Article 1
Short Title
730.1.1
Short Title - Scope
This Chapter may be cited as the "Short-Term Rental Accommodation Licensing By-
law" and shall apply to the whole geographic limits of the City. In the text of the Chapter,
it is referred to as "this Chapter".
Article 2
Interpretation
730.2.1
Advertise - defined
"advertise" for the purpose of short-term rental accommodation, includes to offer,
promote, canvass, or solicit a short-term rental accommodation including through a
website or digital application and, "advertising" has a corresponding meaning.
730.2.2
Applicant - defined
"applicant" means a person who is required to be licensed pursuant to this Chapter or
who has made an application for a licence to the Issuer of Licences and shall include a
licensee.
730.2.3
Bedroom - defined
"bedroom" means a room or area used, designed, equipped, or intended for sleeping.
730.2.4
Building - defined
"building" means a building as defined in the Building Code Act, or a structure used or
intended to be used for supporting or sheltering any use or occupancy.
730.2.5
Chief Building Official - defined
"Chief Building Official" means the person who may, from time to time, be appointed by
Council to the position of Chief Building Official in conformity with the provisions of the
Building Code Act, S.O., 1992, Chapter 23 or designate.
730.2.6
Chief Fire Official - defined
"Chief Fire Official" means the person who may, from time to time, be appointed by
Council to the position of Chief of the Fire Department of the City or designate.
730.2.7
City - defined
"City" means the Corporation of the City of Orillia or the land within the geographic limits
of the Corporation of the City of Orillia as the context requires.

Clerk - defined
"Clerk" means the City Clerk of the Corporation of the City of Orillia, or designate.
730.2.9
Council - defined
"Council" means the Council of the Corporation of the City of Orillia.

730.2.10
Guest - defined
"guest" means any person on the premises who is not a renter.
730.2.11
Issuer of Licences - defined
"Issuer of Licences" means the City's Director of Legislative, Building, Parking, and
Transit Services or designate.
730.2.12
Licence - defined
"licence" means a licence issued by the Issuer of Licences under this Chapter.
730.2.13
Licensed - defined
"licensed" means to have in one's possession a valid and current licence issued under
this Chapter, and "unlicensed" has the contrary meaning. Without limiting the generality
of the foregoing, a person is deemed to be unlicensed if a licence is suspended,
revoked, or expired.
730.2.14
Licensee - defined
"licensee" means the owner of a premises who holds a licence, or is required to hold a
licence under this Chapter for that premises.
730.2.15
Municipal Law Enforcement Officer - defined
"Municipal Law Enforcement Officer" means a person appointed under authority of the
Police Services Act for the purpose of enforcing City by-laws.
730.2.16
Officer - defined
"Officer" means a Municipal Law Enforcement Officer, Building Inspector, Police Officer
or any other person appointed by by-law to enforce the provisions of City by-laws.
730.2.17 Outdoor fireplace - defined
"outdoor fireplace" means a manufactured wood-burning appliance, site-built masonry
fireplace, fire pit, chiminea, clay or metal fireplace, portable wood-burning device used
for outdoor recreation or heating, or other enclosed container that are used outdoors
and that are not fueled by natural gas or propane.
730.2.18
Owner - defined
"owner" means the person holding title to the premises where the short-term rental
accommodation is located and, "ownership" has a corresponding meaning.
730.2.19
Person - defined
"person" includes an individual, sole proprietorship, partnership, limited partnership,
trust, corporation, and an individual in their capacity as a trustee, executor,
administrator, or other legal representative.

Premises - defined
"premises" means the property upon which short-term rental accommodation is
operated, inclusive of buildings or structures or any part thereof used for such purpose.

Property - defined
"property" means the land upon which a short-term rental accommodation is operated,
exclusive of buildings or structures or any part thereof.
730.2.22
Renter - defined
"renter" means any person occupying the short-term rental accommodation by way of
concession, permit, lease, licence, rental agreement, or similar arrangement, but shall
not include daily guests to the premises.
730.2.23
Residential - defined
"residential" means a zone category containing an "R" symbol or abbreviation within the
Zoning By-law.
730.2.24
Responsible person - defined
"Responsible Person" means an owner of a short-term rental accommodation, or a
person 18 years of age or older duly appointed by an owner to act on its behalf, and
being responsible for ensuring the short-term rental accommodation is operated in
accordance with the provisions of this Chapter, the licence, and applicable laws.
730.2.25
Short-term rental accommodation - defined
"short-term rental accommodation" means a building or any part thereof being offered,
or used as a place of seasonal or temporary accommodation, temporary residence, or
occupancy by way of concession, permit, lease, licence, rental agreement, or similar
arrangement for fewer than twenty-eight (28) consecutive calendar days, throughout all
or any part of a calendar year. Short-term rental accommodation uses shall not mean or
include a motel, hotel, bed and breakfast establishment, hospital, or boarding lodging or
rooming house as defined in the Zoning By-law, provided the use complies in all
respects with the Zoning By-law, but may include other types of vacation homes or
living accommodation intended to be used by the travelling public.
730.2.26
Tribunal - defined
"Tribunal" means the City's Licensing Appeal Tribunal.
730.2.27
Zoning By-law - defined
"Zoning By-law" means the City's Comprehensive Zoning By-law 2014-44.
Article 3
General Provisions
730.3.1
Application - in writing
Every application for a licence shall be made in writing on a form provided by the Issuer
of Licences and the required fee shall be deposited with the City at the time of
application.
730.3.2
Fee - set out
The licence fee required is set out in Schedule "A". The fee shall not be pro-rated.

