## THE CORPORATION OF THE TOWN OF PLYMPTON-WYOMING ## By-Law 72-2018 ## A By-law for the Regulation of Traffic and Parking "The Traffic and Parking By-Law" ****************** WHEREAS it is deemed expedient to rescind By-law No. 110 of 2001 and By-law No.47 of 2004 of The Corporation of the Town of Plympton-Wyoming and to pass a new By-law regulating traffic and the parking of motor vehicles within the limits of the Town of Plympton-Wyoming on municipal highways; AND WHEREAS the Municipal Act, S.O. 2001 Chapter 25, as refers to all and any Parking Matters on public or private property, By-laws may be passed prohibiting the parking or leaving o motor vehicles on private or municipal property without consent IND WHEREAS by Section 15 of The Police Services Act, R.S.O. 1990, C. P. 15, as amender unicipal By-law Enforcement Officers may be appointed who shall be peace officers for th purpose of enforcing the By-laws of the Municipality; NOW THEREFORE the Council of The Corporation of the Town of Plympton-Wyoming enacts as follows: ## DEFINITIONS 1. In this By-Law, - a) "alley" means a public thoroughfare which affords only a secondary means of access for vehicular traffic to abutting lots and which is not intended for general traffic circulation; - b) "ATV" means an all-terrain vehicle and for the purpose of this By-Law includes all off road motorized vehicles. - c) "bus" means a motor vehicle designed for carrying ten or more passengers and used for the transportation of persons; - d) "By-law Enforcement Officer" means a duly appointed By-law Enforcement Officer for the Town of Plympton-Wyoming and includes a police officer; - e) "commercial motor vehicle" means a motor vehicle having attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses, and tractors used for hauling purposes on the highway; 7. f "corner" means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic; - g) "Council" means the Council of The Corporation of the Town of Plympton-Wyoming; - h) "dangerous goods" means any product, substance or organism included by its nature or by the regulations in any of the classes listed in the schedule to the Dangerous Goods Transportation Act, RS.O. 1990, Chap. D.1 as amended from time to time; - i) "gross weight" means the combined weight of vehicle and load; - "heavy traffic" means the use of a highwav by a vehicle excess of five tons; - k) "highway" includes a common and public highway, street, alley, avenue parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for or used by the general public for the passage of vehicles; - 1) "intersection" means the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then of the lateral boundary lines of two or more highways that joint one another at an angle, whether or not one highway crosses the other; - m) "park or parking" when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; - n) "pedestrian" includes an invalid or child in a wheelchair or carriage; - o) "police officer" means a member of a police force of the Ontario Provincial Police; - p) "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic but does not include the shoulder, and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively; - q) "sidewalk" means that portion of a highway between the curb lines, or the lateral lines of a roadway and the adjacent property lines, intended for the use of pedestrians; - r) "stand or standing" when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers; - s) "stop or stopping," when prohibited, means a complete cessation of movement, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal; - t) "street" means a Highway; - U) "through highway" means a highway or part of a highway designated as such by the Minister of Transportation or by by-law of the Council; every such highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry of Transportation; - v) "traffic" includes pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together while using any street for the purpose of travel; - w) "traffic control device" means any sign or roadway, curb or sidewalk marking, or other device erected or placed under the authority of the Municipal Council for the purpose of guiding or directing traffic; - x) "traffic signal" means any device manually, electrically or mechanically operated for the regulation of traffic; - y) "trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a sidecar attached to a motorcycle and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn; - z) "U-turn" means to turn a vehicle within a roadway so as to proceed in the opposite direction; - aa) "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, roadbuilding machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails; - bb) "Village" means the limits of the former Corporation of the Village of Wyoming. ## OBEDIENCE TO TRAFFIC REGULATIONS 2. By-law Enforcement Officer to Enforce By-law - The By-law Enforcement Officer of the Town of Plympton-Wyoming shall enforce this Bylaw and may engage the Ontario Provincial Police for aid and advice. 3. Obedience of Traffic Signs and Signals - Every person shall promptly obey all signals given either by a police officer, By-law Enforcement Officer, or by a traffic control device or a traffic signal. ## PARKING RESTRICTIONS ## 4. Method of Parking - a) Parallel - No person shall park a vehicle on any street other than a one-way street unless on the right-hand side of the street having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheels or runners are parallel to and distant respectively not more than fifteen centimetres from the edge of the roadway, provided that this provision shall not apply where angle parking is specifically permitted in this By-law, and appropriate signs have been erected and are on display; - b) Angle - Where angle parking is permitted, no person shall park a vehicle except at an angle of forty-five degrees to the edge of the roadway with the front end of the vehicle at the edge of the roadway. 