## CORPORATION OF THE TOWN OF PETROLIA BY-LAW NUMBER 20-2025
## A By-Law of the Corporation of the Town of Petrolia to provide for regulation of Traffic & Parking in the Town of Petrolia.
WHEREAS the Corporation of the Town of Petrolia has previously provided regulation for Traffic and Parking regulation through Chapter 826 of the Petrolia Municipal Code as adopted on 13th day of July, 1997 through By-Law 47-1992, as amended; and WHEREAS Part Ill, the Municipal Act, S.O. 2001 Chapter 25, as amended provides for specific municipal powers in relation to highways; and WHEREAS the Council of the Corporation of the Town of Petrolia deems it expedient to rescind in whole Chapter 826 of the Petrolia Municipal Code By-law 47- 1992 and to pass a new By-law regulating traffic and the parking of motor vehicles within the limits and municipal highways of the Town of Petrolia; and WHEREAS the Municipal Act, S.O. 2001 Chapter 25, as amended, Sec 11 refers to spheres of jurisdiction respecting matters on Highways, including parking and traffic on highways and parking on public or private property. Permitting By-Laws to prohibit the parking or leaving of motor vehicles on private or municipal property without consent;
WHEREAS by Part IV, Section 55 of The Community Safety and Policing Act, 2019, S.0. 2019 c. 1, schedule 1, as amended; A municipality may appoint persons to enforce the by-laws of the municipality. Municipal by-law enforcement officers appointed under this section are peace officers for the purpose of enforcing municipal by-laws.
NOW THEREFORE the Council of The Corporation of the Town of Petrolia enacts as follows:
## DEFINITIONS
## 1. In this By-Law,
a) "ATV" means an all-terrain vehicle and for the purpose of this By-Law includes all offroad motorized vehicles (ORV);
highway and the roadway, excluding sidewalks and driveways;
b) "Boulevard" means that portion of every highway between the boundaries of the the transportation of persons;
c) "Bus" means a motor vehicle designed for carrying ten or more passengers and used for d) "By-law Enforcement Officer" means a duly appointed By-law Enforcement Officer for the Town of Petrolia and includes a police officer;
e) "Commercial motor vehicle" means a motor vehicle having attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses, and tractors used for hauling purposes on the highway;

h) "Dangerous goods" means any product, substance or organism included by its nature or by the regulations in any of the classes listed in the schedule to the Dangerous Goods Transportation Act, RS.O. 1990, Chap. D.1 as amended from time to time;

k) "Front yard" means the open area of a parcel of land between a building and a highway;
m) "Heavy traffic" means the use of a highway by a vehicle, object or contrivance for moving loads having a gross weight, including the vehicle, object or contrivance, in excess of five tons;
n) "Highway" means a publicly designated road allowance, including but not limited to a common and public highway, street, alley, avenue parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for or used by the general public for the passage of pedestrians and vehicles;
o) "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then of the lateral boundary lines of two or more highways that joint one another at an angle, whether or not one highway crosses the other;
or not, except when standing temporarily for the purpose of and while actually engaged
p) "Park or parking" when prohibited, means the standing of a vehicle, whether occupied in loading or unloading merchandise or passengers;

s) "Roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic but does not include the shoulder, and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively;
t) "Sidewalk" means that portion of a highway between the curb lines, or the lateral lines of a roadway and the adjacent property lines, intended for the use of pedestrians;
u) "Stand or standing" when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers;
v) "Stop or stopping," when prohibited, means a complete cessation of movement, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal;

x) "Through highway" means a highway or part of a highway designated as such by the Minister of Transportation or by by-law of the Council; every such highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry of Transportation;
y) "Town" means the Corporation of the Town of Petrolia.
z) "Traffic" includes pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together while using any street for the purpose of travel;
aa) "Traffic control device" means any sign or roadway, curb or sidewalk marking, or other device erected or placed under the authority of the Municipal Council for the purpose of guiding or directing traffic;
bb) "Traffic signal" means any device manually, electrically or mechanically operated for the regulation of traffic;