730.3.3
Licence - term
A licence that has been issued pursuant to this Chapter shall expire upon the earliest of
the following events:
(a)
December 31st of the year issued;
(b)
Upon the sale or transfer of the premises; or
(c)
The licence has been revoked in accordance with the provisions of this
Chapter.
730.3.4
Licence - issue subject to meeting requirements
Subject to the applicant meeting the requirements of this Chapter, the Issuer of
Licences shall issue the said licence.
730.3.5
Inspections - required
Every licence applied for shall be subject to the following required inspections/review:
(a)
Chief Building Official review; and
(b)
Chief Fire Official review.
Those divisions/departments referenced above may require an inspection of the
premises prior to the provision of comments and prior to the consideration of the
application by the Issuer of Licences. The applicant shall cooperate and facilitate in
arranging the inspection of the premises in a timely manner, and shall be in attendance
during the inspection.
730.3.6
Approval - required
Inspections/reviews shall be received from each division/department as set out in
section 730.3.5 before a licence is issued.
730.3.7
Administration - chapter
The Issuer of Licences shall be responsible for the administration of this Chapter.
730.3.8
Delegation
For the purposes of s. 23.2(4) of the Municipal Act, 2001, it is the opinion of Council that
the powers delegated pursuant to this Chapter are minor in nature.
730.3.9
Licence - subject to conditions
In addition to any other powers conferred on the Issuer of Licences pursuant to this
Chapter, the Issuer of Licences is authorized to impose any condition on a licence to be
issued or renewed under this Chapter as the Issuer of Licences deems necessary to
ensure the safety of public or of property, or for consumer protection.

730.3.10
Conditional licences
Every licensee shall comply with every condition imposed upon the licence.
730.3.11
Applications - file other information upon request
In addition to the specific application submission requirements set out in this Chapter,
every applicant or licensee on request of the Issuer of Licences shall file such
information and material as the Issuer of Licences may deem necessary.
730.3.12
Incomplete application
Where an applicant has failed to provide any fee or document required under this
Chapter to the satisfaction of the Issuer of Licences for the issuance or renewal of a
licence, the application shall be considered incomplete. Incomplete applications may be
returned to the applicant, or held pending further information.
730.3.13
Refusal to issue Licence
The Issuer of Licences shall refuse to grant a licence under this Chapter to any person
if:
(a)
any application or other document provided to the City by or on behalf of
the applicant contains a false statement or provides false information;
(b)
the applicant has failed to comply with the requirements of this Chapter or
other applicable By-laws of the City or of any Local Board thereof, or of
any Statute, Order-in-Council, or Regulation of the Provincial Legislature
or the Parliament of Canada, or of any Agency, Board of Commission
thereof, in, upon or in connection with the applied for licensed activity of
the business or premise, facilities, equipment, vehicles and other property
used or kept for hire in connection with the licensed activity;
(c)
the Issuer of Licences determines that the issuing of the licence would be
contrary to the public interest;
(d)
a licence has previously been revoked by the Issuer of Licences and was
not re-instated by the Tribunal;
(e)
the applicant is indebted to the City in respect of any fine in default that
was imposed under the Provincial Offences Act in connection with the
applied for licensed activity on the premises;
(f)
the applicant is indebted to the City in respect of any administrative
monetary penalty that is past due in connection with the applied for
licensed activity on the premises; or
(g)
the total of all demerit points in effect respecting a short-term rental
accommodation is fifteen or more.

730.3.14
Refusal of licence - refund
Where the Issuer of Licences has refused to grant a licence to an applicant, the licence
application fee less an administrative fee of $150.00 shall be refunded to the applicant.
730.3.15
Suspension or revocation - general
The Issuer of Licences shall suspend or revoke a licence for any one or more of the
grounds listed in section 730.3.13.
730.3.16
Written notice - refusal, suspension or revocation
After a decision is made by the Issuer of Licences to refuse, suspend or revoke a
licence, written notice of that decision shall be given forthwith to the applicant or
licensee.
730.3.17
Written notice - refusal, suspension or revocation - requirements
The written notice to be given under section 730.3.16 shall:
(a)
set out the grounds for the decision;
(b)
give reasonable particulars of the grounds for the decision;
(c)
be signed by the Issuer of Licences; and
(d)
state that the applicant or licensee is entitled to a hearing by the Tribunal if
the applicant or licensee delivers to the Clerk within fifteen (15) calendar
days after the notice is served, a notice in writing that adheres with section
730.3.21, requesting a hearing by the Tribunal accompanied by an appeal
fee of $500. The appeal fee is non-refundable even if the Tribunal grants
the licence, or cancels an administrative monetary penalty as applicable.
730.3.18
Right to appeal
The applicant or licensee may appeal the Issuer of Licences' decision to refuse,
suspend, revoke or to impose any condition on a licence to the Tribunal by filing a
written notice of appeal with the Clerk, within fifteen (15) calendar days following the
receipt of written notice of the Issuer of Licences' decision.
730.3.19
Issuance - demerit points - threshold - right to appeal
Appeals will not be permitted for the issuance of demerit points until they have resulted
in the suspension or revocation of a licence.
730.3.20
Incomplete application - no right to appeal
The issuance of a Notice of Incomplete Application is not a statutory power of decision
and is not subject to appeal to the Tribunal.
730.3.21
Content of notice of appeal
Where an applicant or licensee requests a hearing before the Tribunal, the notice of
appeal shall be in writing to the Clerk and shall include:

