## THE CORPORATION OF THE TOWN OF PRESCOTT
## BY-LAW NO. 47-2017
## A BY-LAW FOR THE REGULATION OF TRAFFIC AND PARKING WITHIN THE CORPORATION OF THE TOWN OF PRESCOTT
WHEREAS pursuant to the provisions of Part II Section 11 (3) and (8) of the Municipal Act 2001, S.O. 2001 c. 25 as amended, provides that a municipality may enact by-laws to regulate and govern parking of vehicles on highways or portions thereof; and
WHEREAS subsection Section 102 of the Municipal Act 2001, S.O. 2001 c. 25 authorizes Councils of municipalities to pass by-laws designating accessible parking spaces and to prohibit the use of such spaces by other vehicles; and
WHEREAS the Council of the Corporation of the Town of Prescott deems it expedient to regulate and control parking of vehicles in the municipality by enactment of this by-law;
## SECTION 1 - DEFINITIONS
- 1) Accessible Parking Permit, means a permit issued under the Highway Traffic Act or a numbered license plate or other marker or device issued by another Provincial jurisdiction and recognized under the Highway Traffic Act.
- 2) Authorized Emergency Vehicle, means:
- i. A fire department vehicle, including an emergency crash extraction vehicle, while proceeding to or returning from a fire or emergency call;
- ii. A vehicle while used by person in the lawful performance of his duties as police officer;
- ill. An ambulance or cardiac arrest emergency vehicle while responding to an emergency call or being used to transport a patient or injured person in an emergency situation; or
- iv. An emergency vehicle of a public or private utility, or Federal, Provincial or Municipal Department when such a vehicle is being used in the performance of emergency duties.
- 3) Authorized Sign, means any parking or traffic control device or traffic signal placed or erected on a highway under the authority of this by-law for the purpose of regulating, warning or guiding traffic and includes such signs as described in the regulation made pursuant to the Highway Traffic Act, R.S.O 1990, c. H8, as amended.

- 4) Boulevard, means that part of the highway situated between the curb line and property line of the lot abutting the highway, but does not include a sidewalk, shoulder, or combined facility, if any.
- 5) Bicycle, means any cycle propelled by human power on which a person may ride, regardless of the number of wheels it has.
- 6) Bylaw Enforcement Officer, means a Bylaw Enforcement Officer for the Town and any other officer authorized for the Town for the enforcement of by-laws in the Town.
- 7) Commercial Motor Vehicle, means a motor vehicle that by its type of construction nd equipment is designed for, and capable of transporting, whether for paymer r not: (1) nine or more persons, including the driver: and 2) commercial good intended to be of service to a business or industry.
- 8) Community Safety Zone means a roadway or a portion of a roadway designated as such under this by-law and signed pursuant to the regulations of the Highway Traffic Act
- 9) Controlled Parking Area, means the parking lots or parts of parking lots which are controlled and regulated by parking machines or signs.
- 10) Corner, means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic.
- 11) Council, means the Council of the Corporation of the Town of Prescott.
- 12) Crosswalk, means:
- i. That part of the highway at an intersection that is included within the confines of the lateral lines of the sidewalk on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or
- ii. Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface.
- 13) Cul-De-Sac, means a highway terminating in a turn around.
- 14) Curb, shall include the edge of the traveled portion of the highway.
- 15) Curb Line means:
- i. Where a curb has been constructed the line of the curb; or
- ii. Where no curb has been constructed the edge of the roadway.
- 16) Designated Building, means an apartment building, hospital, hotel, motel, shopping centre, industrial building and municipal facility and any other structure which is used for the accommodation of public or for the gathering or assembling of people.
- 17) Designate, means the person appointed by the Chief Administrative Officer to represent the Town in the absence of the Director of Public Works and Infrastructure.
- 18) Designated Officer, means a Bylaw Enforcement Officer.
- 19) Director of Public Works and Infrastructure, means the person appointed by the Council of the Town of Prescott to manage the Public Works and Infrastructure department.
- 20) Driver, means a person who drives a vehicle on a highway.
- 21) Driveway, means the improved land on a highway which provides vehicular access from the roadway to adjacent land.
- 22) Fire Access Route, means any road, driveway, lane, ramp, or other means of vehicular access or egress and shall conform to the requirements of the Ontario Fire Code Act and Regulations thereto, as amended.
- 23) Fire Access Route Sign, means a permanently legible sign, approved by the Fire Chief placed at intervals along the fire access route.
- 24) Fire Chief, means the Fire Chief of the Corporation of the Town of Prescott and any person or persons as appointed by the Fire Chief or under his command and supervision and any person or persons designated by him as may be required from time to time, or the officer in charge of the municipality's fire department
- 25) Heavy Trucks, means a commercial motor vehicle having a weight when unloaded of 3 tonnes or more, or when loaded of 5 tonnes or more, but does not include a passenger vehicle, an ambulance, a vehicle of the Police or Fire Departments, a municipal vehicle, a bus operated by or for the Board of Education, a bus operated by or for the municipality, a bus operated by a company having a franchise from the municipality when operating on routes as approved by by-law, or a commercial vehicle making a delivery to or a collection from a bona fide destination which cannot be reached via highway or highways upon which the heavy traffic is not prohibited by the by-law.
