THE CORPORATION OF THE TOWNSHIP OF PERTH EAST
BY-LAW NO. 35-2021
BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING
AND AMEND BY-LAW 73-2016
WHEREAS section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended (the "Act"), gives
The Corporation of the Township of Perth East (the "Township") the power to pass by-laws
respecting its highways, including parking and traffic on highways;
AND WHEREAS section 100 of the Act provides that, without limiting sections 9, 10 and 11, a
local municipality may, in respect of land not owned or occupied by the municipality that is used
as a parking lot, regulate or prohibit the parking or leaving of motor vehicles on that land without
the consent of the owner of the land or regulate or prohibit traffic on that land if a sign is erected
at each entrance to the land clearly indicating the regulation or prohibition;
AND WHEREAS section 100.1(1) of the Act provides that, without limiting sections 9, 10 and 11,
a local municipality may, in respect of land not owned or occupied by the municipality, regulate or
prohibit the parking or leaving of motor vehicles without the consent of the owner of the land,
though that section does not apply to land used as a parking lot;
AND WHEREAS section 101(1) of the Act provides that, if a municipality passes a by-law
regulating or prohibiting the parking or leaving of a motor vehicle on land, it may provide for the
removal and impounding or restraining and immobilizing of any vehicle, at the vehicle owner's
expense, parked or left in contravention of the by-law and subsection 170 (15) of the Highway
Traffic Act applies with necessary modifications to the by-law;
AND WHEREAS section 101(2) of the Act provides that a municipality may enter on land at
reasonable times for the purposes described in section 101(1) of the Act;
AND WHEREAS section 101(3) of the Act provides that, if signs are erected on land specifying
conditions on which a motor vehicle may be parked or left on the land or regulating or prohibiting
the parking or leaving of a motor vehicle on the land, a motor vehicle parked or left on the land
contrary to the conditions or prohibition shall be deemed to have been parked or left without
consent;
AND WHEREAS section 102(1) of the Act provides that, if a municipality passes a by-law for
establishing a system of accessible parking, the sole manner of identifying vehicles shall be an
accessible parking permit issued and displayed in accordance with the Highway Traffic Act and
the regulations made under it;
AND WHEREAS section 102(2) of the Act provides that, without limiting sections 9, 10 and 11, a
local municipality may require the owners or operators of parking lots or other parking facilities to
which the public has access, whether on payment of a fee or otherwise, to provide designated
parking spaces for vehicles displaying an accessible parking permit and if it does so, the local
municipality shall prescribe the conditions of use of the accessible parking permit and shall
prohibit the improper use of the permit;
AND WHEREAS section 102(3) of the Act provides that a by-law passed in accordance with
section 102(2) of the Act may provide for the removal and impounding of any vehicle, at its owner's
expense, parked or left contrary to the by-law;
AND WHEREAS section 7.1(1)(c) of the Fire Protection and Prevention Act, 1997, S.O. 1997, c.
4, as amended (the "FPPA"), provides that a council of a municipality may pass by-laws
designating private roads as fire routes along which no parking of vehicles shall be permitted and
providing for the removal and impounding of any vehicle parked or left along any of the fire routes
at the expense of the owner of the vehicle;
AND WHEREAS section 7.1(4) of the FPPA provides that a municipality may appoint an officer
to enter upon land and into structures at any reasonable time to inspect the land and structures
to determine whether by-laws enacted in accordance with this section are being complied with;
AND WHEREAS the Township deems it desirable to regulate traffic and parking in the Township;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PERTH
EAST hereby enacts as follows:

1.