(a)
the original signature of the applicant (or licensee), or representative;
(b)
the reasons in support of the appeal;
(c)
the applicant's (or licensee's) address, telephone number, and where
available, e-mail address;
(d)
the name, address, telephone number, and where available, e-mail
address of any agent, representative, or lawyer representing the applicant
or licensee.
730.3.22
Written request - hearing scheduled
On receipt of a written request for a hearing from the applicant or licensee, the
Clerk, through the Tribunal Coordinator shall schedule a hearing of the Tribunal and
give reasonable notice of the date, time, and place of the hearing in accordance
with Chapter 117 of the Municipal Code - Licensing Appeal Tribunal Chapter.
730.3.23
Appeal does not suspend decision
The filing of an appeal does not operate to suspend the Issuer of Licences' decision.
730.3.24
Deadline to appeal final
The decision of the Issuer of Licences shall be final and binding if the Clerk does not
receive an appeal by the 15th day following the receipt date of the written notice of
the Issuer of Licences' decision. A notice of appeal is ineffectual to create a right to a
hearing unless it is received by the Clerk on or before the appeal deadline.
730.3.25
Fulfill outstanding requirements
Where the Tribunal has ordered that a licence be granted, reinstated, a suspension
to a licence ended, or a change to the condition(s) of a licence, the applicant or
licensee shall fulfill any outstanding requirements for the licence under this Chapter.
730.3.26
Licensing Appeal Tribunal Chapter applies
The provisions of Chapter 117 of the Municipal Code - Licensing Appeal Tribunal
Chapter apply to any appeal that is made under this article.
730.3.27
Revocation of licence - refund
Where a licence has been revoked, the licence application fee is non-refundable.
730.3.28
Delivery of notice
Any written notice, or Order, including a penalty notice given under this Chapter
shall be deemed to be received on the receipt date which is one of the following:
(a)
immediately, when a copy is personally delivered to the person to whom it
is addressed;
(b)
on the seventh (7th) calendar day following the date a copy is sent by

registered mail or by regular mail to the person's last known address;
(c)
immediately upon sending a copy by facsimile transmission to the
person's last known facsimile number;
(d)
immediately upon sending a copy by electronic mail (i.e. e-mail) to the
person's last known electronic mail address; or
(e)
where more than one method of delivery is used, the latest of the
possible receipt dates.
730.3.29
Notice - last known business or residential address
For the purposes of administration of this Chapter, a person's last known address,
facsimile number, and electronic mail address includes an address (business or
residential), facsimile number, and electronic mail address provided by the person to the
City as may be required on a form.
730.3.30
Licence - no vested or property right
No person shall enjoy a vested or property right in any licence or the continuance of any
licence and such licence and such rights shall remain the property of the City.
730.3.31
Transfer - Licence
No licence issued under the provisions of this Chapter shall be transferable unless such
transfer is specifically provided for in this Chapter.
730.3.32
Licence - alter
No person shall alter, erase or modify a licence or permit the alteration, erasure or
modification of a licence.
730.3.33
Fees - convenience - credit card payments
A 2.4% convenience fee shall be charged for the use of credit cards for online payments
processed by the City's Merchant Services Payment Processor.
Article 4
Short-Term Rental Accommodations
730.4.1
Operation - without licence - prohibited
No person shall operate or permit the operation of a short-term rental accommodation
within the City unless licensed to do so in accordance with the provisions of this
Chapter.
730.4.2
Advertise - prohibitions
No person shall advertise, or cause or permit the advertising of:
(a)
a short-term rental accommodation that is not licensed in accordance with
the provisions of this Chapter;

(b)
the use of more than one building with bedrooms on the premises; or
(c)
a greater number of persons on the premises than is permitted by this
Chapter;
(d)
a greater number of bedrooms on the premises than is permitted by the
licence.
A court or tribunal may, in the absence of evidence to the contrary, accept that an
advertisement, listing, or the like of a short-term rental accommodation is proof that the
premises are being offered or used as a short-term rental accommodation. For greater
certainty, a witness need not possess special or expert knowledge for a court or tribunal
to draw such an inference.
730.4.3
Remove - advertisement
No person shall fail to remove an advertisement, listing, or the like for a short-term
rental accommodation that is prohibited under section 730.4.2 within seventy-two (72)
hours of becoming aware of the prohibition or receiving notice to do so by an Officer.
730.4.4
Application - licence - posted on City's website
Applications for a licence and issued licences will be posted on the City's website,
including information such as the legal description, civic address, and owners' and
Responsible Person's contact information (telephone number and e-mail address).
730.4.5
Licences issued - limit - City wide
The maximum number of short-term rental accommodation licences that may be issued
by the Issuer of Licences shall not exceed 150 for each calendar year. Complete
applications for short-term rental accommodation filed between November 1 and
November 30 shall be eligible for a lottery system to select the 150 applicants to be
granted a licence for the following year. Any application filed before November 1 for the
following year shall not be eligible for the lottery system. If an applicant is not granted a
licence as part of the lottery system, the licence application fee shall be refunded to the
applicant.
If less than 150 complete applications are received between November 1 and
November 30, then any surplus available licences shall be assigned by the Issuer of
Licences on a first-come, first-served basis to applicants that submit a complete
application after November 30.
730.4.6
One licence - per premises
The Issuer of Licences shall not issue a licence to operate a short-term rental
accommodation for more than one building with bedrooms per premises.
730.4.7 Separate licence - required - each location
A separate licence shall be obtained for each short-term rental accommodation.

