The Corporation of the City of Pembroke
By-Law Number 2020-64
Being a by-law to regulate traffic in the City of Pembroke
Whereas, the Municipal Act, 2001, S.O. 2001, c. 25 as amended, states that a
municipality has the capacity, rights, powers and privileges of a natural person
for the purpose of exercising the authority under this or any other act; and,
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that
a municipality may pass by-laws respecting health, safety and well being of
persons; and,
Whereas, the Municipal Act, 2001, S.O. 2001 c. 25 as amended, permits
municipalities to pass by-laws in respect of a highway under the municipalities
jurisdiction; and,
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended, states that a
municipality may pass by-laws providing that a person who contravenes a bylaw
of the municipality passed under this Act is guilty of an offence; and,
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended, states that no
person shall hinder or obstruct, or attempt to hinder or obstruct any person who
is exercising a power or performing a duty under a bylaw passed under this Act;
and,
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended, states that a
municipality may establish a system of fines for offences under a by-law of the
municipality passed under this Act; and,
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended states that a
municipality may require a person to pay an administrative penalty if the
municipality is satisfied that the person has failed to comply with a bylaw
passed under this Act; and,
Now Therefore the Municipal Council of the Corporation of the City of
Pembroke enacts as follows:
Part I - Interpretations and Definitions
Section 1 - Short Title:
1.1
This by-law shall be known and may be cited as the "Regulate Traffic By-
law". In the text of the by-law, it is referred to as "this by-law".
Section 2 - Definitions:
2.1
The following words and phrases, when used in this By-law, shall, for the
purposes of this By-law, have the meaning respectively prescribed to
them;
a)
"Authorized Emergency Vehicles" includes official vehicles of the Fire
Department, Police and such ambulance and emergency vehicles, or
public service corporations as are designated or authorized by the
Operations Manager;
b)
"Authorized Sign" means any sign or other device placed or erected
on a highway under the authority of the By-law or any other legislation
for the purpose of regulating, warning or guiding traffic;
c)
"Boulevard" means all of the parts of the highway save and except
any roadway, shoulder and sidewalk and

i.
"Outer Boulevard" means all the parts of the highway lying
between the property line and the edge of the sidewalk nearest to
the property line and, where there is no sidewalk, it means that
part of the highway lying between the property line and that part of
the travelled portion of the highway or the edge of the shoulder,
where such exists, further from the travelled portion of the
highway;
ii.
"Inner Boulevard" means that part of the highway lying between
the property line and the edge of the sidewalk nearest to the
property line and, where there is no sidewalk, it means that part of
the highway lying between the property line and that part of the
travelled portion of the highway or the edge of the shoulder, where
such exists, further from the travelled portion of they highway;
d)
"Commercial Motor Vehicle" means any motor vehicle having a truck
or delivery body permanently attached thereto and shall include
ambulances, hearses, casket wagons, fire apparatus, police vehicles,
motor buses and tractors used for hauling purposes;
e)
"Community Safety Zone" means when signs have been erected in
compliance with the Highway Traffic Act of Ontario, any highway or
portion of a highway, as set out in "Schedule L", shall be designated
as a Community Safety Zone within the City of Pembroke effective 24
hours a day, 7 days a week, with penalties for violations of the
Highway Traffic Act imposed accordingly;
f)
"Crossover" means that part of a highway at an intersection which is
included within the connection of the lateral lines of the sidewalk on
opposite sides of the highway measured from the curbs, or in the
absence of curbs, from the edges of the travelled portion of the
roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by signs or by lines or other markings on the
surface;
g)
"Curb" shall include the edge of the travelled portion of a street;
h)
"Driver" means any person who drives or who is in actual physical
control of a vehicle;
i)
"Heavy Truck" means a commercial vehicle having a carrying
capacity in excess of one (1) ton but does not include buses,
ambulances or vehicles of the Fire, Police and Works Department of
the Corporation of the City of Pembroke;
j)
"Intersection" means the area contained within the prolongation or
connection of the lateral curb lines or, if none, then the lateral
boundary lines of two or more highways that join one another at an
angle, whether or not one highway crosses the other;
k)
"Lane" means the entire width of the roadway surface between
property lines at the rear or side of places of business or residential
properties. Lane also includes the term laneway.
l)
"Motor Assisted Bicycle" means a bicycle,
i.
That is fitted with pedals that are operable at all times to propel
the bicycle,
ii.
That weighs not more than fifty-five kg;
iii.
That has no hand or foot operated clutch or gearbox driven by
the motor and transferring power to the driven wheel;

