the roadway. 4. Where authorized signs are erected, and on display, no person shall park a vehicle on any highway, street or parking lot or part thereof as described in Schedule B attached hereto. 5. Specific prohibitions shall include the following: a. No person shall park on a sidewalk. b. No person shall park on a crosswalk or pedestrian crossover. c. No person shall park within fifty (50') feet/fifteen (15m) meters of an intersection controlled by traffic signals. d. No person shall park within thirty (30') feet/nine (9m) meters of a corner. e. No person shall park in a fire route/fire access. f. No person shall park in a space designated for fire department parking only. g. No person shall park within ten (10') feet/three (3m) meters of a point on the roadway's curb or edge directly opposite a fire hydrant. h. No person shall park within fifty (50') feet/fifteen (15m) meters of a crosswalk or pedestrian crossover. i. No person shall park in such a position as to obstruct traffic. j. No person shall park in such a position that interferes with the removal of a vehicle previously parked or standing. k. No person shall park in such a position so as to interfere with the removal of snow from any road or sidewalk in the Municipality. The vehicle shall be ticketed and towed to a secure location at the owner's expense. l. No person shall park so as to obstruct an entrance to or exit from any building or areas where persons may be expected to congregate in large numbers. m. No person shall park so as to obstruct an entrance to or exit from a private or public driveway. n. No person shall park on any highway, including a boulevard, between 2:00 a.m. and 7:00 a.m. from November 1 of any year to April 30 of the following year. o. No person shall park on any street or roadway where signs are posted from 2:00 a.m. to 6:00 a.m. p. No person shall park on any road or avenue where signs have been posted. q. No person shall park for more than two (2) hours where signs have been erected. r. No person shall park in the opposite direction of the flow of traffic. s. No person shall park a bus in any area where signs are posted prohibiting such bus parking. t. No person shall park for more than three (3) hours where signs have been erected. u. No person shall park an oversize vehicle where signs have been posted. v. No person shall park in a resident and/or cemetery parking area where signs have been posted Resident Parking Only. 6. Where signs have been posted Tow-Away Zone, no person shall park a vehicle in any parking area or on any portion of any highway. Upon the issuance of a parking infraction, the Bylaw Enforcement Officer authorized to enforce the provisions of this By-law may contact a towing company to remove the vehicle and place or store it in a suitable location. Removal of the vehicle shall be at the vehicle owner's pg. 6 risk and expense, and all such costs and charges for the removal, care and storage, if any, shall be collectable pursuant to the provisions of the Repair and Storage Liens Act, R.S.O. 1990, c.R.25. Section 6 Stopping Prohibited 1. When stopping will interfere with other traffic or a pedestrian(s), no person shall stop a vehicle: a. on a sidewalk b. on a pedestrian crossover c. on a crosswalk d. beside another stopped or parked vehicle, or e. where signs are posted stating no stopping. Section 7 Restricted Parking 1. Where signs, in accordance with the regulations of the Highway Traffic Act, are erected, and on display, no person shall park a vehicle on any highway or any parking lot in the Municipality for a period longer than the time that is posted on the signs and as set out in Schedule C attached hereto. Section 8 Designated Pedestrian Crossovers 1. The portions of roadways set out in Schedule D attached hereto are designated as pedestrian crossovers, and all traffic must stop for pedestrians and pedestrian crossovers. Section 9 Fire Route/Fire Access/Emergency Vehicles 1. Where signs, in accordance with regulations of the Highway Traffic Act, as amended, are erected and on display as set out in Schedule E attached hereto, no person shall park a vehicle in violation of the signs in a fire route/fire access/emergency vehicles. Section 10 Heavy Trucks 1. No person shall park a heavy truck in any residential area for periods of time longer than that required for loading or unloading cargo. Section 11 Accessible Parking Spaces 1. Accessible parking spaces are established and described in Schedule F attached hereto. 2. Where authorized signs are erected and on display, bearing the International Symbol of the Accessible Parking Permit, in public parking lots or parking facilities, no person shall park a vehicle in a designated parking space, except when the parking is for the convenience of the person and the vehicle in which it displays the International Symbol of Accessible Parking Permit. 3. The accessible parking permit is a card displayed on the dashboard or attached to the turned-down sun visor on the driver's side of a parked vehicle, ensuring the International Symbol for Persons with a Disability, the permit number and the expiry date of the permit are clearly visible from the outside of the vehicle. 