DEFINITIONS
The definitions contained within the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended (the
"Highway Traffic Act"), or the regulations made thereunder, shall apply in the interpretation of
this by-law except where they are inconsistent, in which case the definition under this by-law shall
apply. For purposes of this by-law:
1.1
"accessible parking permit" means a disabled person parking permit issued under and
displayed in accordance with the Highway Traffic Act and the regulations made
thereunder;
1.2
"accessible parking space" means a parking space distinctly indicated for the exclusive
use of a person with a disability in accordance with the requirements of the applicable
regulations under the Highway Traffic Act;
1.3
"authorized sign" means any traffic control device or traffic control signal that has been
erected on a highway under the authority of this by-law for the purpose of regulating,
warning or guiding traffic;
1.4
"boulevard" means that part of a highway from the edge of the roadway to the nearest
lateral property line, but does not include a shoulder, sidewalk or multi-use trail;
1.5
"bus stop" means that part of a highway designated by the Township as a "bus stop" by
a sign for the use of transit buses, as a space for loading and unloading passengers;
1.6
"corner" means the point of intersection of curb lines;
1.7
"Council" means the municipal Council of the Township;
1.8
"County" means the County of Perth;
1.9
"curb line" means:
(a)
where a curb has been constructed, means the line of the curb; and,
(b)
where no curb has been constructed, means the edge of the roadway;
1.10
"drive" means to drive, move or operate a vehicle;
1.11
"driveway" means that part of a highway that provides vehicular access to and from the
roadway and an adjacent property;
1.12
"Fire Chief" means the person appointed by Council for the Township as defined in the
FPPA, or his or her designate;
1.13
"Fire Department" means the fire department established by the Township;
1.14
"fire route" means an access route required for the use by the Fire Department provided
by means of a private roadway or yard;
1.15
"highway" means a highway or a part of a highway under the jurisdiction of the Township;
1.16
"motorized snow vehicle" means a self-propelled vehicle designed to be driven primarily
on snow;
1.17
"multi-use trail" means that part of a highway with surface improved with asphalt,
concrete or gravel for the use of pedestrians and non-motorized vehicles or another public
trail owned by the Township;
1.18
"municipal law enforcement officer" means a person appointed by the Township to
enforce its by-laws;
1.19
"Officer" means a municipal law enforcement officer, police officer, Fire Chief and / or his
or her designate;
1.20
"one-way street" means a highway upon which vehicular traffic is limited to movement in
one direction;
1.21
"parking space" means that part of a roadway that is designated by the Township for the
purpose of parking one vehicle;

1.22
"pedestrian" means any person afoot, any person in a wheelchair, any child in a wheeled
carriage, and any person riding a non-motorized bicycle with wheels less than 50
centimetres in diameter;
1.23
"police officer" means a means an employee of the Ontario Provincial Police or other
police service who is appointed as a peace officer pursuant to the Police Services Act,
R.S.O. 1990, c. P. 15, as amended;
1.24
"private road" means any private road, lane, ramp or other means of vehicular access to
or from a building or structure and may include part of a parking lot;
1.25
"property owner" includes a person:
1.25.1 whose interest in land is such that he is deemed to be an owner under the
appropriate land registrations system; and,
1.25.2 who is or appears to be receiving rent or other compensation from the use of land
by a third party whether he/she is receiving it on his/her own account or as agent,
trustee or representative of like capacity;
1.26
"Public Works Manager" means the person appointed by the Township to manage the
Township's Public Works Department.
1.27
"reserved lane" means a lane within a highway reserved under this by-law exclusively for
use by bicycles, horse-drawn vehicles, buses or other specific classes or types of vehicles;
1.28
"school bus" means a publicly or privately owned vehicle that is used for taking school
children to and from school or school-related activities;
1.29
"school crossing" means any portion of a highway distinctly indicated for pedestrian
crossing by school crossing signs and lines or other markings on the surface of the
roadway;
1.30
"school-purpose vehicle" means a vehicle that a school board has provided to transport
one or more students, including but not limited to a school bus;
1.31
"shoulder" means that portion of a highway lying adjacent to the roadway that is improved
with granular or paved surface and is not intended for the passage of motor vehicles or
pedestrians;
1.32
"sidewalk" means that portion of a highway between the curb line and the property line of
the lot abutting the highway improved for the use of pedestrians;
1.33
"traffic control device" means a sign, marking or other device on a highway for the
purpose of controlling, guiding or directing traffic;
1.34
"traffic control signal" means any device, manually, electrically or mechanically operated
for the regulation of traffic;
1.35
"transit bus" includes a charter transit operator but does not include a school-purpose
vehicle; and,
1.36
"vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building
machine and any vehicle drawn, propelled or driven by any kind of power, including
muscular power, but does not include a motorized snow vehicle, all-terrain vehicles or the
cars of electric, diesel or steam railways running only upon rails.