cc) "Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a sidecar attached to a motorcycle and shall be considered a separate vehicle and not part of the motor vehicle by which it direction;
dd) "U-turn" means to turn a vehicle within a roadway so as to proceed in the opposite steam railways running only upon rails;
ee) "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, roadbuilding machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or the cars of electric or
## OBEDIENCE TO TRAFFIC REGULATIONS
2. By-law Enforcement Officer to Enforce By-law a) The By-law Enforcement Officer of the Town of Petrolia shall enforce this By-law and may engage the Ontario Provincial Police for aid and advice.
3. Obedience of Traffic Signs and Signals b) Every person shall promptly obey all signals given either by a Police Officer, By-law Enforcement Officer, or by a traffic control device or a traffic signal.
## PARKING RESTRICTIONS
## 4. Method of Parking
- unless the right front and right rear wheels or runners are parallel to and distant respectively not more than fifteen centimetres from the edge of the roadway;

b) Angle - Where angle parking is permitted, no person shall park a vehicle except at an angle of forty-five degrees to the edge of the roadway with the front end of the vehicle at the edge of the roadway.

6. Parking Prohibited - Vehicles No Parking in Unposted Locations:
a) No person shall park a vehicle in any of the following places:
On a sidewalk or on any road, boulevard or driveway so as to obstruct a sidewalk;
In front of a public or private driveway;
Within an intersection;
Within 30 metres approaching and 30 meter preceding a light controlled crosswalk;
Within 3.1 metres of a point on the curb or edge of the roadway nearest any fire
hydrant;
On any street in such a manner as to obstruct traffic; In such a position as will prevent the convenient removal of any vehicle previously parked or left standing;
On any boulevard.

On any paved shoulder intended to be used as a recreational trail or multi-use one indicating "no parking," or where heavy trucks are prohibited;

No person shall leave any vehicle parked on a highway for a period of more than

7. Parking Prohibited - Commercial Motor Vehicles a) No person shall park a commercial vehicle more than 6.1 metres in length on any municipal road allowance or upon any lands owned or leased by the Corporation of the Town of Petrolia except for the following;
Commercial motor vehicles greater than 6.1 meters shall be permitted to park on James Street between the Eureka Street intersection to the Centre Street intersection at any time up to a maximum two-hour time limit. Commercial motor vehicles greater than 6.1 meters shall be permitted to park within areas designated and signed as commercial loading zones at any time up to a maximum two-hour time limit provided, they are delivering or picking up from adjacent businesses.
b) No person shall park a commercial motor vehicle that carries dangerous goods on any municipal road allowance or upon any lands owned or leased by the Corporation of the Town of Petrolia. Should there be a requirement for an exception a person may apply forty-eight (48) hour in advance to the Municipal Clerk for consideration.
8. Parking Prohibited - Derelict Vehicles a) No person shall at any time park a derelict vehicle on any highway in the Town of Petrolia.
9. Parking Prohibited - Marine Vehicles, Commercial Trailer, Recreational Trailer

## 18. No Stopping
a) No person shall stop a vehicle or any part of a vehicle where an official "No Stopping"
sign has been erected.
## ENFORCEMENT
19. General Penalty a) This By-law may be enforced by any enforcement officer;

b) Enforcement officers are hereby authorized to enforce the provisions of this by-law on the highways within the municipality that are under the jurisdiction and control of the Town Except as otherwise expressly provided by this By-law or the Highway Traffic Act, every person is guilty of an offense and is subject to the provisions of the Provincial Offences Act. R.S.O. 1990, Chapt. P. 33, as amended if they:
contravene any provision of this By-law; or are the owner of a vehicle that is parked or stopped in contravention of this By-

Illegally Parked Vehicles a) Where a vehicle has been parked or stopped in contravention of this By-law, the owner of the vehicle, notwithstanding that they were not the driver of the vehicle at the time of the contravention of this By-law, is guilty of an offence and is liable to the fine prescribed unless, at the time of the offence, the vehicle was in possession of some other person without the owner's consent, the proof of which rests on the owner of the vehicle.
21. Parking Infraction Notice a) Where a vehicle is found parked in contravention of the provisions of this By-law, the Bylaw Enforcement Officer finding the vehicle, shall serve a parking infraction notice as provided for in the Provincial Offences Act, R.S.O. 1990, Chapt. P. 33, as amended.
b) The parking infraction notice shall allow for the addition of an administration fee.
22. Any and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, Chapter. R. 25, as amended, move or take a motor vehicle from its place of storage or impoundment until No person, except under the authority of a By-law Enforcement Officer, shall all costs and charges constituting a lien upon the motor vehicle under this By- law have been paid.
## GENERAL PROVISIONS
