BY-LAW
TO
REGULATE
THE
MOVING
OF
BUILDINGS AND TO AUTHORIZE THE ISSUANCE OF
PERMITS THEREFOR
THE CORPORATION OF THE CITY OF OWEN SOUND
WHEREAS The Municipal Act R.S.O. 1970 c. 284 s. 460 (1) provides that
a municipal council may pass by-laws for prohibiting or regulating the obstructing,
encumbering, injuring or fouling of highways or bridges.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
OWEN SOUND ENACTS AS FOLLOWS:
1.
In this By-law:
(a)
"Chief Official" means the Chief Building Official appointed by the
Council of the Corporation of the City of Owen Sound.
2.
No person shall move or cause to be moved any building into, within or
through the City of Owen Sound without first having obtained a permit therefor.
3.
No person shall occupy any building that has been moved into or within
the City of Owen Sound that does not conform to The Ontario Building Code Act and
the Regulations made thereunder.
4.
The Chief Official of the Corporation of the City of Owen Sound is hereby
appointed and authorized to issue on behalf of the City of Owen Sound, permits as
prescribed by this By-law".
5.
All applications for the moving of buildings shall be in writing on the
prescribed application form provided by the Corporation.
6.
The applicant shall obtain the approvals as specified on the Permit
before final approval is obtained from the authority having jurisdiction. No permit
shall be issued under the authority of this By-law until all approvals are obtained,
including the approved route.
7.
The applicant shall furnish security sufficient to cover the cost of
repairing any damage or injury to City streets or property satisfactory to the agencies
concerned and the City of Owen Sound.
8.
Before any permit is issued under the authority of this By-law, the Chief
Official shall collect a permit fee of $10.00.
9.
Any person who contravenes any of the provisions of this By-law shall
upon conviction therefor be subject to a penalty of not more than $1,000.00 exclusive
of costs, and any such penalty shall be recoverable under The Summary Convictions
Act all of the provisions of which apply.