iv.
That has an attached motor driven by electricity or having a
piston displacement of not more than fifty cubic centimetres;
and,
v.
That does not have sufficient power to enable the bicycle to
attain a speed greater than 50 km per hour on level ground
within a distance of 2 km from a standing start.
m)
"Motor Vehicle" includes an automobile, motorcycle, motor assisted
bicycle or scooter unless otherwise indicated in this Act, and any
other vehicle propelled or driven otherwise than by muscular power,
but does not include a street car or other motor vehicles running only
upon rails or a motorized snow vehicle, traction engine, farm tractor,
self-propelled implement of husbandry or road-building machine
within the meaning of this Act;
n)
"Municipal By-Law Enforcement Officer" means any person engaged
by the City of Pembroke to enforce or carry out any of the provisions
of this by-law;
o)
"Official Standard Time": shall mean standard time or daylight savings
time, as may be in use in the City of Pembroke, whenever certain
times are named herein;
p)
"Pedestrian" means any person afoot, in a wheelchair or a child in a
carriage;
q)
"Pedestrian Crossover" means any portion of a roadway, designated
by by-law of a municipality, at an intersection or elsewhere distinctly
indicated for a pedestrian crossing by signs and devices on the
highway and by lines or other markings on the surface of the roadway
as prescribed by the regulations;
r)
"Person" includes every natural person, firm partnership, association
or corporation;
s)
"Private Roadway or Driveway" means every way or place in private
ownership and used for vehicle traffic by the owner and those having
expressed or implied permission given from the owner but not by
other persons;
t)
"Roadway" means the part of the highway that is improved, designed
or ordinarily used for vehicular traffic but does not include the
shoulder, and where a highway includes two or more separate roads,
the term roadway refers to any one roadway separately and not to all
of the roadway collectively;
u)
"Sidewalk" means that portion of the street between the curb lines or
the lateral lines of the roadway and the adjacent property lines
intended for the use of pedestrians;
v)
"Street" includes a common and public highway, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle designated and
intended for, or used by, the general public for the passage of
vehicles;
w)
"Through Highway" means a highway or part of a highway designated
as such by by-law of the City of Pembroke, and every such highway
shall be marked by a stop sign or yield right-of-way sign;
x)
"Traffic" includes pedestrians, ridden or herded animals, vehicles,
buses and other such conveyances either singly or together while
using any street for the purpose of travel;