- 26) Highway, includes a common public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles.
- 27) Highway Traffic Act, means unless modified or changed herein, words or expressions used in this by-law have the same meaning as given or used in the Highway Traffic Act, R.S.O. 1990 c. H8, as amended.
- 28) Hotel/Motel, means a building or part of a building in which a minimum of six (6) rooms are rented for gain on a temporary or transient basis
- 29) Industrial Building, means a building or structure for the purpose of manufacturing, assembling, making, preparing, inspecting, ornamenting, finishing, treating, altering, repairing, warehousing, storing or adapting for the sale of any goods, substance, article, thing, or any part thereof and the storage of building and construction equipment and materials.
- 30) Intersection, means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other.
- 31) Island, means a portion of a highway so constructed or designed to separate or direct vehicular traffic onto specific portion of the highway.
- 32) Issuing Officer, means a Provincial Offences Officer.
- 33) Median Strip, means that portion of a highway so constructed as to separate traffic traveling in one direction from traffic traveling in the opposite direction by a physical barrier or an unpaved strip of ground.
- 34) Motor Vehicle, includes an automobile, motorcycle, motor assisted bicycle, unless otherwise indicated in this by-law, and any other vehicle propelled or driven otherwise than by muscular power, but does not include the cars of electric or steam railways, or other motor vehicles running only on rails or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement or husbandry of road-building machine within the meaning of the Highway Traffic Act, R.S.O. 1990 c. H8, as amended.
- 35) Municipal Facility, means a library, arena, community halls, multi-purpose outdoor pads, administration building owned or controlled by the Town and all other municipal buildings owned or controlled by the Town.
- 36) Official Sign, means a sign approved by the Ministry of Transportation and or the Council of the Town.
- 37) One Way Street, means a highway upon which the movement of vehicular traffic is designated by by-law for movement in one direction.
- 38) Park or Parking, when prohibited means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
- 39) Parking Meter, means a device which shall indicate thereof the length of time during which a vehicle may be parked which shall have as a part thereof a receptacle for receiving and storing coins, a slot to indicate the passage of the interval of time during which the parking is permissive and which shall also display a signal when said interval of time shall have elapsed.
- 40) Parking Lot, means an area of land controlled by the Town which has been arranged, laid out or improved to provide for the parking of motor vehicles.
- 41) Parking Machine, means a mechanical or electronic device, other than a parking meter, used for the control and regulation of the parking of vehicles measuring and indicating the parking time for which payment has been made, and signaling mechanically or electronically when such time has elapsed.
- 42) Pedestrian, includes a person afoot and a person with a disability with additional transportation assistance.
- 43) Pedestrian Crossover, means any portion of a roadway designated by this bylaw, at an intersection or elsewhere distinctly indicated for pedestrian crossing by use of signs or lines or other markings on the surface of the roadway as regulated by the regulations under the Highway Traffic Act.
- 44) Person, means a person, firm or corporation used in the normal context of the word.
- 45) Police Officer, means a member of the Ontario Provincial Police Force or a person authorized by the Ontario Provincial Police to regulate or direct traffic.
- 46) Provincial Offences Officer, means a Police Officer, Peace Officer or other person appointed to enforce the by-laws of the Town.
- 47) Pathway, Local, means a pathway that provides secondary routes within communities, linking residential areas to facilities such as neighbourhood parks, schools and other local community destinations.
- 48) Pathway, Recreational, means a pathway which runs through parks, open space, environmental reserves or along river banks intended for the use of pedestrians and cyclists subject to restrictive signage.
- 49) Reserved Parking Area, means an area owned or controlled by the Town and designated for the purpose of the parking of vehicles, as required.
- 50) Roadway, means that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadway collectively.
- 51) Sidewalk, means that portion of a highway between the curb lines and the property lines of the lot abutting the highway and which is intended for the use of pedestrians.
- 52) Shoulder, means that part of the highway lying adjacent to the roadway where there is no barrier curb, and which is improved with granular or paved surface which extends for a maximum distance of three (3) metres.
- 53) Stand Or Standing, when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and when actually engaged in receiving or discharging passengers.
- 54) Stop or Stopping, when prohibited, means the halting of a vehicle even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal.
- 55) Street, means a highway.
- 56) Taxi Stand, means a space designated for taxi parking only.
- 57) Time, means whenever certain hours are named herein Standard Time or Daylight Savings Time, whichever shall be in official current use in the Town.
- 58) Town, means the Corporation of the Town of Prescott.
- 59) Trail, means a constructed linear path with a granular surface generally located in natural areas.
- 60) Trailer, means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily draw, propelled or moved upon such highway, and except for a side can attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn.
- 61) Traffic Control Signal, means any device, manually, electrically or mechanically operated for the control of traffic.