2.
GENERAL
Driving on a Boulevard, Sidewalk or Multi-Use Trail
2.1
No person shall drive a motor vehicle or a motor-assisted vehicle on any boulevard,
sidewalk or multi-use trail except on a driveway.
2.2
No person shall drive a bicycle having a wheel or wheels more than 50 centimetres in
diameter or ride a skateboard on any boulevard or sidewalk, except on a driveway.

Closed Highways
2.3
No person shall drive a vehicle, except an emergency vehicle or a vehicle authorized by
the Public Works Manager, or their designate, or by a police officer, on any highway that
is roped, barricaded or marked by an authorized sign prohibiting its use.
Newly Painted Lines
2.4
No person shall drive, or attempt to drive, on or over, or tamper with, or walk on any newly
painted line or series of lines, on any roadway or shoulder, when the presence of such is
indicated by signs, markers, electric lanterns or otherwise.
Blocking Intersection
2.5
No driver of a vehicle approaching, at an intersection, a traffic control signal showing a
circular green or a green arrow shall enter the intersection unless traffic in front of him or
her is moving in a manner that would reasonably lead him or her to believe that he or she
can clear the intersection before the signal indication changes to a circular red indication.
This prohibition, however, does not apply to the driver of a vehicle who enters an
intersection for the purpose of turning to the right or left onto an intersecting roadway and
signals his or her intention to make the turn prior to entering the intersection.
Riding Abreast
2.6
No person shall ride a bicycle on any roadway or shoulder abreast of another bicycle
except in the course of passing such other bicycle.
Parking a Bicycle
2.7
Unless otherwise permitted in this by-law, no person shall park a bicycle on any roadway
or shoulder.
2.8
No person shall park a bicycle on any highway except in an upright position.
Walking on Sidewalks
2.9
All pedestrians shall utilize sidewalks whenever they are provided adjacent to a roadway.
2.10
No person shall obstruct or impede pedestrians on a sidewalk unless otherwise permitted
by the Township.
Animals - Attendance While in Motion
2.11
No person shall drive an animal-drawn vehicle on a highway unless he or she remains
upon the vehicle while it is in motion or walks beside the animal drawing it.
Animals - Parking of Carriages
2.12
No person shall leave a carriage, cart, wagon, and sleigh or sled drawn by an animal on
a highway without the animal drawing it.
Objects on the Roadway
2.13
Unless otherwise authorized, no person shall place or store any object or accumulation of
material, including construction materials and snow or ice, upon a roadway.
3.
PARKING AND STOPPING REGULATIONS
General
3.1
Unless otherwise permitted in this by-law, no person shall park or stop a vehicle on any
highway except on the right side of the highway having regard to the direction in which the
vehicle was travelling, parallel to and not exceeding a distance of 0.15 metres from the
curb line.

One-Way Streets
3.2
Unless otherwise permitted in this by-law, where parking is permitted on either side or
both sides of a one-way street, no person shall park or stop a vehicle except parallel to
and not exceeding a distance of 0.15 metres from the curb line and so that the front end
of the vehicle is facing the direction in which the vehicle is permitted to proceed.
Angle Parking
3.3
Where angle parking is permitted, no person shall park or stop a vehicle except at the
angle with the highway indicated by markings and/or signs and so that the front end of the
vehicle is angled toward the direction in which the vehicle is permitted to proceed.
Parking Spaces
3.4
No person shall park a vehicle in such a manner as to encroach on a contiguous parking
space unless the vehicle cannot be accommodated in one parking space.
