The Corporation of the City of Peterborough By-Law Number 25-128 Being a By-law to establish User Fees as approved as part of the 2026 Budget process Whereas Section 391 (1) of the Municipal Act, S.O. 2001, c.25, as amended, stipulates that despite any Act, a municipality may pass by-laws imposing fees or charges on any class of persons for services or activities provided or done by or on behalf of it; for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and for the use of its property including property under its control; And Whereas Section 398 (1) of the Municipal Act S.O. 2001, c.25, as amended, states fees and charges imposed by a municipality or local board on a person under this Part constitute a debt of the person to the municipality or local board, respectively; And Whereas Section 398 (2) of the Municipal Act S.O. 2001, c.25, as amended, states the treasurer of a local municipality may add fees and charges imposed by the municipality to the tax roll for the following property in the local municipality and collect them in the same manner as municipal taxes; 1. In the case of fees and charges for the supply of a public utility, the property to which the public utility was supplied; 2. In all other cases, any property for which all of the owners are responsible for paying the fees and charges; And Whereas at its meeting held December 8, 2025, the Council of the City of Peterborough adopted a series of 2026 budget recommendations including a number of fees and charges as set out in Part 5 of the budget book entitled "2026 Budget Book", as amended and as set out in Schedule A to this by-law. Now Therefore, The Corporation of the City of Peterborough by the Council thereof hereby enacts as follows: 1. The 2026 user fees as set out in Schedule A to this by-law are adopted. 2. Simple interest of 1.25% per month may be added on the first day of default and on the first day of each successive month to any fee not paid by the stipulated due date. 3. At the Treasurer's discretion and, where possible, any unpaid fees, including interest, may be added to the tax roll. 4. Subject to section 5, User Fee By-laws 24-084 and 25-007 are repealed. 5. The repeal of User Fee By-laws 24-084 and 25-007 does not affect its previous operation or a right, privilege, obligation or liability that came into existence under it. Without limitation, User fee By-laws 24-084 and 25-007 continues to apply to a service or thing for which User Fee By-laws 24-084 and 25-007 imposed a fee or charge to the extent that such part of the service or thing has been provided to the moment of its repeal. 6.