730.4.8
Licence issuance - owner of premise only
Every applicant for a licence shall be the owner of the premises.
730.4.9
Applicant - Licensee - notify - information change
An applicant or licensee shall be responsible for informing the Issuer of Licences, in
writing, of any changes to the information contained within the application for the short-
term rental accommodation licence within seven (7) calendar days of such change or
deviation, including but not limited to a cancellation, expiration, or variation in the
amount or conditions of the insurance policy requirements set out in Article 4. Nothing
herein allows a licensee to rent bedrooms other than those identified and approved on
the floor plans submitted with the application unless the Issuer of Licences has
approved same by re-issuing a new licence. A licence may be re-issued for a change to
the number or location of bedrooms upon submission of:
(a)
a completed licence amendment application form;
(b)
any other required inspections, approvals, or documents as required by this
Chapter; and
(c)
payment of an administrative fee as set out in Schedule "A".
730.4.10
Application - required documentation
Every application for a new licence, or the renewal of an existing licence, shall include:
(a)
a completed application using the form or forms required by the Issuer of
Licences, that is signed by the applicant, or where the application is from a
partnership, signed by each and every partner, or where the application is
from a corporation, signed by the president or other authorized signing
officer of the corporation;
(b)
if the applicant is a corporation, proof that the corporation is legally entitled
to conduct business in Ontario, including but not limited to the Articles of
Incorporation or other incorporating documents, duly certified by the
proper government official or department of the Province of Ontario or of
the Government of Canada;
(c)
if the applicant is a partnership, the names and addresses of each
member of the partnership, as well as the name under which the
partnership intends to carry on business and proof of the business name
registration;
(d)
payment of the applicable licensing fee as set out in Schedule "A";
(e)
a signed Licensee Code of Conduct and Acknowledgment as set out in
Schedule "B" by each and every owner;

proof of the insurance required under this Article;
(g)
a floor plan, fully dimensioned of the premises clearly identifying:
(i)
the location, dimensions, and use of each room;
(ii)
each bedroom intended to be used as part of a short-term rental
accommodation;
(iii)
the location of fixtures (i.e. toilet, bathtub, shower, or sink);
(iv)
all entrances/exits;
(v)
the location of all fuel-fired appliances (i.e. gas fireplace, stove,
furnace, or hot water tank) or solid fuel-fired appliances (i.e. wood
burning fireplace, woodstove or wood furnace);
(vi)
the location of smoke alarms;
(vii)
the location of fire extinguishers;
(viii)
the location of carbon monoxide alarms if the short-term rental
accommodation has a fuel-fired or solid fuel-fired appliance, or an
attached garage;
(h)
a site diagram, fully dimensioned of the premises clearly identifying:
(i)
the property lines;
(ii)
the location of all buildings and structures on the property;
(iii)
the exterior decks and related site amenities, and other buildings or
structures on the property;
(iv)
the location of the parking area on the premises with a minimum
number of parking spaces as set out in the Zoning By-law;
(v)
the surface type of the parking area;
(vi)
the location of the outdoor fireplace including noting distance from
property lines and structures, if applicable;
(vii)
the location of the wood burning appliance, if applicable;
(viii) well location, if applicable;
(ix)
septic tank and bed location, if applicable;
(i)
if the City has no record on file with respect to the installation of a septic
system at the premises, a site report prepared by a qualified septic
designer, septic installer, or related professional which includes identifying
the capacity of the septic tank, and location of the septic tank and bed, if
applicable;
(j)
proof of a septic system pump-out and any required repairs to the system
identified during the pump-out, dated less than five years old, if applicable;
(k)
where there are wood burning appliances, a Wood Energy Technical
Transfer (WETT) report dated less than 5 years old issued by a certified
WETT Inspector and indicating that the appliances are safe to be utilized;

