BY-LAW NUMBER 287, 1974. ## BEING A BY-LAW IO REGULATE, GOVERN, OR PROHIBIT THE OPERATION OF MOTORIZED SNOW VEHICLES IN THE TOWN OF PELHAM WHEREAS the Corporation of the Town of Pelham recognizes the need to regulate, govern, or prohibit the operation of motorized snow vehicles within the municipality and has been given the power to do so under the Motorized Snow Vehicles Act, R.S.O. 1970 c. 283. NOW THEREFORE the Council fo the Corporation of the Town of Pelham Enacts as Follows: ## 1. DEFINITIONS In this by-law: - (a) "Built-up area" means those areas outlined and shaded on the map annexed hereto as Schedule "A". - (b) "Highway" means such highway as defined in The Highway Traffic Act over which council of the Town of Pelham has jurisdiction. - (c) "Motorized snow vehicle" means a motorized snow vehicle as defined in The Motorized Snow Vehicles Act. - (d) "Recreational purpose" means any purpose other than medical aid or treatment, fire protection, law enforcement or emergency relief. - (e) "Public trail" means any motorized snow vehicle trail, designated for such use by the Corporation of the Town of Pelham or the Ministry of Natural Resources. - (I) "Public place" means any place or area owned by the Corporation of the Town of Pelham other than a highway, and shall further include a public park or cemetery whether owned by the Corporation of the Town of Pelham or otherwise. ## 2. CURFEW HOURS No person shall operate a motorized snow vehicle for recreational purposes between the house of 12:01 a.m. to 8:00 a.m. Monday to Friday inclusive and 1:00 a. m. to 8:00 a.m. Saturdays and Sundays. ## 3. SPEED LIMIT No person shall operate a motorized snow vehicle at a greater rate of speed that 20 miles per hour within a built up area ## VEHICLE CAPACITY Not more than two persons shall ride on or operate a motorized snow vehicle at the same time. ## 5. PROTECTIVE EQUIPMENT No person shall ride on or operate a motorized snow vehicle unless wearing a helmet approved for such use by the Canadian Standards Association. ## RESTRICTED AREAS No person shall operate a snowmobile in any public place except as authorized by Resolution of Council. ## 7. SIDEWALKS No person shall operate a motorized snow vehicle upon along any sidewalk, or any pathway or footpath commonly used for pedestrian travel, or upon or along any boulevard lying between a sidewalk and the shoulder or travelled portion of a roadway but this section shall not prohibit the right-angled crossing of such a sidewalk, footpath or boulevard. ## 8. EXCESSIVE NOISE No person shall operate a motorized snow vehicle having a modified muffler system which has the effect of increasing the noise of operation. ## 9. APPLICABILITY OF TRAFFIC BY-LAWS Except as otherwise provided, the provisions of all by-laws of the Town of Pelham pertaining to the regulation of traffic on highways shall be applicable, to the operation of motorized snow vehicles on highways. ## 10. PARKING No person shall park, stand or stop a motorized snow vehicle on the travelled portion of any highway, sidewalk or trail. ## 11. TRAILERS OR ACCESSORY ATTACHMENTS No person shall tow a trailer or other device with a motorized snow vehicle unless such trailer or device is using a rigid tow hitch and safety chain. 12. Every person who contravenes any provisions of this by-law is guilty of an offence and on dannary conviction is liable to a fine of not less than $ 10.00 and not more than $300.00, exclusive of court costs. 13. This by-law shall take effect upon passage by Council and approval by the Ministry of Transportation and Communications. READ A FIRST TIME READ A SECOND AND THIRD TIME AND FINALLY PASSED THIS 16th.
