## THE CORPORATION OF THE CITY OF PORT COLBORNE ## BY-LAW NO.\_ 6116/82/14 ## BEING A BY-LAW TO ESTABLISH A PERMITTING SYSTEM FOR THE PARKING OF VEHICLES ON DESIGNATED HIGHWAYS WITHIN THE CITY OF PORT COLBORNE WHEREAS Section 11 of the Municipal Act 2001, S.O. 2001 c.25, as amended (the "Act") provides that by-laws may be passed by the Councils of local municipalities within the jurisdiction of highways, including parking and traffic on highways; AND WHEREAS the Council of the Corporation of the City of Port Colborne deems it expedient to allow the parking of motor vehicles on certain designated highways within the City of Port Colborne: ## NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PORT COLBORNE enacts as follows: ## 1. DEFINITIONS In this By-law: - (a) "Director" means the Director of Planning and Development Services for the Corporation of the City of Port Colborne, or his or her designate. - (b) "Park" means the stopping or standing of a vehicle, whether occupied or not, and "Parking" or "Parked" shall bear a similar meaning as the tense allows; - (c) "Police Officer" means a constable, any Municipal Law Enforcement Officer or any person appointed for enforcing or carrying out the provisions of this by-law; - (d) "On-Street Parking Permit" means a permit issued by the City to park a vehicle on the streets or parts of street specified on the permit during the times authorized herein; - (e) "Street" means any public highway or part of a public highway under the jurisdiction of the Corporation of the City of Port Colborne; - (f) "Vehicle" shall have the meaning defined in The Highway Traffic Act, R.S.O. 1990, c. H.8 ## 2. ADMINISTRATION - 2.1. The Director is hereby authorized to issue or renew permits on behalf of the City pursuant to the provisions of this By-law and any renewal of a permit may be issued and directed by the said Director. - 2.2. The authority of the Director pursuant to this By-law is specific to the designated areas on the streets or parts of streets as set out in Columns 1, 2, 3 and 4 on Schedule "A" to this By-law. - 2.3. Every application for a permit hereunder shall be in the form provided by the City and shall contain the following information: - (a) Name and Address of applicant; - (b) Name and Address of the registered owner of the vehicle; - (c) The Licence Plate Number, make and year of the vehicle; - (d) A statement that the said registered owner of the vehicle is, at the date of the application, a resident at the property for which the permit is issued - (e) The fee as set out in Schedule "B" to this By-law. In the event of the owner of a permit changing address or having the permit revoked there will be no refund available. - 2.4. A parking permit issued under this By-law in relation to a specific location shall only be issued to a registered owner who is a resident of that location and will not be valid for any other vehicle. - 2.5. Every permit holder shall, within seven (7) days of changing his or her address, return the parking permit to the Director. - 2.6. Every permit shall be valid for a period of one year from the date of issuance. - 2.7. Every permit shall be valid only for the area designated within the permit and for no other area. - 2.8. Whenever in this by-law a time of day or hour is referred to, the same shall be construed in accordance with Standard Time or Daylight Saving Time, as may be in current official use in the Region. ## 3. PARKING PERMITS - 3.1. Every person who is an owner or an occupant of a property located on the streets listed in Column 1 of Schedule "A" to this By-law shall be entitled to one parking permit for a registered vehicle. A separate permit is required for each vehicle registered at a designated address. - 3.2. A permit issued under this By-law will exempt only that vehicle for which the permit has been issued, from the provisions of By-law No. 89-2000, Section 207.01, and Schedule "E", Parts 3, 4 and 5 as they apply to the areas described in Schedule "A" attached thereto, with respect to restricting parking for limited periods of time during stated hours. All other provisions which apply to the roadway as contained in By-law No. 89-2000 for The Corporation of the City of Port Colborne, as amended, and regulations dealing with maximum parking periods as well as other emergency parking by-laws shall still apply. - 3.3. Every person shall ensure that a permit issued under this By-law is placed or affixed to the vehicle in the windshield area, in a prominent location when the vehicle is parking pursuant to the permission granted by this By-law. - 3.4. The lawful directions of a Police Officer for the regulation of traffic on a street shall be obeyed notwithstanding any provision of this Bylaw, and nothing in this By-law shall affect the power of The Corporation of the City of Port Colborne to regulate traffic and the parking of vehicles. - 3.5. Any permit issued under this By-law may be revoked by the City at any time. ## 4. PENALTIES - 4.1. When Official Signs are on display, no person shall park a vehicle or permit a vehicle to remain parked on any highway, at the side, between the limits, and during the times and days set out respectively in Columns 1, 2, 3, and 4 of Schedule 'C' of this by-law without an On-Street Parking Permit displayed in accordance with this By-law. - 4.2. Every person who contravenes a provision of this By-law is guilty of an offence. - 4.3. This By-law is designated as a by-law to which the City's Administrative Penalty By-law applies. - 4.4. Any person who permits a vehicle to be parked, stopped or standing contrary to this By-law and each owner of a vehicle, when given a Penalty Notice in accordance with the City's Administrative Penalty By-law, is liable to pay to the City an administrative penalty in the amount specified in Schedule "C" to this By-law for each day or part of a day on which the contravention continues. ## 5. SHORT TITLE - 5.1. The Short Title of this By-law is "On-Street Parking Permit By-law" READ A FIRST, SECOND AND THIRD TIME AND FINALLY P 11TH DAY OF AUGUST, 2014.
