Now therefore the Council of the Corporation of the County of Peterborough hereby enacts as follows: Short Title: 1. This by-law may be cited as the "Parking Regulation By-law". Page 4 of 22 Interpretation Unless otherwise stated: 2. A reference to any statute or regulation refers to a statue or regulation of Ontario as it may be amended or replaced from time to time. 3. A reference to a by-law refers to a by-law of the County or the City of Peterborough as it may be amended or replaced from time to time. 4. The Schedules referred to in this by-law form an integral part of it. Each entry in a column of a Schedule is to be read in conjunction with the entry or entries across from it. 5. Where any expression of time occurs, the time referred to is intended to be the system of time keeping in force in the municipality at the time of application of the by-law. 6. A reference to any statute or regulation refers to a statue or regulation of Ontario as it may be amended or replaced from time to time. 7. If any part of this By-law is determined to be invalid by a court of competent jurisdiction, the invalid part is severed and the remainder continues to be valid. Definitions 8. For the purpose of this by-law: The definitions contained in applicable City of Peterborough by-laws: 20-073, AMP System By-law; 20-076, Enforcement By-law; and 20-077, Hearing Officer By-law. are hereby incorporated by references as applicable to this by-law. To the extent that the above by-laws do not address a matter, the following definitions apply provided that, to the extent of any inconsistency between a definition in a City of Peterborough By-law and any of the following definitions, the definition in a City of Peterborough By-law prevails to the extent of the inconsistency in relation to the inter-municipal service agreement referred to in the recitals to this by-law: "Accessible parking permit" - means a permit issued under the Highway Traffic Act, R.S.O. 1990, c. H.8 (the "Highway Traffic Act"), or a similar permit, number plate or other marker or device bearing the international symbol of access for the disabled and lawfully issued by another jurisdiction. Page 5 of 22 "Accessible parking space" - means a parking space provided under this by-law and identified by an official sign for the exclusive use of a vehicle displaying an accessible parking permit in accordance with the requirements of the Highway Traffic Act. "Authorized sign" - means any sign or other device, which is not an official sign, and which has been placed or erected on a highways, municipal property, or private property under the authority of this by-law. "Bus stop" - means a part of a highway designated by an authorized sign where buses stop to take on or discharge passengers. "City" means the Corporation of the City of Peterborough. "Council" means the Council of the Corporation of the County of Peterborough. "County" means the Corporation of the County of Peterborough. "Commercial motor vehicle" - means a motor vehicle having attached thereto a truck or delivery body and includes an ambulance, hearse, casket wagon, fire apparatus, buses and school buses, and tractors used for hauling purposes on a highway, and notwithstanding the foregoing shall include any and all motor vehicles which have a rated gross vehicle weight which exceeds 3 tonnes (3,000 kilograms or 6,614 pounds) according to the current permit or vehicle registration which has been issued under the Highway Traffic Act, or its foreign equivalent for such vehicle, regardless of the actual weight of such vehicles, but does not include a vehicle operated by or on behalf of the County. "Commercial vehicle loading zone" - means any part of a street or highway designated by an authorized sign as a loading or unloading berth. "Crosswalk" - means: (i) that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the roadway, or (ii) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by school crossing signs (in accordance with the Ontario Traffic Manual - Book 5 Regulatory Signs) or by lines or other markings on the surface thereof, but excludes "pedestrian crossovers". "Director" means the Senior Director of Planning and Public Works, or designate, being the person authorized to give effect to the provisions of this by-law within the County. Page 6 of 22 "Emergency vehicle" means an ambulance, fire department vehicle, or police vehicle. "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof under the jurisdiction of the County. "Loading" means the physical activity of moving merchandise from or to a property or another vehicle and the physical activity of passengers entering or departing a vehicle. "Loading zone" means portion of a highway designated by an official sign, where a commercial motor vehicle may be parked and/or stopped for the purpose of loading or unloading materials or persons. "Municipal Law Enforcement Officer" means a person appointed or employed by the County or the City as a municipal law enforcement officer under section 15 of the Police Services Act, R.S.O. 1990, c. P.15. "Motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated by this By-law, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a streetcar, or other motor vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act. "Officer" means a police officer, police cadet, provincial offences officer, a Municipal Law Enforcement