(l)
the name and contact information of the Responsible Person who can be
available at all times to attend to the short-term rental accommodation
within a period of no greater than one hour from the time of contact by
telephone or e-mail by an Officer; and
(m)
a Municipal Accommodation Tax Remittance Compliance Report issued
by City's Tax Collection Agent, if applicable.
730.4.11
Insurance requirements
Every licensee shall obtain and maintain at all times while licensed under this Chapter
the following minimum insurance policy requirements:
(a)
liability limit of no less than two million dollars ($2,000,000) per occurrence for
property damage and bodily injury; and
(b)
such policy shall identify that a short-term rental accommodation is being
operated on the premises.
730.4.12
Licence - information required
Every licence shall include the following information:
(a)
premises address/number identifier;
(b)
the part of the premises approved on the floor plans submitted with the
application for the short-term rental accommodation licence;
(c)
licence number;
(d)
effective date and expiry of licence;
(e)
owner's name and contact information (telephone number and e-mail
address);
(f)
Responsible Person's name and contact information (telephone number
and e-mail address); and
(g)
occupancy limit.
730.4.13
Renter's Code of Conduct - produce - upon request
Every licensee shall ensure that the Renter's Code of Conduct set out in Schedule "C"
is completed before any renter uses the short-term rental accommodation. No licensee
shall fail to produce a copy of the completed Renter's Code of Conduct within 24 hours
upon request of an Officer.
730.4.14
Data Collection - Retention - Records
Every licensee shall retain the records required under Article 4 for at least two (2) years.

730.4.15
Licence - posted
Every licensee shall ensure that the licence is plaqued or framed, displayed in a
prominent place in the licensed premises to which it applies, and clearly visible at all
times. The fee for a replacement licence placard shall be $50.00.
730.4.16
Responsible Person - available
Every licensee shall ensure that there is a Responsible Person available at all times to
attend to the licensed premises within a period of no greater than one (1) hour from the
time of contact by telephone or e-mail by an Officer.
730.4.17
Limit - number of persons - per bedroom
No person shall permit at any one time between the hours of 10:00 p.m. and 7:00 a.m.
of the following day more than two (2) persons on the premises for each bedroom
identified and approved as such on the floor plans submitted with the application for the
short-term rental accommodation licence.
730.4.18
Limit - number of persons - max
Notwithstanding section 730.4.17, no person shall permit at any one time between the
hours of 10:00 p.m. and 7:00 a.m. of the following day more than a maximum total of
ten (10) persons on the premises regardless of the number of bedrooms.
730.4.19
Limit - number of persons - septic system
Notwithstanding sections 730.4.17 and 730.4.18, the maximum number of persons
permitted on any premises that is serviced by a septic system shall be determined at
the time of application following a review of the septic system's capacity, but for greater
certainty such number of persons shall not exceed the maximum number of persons set
out in sections 730.4.17 and 730.4.18 regardless of the system's capacity.
730.4.20
Limit - number of bedrooms - use
No person shall permit a bedroom to be used that is not identified as being intended for
use as part of a short-term rental accommodation on the floor plans submitted and
approved with the application for the short-term rental accommodation licence.
730.4.21
Fire extinguisher - requirements - type - location
Every licensee shall ensure that a Class A ULC listed portable fire extinguisher with a
minimum rating of 2A 10B:C is located in any indoor cooking area of the short-term
rental accommodation, and located so that they are clearly visible and accessible at all
times.
730.4.22
Fire extinguisher - requirements - general
Every licensee shall ensure that portable fire extinguishers are kept operable and fully
charged.
730.4.23
Exemption - when not rented for short-term rental accommodation
The provisions of sections 730.4.15 to 730.4.22 inclusive shall not apply when the
premises is not rented for short-term rental accommodation.

Article 5
Demerit Point System
730.5.1
Demerit point system - short-term rental accommodation
A Demerit Point System has been established in accordance with Schedule "D", without
prejudice to options otherwise available to enforce this Chapter or any other chapter or
by-law of the City, provincial act or regulation, including, but not limited to,
administrative monetary penalties as set out in this Chapter, and actions pursuant to the
Building Code Act, and Fire Protection and Prevention Act. The number of demerit
points referenced in Column 4 of Schedule "D" will be assessed against a short-term
rental accommodation premises and licensee in respect of the infraction noted in
Column I upon the following event:
(i)
the expiry of the period for appealing a fine imposed pursuant to Part I or
Part Ill of the Provincial Offences Act;
(ii)
the expiry of the period for appealing against a conviction in the Ontario
Court of Justice;
(iii)
the affirmation of an administrative monetary penalty;
(iv)
an Order not complied with;
(v)
an Order not complied with resulting in City remediation; or
(vi)
an observation by an Officer, Chief Fire Official, or Chief Building Official.
730.5.2
Licence - suspension - seven demerit points or more
A licence may be suspended by the Issuer of Licences for a period of six months if the
total demerit points in effect respecting a short-term rental accommodation is seven (7)
or more.
730.5.3
Notice of suspension - revocation - demerit points
Notice of the suspension or revocation of a licence shall be provided to the licensee in
accordance with this Chapter and a licensee may appeal the suspension or revocation
in accordance with section 730.3.18 of this Chapter.
730.5.4
Demerit points - two years - expire
Demerit points shall remain in place until the two-year anniversary of the date of which
the demerit points were assessed.
Article 6
Orders
730.6.1
Order - discontinue activity - correct contravention
If an Officer is satisfied that a contravention of this Chapter has occurred, the Officer

may make an Order requiring the person who contravened the Chapter, or who caused
or permitted the contravention, or the owner or occupier of the licensed premises on
which the contravention occurred to:
(a)
discontinue the contravening activity, or
(b)
do work to correct the contravention.
730.6.2
Order - details
The Order under section 730.6.1 shall set out:
(a)
reasonable particulars of the contravention adequate to identify the
contravention and the location of the land on which the contravention
occurred; and
(b)
the date by which there shall be compliance with the Order.
730.6.3
Service - Order
An Order may be served personally upon the person to whom it is directed to or sent by
regular mail to the address shown on the last revised assessment roll, or to the last
known address.
730.6.4
Contravention before by-law came into force
An Order under section 730.6.1 may require work to be done even though the facts
which constitute the contravention of this Chapter were present before the by-
law/chapter making them a contravention came into force.
730.6.5
Fail to comply with Order
No person shall fail to comply with an Order issued pursuant to section 730.6.1.
Article 7
Administrative Monetary Penalties

