Corporation of the City of Owen Sound
A By-law to Prohibit the Keeping of Ice Boxes, Refrigerators or
Similar Appliances Under Conditions Hazardous to Children
WHEREAS ice boxes, refrigerators or similar appliances constitute a menace to the
health" safety and welfare of children when left in a dangerous condition in places
accessible to children;
AND WHEREAS small children in other municipalities have met death due to
suffocation while playing in ice boxes or refrigerators;
AND WHEREAS This council is authorized pursuant to the provisions of section 260
of the Municipal Act to pass bylaws for the health" safety" morality and welfare of
the inhabitants of the municipality in matters not specifically provided for by the
said act as may be deemed expedient and are not contrary to law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF OWEN
SOUND HEREBY ENACTS AS FOLLOWS:

No person shall have, keep, or permit upon any lands or in or upon any
premises owned or occupied by him or under his control in a place accessible
to children any ice box, refrigerator or similar appliance not then being used
for the purpose for which it was manufactured or produced or which has been
abandoned or discarded having an air-tight door or doors which, when
closed, cannot be easily opened from the inside without first removing such
door or doors or taking such other adequate precautionary measures as may
be required so as to prevent any person from being trapped inside such ice
box, refrigerator or similar appliance or in any part thereof.

Any person who contravenes and of the provisions of this By-law is guilty of
an offence and is liable to a fine of not more than $2,000.00 exclusive of
costs and the said fine shall be recoverable pursuant to the provisions of the
Provincial Offences Act.
This By-law shall come into full force and effect upon the final passing
thereof.
