Whereas pursuant to Section 10(2) of the Municipal Act 2001, S.O. c.25, the Town of Parry sound may pass by-laws respecting animals, and the health, safety and well-being of persons; and Whereas pursuantto Section 128 ofthe Municipal Act, 2001, S.O. c.25 the Town of Parry Sound is authorized to pass a by-law to prohibit and regulate public nuisances; and Whereas pursuantto section 129 ofthe Municipal Act, 2001, S.O. c.25, the Town of Parry Sound is authorized to pass a by-law to prohibit and regulate noise, vibration, odour, dust and outdoor illumination; and Whereas pursuant to section 425 ofthe Municipal Act, 2001, Council is authorized to pass by-laws providing that a person who contravenes a by-law ofthe Town of Parry Sound passed under that Act is guilty of an offence; and Whereas, it is desirable to regulate the keeping of backyard hens in the Town of Parry Sound. Now therefore the Council ofthe Corporation ofthe Town of Parry Sound enacts as follows: 1. DEFINITIONS a) "At large" means a hen found at any place other than within the enclosure on the property of the owner of the hen. b) "Coop" means a fully enclosed weatherproof structure where hens are kept and the interior ofwhich includes nest boxes for egg laying, perches for hens to roost on and food and water containers. c) "Hen" means a domesticated female chicken that is at least four months old; d) "Hen enclosure" means the building for housing the hens as well as the outdoor enclosed space; e) "Owner" means any person who possesses, harbours or keeps a chicken. REGULATIONS FOR THE KEEPING OF HENS 2. No person shall keep more than six (6) hens. 3. Roosters are not permitted. 4. Only hens four (4) months of age or older are permitted. 1 The Corporation of the Town of Parry Sound By-law2021-7164 5. No owner shall allow or permit their chickens to run at large. 6. Hens must be kept contained at all times in a fully enclosed enclosure. 7. Hens shall be kept for personal use only, the sale of eggs, manure, meat or other products derived from hens is not permitted. 8. A hen coop shall: a. Not exceed 3 meters in height; b. Provide at least 0.37 square meters of floor area; c. Be enclosed on all sides and have a roof and doors; d. Include a perch for each hen; e. Include nest boxes; f. Be maintained in good repair, in a clean, dry, odour free, and sanitary condition free from vermin; g. Be constructed and maintained to prevent any wildlife from harbouring underneath or within it or within its walls, and to prevent entrance by any otheranimal. 9. A hen enclosure shall: a. Be a maximum area of 10 square meters; b. Provide at minimum 0.92 square meters of outdoor space per hen; c. Be maintained in good repair, in a clean, odour free and sanitary condition; d. Be constructed and maintained to prevent access by other animals. lO.htens must be provided with food, water, shelter, light, ventilation, veterinary care, and opportunities for essential behaviours such as scratching, dust-bathing, and roosting, all sufficient to maintain the hens in good health. 11. Manure must be disposed of properly but cannot be composted or disposed of on property, disposed of in water, or included within any municipal garbage disposal. 12. No person shall slaughter, or attempt to euthanize, hens on the property. 13.The owner shall ensure that all dead hens are disposed of immediately by the owner in a sanitary manner at the owner's sole cost and expense. 14.The keeping of hens must be in accordance with the Town of Parry Sound Zoning By-law. 15. No person shall keep hens on a property less than 460 square meters (0.11 acres) in size. 16.hlens are only permitted for a single detached dwelling within an R1, R2, RR or RU zone. 17. Backyard hens shall be setback a minimum of 20 meters from any waterbody. 2 The Corporation ofthe Town of Parry Sound By-Iaw2021 -7164 18. Backyard hens shall not be permitted in any front yard or exterior side yard. 19.No person shall keep backyard hens without a licence from the Issuer of Licenses. ENFORCEMENT 20.The Municipal Law Enforcement Officers are hereby authorized and empowered to enforce this by-law. 21.No person shall hinder, obstruct or interfere with a Municipal Law Enforcement Officer conducting an investigation and/or provide the officerwith information, on matters relevant to the investigation that the person knows to be false or misleading. PENALTY 22. Every person who contravenes any of the provisions of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act R.S.O. 1990, Chapter p.33, as amended. SEVERABILITY 23. If any section or sections ofthis By-law or parts thereof are found in any court of law to be illegal or beyond the power of Council to enact, such section or sections or parts ofthis By-law shall be deemed to be separate and independent there from and to be enacted as such.