4. In public parking lots or parking facilities where authorized signs are erected and on display bearing the International Symbol of the Accessible Parking space, no person shall park a vehicle in a designated parking space except when the vehicle displays a permit which contains the International Symbol of Accessible Parking. Section 12 Bus Unloading/Loading, Shuttle Bus Loading/Unloading Zones 1. Where authorized signs have been erected and are on display indicating a loading zone, no person shall park a vehicle in any area, and as described in Schedule G pg. 7 attached hereto, between the hours of 8:00 a.m. and 6:00 p.m., Monday to Sunday inclusive, except persons loading or unloading passengers who are permitted to park in the loading zone for a period of time for this purpose. 2. Where, in Schedule G attached, a bus loading zone has been established, notwithstanding anything contained herein, the use of the bus loading zone will be for bus traffic only. Buses will follow the prescribed route for parking, loading and unloading, as posted. No person shall park a vehicle in any area described as a bus loading zone, as described in Schedule G attached, unless such a vehicle is a bus loading or unloading passengers. 3. Where signs regarding a shuttle bus zone have been erected and are on display, the use of the shuttle bus loading/unloading zone will be for shuttle bus traffic only. No person shall park a vehicle or bus in any area described as a shuttle bus loading/unloading zone. Section 13 Parking on Private Property 1. No person shall park on private property where authorized signs have been erected and on display stating, "No Parking Private Property" or "Private Property". 2. No person(s) shall park in an accessible parking space on private property where authorized signs are on display bearing the International Symbol of Accessible Parking unless such vehicle displays a permit bearing the International Symbol of Accessible Parking. 3. No person (s) shall park in a fire route on private property where authorized signs are on display indicating the fire route. 4. No person(s) shall park any vehicle contrary to the signs posted. 5. Any property owner or agent acting for the owner of any private property, Provincial or Federal Lands, where no parking signs stating, two (2) hour, three (3) hour, accessibility, park vehicle contrary to sign or fire route signs are in place, shall first request the Municipality to enforce this By-law. The request shall be in writing and signed by the property owner or agent. Section 14 Paid Parking/Reservation Parking 1. The locations of Paid Parking machines and Reservation Parking are described in Schedule J attached hereto. 2. The Paid Parking and Reservation Parking and times are described in Schedule K attached hereto. 3. Who may cancel a Paid Parking infraction is outlined in Section 20 of this by-law. 4. No person shall park in a Paid Parking or in a Reservation Parking area as described in this By-law except in accordance with this by-law. 5. No person shall park in a Paid Parking or Reservation Parking area shown in Schedule K during the required paid parking or reservation times as provided herein without paying for a Paid Parking Permit by using a Paid Parking Machine or other means of payment provided by the Municipality or by purchasing a Parking Pass. 6. Parking spaces within the Paid Parking Zone at the Tobermory M.T.O. parking lot on Hay Bay Road that are designated for the use of bus parking, loading and unloading. Buses must be parked or actively engaged in loading or unloading to pg. 8 occupy the parking spaces. Parking fees will apply as listed within the Municipality's Fees and Charges By-law. 7. No person shall park within a Reservation Parking area unless a reservation has been completed and payment has been made. Reservation fees will apply as listed within the Municipality's Fees and Charges By-law. Section 15 Paid Parking Permits 1. The Municipality may issue paid Parking and Virtual permits to allow a permit holder to park in an authorized area for a period of time as set out in Schedule K attached hereto. 2. No person shall park in a designated paid parking space without a permit or a reservation. 3. No person shall park a vehicle or allow it to remain parked when the payment or reservation for the parking has not been paid. 4. Upon the expiration of a Paid Parking or Reservation time, the person responsible for the vehicle must obtain from a Paid Parking Machine, QR code or other means of payment provided by the Municipality, further time, should they wish to remain parked in the Reservation or Paid Parking Zone. 5. Persons with a valid accessible parking permit parked in a designated accessible parking space within the Paid Parking Zone are exempt from payment or obtaining a Paid Parking Permit. 6. There will be no refund of any fee paid to purchase a Paid Parking Permit. 7. Paid Parking Permits will not be provided free of charge to any person or an organization without the express permission of the C.A.O. or designate. 