y)
"Traffic Control Device" means any sign, signal light traffic control
system, traffic signal, marking or device placed or erected by the
authority of Council for the purposes of regulating, warning or guiding
traffic;
z)
"U-Turn" means to turn a vehicle within a roadway so as to proceed in
the opposite direction;
aa)
"Vehicle" includes a motor vehicle, trailer, traction engine, farm
tractor, road building machine, bicycle, skateboard, in-line skates,
roller blades and any vehicle drawn, propelled or driven by any kind
of power including muscular power, but does not include a motorized
snow vehicle, a wheelchair whether powered or not, a power scooter
specifically designed for use on the sidewalk by a person who has a
physical defect or disability or cars of an electric or steam railway
running only upon rails.
bb)
"Wheelchair" means a chair mounted on wheels driven by muscular
or any other kind of power and used for the carriage of a person who
has a physical defect or disability;
Part II - General Regulations - Special Circumstances
Section 3
3.1
It is an offence for any person to do any act forbidden, or fail to perform
any act required, by this By-law.
3.2
No person shall fail or refuse to comply with any lawful order or direction
of a Police Officer, a Municipal By-law enforcement Officer or Traffic
Officer for the City of Pembroke.
3.3
The members of the Pembroke Police Service and Municipal By-law
Enforcement Officers shall have the duty of enforcing this By-law.
Section 4
4.1
In the event of conflict between this By-law and any other By-law
passed by the City of Pembroke prior to the effective date of this By-
law, this By-law shall take precedence.
Section 5 - Regulations - Special Circumstances
5.1
If the Operations Manager is of the opinion that, for some temporary
period, to ensure the safety of the public, the proper movement of traffic
or the proper safe performance of some vital function of the
municipality, special regulations are required for the movement of
vehicles on a highway under the jurisdiction of the municipality, such
person is authorized to make special regulations to prohibit or regulate
the movement of vehicles on such highway during such times and days
as such person deems proper and necessary and such person shall
erect official signs or otherwise give reasonable notice to indicate such
special regulations.
5.2
When official or authorized signs have been erected or notice has been
otherwise given under Subsection (1), every person shall obey the
instructions or directions on any sign so erected and the sign is deemed
to have been erected pursuant to the section that normally regulated or
prohibits the matter, and those provisions apply to any act, or failure to
act, contrary to any special regulations made pursuant to this by-law.

Section 6 - Signs and Lines
6.1
Erection of Signs, Traffic Signals, etc.
The Operations Manager is hereby authorized and directed to erect and
maintain such signs, traffic control devices and other structures, plant and
equipment as are required to give effect to this By-law and as are required to
regulate, direct, warn or guide pedestrian and vehicular traffic for the safety and
convenience of the public.
6.2
Defacing Signs and Traffic Signals
No person shall move, remove or in any manner interfere with a sign, traffic
control signal, marking or any other traffic control devices placed, erected or
maintained under this By-law.
6.3
Freshly Painted Lines on Roadway
No person shall wilfully drive any vehicle over any marking on the roadway
where markers are in place to indicate that the marking material has been
freshly applied nor shall any person drive into or over any marker so placed.
Part III - Traffic
Section 7 - Funerals and other Processions
7.1
No person shall drive a vehicle between the vehicles comprising a
funeral procession or other authorized procession while the procession is
in motion. This provision shall not apply at intersections when traffic is
controlled by a Police Officer or a Traffic Officer.
Section 8 - Reversing
8.1
The driver of a vehicle shall not back the same into an intersection or
over a crosswalk or any other place, unless such movement can be
made in safety.
Section 9 - Merging from Private Property
9.1
The driver of a vehicle emerging from a lane, driveway, lot or building
shall not drive the vehicle on to the sidewalk or enter the roadway until
the driver or the vehicle can do so in safety.
Section 10 - Pedestrians
10.1
No person shall step from the sidewalk to cross the street unless such
movement can be made in safety and shall cross at right angles to the
street.
10.2
No person on any highway, roadway, sidewalk, street, or through
highway shall fail to obey signals given either by a police officer or by a
traffic control device.
10.3
No person shall obstruct sidewalks or street corners and, where three (3)
or more persons are congregated, they shall be subject to the direction
of the Police Officer or By-law Enforcement Officer.
10.4
No person shall cause the obstruction of a sidewalk or street corner.
10.5
No person shall walk on the roadway where a sidewalk is available to be
used.
10.6
No person shall cross a roadway at a point other than within a pedestrian

