BY-LAW NO. 1976 - 027 A BY-LAW TO CONTROL THE OPERATION OF MOTORIZED SNOW VEHICLES WITHIN THE CITY OF OWEN SOUND THE CORPORATION OF THE CITY OF OWEN SOUND WHEREAS City Council deems it desirable to enact legislation to control the operation of Motorized Snow Vehicles within the City; and WHEREAS Section 6 (2) of The Motorized Snow Vehicles Act, Statutes of Ontario, 1974, empowers a Municipal Council to enact such legislation, NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF OWEN SOUND ENACTS AS FOLLOWS; 1. In this by-law, (a) "motorized snow vehicle" means a self-propelled vehicle designed to be driven primarily on snow, but does not include motorized snow vehicles of the City of Owen Sound used for snow cleaning operations; (b) "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways the term "roadway" refers to anyone roadway separately and not to all of the roadways collectively. By-law 1978-013 2. No person shall operate a motorized snow vehicle, (a) within the City of Owen Sound between the hours of twelve o'clock midnight and seven o'clock a.m., daily; (b) within a one-half mile radius of any church or synagogue within the City of Owen Sound during a worship service; (c) on any sidewalk; (d) on the highways or parts of highways set out in Column 1 and between the limits set out in Column 2 of schedule 1 of this by-law; (e) within the area bounded on the east by 3rd Avenue East, on the west by 2nd Avenue West, on the north by 12th Streets east and west and on the south by 7th Streets east and west. By-law 1997-177 (f) east of 3rd Avenue West on that part of the former Canadian National Railway corridor, extending south of a line drawn across the same, measured 50 metres south thereon from the southerly limit of 24th Street West, to the north bank of the Pottawatomi River. 3. No person shall park, stand or stop a motorized snow vehicle on a roadway. By-law 1998-009 4. Any person who contravenes any of the provisions of this By-law is guilty of an offence and upon conviction therefor is subject to the penalty set out in the Provincial Offences Act. 5. By-law Nos. 3561 and 1972-3 are hereby repealed. Page 3 By-law 1976-027 6. This By-law shall come into full force and effect when the same has been finally passed, has received the approval of the Ministry of Transportation and Communications for the Province of Ontario and when appropriate signs have been erected.