730.7.1
Penalty notice - issuance - amount
An Officer who determines that a person has contravened any provision of this Chapter
may issue a penalty notice addressed to that person. Any person who contravenes any
provision of this Chapter shall, upon issuance of a penalty notice, be liable to pay to the
City an administrative monetary penalty as follows:
(a)
1st contravention: $500
(b)
2nd contravention: $1,000
(c)
3rd or subsequent contravention: $1,500

730.7.2
Penalty notice - issuance - amount - exception
Notwithstanding section 730.7.1, any person who advertises (or causes or permits the
advertising of) or operates (or permits the operation of) a short-term rental
accommodation without being licensed shall, upon issuance of a penalty notice, be
liable to pay to the City an administrative monetary penalty in the amount of $3,000, for
each offence.
730.7.3 New - separate offence
Where the offence is continuous, each day the offence continues shall constitute a new
and separate offence.
730.7.4
Penalty notice - information required
The penalty notice shall be given to the person to whom or to which it is addressed as
soon as is reasonably practicable and shall include the following information:
(a)
particulars of the contravention, including to which property it applies;
(b)
the amount of the administrative monetary penalty;
(c)
the penalty due date which is thirty (30) days following the penalty notice
date;
(d)
information respecting the process by which the person may exercise the
person's right to request a review of the administrative monetary penalty
including noting the prescribed review fee; and
(e)
a statement advising that an administrative monetary penalty will, unless
cancelled pursuant to the review process, constitute a debt to the City.
730.7.5
Payment - not to Officer
No Officer may accept payment in respect of an administrative monetary penalty.
730.7.6
Tribunal - review - administrative monetary penalty
A person who has been imposed an administrative monetary penalty may, within fifteen
(15) calendar days of the penalty notice being given, apply to the Tribunal for a review
of the decision. If an application for review has not been applied for within fifteen (15)
calendar days including payment of the review fee of $250, the administrative monetary
penalty levied is deemed to be affirmed.
730.7.7
Fail to attend hearing
Where a person fails to attend a hearing in front of the Tribunal, the administrative
monetary penalty levied is deemed to be affirmed.
730.7.8
Refund - administrative monetary penalty
Where a person has paid an administrative monetary penalty that is then cancelled by
the Tribunal or reduced, the City shall refund the amount cancelled or reduced.

730.7.9
Laying a charge when administrative monetary penalty issued
If a person is required to pay an administrative monetary penalty in respect of a
contravention, the person shall not be charged with an offence pursuant to the
Provincial Offences Act in respect of the same contravention.
730.7.10
Administrative monetary penalty - debt to City
An administrative monetary penalty that is deemed to be affirmed, or reduced or in
respect of which the time for payment has been extended by the Tribunal, constitutes a
debt to the City of each person to whom or to which the penalty notice was given.
730.7.11
Administrative monetary penalty - add to tax roll
An administrative monetary penalty that is not paid may be added to the tax roll to the
licensed premises to which it applies and collected in the same manner as taxes.
Article 8
Enforcement
730.8.1
Authority - Enforcement
The provisions of this Chapter may be enforced by an Officer.
730.8.2 Entry and inspection
An Officer may, at any reasonable time, enter on any land, and into any building or
structure thereon, for the purpose of carrying out an inspection to determine whether or
not the following are being complied with:
(a)
the provisions of Chapter 730;
(b)
a direction or order of the City made under the Municipal Act, 2001 or
made pursuant to Chapter 730;
(c)
a condition of a licence issued under the provisions of Chapter 730;
(d)
an order made under section 431 of the Municipal Act, 2001.
For the purpose of such inspection, the Officer may:
(i)
require the production for inspection of documents or things relevant to the
inspection;
(ii)
inspect and remove documents or things relevant to the inspection for the
purpose of making copies or extracts;
(iii)
require information from any person concerning a matter related to the
inspection; and