Parking Prohibited
3.5
Unless otherwise permitted in this by-law, no person shall park a vehicle on any highway:
On or Overhanging
3.5.1 on or overhanging any curb, sidewalk or multi-use trail;
3.5.2 on or overhanging a boulevard, except where it has been improved by the
Township with asphalt, concrete or gravel, for the purpose of accommodating the
parking of vehicles;
Intersections
3.5.3 within an intersection;
3.5.4 within 9 metres of an intersecting highway or within 15 metres of an intersection
controlled by traffic control signals;
Bridges
3.5.5 within thirty (30) metres of a bridge over, under or across which the highway
passes
Fire Stations/Hydrants/Routes
3.5.6 within eight (8) metres of any fire hall access on the side of the highway on which
the fire hall is located and/or within thirty (30) metres of such fire hall access on
the opposite side of the highway;
3.5.7 within 4 metres of a point on the curb or edge of the highway nearest a fire hydrant;
Railway Crossings
3.5.8 within 15 metres of the nearest rail of a level railway crossing;
Obstructing
3.5.9 in front of or within 1.5 metres of the entrance to a driveway or so as to prevent
ingress to or egress from such driveway
3.5.10 in such a manner as to obstruct an entrance on the highway to or from a private
road or lane;
3.5.11 in such a manner as to obstruct a crosswalk or a school crossing;
3.5.12 in such a manner as to obstruct traffic;
3.5.13 in a position or place that prevents or is likely to prevent the removal of any vehicle
already parked on the highway;

3.5.14 in such a manner so as to obstruct any designated bicycle lane, provided that this
shall not prohibit: a momentary stopping of taxis actively engaged in receiving or
discharging passengers or other motor vehicles, while actively engaged in
receiving or discharging passengers;
Time Periods
3.5.15 subject to section 3.5.16 of this by-law, for a longer period of time than 24
consecutive hours;
3.5.16 between the hours of 2:00 a.m. to 8:00 a.m. between November 1st and April 15th
of each year;
Repairing/Washing/Maintaining
3.5.17 for the purpose of repairing, washing, or maintenance of a vehicle, except when
such use of the highway is unavoidable through emergency;
Soliciting/Vending/Buying/Selling
3.5.18 for the purpose of soliciting, vending, buying or selling goods and/or services,
except for the soliciting, vending, buying or selling of consumable goods, flowers,
or unless otherwise permitted by by-law;
Trailers
3.5.19 if such vehicle is a trailer that is not attached to a motor vehicle;
3.5.20 if such vehicle is a trailer more than 10 metres in length;
Unlicensed Vehicles
3.5.21 if such vehicle is an unlicensed vehicle; and,
Vehicle Leaking
3.5.22 if such vehicle is leaking gasoline, engine oil or any other vehicular fluid.
4.
NO PARKING AND NO STOPPING ZONES
No Parking Zones
4.1
When authorized signs establishing a "no parking" zone are on display, no person shall
park a vehicle within such zone except when necessary to avoid conflict with other traffic
or in compliance with a traffic control signal, sign, device, or the directions of a police
officer.
4.2
Without limiting the generality of section 4.1 of this by-law an authorized sign establishing
a "no parking" zone shall be erected prohibiting the parking of a vehicle on any highway
named or described in Schedule E of this by-law, on the side or sides of the highway set
out therein.
4.3
The Public Works Manager, or designate, is hereby authorized to erect or place temporary
"no parking" signs on any common or public highway, roadway, street, avenue, parkway,
driveway, laneway, square, place, bridge, viaduct or trestle designed for and intended for,
or used by the general public for the passage of vehicles at any time and for any reason.
No Stopping Zones
4.4
When authorized signs establishing a "no stopping" zone are on display, no person shall
stop a vehicle within such zone except when necessary to avoid conflict with other traffic
or in compliance with a traffic control signal, sign, device, or the directions of a police
officer.
4.5
The Public Works Manager, or designate, is hereby authorized to erect or place temporary
"no stopping" signs on any common or public highway, roadway, street, avenue, parkway,
driveway, laneway, square, place, bridge, viaduct or trestle designed for and intended for,
or used by the general public for the passage of vehicles at any time and for any reason.

5.
LIMITED TIME PARKING ZONES
5.1
When authorized signs are on display, no person shall park a vehicle on any highway
named or described in Schedule F of this by-law, except on the side or sides of the
highway set out therein, during the times and/or days set out therein, for the length of time
set out therein.