8. Every person shall display tickets obtained from the Paid Parking Ticket Machines face up on the dashboard of the vehicle. Section 16 Parking Pass - Resident and Non-Resident 1. The Municipality will issue Resident Parking Passes per residential property owner(s) at no charge. The issuance of Resident Parking Passes will be issued for a person(s) residing, renting or leasing residentially on a full-time, year-round basis in the Municipality. Proof of residency will be required in the form of a valid photo identification issued by the Province of Ontario (such as a Driver's Licence) and vehicle ownership. A Resident Parking Pass will be associated with a licence plate. 2. The Municipality will issue up to two (2) Resident Parking passes per residential property for the residential property owner(s) at no charge. The issuance of a Resident Parking Pass will be issued for a person(s) owning improved property in the Municipality. A current-year tax bill and vehicle ownership are required, as each resident parking pass will be associated with a licence. 3. The Municipality reserves the right to charge a $50.00 fee for persons requiring or requesting a Resident Parking Pass(es) if they do not meet the requirements set out in Sec 16 sub 1 and Sec 16 sub 2. 4. There will be no refund of any fee paid for parking. 5. Resident Parking Passes are non-transferable except in the circumstances described in Section 16.6. 6. Where the original licence plate has been returned to Service Ontario and a new pg. 9 licence plate has been issued; a Resident Parking Pass issued to the original licence plate may be transferred to the new licence plate only if all applicable documentation is provided to the satisfaction of the Municipality showing the legal return and issuance of a new licence plate. 7. The Municipality will offer Non-Resident Parking Passes for person(s) who do not rent, lease or reside on a full-time, year-round basis or own property in the Municipality. Valid photo identification issued by the Province of Ontario, and the vehicle ownership will be required to be presented in order to obtain a Non- Resident Parking Pass. A Non-Resident Parking Pass fee is applicable. A Non- Resident Parking Pass will be associated with a licence plate. 8. The Municipality reserves the right to charge fees for persons requesting Non- Resident Parking Passes, subject to fees within the Municipality's Fees and Charges By-Law. 9. There will be no refund of a Non-Resident Parking Pass fee. 10. Non-Resident Parking Passes are non-transferable except in the circumstances described in Section 16.11. 11. Where the original licence plate has been returned to Service Ontario and a new licence plate has been issued, a Non-Resident Parking Pass issued to the original licence plate may be transferred to the new licence plate only if all applicable documentation is provided to the satisfaction of the Municipality showing the legal return and issuance of a new licence plate. 12. No person(s) shall use a Resident Parking Pass on any other vehicle other than the one it was issued for. Section 17 Exceptions 1. The provisions of this By-law shall not apply to the following vehicles while actively engaged in their duties: a. Fire Department b. Police c. Municipal By-law Enforcement d. Vehicles operated by employees of the Municipality. e. Ambulances f. Emergency g. Vehicles of the public utility commission while performing the duties for which they are intended. h. Vehicles owned by the Municipality. 2. A By-law Enforcement Officer may grant relief from any provision of this By-law relating to construction and/or an unusual or unforeseen circumstance only if all conditions of the relief are obeyed, and no offence is committed. Section 18 Emergency Prohibitions 1. Notwithstanding any other provision of this by-law, a By-law Enforcement Officer and/or the Fire Chief appointed by Council to enforce the provisions of this By-law during an emergency or special circumstance, may declare a period of parking prohibitions and, by use of signs or other clear direction stating Emergency and Authorized Vehicles Only, may suspend the parking of a vehicle on any street or parts thereof. A vehicle lawfully parked prior to such declaration may be deemed to be parked in violation of this Section. No person shall park a vehicle in any area declared and designated as an area controlled by an emergency parking prohibition. pg. 10 Section 19 Provisions 1. A By-law Enforcement Officer who finds a vehicle parked in contravention of this By-law shall serve the owner or driver of the vehicle with a parking infraction notice indicating: a. the permit number and concise description of the vehicle b. the offence alleged. c. the date, time, and place of the alleged offence. d. where the owner or driver of the vehicle may attend or send payment to the location specified on the back of the notice. 2. The By-law Enforcement Officer may serve the parking infraction notice: a. upon the owner of the vehicle, by affixing the notice to the vehicle in a conspicuous place at the time of the alleged infraction, or by delivering it personally to the person having care and control of the vehicle at the time of the alleged infraction, or b. upon the driver of the vehicle by delivering the notice to the driver personally at the time of the alleged infraction. 3. A person receiving a parking infraction shall pay the set fine on the parking infraction notice, and no further action will be taken. 