(iv)
alone, or in conjunction with a person possessing special or expert
knowledge, make examinations or take tests, samples or photographs
necessary for the purposes of the inspection.
For the purpose of exercising the power of entry, the person exercising the power shall
comply with the provisions of the Municipal Act, 2001 including any requirements of
sections 435 (Conditions Governing Powers of Entry) and 437 (Restriction Re:
Dwellings) of the said Act.
730.8.3 Fine - contravention - general
In addition to any other applicable penalty, every person who contravenes any of the
provisions of this Chapter, contravenes the terms and conditions of a licence or an
Order issued pursuant to this Chapter, and every director or officer of a corporation who
knowingly concurs in such contravention by a corporation, upon conviction, is guilty of
an offence and shall be liable to a fine not exceeding $50,000. Notwithstanding the
foregoing, where a corporation is convicted of contravening any of the provisions of this
Chapter, the corporation shall be liable to a fine not exceeding $100,000.
730.8.4
Fine - contravention - part 1 offence
Despite section 730.8.3, every person who is issued a Part 1 offence notice or
summons and is convicted of an offence under this Chapter is liable to a maximum fine
as provided for in the Provincial Offences Act.
730.8.5
Order - prohibiting continuation - offence
Upon conviction, in addition to any other remedy and to any penalty imposed by this
Chapter, the court in which the conviction has been entered and any court of competent
jurisdiction thereafter may make an order prohibiting the continuation or repetition of the
offence by the person convicted.
730.8.6 Hinder or obstruct
No person shall hinder or obstruct, or attempt to hinder or obstruct, any Officer
exercising a power or performing a duty under this Chapter, or any person lawfully
acting in aid of such an Officer. Without limiting the generality of the meaning of "hinder"
or "obstruct", a person shall be deemed to have obstructed or hindered an Officer in the
execution of their duties if the person:
(a)
provides false information to such Officer; or
(b)
is alleged on reasonable and probable grounds to have contravened any
of the provisions of this Chapter, and fails to identify themselves to such
Officer upon request.
730.8.7 Notice - unpaid licensing fine
If any part of a fine for a contravention of this Chapter remains unpaid after the fine
becomes due and payable under section 66 of the Provincial Offences Act, including
any extension of time for payment ordered under that section, the City Treasurer or

agent of the City Treasurer may give the person against who the fine was imposed
written notice specifying the amount of the fine payable and the final date on which it is
payable, which shall be not less than twenty-one (21) calendar days after the date of the
notice, by delivering the notice or causing it to be delivered to that person at the
person's residence or place of business.
730.8.8 Distress - unpaid licensing fines
If the fine referred to in section 730.8.7 remains unpaid after the final date on which it is
payable as specified in the notice, the fine shall be deemed to be unpaid taxes for the
purpose of section 351 of the Municipal Act, 2001.
730.8.9 Rebuttable presumption - identification
In a prosecution for a contravention of this Chapter, evidence of identification shall be
presumed to be correct and accurate, unless rebutted by evidence to the contrary.
Article 9
Interpretation and Validity
730.9.1
Words - plural - singular
In this Chapter, words used in the present tense include the future, words in the
masculine gender include the feminine and neuter; the singular number includes the
plural, and the plural includes the singular, as applicable, unless used with a number
modifying them.
730.9.2
Headings - convenience only
Headings are inserted for convenience of reference purposes only, form no part of this
Chapter and shall not affect in any way the meaning or interpretation of the provisions of
this Chapter.
730.9.3
Amended references
Any references to a statute, regulation, by-law or other legislation or statutory
instrument in this Chapter shall include such statute, regulation, by-law or other
legislation or provision thereof as amended, revised, re-enacted and/or consolidated
from time to time and any successor legislation thereto.
730.9.4
Schedules
All schedules to this Chapter shall form part of this Chapter.
730.9.5
Conflict - most restrictive prevails
Where there is a conflict or a contradiction between this Chapter and any other by-law
or Chapter of the City, the provision that is most restrictive shall prevail.
730.9.6
Compliance - other applicable law
Nothing in this Chapter relieves any person from complying with any provision of any
Federal or Provincial legislation, or any other by-law of the City.

730.9.7
Validity and severability
If any provision of this Chapter is declared by a Court of competent jurisdiction to be
invalid, illegal or ultra vires for any reason, all other provisions of this Chapter shall
remain and continue in full force and effect and shall remain valid and binding.

Enactment

Effective date
That the provisions of this Chapter come into effect on January 1, 2024.

1.
Operation in compliance with all applicable legislation
The premises identified above shall be operated in accordance with the City's Short-
Term Rental Accommodation Licensing By-law, and all applicable acts, regulations and
other municipal by-laws including, but not limited to the following: Noise By-law (Chapter
938), Open Air Burning By-law (Chapter 387), and Property Standards By-law (Chapter
866).
2.
Licensee held responsible for renters and/or guests
The licensee will be held responsible for contraventions of any municipal by-law, act or
regulation by people using the premises, and may be subject to demerit points, fines or
other enforcement measures.
3.
Licence Posted
The licensee shall ensure that the licence is plaqued or framed, displayed in a
prominent place in the premises, and clearly visible at all times. The licensee shall not
rent part of a premises other than those identified on the licence.
4.
Notification Required of Changes to Information in Application
The licensee is responsible for informing the Issuer of Licences in writing of any
changes to the information contained in the application for the Short-Term Rental
Accommodation Licence within seven (7) calendar days of such change or deviation.
5.
Smoke Alarms Required
The licensee shall ensure that the licensed premises is equipped with operational and
within the ten-year life span smoke alarms that are installed in accordance with the
manufacturer's standards and the Ontario Fire Code. Further, the licensee shall test the
alarms at least monthly to ensure they are operational.
6.
Portable Fire Extinguishers Required
The licensee shall ensure that a Class A ULC listed portable fire extinguisher with a
minimum rating of 2A 10B:C is located in any indoor cooking area of the Short-Term
Rental Accommodation, and clearly visible and accessible at all times. A licensee shall
ensure that portable fire extinguishers are:
(a) kept operable and fully charged; and
(b) inspected at least monthly.
7.
Carbon Monoxide Alarm Requirements
In Short-Term Rental Accommodations which have a fuel-fired appliance (i.e. gas
fireplace, stove, furnace, or hot water tank) or solid fuel-fired appliance (i.e. wood