6.
ACCESSIBLE PARKING SPACES
6.1
No person shall park, stop or leave a motor vehicle in an accessible parking space at any
time without displaying an accessible parking permit.
6.2
No person shall park, stop or leave a motor vehicle displaying an accessible parking permit
in an accessible parking space if the vehicle is not transporting or picking-up a person with
a disability.
6.3
No person shall create or otherwise establish an accessible parking space without a
minimum width of 3.9 metres and a minimum length of 5.5 metres.
7.
TOWNSHIP PROPERTY
7.1
When authorized signs are on display, no person shall park a vehicle on the Township
property named or described in Schedule G of this by-law, during the times and/or days
set out therein, unless otherwise authorized or permitted by the Township.
8.
FIRE ROUTES
8.1
The Chief Fire Official may require a private road or parking lot, or part thereof, in the
Township to be established as a fire route.
8.2
Where a private road or parking lot, or part thereof, has been required to be established
as a fire route, under this by-law it is hereby designated as a fire route and the Chief Fire
Official is delegated the authority to amend Schedule C to add, remove or modify
established fire routes as required.
8.3
Where a fire route has been designated under this by-law, the Chief Fire Official may issue
an order requiring the property owner:
9.3.1 to establish the fire route in accordance with the provisions of this by-law; and
9.3.2 erect and maintain an authorized sign at locations on the fire route approved by
the Chief Fire Official.
8.4
Where a property owner fails to erect or to maintain an authorized sign under this by-law,
the Chief Fire Official or other employee designated by the Township may enter on the
property owner's land and may erect an authorized sign at the expense of the property
owner and the costs incurred as a result thereof may be added to the tax roll and collected
by the Township in the same manner as property taxes under the Act.
8.5
Where a fire route has been designated, constructed and signed in accordance with this
by-law, if the Chief Fire Official deems it to be in the interest of the life safety requirements
under the Fire Code, the Chief Fire Official may issue an order for any change to the
designated fire route deemed necessary and the property owner shall carry out whatever
construction or changes to an authorized sign as may be necessary.
8.6
No person shall park or stand a vehicle along, in, or over, any properly signed fire route
designated in Schedule C to this by-law.
9.
PEDESTRIAN CROSSOVERS
9.1
When authorized signs or pavement markings are on display on any highway named or
described in Schedule A of this by-law, any location set out therein is designated as a
pedestrian crossover.
10.
ONE WAY STREETS
10.1
When authorized signs are on display, any highway named or described in Schedule B
of this by-law is designated as a one-way street in the direction of travel stated therein.

11.
SCHOOL BUS AND ACCESSIBLE VEHICLE LOADING ZONES
11.1
When authorized signs are on display, the driver of a school-purpose vehicle or a vehicle
carrying a person with a disability may park, stand or stop on the side the building set out
in Schedule D for the purpose of loading or unloading of passengers.
12.
EXEMPTIONS
12.1
Notwithstanding any other provision of this by-law, this by-law shall not apply to the
following, if compliance thereof would be impractical:
12.1.1 police or Fire Department vehicles, ambulances or any other emergency vehicles;
and
12.1.2 vehicles utilized by the Township, the Ministry of Transportation of Ontario, and
the County.
12.2
The exemptions set out in section 12.1 of this by-law shall apply only when such vehicles
are being engaged in an official capacity.
13.
EMERGENCIES & SNOW EVENTS
13.1
The Public Works Manager, or designate, is authorized to declare an emergency in
relation to:
13.1.1 fire, flood, tornado, earthquake or other natural disaster; or,
13.1.2 terrorism, insurrection or apprehended insurrection (an "Emergency").
13.2
The Public Works Manager, or designate, is authorized to declare a snow event in relation
to inclement weather conditions, such as when sufficient snow or ice has accumulated
and the parking of vehicles on highways interferes with the movement of vehicles and with
the efficient removal of snow from such highways (a "Snow Event").
13.3
Notwithstanding any other provision of this by-law, during an Emergency or a Snow Event,
no person shall park or stop a vehicle on any highway.