crossover without yielding the right of way to the driver of a vehicle.
10.7
No person shall spit or urinate along, upon or adjacent to any sidewalk or
highway.
Section 11 - Pedestrian Crossovers/School Crossings
11.1
A driver shall yield the right of way to the pedestrian where traffic control
signals are not in place or not in operation and a pedestrian is crossing
the highway within a pedestrian crossover and the pedestrian is upon the
half of the highway upon which a vehicle is travelling or is approaching
so closely from the other half of the highway, that the pedestrian is in
danger.
11.2
Where a vehicle is stopped at a pedestrian crossover or at an intersection
to permit a pedestrian to cross the highway, no driver approaching from
the rear of the stopped vehicle shall overtake or pass the stopped vehicle.
11.3
The portion of the roadways as set out in "Schedule A" are designated a
pedestrian crossovers.
11.4
The portion of the roadways as set out in "Schedule B" are designated as
school crossovers.
Section 12 - Left-Hand Turns
12.1 When signs are erected giving notice thereof, no driver of a vehicle is
permitted to make a left-hand turn from:
-
the westerly side of the property municipally known as 415 Pembroke
Street West to Christie Street;
-
the westerly exit of the property municipality known as 1215
Pembroke Street West to Pembroke Street West;
-
the easterly exit of the property municipally known as 1200 Pembroke
Street West to Pembroke Street West;
-
The westerly exit of the property known as 1231 Pembroke Street
West to Pembroke Street West;
Section 13 - Through Streets - Stop
13.1
The streets or portions of streets, as detailed in "Schedule C", are hereby
designated as "Through Streets" and the operator or driver of every
vehicle shall, immediately before entering or crossing said street or
streets, bring the vehicle to a full stop and shall yield the right-of-way to
any vehicle standing in the intersection.
13.2
The provisions of this section shall not come into effect until "Stop" signs
have been erected in accordance with the regulations of the Ministry of
Transportation.
Section 14 - Through Streets - Yield
14.1
The streets or portions of streets, as detailed in "Schedule D", are hereby
designated as "Through Streets" and the operator or driver of every
vehicle shall, immediately before entering or crossing said street or
streets, yield the right-of-way.
14.2
The provisions of this section shall not come into effect until "Yield" signs
have been erected in accordance with the regulations of the Ministry of
Transportation.

Section 15 - Four-Way/All-Way Stops
15.1 The streets or portions of the streets, as detailed in "Schedule E", are
hereby designated as "Four-Way Stop Locations" and the operator or
driver of every vehicle shall, immediately before entering or crossing said
street or streets, bring the vehicle to a full stop and shall, before
proceeding, yield the right-of-way to any vehicle or vehicles which
already stand at the intersection.
Section 16 - Three-Way Stops
16.1 The streets or portions of streets, as detailed in "Schedule F", are hereby
designated as "Three-Way Stop Locations" and the operator or driver of
every vehicle shall, immediately before entering or crossing said street or
streets, bring the vehicle to a full stop and shall, before proceeding, yield
the right-of-way to any vehicle or vehicles which already stand at the
intersection.
Section 17 - Singular Stops
17.1 The streets or portions of streets, as detailed in "Schedule O", are hereby
designated as "Singular Stop Locations" and the operator or driver of
every vehicle shall, immediately before entering or crossing said street or
streets, bring the vehicle to a full stop and shall, before proceeding, yield
the right-of-way to any vehicle or vehicles which already stand at the
intersection.
Section 18 - Four-Way Traffic Signal Locations
18.1 The intersections, as detailed in "Schedule G ", are hereby designed as
"Four-Way Traffic Signal Locations.
Section 19 - Three-Way Traffic Signal Locations
19.1 The intersections, as detailed in "Schedule H", are hereby designated as
"Three-Way Traffic Signal Locations.
Section 20 - One-Way Streets
20.1 The streets or portions of streets, as detailed in "Schedule I", are hereby
designated as "One-Way Streets". Where a street or portion of a street
has been designated for one-way traffic only and official signs have been
erected accordingly, no person shall drive a vehicle in other than the
direction so designated.
Section 21 - Bicycles, Skateboards and In-Line Skates
21.1
A person riding a bicycle, skateboard, in-line skates and roller skates
upon any roadway shall:
i.
Drive as near to the right hand side of the roadway as practicable;
ii.
Exercise due care when passing a parked, stopped or standing
vehicle or one proceeding in the same direction;
21.2
Persons operating bicycles, skateboard, in-line skates and roller skates
upon a roadway shall do so in single file.
21.3
No person riding a bicycle on a roadway shall carry any package, bundle
or article which prevents the rider from keeping both hands on the handle
bars.