4. If the payment is not received within the timeframe set out on the back of the parking infraction notice, fifteen (15) days, an administrative fee, as set out in the Municipality's Fees & Charges By-law, will be added to the amount of the parking infraction and mailed to the owner of the vehicle. The owner of the vehicle will be given thirty (30) days to make payment to the Municipality. This is called the Impending Conviction stage of the parking infraction. 5. If payment for the impending infraction is not received in the timeframe set out in Section 16.4 of this By-law, the Municipality will add a court administration fee of Sixteen ($16.00) Dollars, which will be in addition to the amount of the parking infraction and the impending infraction administrative fee. The Municipality will then forward the parking infraction to the Ontario Provincial Court of Justice. The owner of the vehicle is then responsible for paying the fee as set out by the Ontario Provincial Court of Justice. Section 20 Cancellation of A Ticket 1. When a violator wishes to dispute a parking infraction notice, they must submit a written request for review, accompanied by the original ticket. The request must include a detailed explanation of the circumstances surrounding the infraction. Upon receipt, the Chief By-law Officer will conduct an initial review to ensure the ticket is complete. If the ticket is found to be incomplete--meaning required information is missing on the face of the ticket--the review may be dismissed on that basis. The By-law Enforcement Officer will assess each request on a case-by-case basis and render a decision accordingly. All submissions must include the violator's signature, email address, phone number and complete mailing information, clearly indicated on the reverse side of the infraction notice. 2. The Chief By-law Enforcement Officer will not cancel a parking infraction notice if the violator took more than ten (10) minutes from the time they arrived in the parking space to purchase a parking permit. pg. 11 Section 21 Parking Lots 1. No person shall park a vehicle in a Municipal parking lot between the hours of 2:00 a.m. and 6:00 a.m. on each and every day of the year. 2. No person shall park any vehicle in such a manner that said vehicle is not wholly within one (1) parking space as indicated by the lines marked on the paved surface of the parking lot. 3. Parking in a Municipal parking lot shall be at your own risk. 4. No trailers, recreational vehicles or similar units shall be parked in any Municipal parking lot unless in compliance with Sections 21(1) and (2) of this By-law. 5. (a) The Tobermory M.T.O. parking lot, described by location in Schedule I attached hereto, shall be exempt from Sections 21(1) of this By-law as it relates to the storage of vehicles, including trailers, recreational vehicles and/or similar units. (b) The maximum length of time for storage in the Tobermory M.T.O. parking lot shall be fourteen (14) calendar days. (c) Every person shall display the permit prominently on the dashboard of the stored vehicle. (d) Every person shall remove the said vehicle within 10 minutes upon expiration of the permit. 5. Legal descriptions for all Municipal parking lots are attached hereto in Schedule I. Section 22 Enforcement and Penalties 1. This By-law will be enforced by the By-law Enforcement Officer appointed by the Municipality of Northern Bruce Peninsula. 1. No person shall interfere with a By-law Enforcement Officer or an authorized person while carrying out his/her duties of enforcing this By-law. 3. In addition to any other penalty that may be imposed under this By-law, where a vehicle is parked in such a manner that it interferes with the movement of traffic or the removal of snow from any road or sidewalk or violating any section of this by- law, a By-law Enforcement Officer or an authorized person, shall enforce the provisions of this By-law and may remove and impound the vehicle at the owner's expense and all costs incurred may become a lien against the vehicle. 4. Should a violation of this By-law continue in excess of two (2) hours and/or three (3) hours, the By-law Enforcement Officer, or an authorized person, may charge the violator with a second offence and subsequently charge further offences every two (2) hours and/or three (3) hours thereafter until the violation ceases. 5. Every person who violates a provision of this By-law is guilty of an offence and on conviction is liable to the penalty provided in Section 61 of the Provincial Offences Act, R.S.O. 1990, c. p.33, as amended. 6. The Bylaw Enforcement Officer, upon finding a vehicle violating any section of the by-law, may, in his/her sole discretion, order the removal of the vehicle violating the by-law when deemed necessary, and any expenses incurred for such removal shall be charged to and collected from the owner of such offending vehicle. In the event that the owner of such an offending vehicle does not pay the said charges, the vehicle may be sold at public auctions to pay the said charges. pg. 12 Section 23 Short Title 1. This By-law shall be known as the Traffic and Parking By-law. Section 24 Repeal 1. This By-law shall supersede and rescind By-law No. 2023-10 and By-law 2024-43 any other by-laws inconsistent with this by-law.