13.4
Notwithstanding any other provision of this by-law, the Public Works Manager, or
designate, is authorized to place, erect, maintain, move and remove such authorized signs
as are required for an Emergency, Snow Event or, more generally, for public safety.
14.
POWERS OF ENTRY AND INSPECTION
14.1
An Officer may, at any reasonable time, enter and inspect any land or premises to
determine whether the provisions of this by-law or any direction or order made under this
by-law is being complied with.
15.
OBSTRUCTION
15.1
No person shall hinder or obstruct, or attempt to hinder or obstruct, an Officer exercising
a power or performing a duty under this by-law.
16.
PENALTIES
16.1
Every person who contravenes any of the provisions of this by-law is guilty of an offence
and, upon conviction, shall be subject to a fine pursuant to the Provincial Offences Act,
R.S.O. 1995, c.P.31.1 as amended.
16.2
The owner of a vehicle that is found parked, stopped or standing in contravention of this
by-law, is guilty of an offence and on conviction is liable to the fine prescribed for the
offence unless the owner proves to the satisfaction of the Court that, at the time of the
offence, the motor vehicle was in the possession of another person without the owner's
consent, either express or implied.
16.3
In addition to any other penalties provided for in this by-law, a police officer or a municipal
law enforcement officer may cause a vehicle to be moved or taken to and placed or stored
in a suitable place and all costs and charges for the removal, care and storage of the
vehicle, if any, are a lien upon the vehicle, which may be enforced in the manner provided
by the Repair and Storage Liens Act, R.S.O. 1990, Chapter R.25, as amended.

17.
ENFORCEMENT AND AUTHORITY
Enforcement
17.1
This By-law may be enforced by an Officer.
Authority
17.2
The Public Works Manager, or designate, is authorized to place, erect and maintain, or
cause to be placed, erected and maintained, such authorized signs that are required to
give effect to the provisions of this by-law and/or that are authorized by the schedules of
this by-law.
17.3
The Public Works Manager, or designate, is authorized to, notwithstanding any other
provision of this by-law, place, erect, maintain, move and remove such authorized signs
as are required for an activity for which the Township has granted a permit.
17.4
Unless otherwise permitted in this by-law, no person shall place, maintain, or display upon
any highway, any sign, signal, marking or device which purports to be or is an imitation of
or resembles any authorized sign without prior written approval of the Public Works
Manager or their designate.
17.5
The Public Works Manager or designate is authorized to issue a permit for use of a
highway by a vehicle or combination of vehicles in excess of the dimension and weight
limits set out in the Highway Traffic Act.
18.
GENERAL
18.1
The Schedules referred to in this by-law shall form a part of this by-law and each entry in
a column of such a Schedule shall be read in conjunction with all entries across therefrom,
and not otherwise.
18.2
In the Schedules referred to in this by-law, the abbreviations contained therein, shall be
interpreted as follows:

18.3
In this by-law:
18.3.1 words importing the singular number of the masculine gender include more
persons, parties, or things of the same kind and females as well as males and the
converse;
18.3.2 a word interpreted in the singular number has a corresponding meaning when used
in the plural;
18.3.3 "may" shall be construed as permissive;
18.3.4 "shall" shall be construed as imperative.
18.4
Where a distance is used in the By-law as part of a prohibition of parking or stopping within
a specified distance of an object, structure, land or a part of a highway, such distance shall
be measured:
18.4.1 along the curb or edge of the roadway from a point in such curb or edge of the
roadway opposite such object, structure, land or part of a highway, unless the
context otherwise requires;
18.4.2 from such object, structure, land or part of a highway in all directions; and

18.4.3 when in reference to an intersection, street shall mean from the prolongation of the
closest curb line or boundary line of the intersecting highway.
18.5
The various prohibitions of this by-law are cumulative and not mutually self-exclusive.
19.
SEVERABILITY
19.1
It is declared that if any section, subsection or part of parts thereof be declared by any
Court of Law to be bad, illegal or ultra vires, such part of parts shall be deemed to be
severable and all parts hereof are declared to be separate and independent and enacted
as such.
20.
