Article 2 GENERAL PROVISIONS 674.2.1 Firecrackers - sale - supply - prohibited No person shall by himself/herself, his/her clerk, servant or agent, sell, give or furnish firecrackers to any person within the limits of the Corporation. 674.2.2 Firecrackers - setting off - prohibited No person shall set off firecrackers within the limits of the Corpora- tion. JULY 1991 674.2 PETERBOROUGH 674.2.3 FIREWORKS 674.2.10 674.2.3 Family fireworks - sale - supply - adult only No person shall by himself/herself, his/her clerk, servant or agent, sell, give or furnish family fireworks within the limits of the Corporation to any person other than an adult. 674.2.4 Discharge - family - exhibition - fireworks - adult only No persons other than an adult shall set off family or exhibition fireworks within the limits of the Corporation. 674.2.5 Discharge - family fireworks - children - supervision Notwithstanding Section 674.2.4, children under the supervision of an adult, may set off family fireworks on private property provided the said fireworks are supplied by the said adult. 674.2.6 Discharge - exhibition fireworks - permit - required No person or persons shall set off exhibition fireworks within the limits of the Corporation other than community groups, service clubs, civic organizations or groups of responsible citizens who have first obtained a properly authorized permit from the Peterborough Fire Department so to do. 674.2.7 Permit - issue - safety requirements - compliance Permits will only be issued to those groups set out in Section 674.2.6 provided they comply with all safety requirements established by the Fire Department. 674.2.8 Sale- exhibition fireworks - permit - produced No person shall by himself/herself, his/her clerk, servant or agent sell, give or furnish exhibition fireworks within the limits of the Corpora- tion to any person or persons unless they produce, at the time ofselling, giving or furnishing, a permit issued by the Fire Department. 674.2.9 Business - wholesale - exemption A person or persons in the business of selling firecrackers, family fireworks or exhibition fireworks by wholesale shall be permitted so to do, notwithstanding Section 674.2.1 and the requirements of Sec- tions 674.2.3 and 674.2.8. 674.2.10 Street - highway - park - discharge - prohibited No person shall set off family or exhibition fireworks on any public lane, street, highway, sidewalk, boulevard, park or other public place without first having been granted permission so to do by the Clerk. PETERBOROUGH 674.3 JULY 1991 674.2.11 FIREWORKS 674.4.2 674.2.11 Private property- owner - permission- required No person shall set off family or exhibition fireworks on any private property within the limits of the Corporation without having first been granted permission so to do by the owner or occupant of such property. By-law 1971-77, 5 July, 1971. Article 3 ENFORCEMENT 674.3.1 Fine - for contravention Every person who contravenes this Chapter is guilty of an offence and is liable to the penalty, as prescribed by applicable law, for each offence. By-law 91-116, 22 April, 1991. Article 4 REPEAL - ENACTMENT 674.4.1 By-law - previous By-law 1962-69 is hereby repealed. 674.4.2 Effective date This Chapter shall come into force and take effect upon the passing thereof. By-law 1971-77, 5 July, 1971. Note: Except where otherwise expressly provided in this Chapter, and pursuant to other provincial statutes, such as the Planning Act, the maxi- mum fine for violation of the Code is specified in section 62 of the Provincial Offences Act, R.S.O. 1980, c. 400, which indicates that a party guilty ofan offence is liable to a fine of not more than five thousand dollars ($5000.00).