burning fireplace, woodstove or wood furnace), or an attached garage, the licensee
shall ensure that the building is equipped with operational and within the ten-year life
span carbon monoxide alarms installed outside of the sleeping areas in accordance with
the manufacturer's standards and the Ontario Fire Code. Further, the licensee shall test
the alarms at least monthly to ensure they are operational.
8.
Application for renewal of a licence
The maximum number of short-term rental accommodation licences that may be issued
by the Issuer of Licences shall not exceed 150 for each calendar year, and completed
applications for short-term rental accommodation filed between November 1 and
November 30 shall be eligible for a lottery system to select the 150 applicants to be
granted a licence for the following year.
I, having read the above, and the Short-Term Rental Accommodation Licensing By-law,
undertake to provide renters with a copy of the Renter's Code of Conduct and ensure
the document is signed. I also realize non-compliance with applicable regulations may
result in the suspension or revocation of the Short-Term Rental Accommodation

Objective
The objective of this Code is to summarize the City of Orillia's regulations applicable to
renters of Short-Term Rental Accommodations in order to inform renters and to
minimize adverse impacts to residents in the neighbourhood while protecting the health,
safety and well-being of people.
2.
Maximum Number of Renters/Guests
The maximum number of persons at a licensed premises between the hours of 10:00
p.m. and 7:00 a.m. of the following day shall not exceed:
(a)
more than two (2) persons on the premises for each bedroom identified and
approved as such on the floor plans submitted with the application for the short-
term rental accommodation licence; and
(b)
more than a maximum total of ten (10) persons on the premises regardless of the
number of bedrooms.
3.
Noise
The City's Noise By-law (Chapter 938) prohibits a person from making, causing, or
permitting noise that disturbs others such as by way of:
(a) loud music;
(b) yelling, shouting, or singing;
(c) a barking dog.
4.
Parking
Please familiarize yourself and your guests with the on-site parking available on the
licensed premises, and be mindful of the City's Traffic/Parking By-law No. 2007-55
which prohibits parking in various areas including the following:

(a) on a front yard or side yard (i.e. lawn);
(b) on the street within one (1) metre of a driveway;
(c) on the street within nine (9) metres of a non-signalized intersection;
(d) on or overhanging a sidewalk; and
(e) on the street between midnight and 7:00 a.m. (November 15 to April 15).
An illegally parked vehicle can be ticketed/towed at the vehicle owner's expense.
5.
Fires
The City's Open-air Burning By-law (Chapter 387) outlines where, when, how and if you
can have a recreational fire on the property. Requirements include ensuring the fire is
attended to all times, and not burning:
(a) within five (5) metres of a structure, other combustibles, or a property line;
(b) when the wind velocity is more than 24 km/hr;
(c) waste material including leaves;
(d) if it creates excessive smoke that is likely to cause discomfort or harm to others;
(e) during a smog alert
(f) unless the fire is not greater than 1 metre in any direction;
(g) unless a portable fire extinguisher or operable garden hose is available.
6.
Dogs
The City's Dog Licensing By-law (Chapter 284) prohibits a dog being off leash on a
neighbouring property.
7.
Garbage and Recycling
Please familiarize yourself and your guests with the City's Solid Waste Management By-
law (Chapter 877), and the day of the week in which waste collection is scheduled.
Garbage, readily compostable organics, and recycling box material shall be placed out
for collection not later than 7:00 a.m. on the day of collection and not earlier than 11:00
a.m. on the previous day. However, within the Business Improvement Area, material
shall be placed out for collection not later than 5:00 a.m. on the day of collection and not
earlier than 4:00 p.m. on the previous day.
8.
Licensed Premises with Private Sewage Disposal Systems
Exceeding the maximum occupancy may result in the malfunctioning of the septic
system and pollution of the ground water system.
9.
Fire and Safety Precautions
All Short-Term Rental Accommodations shall have operating smoke alarms in
accordance with the provisions of the Ontario Fire Code. If a renter discovers that any of
the alarms are not operational, the renter shall immediately notify the Responsible
Person of the deficiency. No person shall disable a smoke and/or carbon monoxide
alarm.

Fireworks
The City's Fireworks By-law (Chapter 920) prohibits all types of fireworks being set off in
the City, 365 days per year.

to conduct myself and those that are occupying this premises at the same time in
accordance with this Code and all applicable acts, regulations, and by-laws. I
understand that my action, if found in contravention of applicable laws/regulations, may
subject the licensee to Demerit Points against their licence and may include
enforcement measures against myself, guests or the licensee(s) including fines.
I am aware that applications for a licence and issued licences will be posted on the
City's website, including information such as the legal description, civic address, and
owners' and Responsible Person's contact information (telephone number and e-mail
address).