5. Parking Prohibited - Vehicles - a) In Specified Places - No person shall park a vehicle in any of the following places: - i. On a sidewalk or on any road, boulevard or driveway so as to obstruct a sidewalk; - ii. In front of a public or private driveway; - iv. Within 30 metres approaching and 30 meter preceding a light controlled crosswalk; - iii. Within an intersection; - V. Within 3.1 metres of a point on the curb or edge of the roadway nearest any fire hydrant; - vii. In such a position as will prevent the convenient removal of any vehicle previously parked or left standing; - vi. On any street in such a manner as to obstruct traffic; - vili. On any boulevard on Broadway Street (County Road No. 21); - ix. On any paved shoulder intended to be used as a recreational trail or multi-use path; - x. In contravention of a sign, temporarily or posted permanently, including one indicating "no parking," or where heavy trucks are prohibited; - xi. Within 8 metres of the entrance to a Fire hall, or in a fire route; 12. Xii. In an area marked as being an accessible zone; ## 6. Parking Prohibited -Commercial Motor Vehicles - a) No person shall park a commercial vehicle in excess of 6.1 metres in length on any municipal road allowance or upon any lands owned or leased by the Corporation of the Town of Plympton-Wyoming with the exception of the following; - i. Commercial motor vehicles greater than 6.1 meters shall be permitted to park on Broadway Street (County Road No. 21) from the Plympton Street intersection north to the Ontario Street intersection at any time up to a maximum two-hour time limit. - ii. Commercial motor vehicles greater than 6.1 meters shall be permitted to park within areas designated and signed as commercial loading zones at any time up to a maximum two-hour time limit provided they are delivering or picking up from adjacent businesses. The following areas are designated as commercial loading zones: 4. (a) The north side of Niagara Street adjacent to 623 Broadway Street 5. (b) The alley west of Broadway Street from Main Street north to the southern-most property line of 546 Niagara Street - b) No person shall park a commercial motor vehicle that carries dangerous goods on any municipal road allowance or upon any lands owned or leased by the Corporation of the Town of Plympton-Wyoming with the exception of the following: - i. Parking of a commercial motor vehicle carrying dangerous goods shall be restricted to a one-hour time limit on Broadway Street (County Road No. 21) from the Plympton Street intersection north to the Ontario Street intersection for the purpose of conducting personal business (such as lunch breaks); 7. Parking Prohibited - Derelict Vehicles - a) No person shall park a derelict vehicle on any road or street at any times of the year. A derelict vehicle for the purpose of this by-law shall mean any inoperable vehicle or one that has an improper or expired vehicle license. 8. Parking Prohibited - Marine Vehicles, Commercial Trailer, Recreational Trailer - a) No person shall park a marine vehicle, commercial trailer, camping trailer or other recreational trailer on Town or County road at any time, when not attached to a legally parked licensed vehicle. ## OPERATION OF VEHICLES 9. Parking Restrictions on Alleys - a) No person shall park a vehicle on: - i. the alleys running north and south, east of Broadway Street and west of Toronto Street from Thames Street to Main Street and from Front Street to Plympton Street; - ili. the alley running north and south, west of Broadway Street and east of London Street between Thames Street and Ontario Street. - ii. the alley running north and south, west of Broadway Street and east of London Street from Niagara Street to Main Street; 10. Funeral and Other Processions - a) No person shall intersect a funeral or other properly authorized procession while it is in motion, except under the direction of a police officer; - b) The driver of a vehicle in a funeral or other procession shall drive as near to the right hand edge of the roadway as practicable and follow the vehicle ahead as close as is practicable and safe. "Traffic and Parking By-Law" ## 11. Detours and Closed Roads No person shall operate a vehicle on streets under construction or reconstruction where appropriate signs have been erected and are on display indicating the road is closed to traffic. ## 12. ATV's ATV's and all off-road motorized vehicles are prohibited from all Municipal road allowances, highways, Municipal Parks and public property. ## HEAVY TRUCK TRAFFIC 13. When appropriate signs have been erected and are on display, heavy traffic is prohibited. 14. The provisions of this Part shall not extend to use of the said highways or parts of highways for deliveries to or removals from any premises abutting thereon, to ambulances, to police or fire department vehicles, to a privately owned vehicle driven to or from the owner's residence abutting thereon, to tradesmen or other general contractors engaged in their business or trade tentatively at the premises, or to vehicles actually engaged in works undertaken for or on behalf of the Corporation of the Town of Plympton-Wyoming. ## PARKING RESTRICTIONS IN MUNICIPAL PARKS AND VARIOUS WATERFRONT ACCESS POINTS 15. There will be "no parking" at any Municipal Park and/or Municipal Waterfront Access Points between the hours of 10:00 p.m. and 6:00 a.m. EST. ## OFFICIAL SIGNS 16. Placement and Management of Official Signs - a) Where reference is made in this By-law to official signs, the posting of such signs is hereby authorized; - b) No person shall move, remove, interfere with or deface an official sign; - c) No person shall erect or maintain any sign or facsimile thereof which