Officer appointed by the Council of the County, a Municipal Law Enforcement Officer appointed by the Council of the City of Peterborough, or any other person appointed by Council by by-law for the purpose of enforcing this by-law or a class of County by-laws. "Official sign" means a sign pursuant to either the Highway Traffic Act or the Manuals of Uniform Traffic Control Devices of Ontario and of Canada approved by the County. "Park" or "Parking" when prohibited means the standing of a vehicle or equipment, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or for receiving or discharging passengers. "Parking permit" means a permit issued by the Director which allows parking in a designated area during a time period when parking may otherwise be prohibited. "Pedestrian" means a person on foot, children in wheeled carriages and a person in a wheelchair powered by muscular power or any other kind of power. "Pedestrian crossover" means any portion of a roadway, at an intersection or elsewhere, designated by this by-law and distinctly indicated for pedestrian crossing Page 7 of 22 by signs on the highway and lines or other markings on the surface of the roadway as prescribed by the regulation of the Highway Traffic Act. "Person" includes any person, firm, partnership, association, corporation, company, or organization of any kind. "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively. "Sidewalk" means any municipal walkway, or that portion of a municipal right of way between the curb line or the lateral line of a roadway and the adjacent property line, primarily intended for the use of pedestrians. "School bus loading zone" means a part of a highway designated by official signs as an area reserved for school purpose vehicles, in accordance with regulations made under the Highway Traffic Act. "School purpose vehicle" means: a. A "school bus" as defined in the Highway Traffic Act; or b. A passenger vehicle used for hire, operated by or under contract with a school board or other authority in charge of a school, including vehicles which are used as transportation service providers to a disabled person. "School crosswalk" means a crosswalk which is established and specifically designated by signs to facilitate the crossing of a highway by school children under the supervision of a school crossing guard. "Stand" or "Standing" means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. "Stop" or "Stopped" or "Stopping" when required, means the complete cessation of movement. "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building machine and any vehicle and/or piece of equipment that is drawn, propelled or driven by any kind of power, including muscular power, but does not include a non-motorized bicycle, motorized snow vehicle or the cars of electric or steam railways running only upon rails. Prohibitions 9. (a) No person shall park a vehicle, including equipment and/or a commercial motor vehicle, on the highways or roadways, or portions thereof within the jurisdiction of the County as provided for in Schedule "A" to this By-law, such areas being designated as "Restricted Parking Zones" without a parking Page 8 of 22 permit. (b) No person shall stand, stop, or park a vehicle, including equipment and/or a commercial motor vehicle, on the highways or roadways, or portions thereof within the jurisdiction of the County as provided for in Schedule "C" to this By-law, such areas being designated as "Restricted Standing/Stopping/ Parking Zones" without a parking permit. (c) No person, other than a school purpose vehicle, shall park a vehicle, including equipment and/or a commercial motor vehicle, on the highways or roadways, or portions thereof within the jurisdiction of the County in a school bus loading zone without a parking permit. (d) No person shall stop a vehicle in such a manner that any part of the vehicle is on or over a sidewalk." Designation of By-law as Administrative Monetary Penalties 10. This by-law is hereby designated as a by-law to which a system of administrative penalties applies, for the purposes of Section 102.1 of the Municipal Act, 2001 and Section 3(1) (b) of the Regulation. Seasonal Parking Prohibition 11. Notwithstanding any other provision of this by-law, and notwithstanding Section 8 above, no person shall park any vehicle, including equipment and/or a commercial motor vehicle, on any of the highways or roadways, or portions thereof within the jurisdiction of the County, between the hours of 11:00 p.m. and 7:00 a.m., between the 15th day of October to the 15th day of May, inclusive. Accessible Parking 12. No person shall park, stand or stop a vehicle on the highway set out in schedule "F" to this by-law, unless that vehicle is operated by a person possessing a valid accessible parking permit issued under Part III of the Highway Traffic Act and such permit is visibly displayed on the vehicle. Loading Zones 13. The driver of a vehicle may cause or permit it to park, stand and/or stop in a loading zone, during the hours the loading zone is in effect, only for a period not exceeding: (a) three (3) minutes for the purpose of loading or unloading passengers, or (b) fifteen (15) minutes while goods or merchandise are actually being loaded or unloaded from the vehicle. Page 9 of 22 14. A separate offence under this by-law is committed at the expiry of each fifteen (15) minutes during which a vehicle is parked, standing and/or stopped in a Loading Zone in violation of this Section. 