BY-LAW NO. 1977 - 049 A By-law to Fix Days When Persons and Organizations May Solicit Contributions of Money From Persons on the Highways of the City of Owen Sound THE CORPORATION OF THE CITY OF OWEN SOUND WHEREAS it is desirable to fix days when persons and organizations in charitable or patriotic work may solicit contributions of money from persons on the highways of the Municipality NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF OWEN SOUND ENACTS AS FOLLOWS: 1. No person or organization in charitable or patriotic work shall solicit contributions of money from persons on the highways of the City of Owen Sound except upon the days fixed pursuant to the provisions of this By-law. 2. No days other than Friday and Saturday shall be fixed for such solicitations except that during the month of December special permission may be granted by City Council to fix a longer period of time for such solicitations. 3. Such person or organizations as may desire to solicit such contributions shall apply to the Corporation of the City of Owen Sound, in writing, for a day or days to be fixed for such solicitation. No application shall be made for a day to be fixed; except a day within the then current calendar year. Only one such person or organization shall be permitted to make such solicitations per week. 4. The application shall show the purpose for which the monies are proposed to be solicited, the name and address of the principal promoter or promoters who shall sign such application and who shall undertake that not less than 90% of the monies collected shall be used for the purposes set out in the application and that such promoter or promoters shall file with the Corporation within 10 days of such solicitation a financial statement showing the amount collected and the amount to be accounted for as used for such charitable or patriotic work. 5. The Corporation of the City of Owen Sound may consider such applications, may consider whether such applicant is a person or organization in charitable or patriotic work, and if the applicant is so qualified and a date be available, fix a day or days for such applicant to carry out such solicitation. 6. This By-law shall be administered by the City Clerk's Department of the City of Owen Sound. 7. Any person convicted of a breach of any of the provisions of this By- law shall forfeit and pay a penalty or sum not exceeding One Thousand Dollars ($1,000.00), exclusive of costs, for each offence, and every such penalty shall be recoverable under the provisions of The Summary Convictions Act, all of the provisions of which apply. 8.