may conflict or be confused with an official sign; and - d) No person shall erect or maintain any unauthorized sign marking or other device attempting or purporting to control or regulate traffic or parking. ## 17. Placement and Management of Stop Signs - a) Intersections on highways in the Town of Plympton-Wyoming set out in Column 1 on Schedule "A" are designated as intersections where stop signs shall be erected at the locations shown in Column 2 on Schedule "A." ## ENFORCEMENT ## 18. General Penalty - (a) This By-law may be enforced by any enforcement officer; - (b) Enforcement officers are hereby authorized to enforce the provisions of this by-law on the highways within the municipality that are under the jurisdiction and control of the Town of Plympton-Wyoming; - (c) Except as otherwise expressly provided by this By-law or the Highway Traffic Act, every person is guilty of an offense and is subject to the provisions of the Provincial Offences Act. R.S.O. 1990, Chapt. P. 33, as amended if they: - i. contravene any provision of this By-law; or - її. are the owner of a vehicle that is parked or stopped in contravention of this By-law; ## 19. Illegally Parked Vehicles Where a vehicle has been parked or stopped in contravention of this By-law, the owner of the vehicle, notwithstanding that he/she was not the driver of the vehicle at the time of the contravention of this By-law, is guilty of an offence and is liable to the fine prescribed unless, at the time of the offence, the vehicle was in possession of some other person without the owner's consent, the proof of which rests on the owner of the vehicle. ## 20. Parking Infraction Notice Where a vehicle is found parked in contravention of the provisions of this By-law, the Bylaw Enforcement Officer finding the vehicle shall serve a parking infraction notice as provided for in the Provincial Offences Act, R.S.O. 1990, Chapt. P. 33, as amended. ## 21. Tow Away Provisions In addition to any other penalties provided for in this By-law, any By-law Enforcement Officer, upon discovering a vehicle parked or stopped in contravention of this By-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, Chapter. R. 25, as amended, and no person, except under the authority of a By-law Enforcement Officer, shall move or take a motor vehicle from its place of storage or impoundment until all costs and charges constituting a lien upon the motor vehicle under this By-law have been paid. ## GENERAL PROVISIONS ## 22. Headings Not Part of By-law The headings in the body of this By-law form no part of the By-law but are inserted for convenience of reference only. ## 23. Gender and Number Reference in this By-law to masculine gender includes the feminine, and reference to the singular includes the plural as determined by the context. ## 24. Schedules The schedule(s) attached to this By-law shall form part thereof. ## 25. Deviation from Forms Where a form or words or expressions are prescribed in any schedule to this By-law, deviations therefrom not affecting the substance or calculated to mislead shall not invalidate such forms, words, or expressions or any parking infraction notice in which they appear. ## 26. Conflict with Highway Traffic Act In the event of conflict between the provisions of this By-law and the Highway Traffic Act, the provisions of the Act prevail. ## 27. Severability If any section or sections of this By-law or parts thereof may be found by any court to be illegal or beyond the power of Council to enact, such section or sections or parts thereof shall be deemed to be severable and all other sections of parts of this By-law shall be deemed to be separate and independent therefrom and continue in full force and effect unless and until similarly found and this By-law shall be enacted as such. ## REPEAL OF PREVIOUS BY-LAWS 1. P. 33, as amended ## CORPORATION OF THE TOWN OF PLYMPTON-WYOMING ## BY-LAW 4 OF 2021 Beina a By-Law to Amend By-Law 72 of 2018 to Prohibit Overnight Parking on Roads from 11 p.m. to 5 a.m. from January 7'h 2021 to March 15th 2021 and from November 15th to March 15th Each Year After. WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 (the "Act"), refers to all and any parking matters on public or private property; AND WHEREAS By-law No. 72 of 2018 (the "By-Law"), govems the Regulation of Traffic and Parking for The Corporation of the Town of Plympton-Wyoming ("Plympton-Wyoming"); AND WHEREAS the Council of the Town of Plympton-Wyoming considers it desirable to prohibit overnight parking from 11 p.m. to 5 a.m. during specific winter months so that winter maintenance can be completed allowing for safe travel for the public and access by emergency services throughout the Town. NOW THEREFORE the Council of The Corporation of the Town of PlymptonWyoming enacts as follows: 1. The By-Law is hereby amended by adding thereto a new section 5. b) that reads as follows: ## 5. Parking Prohibited - Vehicles ## b) In Specified Times - No person shall park or leave a vehicle on a highway, road or street in such a manner as to interfere with the clearing of snow or any winter control operation by municipal forces or contracts during the hours of 11 p.m. and 5 a.m. from January 7'h 2021 - March 15"h 2021 and November 15'h - March 15" each year after. Vehicles that are not in compliance will be given a first time written warning and then towed if still not in compliance. Section 21 of the By-law refers to the Tow Away Provisions. Official notice will be provided by placing the notice shown schedule 'A' to this By-law on the vehicle under the windshield wiper. By-law Enforcement staff will take a picture of the notice on the vehicle and the vehicles license plate and together these photos will be deemed as official service. 2. By-Law 72 of 2018 as amended is hereby ratified and confirmed in all other respects. 3.
