THE CORPORATION OF THE VILLAGE OF POINT EDWARD BY-LAW NUMBER 26 OF 2024 BEING A BY-LAW TO ESTABLISH FEES AND CHARGES FOR THE VILLAGE OF POINT EDWARD WHEREAS Section 391 of the Municipal Act 2001, S. O. 2001, c. 25 as amended authorizes a municipality to pass by- laws imposing fees or charges on persons for services and activities provided or done by or on behalf of it, for costs payable by it for services or activities provided or done by or on behalf of any other municipality or any local board; and for the use of its property including property under its control; and WHEREAS Section 69 of the Planning Act. S. O. 1990, P. 13 as amended. Permits the Council of a municipality to pass by-laws to establish a tariff of fees for the processing of applications made in respect of planning matters; and WHEREAS Section 7 of the Building Code Act, S. O. 1992 c.23, as amended, permits the Council of a municipality to pass by- laws to require the payment of fees on applications for and on the issuance of permits and prescribing the amounts thereof; NOW THEREFORE, the Council of the Village of Point Edward enacts as follows: THAT fees and charges be imposed in accordance to the attached; Schedule A--Administration Schedule B-- Building and By-Law Schedule C-- Fire Services Schedule D-- Planning and Development Schedule E-- Recreation Schedule F-- Water and Wastewater THAT no person shall engage in or carry on any of the occupations included within Schedules A thru F within the Village of Point Edward unless and until the person has obtained from the Clerk a licence authorizing the occupation or business, and has paid the fee set out in respect to such licence according to Schedules A thru F. THAT the Village may charge double the established fee in cases where work commences prior to obtaining the appropriate permit or license. THAT a transient trade shall apply for a licence no later than thirty( 30) days prior to the event that the transient trader intends on holding for the sale of goods, wares or merchandise. THAT the fees and charges established by this by-law shall be due and payable in full, without discount by cheques or cash at the time of submitting an application or prior to the request for service. THAT all licences issued under this By-Law, unless otherwise stated, expire 30 days after the issuance of the licence. THAT any required inspections to operate the business or occupation licenced be the sole responsibility of the person applying for the licence. THAT prior to obtaining a licence the applicant shall provide to the Clerk a Certificate of Insurance showing that the occupation or business is covered by Insurance for public liability and property damage in the amount required by the Clerk, but not less than Two Million ($2, 000, 000. 00) dollars per occurrence. Said insurance shall hold harmless and indemnify the Village of Point Edward in all respects in the operation of said occupation or business should the Clerk request such insurance. THAT the fees or charges imposed by this by-law that are unpaid as required by this by- law are subject to an additional penalty charge calculated at 1. 25% per month or any part thereof THAT the fees and charges established by this by-law shall be collectable by adding the costs to the tax roll and collecting them in the same manner as property taxes. THAT this by- law shall come into force and take effect on October 22, 2024. THAT By-Law 17 of 2023 and any other pertinent By-Laws be repealed upon passing of this By- Law. THAT the fees established in this By-Law be reviewed at the regular Finance Committee Meeting held in September of each calendar year, at a minimum and THAT any fees may be reviewed at any other time throughout the year that Council sees fit.
