BYLAW NO. 2021 - 25
SPEED LIMITS
A Bylaw to Regulate Vehicle Speed Limits on Highways under
the jurisdiction of the Township of Pelee
WHEREAS Section 128(1) of the Highway Traffic Act, R.S.O. 1990, c. H.8, limits the rate of speed of a motor vehicle
on a highway to 50 kilometres within a built up area and to 80 kilometres per hour on a highway that is not within a
built up area that is within a local municipality that had the status of township on December 31, 2002;
AND WHEREAS Section 128(2) of the Highway Traffic Act, R.S.O. 1990, c. H.8, authorizes the Council of a
municipality by by-law prescribe a rate of speed for motor vehicles driven on a highway under the jurisdiction of the
municipality different from the default rate set out in Section 128(1), as long as the rate of speed set by the
municipality is not greater than 100 kilometres per hour;
AND WHEREAS it is deemed necessary that the speed of motor vehicles on certain highways within the jurisdiction
of the Township of Pelee be restricted;
AND WHEREAS the Council of the Corporation of the Township of Pelee deems it expedient to pass a by-law to
prescribe and authorize rates of speed on the highways within the jurisdiction of the Township of Pelee;
NOW THEREFORE the Council of the Corporation of the Township of Pelee, in the Province of Ontario, hereby
ENACTS AS FOLLOWS:
1.
TITLE
This bylaw may be cited for all purposes as the "Township of Pelee Speed Bylaw No. 2021-25".
2.
RATE OF SPEED
That when any highway or portion of any highway set out in Schedule "1" appended hereto is marked in
compliance with the regulations under the Highway Traffic Act, R.S.O. 1990, c. H.8, the maximum rate of
speed thereon shall be 80 kilometres per hour.
That when any highway or any portion of highway set out in Schedule "2" appended hereto is marked in
compliance with the regulations under the Highway Traffic Act, R.S.O. 1990, c. H.8, the maximum rate of
speed thereon shall be 50 kilometres per hour.
That when any highway or any portion of highway set out in Schedule "3" appended hereto is marked in
compliance with the regulations under the Highway Traffic Act, R.S.O. 1990, c. H.8, the maximum rate of
speed thereon shall be 30 kilometres per hour.
3.
PENALTIES
That the penalties provided for in subsection 14 of Section 128 of the Highway Traffic Act, R.S.O. 1990, c.
H.8, shall apply to any violation of the speed limits set by this By-law No. 2021-25.

4.
REPEAL OF PREVIOUS BYLAWS RELATED TO SPEED LIMITS
That all previous by-laws of the Corporation of the Township of Pelee that regulate motor vehicle speed
limits on highways within the jurisdiction of the Township of Pelee, including, but not limited to, By-laws No.
1070, No. 1092, No.1355, No. 1383, No. 1449, No. 1589, and No. 1602, are hereby repealed.
The effective date of this bylaw shall be July 13, 2021.