21.4
No person riding a bicycle on a roadway shall remove his feet from the
pedals while the bicycle is in motion.
21.5
No person shall ride any bicycle, skateboard, in-line skates and roller
skates on any sidewalk, footpath or walkway except for the purpose of
directly crossing the sidewalk, walkway or footpath or when permitted by
official sign and under "Schedule J".
21.6
No person riding upon a bicycle, skateboard, roller skates or in-line
skates shall attach themselves to a vehicle travelling on a roadway.
21.7
No person riding on a bicycle designated for carrying one person shall
carry any other person thereon save and except bicycles properly
equipped with a child carrier for the purpose of transporting an infant or
toddler.
Section 22 - Vehicles Crossing Sidewalks, Boulevards or Curbs
22.1
Vehicles on Sidewalks Prohibited
No person shall drive a vehicle or use or ride a skateboard, roller skates or in
line skates on a sidewalk or footpath on a highway except for the purpose of
directly crossing the sidewalk or footpath
22.2
Vehicles on Boulevards Prohibited
No person shall drive a vehicle on a boulevard except for the purpose of directly
crossing a boulevard at a driveway or other vehicular crossing.
22.3
Curb and Sidewalk Depressions
No person shall drive a vehicle over a raised curb or raised sidewalk except
where there is a ramp, rolled curb or depressed curb.
22.4
Exceptions
Subsections 22.1, 22.2 and 22.3 shall not apply to wheelchairs, baby carriages,
tricycles or children's wagons.
Section 23 - Littering Highway
23.1
No person shall throw or deposit or cause to be deposited any glass,
nails, tacks or scraps of metal or any rubbish, refuse, waste or litter upon,
along or adjacent to any sidewalk or highway.
Section 24 - Blocking of Intersections
24.1
A driver of a vehicle approaching an intersection where a traffic control
signal exists and is showing a circular green or green arrow is prohibited
from entering the intersection unless traffic in front of him or her is moving
in a manner that would reasonably lead him or her to believe he or she
can clear the intersection before the signal indication changes to a
circular red indication.
Section 25 - U-Turns Prohibited
25.1
When official signs have been erected, no driver or operator of a vehicle
shall execute a U-turn on a highway.
Section 26 - Miller Street Pedestrian Bridge
26.1
Miller Street Pedestrian Bridge is hereby set apart for the exclusive use
of pedestrians.

26.2
No person shall drive or operate any vehicle or conveyances of any
description and whatever the mode of power on the said pedestrian
bridge, but does not include wheelchairs, whether powered or not, or a
powered scooter specifically designed for use by a person who has a
physical defect or disability.
Section 27 - Prohibition of Heavy Trucks
27.1
When signs to the effect have been displayed, no person shall drive, or
cause to be driven, any heavy truck on that portion of a highway as
outlined in "Schedule K".
27.2
That the preceding section shall not apply to heavy trucks performing a
service of pick up or delivery on those portions of the highway outlined in
"Schedule K" or to heavy trucks proceeding to or from a garage or other
premises for the repair of heavy trucks.
Section 28 - Community Safety Zones
28.1
The streets or portions of streets, as detailed in "Schedule N", are hereby
designated as "Community Safety Zones" within the City of Pembroke
effective 24 hours a day, 7 days a week.
Section 29 - Rates of Speed
29.1
School Zones
When signs have been erected in compliance with the Highway Traffic Act of
Ontario, any highway or portion of a highway, as set out in "Schedule L" , shall
be designed as a School Zone and will have a maximum speed of 40 kilometres
per hour on days on which school is regularly held between the hours of 8:00
a.m. and 5:00 p.m., except for the School Zone on Carmody Street, from
Everett Street to the entrance of Bishop Smith Catholic High School, which will
have a maximum speed of 30 kilometres per hour.
29.2
Parks, Exhibition Grounds
When signs have been erected in compliance with the Highway Traffic Act of
Ontario any highway or portion of a highway, as set out in "Schedule M" and
designated as highways in park or exhibition grounds and will have a maximum
speed of 25 kilometres per hour.
29.3
Community Safety Zones and Hospital Zones
When signs have been erected in compliance with the Highway Traffic Act of
Ontario any highway or portion of a highway, as set out in "Schedule L" shall be
designated as either a Community Safety Zone or a Hospital Zone and will have
a maximum speed of 40 kilometres per hour, 24 hours a day, 7 days a week.
29.4
The provisions of this section shall not come into effect until appropriate
signs have been erected in accordance with the regulations of the
Ministry of Transportation.
Section 30 - Authority to Temporarily Close/Permit the Use of Road and/or
Sidewalks
30.1
The Chief Administrative Officer is hereby authorized, under authority of
The Municipal Act, c.25, S.O. 2001, to review and approve requests to
temporarily close or use public roadways or sidewalks subject to the
approved City policy guidelines.