15. No person shall park and/or stop any vehicle, other than a commercial motor vehicle, in a loading zone on any highway between the limits set out respectively in Columns 1 and 2 of Schedule "D", such areas being designated as "Loading Zones" or during the times or days set out in Column 2. It shall be lawful, however, for the driver of a vehicle to park and/or stop in a loading zone while actually engaged in loading or unloading passengers so long as such parking and/or stopping does not interfere with any commercial motor vehicle about to enter or attempting to use that loading zone. Crosswalks, School Crosswalks and Pedestrian Crossovers 16. No person shall park a vehicle on or within a crosswalk or pedestrian crossover at any time or within six (6) metres of the nearest crosswalk or pedestrian crossover at any time. 17. No person shall stop a vehicle on any highway within twenty (20) metres of a crosswalk or pedestrian crossover when an official sign designating "No Stopping Zone" and an official sign designating "School Crosswalk" have been erected and are on display. 18. When official signs are on display in compliance with the Highway Traffic Act, the highways at locations set out in Columns 1, 2 and 3 of Schedule "E" of this By-law are thereby designated as crosswalks, school crosswalks or pedestrian crossovers; Enforcement 19. This by-law may be enforced by an officer. 20. No person shall hinder or otherwise obstruct, nor attempt to hinder or obstruct, either directly or indirectly, an officer, employee and/or agent of the County in the lawful exercise of a power or duty under this by-law. 21. No person shall provide false information or give a false statement to an officer, employee and/or agent of the County in the lawful exercise of a power or duty under this by-law. Establishment of the Administrative Penalties System 22. The following City of Peterborough by-laws are adopted and incorporated into this by-law by reference, mutatis mutandis (being, with the necessary minor changes for context), to establish the components of an administrative monetary penalty system: 20-073, AMP System By-law; 20-076, Enforcement By-law; and 20-077, Hearing Officer By-law. Page 10 of 22 23. Each screening officer and hearing officer appointed by the City for the administration of its AMP system is hereby appointed by the County for as long as such officer's appointment by the City remains in force. 24. Fees and charges related to the AMP system may be imposed and charged by the City of Peterborough on behalf of the County. Offence and Penalty 25. Every person who contravenes any provision of this by-law is subject to an administrative penalty in the amounts as set out in Schedule "B" to this by-law, for the corresponding prohibited activity. 26. Every person who contravenes any provision of this by-law may be subject to applicable fees and charges as set out in Schedule "B" to this by-law. 27. Where a vehicle has been left parked, stopped or left standing in contravention of this by-law, the owner of the vehicle, notwithstanding that he or she may not have been the driver of the vehicle at the time of the contravention of this by-law, is guilty of an offence and is liable to the fine prescribed for the offence unless, at the time of the offence, the vehicle was stolen from the owner and a report of the theft was filed with the applicable police service. 28. Where a vehicle has been left parked or stopped in contravention of this by-law, the owner of the vehicle, notwithstanding that the owner was not the operator of the vehicle at the time of the contravention of this by-law, is guilty of an offence and is liable to the fine prescribed for the offence. 29. Any amount payable to the County under this by-law may be imposed and collected by the City of Peterborough on behalf of the County. Removal of Illegally Parked Vehicles 30. In addition to any other penalties prescribed herein, an officer may cause a vehicle parked or left in contravention of this by-law to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage, if any, are a lien against the said vehicle which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c. R.25, pursuant to the provisions of the Municipal Act, 2001 and the Highway Traffic Act. 31. A police officer, police cadet, a municipal law enforcement officer, an Officer appointed to carry out the provisions of the Highway Traffic Act, or a Provincial Offences Officer, appointed to carry out the provisions of this by-law may, upon observing any object or vehicles stopped or parked in contravention of this by-law, cause it to be removed, impounded, restrained and/or immobilized, in accordance with the provisions of subsection 170 (15) of the Highway Traffic Act. Towing may occur in addition to any other enforcement mechanism. Page 11 of 22 Limited Exceptions for Emergency Vehicles 32. If compliance is impracticable, sections 9, 11-18 of this By-law shall not apply to (a) Emergency Vehicles; or (b) Vehicles while engaged in works undertaken for or on behalf of the County, the City or other local area municipalities within the County; By-laws Repealed 33. That By-law Nos. 2021-20 and 2021-62 are hereby repealed. Effective Date 34. This by-law shall come into force and effect on the date enacted by Council.
