# The Corporation of the Town of Petawawa
## By-law No. 174/2001
**Being a By-law to Regulate the Keeping of Animals Within the Municipality and for Providing for an Animal Identification System and for the Registration and Regulation of Dogs and Cats**
**Whereas** the Councils of Municipalities are authorized by the Municipal Act to prohibit or regulate the keeping of animals, regulate breeding/boarding establishments, regulate animals at large, provide for identification systems, require leashing, require removal of excrement, and license dogs;
**Now Therefore the Corporation of the Town of Petawawa, enacts as follows:**
### PART 1: DEFINITIONS
* **"Animal":** means all species of fauna excluding humans, fish and aquatic invertebrates.
* **"At Large":** means to be any animal found in any place other than the premises of the owner and not under the physical control of a person responsible.
* **"Dangerous Dog":** means any individual dog that:
+ (a) has killed a domestic animal without provocation off the owner's property;
+ (b) has bitten/injured a human or domestic animal without provocation;
+ (c) is attack trained;
+ (d) is trained/kept for security or protection; or
+ (e) has shown the disposition or tendency to be threatening or aggressive 1.
* **"Kennel":** means a lot, building, structure or establishment for the breeding and/or boarding of dogs.
* **"Public Nuisance Animal":** means any animal that unreasonably annoys humans, endangers life/health, or interferes with rights. Includes animals that:
+ (a) are repeatedly at large;
+ (b) damage property;
+ (c) molest/intimidate pedestrians;
+ (d) chase vehicles;
+ (e) make excessive noise (howling, barking, whining);
+ (f) cause unsanitary conditions; or
+ (h) attack other domestic animals 2.
* **"Restraint":** means controlled by a chain/leash, within a vehicle, within a secure enclosure, or within the owner's property limits.
### PART 2: PROVISION OF NEEDS
* **2.1 Basic Needs:** Every person who keeps an animal shall provide:
+ (a) Clean, fresh drinking water and suitable food;
+ (b) Clean/disinfected food receptacles;
+ (c) Opportunity for periodic exercise; and
+ (d) Necessary veterinary medical care 3.
* **2.2 Outdoor Keeping:** Animals kept outside must have an enclosure at least twice the animal's length, a shelter protecting from heat/cold/wet, sufficient shade, and be cleaned daily.
* **2.3 Restraints:** Choke collars or ropes tied directly around the neck are prohibited for tethering.
* **2.5 Ventilation:** Animals confined in enclosed spaces (cars/trucks) must have adequate ventilation.
* **2.6 Transportation:** Animals outside the passenger compartment must be confined or secured to prevent falling/injury.
* **2.7 Unsanitary Conditions:** Keeping animals in conditions resulting in accumulation of feces, odours, or insect/rodent infestation is prohibited.
### PART 3: CLASSES OF ANIMALS
* **Class 1:** Cow, donkey, goat, horse, mule, pig, pony, sheep.
* **Class 2:** Chicken, goose, turkey, duck, pigeon, domestic fowl.
* **Class 3:** Guinea pig, gerbil, hamster, mouse, rat, rabbit, chinchilla, mink, ferret, turtle.
* **Class 4:** Wild/Exotic animals (e.g., lions, tigers, monkeys, wolves, poisonous reptiles, raptors, dangerous fish).
* **Domestic Cat/Dog:** Domestic felines and canines 4.
### PART 4: EXEMPTIONS
Exemptions apply to: The contracted Animal Shelter, Petawawa Humane Society, Veterinary Hospitals, Public Zoos/Fairs, and Registered Research Facilities.
### PART 5 & 6: CLASS 1 & 2 ANIMALS (Livestock & Fowl)
* **Class 1 (Livestock):** Prohibited on lots smaller than 1 acre or zoned Residential/Commercial/Industrial. Must have access to a stable/building at least 55 meters from other dwellings.
* **Class 2 (Fowl):** Prohibited on lots smaller than 0.25 acres or zoned Residential/Commercial/Industrial. Must be kept in a coop/pen at least 15 meters from other dwellings.
* **Strayed Pigeons:** The Animal Control Officer may remove/exterminate strayed pigeons upon complaint 5.
### PART 8: CLASS 4 ANIMALS (Wild/Exotic)
* **8.1:** No person shall keep a Class 4 animal within the municipal boundaries.
### PART 9: VACCINATION
* **9.1:** Every dog and cat owner must have their animal vaccinated against rabies annually.
* **9.2:** Proof of vaccination must be provided to the Animal Control Officer.
### PART 10: LICENCING AND IDENTIFICATION
* **10.1 & 10.2:** Owners must register dogs and cats and renew tags annually.
* **10.5:** Tags must be securely affixed to the animal.
* **10.6:** New residents must license animals within 30 days.
* **10.12:** Licences expire on **December 31st** annually.
* **10.15:** Lost tags must be replaced within seven days.
* **Exemptions:** Guide dogs, hearing ear dogs, and working dogs for disabled persons are exempt from fees but must be licensed. Farm cats are exempt from licensing 6.
### PART 11: DOMESTIC CATS
* **11.2:** Cats are prohibited from running at large.
* **11.7:** Cats are not permitted on private property without consent.
* **11.8:** Owners must remove cat excrement immediately.
* **11.9:** Cats must not become a Public Nuisance Animal.
### PART 12: DOMESTIC DOGS
* **12.4:** Dogs are prohibited from running at large.
* **12.9 & 12.17:** Owners must remove and sanitarily dispose of dog excrement immediately anywhere in the Town.
* **12.11:** Leashes must not exceed **2 meters (6 feet, 6 inches)**.
* **12.20:** Dogs must not become a Public Nuisance Animal 7.
### PART 13: IMPOUNDING
* **13.1:** The Animal Control Officer or Police may seize animals running at large.
* **13.6:** Owners may redeem animals within **five (5) days** upon paying maintenance charges and fines.
* **13.10:** If unclaimed after the redemption period, the Poundkeeper may sell, euthanize, or dispose of the animal.
* **13.11:** Animals may be euthanized without delay if injured or for safety/humane reasons.
* **13.15:** Forcible retrieval of an animal from the Poundkeeper or Officer is prohibited 8.
### PART 14: KENNELS/CATTERIES
* **14.1:** Kennels are only permitted in zones designated for breeding/boarding.
* **14.2:** A license is required annually by **January 1st**.
* **14.10 - 14.13:** Regulations regarding floors (impermeable, cleaned daily), lighting (8 hours/day), ventilation, and temperature (min 9°C).
* **14.16:** Yards/runways within 30 meters of an occupied building must be paved, fenced, and cleaned daily 9.
### PART 15: ENFORCEMENT
* **15.1:** Contravention is an offence liable to a penalty under the Provincial Offences Act.
* **15.5:** Second offences within 12 months carry **double** the specified penalty.
* **15.6:** Third/subsequent offences within 12 months carry **triple** the specified penalty.
### SCHEDULE "B": IMPOUNDMENT FEES
* **Dogs:**
+ First 3 days (Licensed): **$15.00**
+ First 3 days (Unlicensed): **$25.00**
+ Each additional day: **$9.00**
* **Cats/Other:**
+ First 3 days: **$10.00**
+ Each additional day: **$3.00** 10
### SCHEDULE "C": KENNEL FEES
* Yearly Kennel/Cattery Licencing fee: **$125.00**11.