Part IV - Penalties
Section 31 - Penalties
31.1
Every person who contravenes any provision of this By-law is guilty of an
offence and upon conviction is liable to the penalties specified in
accordance with the Provincial Offences Act, R.S.O. 1990, Chapter P.
33, as amended from time to time, or any successor legislation thereto.
Section 32
32.1
That By-law Numbers 2005-25, 2006-33, 2007-41, 2008-57, 2009-65,
2016-43, 2018-46 and any subsequent amendments to these by-laws be,
and they are, hereby repealed.
Section 33
33.1
This By-law shall come into force and take effect upon the date of the
final passing thereof.

A By-law to amend By-law 2020-64, being a by-law to regulate traffic in the
City of Pembroke
Whereas the Municipal Act, 2001, S.O. 2001, c.25 as amended, states that a
municipality has the capacity, rights, powers, and privileges of a natural person
for the purpose of exercising the authority under this or any other act; and
Whereas, the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that
a municipality may pass by-laws respecting health, safety and well-being of
persons; and
Whereas the Municipal Act, 2001, S.O. 2001, c.25, permits municipalities to
pass by-laws in respect of a highway under the municipality's jurisdiction; and
Whereas on September 1, 2020, the Municipal Council of the Corporation of the
City of Pembroke did enact By-law 2020-64 to regulate traffic in the City of
Pembroke; and
Whereas the Council of the Corporation of the City of Pembroke deems it
expedient to amend Schedule "I" One-Way Street Locations to By-law 2020-64.
Now Therefore, the Municipal Council of the Corporation of the City of
Pembroke enacts as follows:
1. That Schedule "I" to By-law 2020-64 One-Way Street Locations be
amended as of August 5, 2022, by adding thereto the following:
Fraser Street from Pembroke Street East to Esther Street
2. This By-law shall come into force and take effect upon the final passing
thereof.

Whereas, the Municipal Act, 2001 , S.O. 2001 , c.25 as amended states that a
municipality may require a person to pay an administrative penalty if the
municipality is satisfied that the person has failed to comply with a bylaw
passed under this Act; and,
Now Therefore the Municipal Council of the Corporation of the City of
Pembroke enacts as follows:
1. That Section 2 of Part 1 Interpretations and Definitions of By-law 2020-64
a by-law to Regulate Traffic be amended to include the following:
a)
"Crosswalk" means that part of a highway at an intersection which is
included within the connection of the lateral lines of the sidewalk on
opposite sides of the highway measured from the curbs, or in the
absence of curbs, from the edges of the travelled portion of the
roadway at an intersection.
b)
"Crossover" means that part of a highway distinctly indicated for
pedestrian crossing by signs and by lines or other markings on the
surface at any location including at an intersection.
2. That Section 11 of Part Ill - Traffic, be amended as follows:
a) Delete "School Crossings" from the title.
b) Delete section 11.4
3. That Schedule "A" - Pedestrian Crossovers of By-law 2024-60 be
replaced by the new Schedule "A".

4. That Schedule "B" - School Crossovers of By-law 2020-64 be deleted
from by-law 2024-60 and all subsequent Schedules be re-named as
appropriate.
5. This By-law shall come into force and take effect upon the date of the
final passing thereof.