- 62) U-turn, means the turning of a vehicle within a highway so as to proceed in the opposite direction.
- 63) Vehicle, means and includes a motor vehicle, trailer, traction engine, farm tractor, road building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails.
- 64) Vending Vehicle, includes all vehicles of any kind in or from which goods, produce, food or beverage are offered for sale or sold.
- 65) Weight Restriction is the weight value allowed in ibs. per axle of any commercial or industrial use vehicle.
## SECTION 2 - INTERPRETATION
- 1) Where a distance is used in this by-law as part of a prohibition of parking or stopping within a specific distance of an object, structure, land or a part of a highway, such distance shall be measured:
- a) Along the curb or edge of the roadway from a point in such curb or edge of roadway opposite such object, structure, land or part of a highway, unless context otherwise requires, and
- c) Where a measurement of length is provided in imperial measure and in brackets, in this by-law, e.g. (feet), such measurement is given as a guide to interpretation only and in all cases the metric standard shall take precedence.
- b) From such object, structure, land or part of a highway in all directions.
- 2) In this by-law words importing the singular number or the masculine gender only, include more persons, parties or things of the same kind than one and female as well as male and the converse;
- a) A word interpreted in the singular number has a corresponding meaning when used in the plural.
- c) "Shall" shall be construed as imperative.
- b) "May" shall be construed as permissive.
- 3) Every vehicle parked on a street or in a municipal parking lot shall be parked at the risk of the owner, and the municipality is not responsible for any loss of damage to any vehicle or its contents.
- 4) Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be current local time being Eastern Standard Time.
## SECTION 3 - GENERAL REGULATIONS
- 1) No person shall drive a vehicle or bicycle upon a sidewalk of a highway or any recreation area except for the purpose of directly crossing the sidewalk. An exception is granted for children learning to cycle on bicycles having a wheel diameter of 50 cm or less (20 inches or less).
- 2) No person shall drive a vehicle over a raised curb unless there is a sufficient ramp abutting the curb.
- 3) A Police Officer, Bylaw Enforcement Officer, Director of Public Works and nfrastructure or designate may prohibit or restrict the movement of vehicles on an street or portion thereof for such length of time as he/she may deem necessary fo snow removal, street repairs, emergency detours or funerals. Special occasions and parades require a road closure application approved by the Director or designate.
- 4) No person shall intersect a funeral or other properly authorized procession while it is in motion with the exception of emergency vehicles in an emergency response.
- 5) Subject to the other provisions of this by-law prohibiting parking or stopping, no other commercial motor vehicle, attended or not, shall be parked or left standing on any street, other than for the purpose as is reasonably necessary to load or unload same.
## SECTION 4 - PERSON WITH A DISABILITY
- 1) Council may establish parking areas on highways, in Town parking lots, on Town owned or controlled lands or on private property which are to be used solely for the parking of vehicles which display an accessible parking permit.
- 2) The said parking areas shall be clearly marked as areas set aside for the parking of vehicles displaying an accessible parking permit.
- 3) The said accessible parking permit shall be displayed on the sun visor or on the dashboard of the vehicle so that the international symbol of access, the permit number and the expiry date of the permit are clearly visible from the outside of the vehicle.
- 4) Those areas and locations reserved for accessible parking are listed on Schedule "B".
- 5) No person, firm or corporation shall park, or permit to be parked, a vehicle in a designated accessible parking area unless said vehicle is equipped with an accessible parking permit.
- 6) No person, corporation nor organization shall display an accessible parking permit in any vehicle unless that person, corporation or organization is operating a vehicle which is being used at that time for the pick up or transport of the holder of an accessible person parking permit.
- 7) No person shall:
- a) Have in his or her possession an accessible parking permit that is fictitious, altered or fraudulently obtained;
- c) Fail or refuse to surrender an accessible parking permit in accordance with this bylaw;
- b) Display an accessible parking permit other than in accordance with this by-law; or
- d) Every person having possession of a accessible parking permit shall, upon the demand of a Police Officer or Bylaw Enforcement Officer surrender the permit for reasonable inspection to ensure that the provisions of this by-law are being complied with.
- e) An officer to whom an accessible parking permit has been surrendered may retain it until disposition of the case if the officer has reasonable ground to believe that the permit:
- i. Was not issued under the Highway Traffic Act;
- ili. Has been defaced or altered;
- ii. Was obtained under false pretenses;
- iv. Has expired or been cancelled; or
- v. Is being or has been used in contravention of this by-law.
- f) A Police Officer or Bylaw Enforcement Officer upon discovery of any vehicle parked or left in contravention of this section, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by Part I!! of the Repair and Storage Liens Act, 1990.
## SECTION 5 - HIGHWAY REGULATIONS

- 3) All other highways or portions of highways inside the Town of Prescott shall have a maximum rate of speed as set out in Part IX of the Highway Traffic Act.
- 4) The access road on the west side of Edward Street between Eliza Street to Wood Street is hereby designated a one way street in the southerly direction.
- 5) When signs are erected, the following areas are designated as school bus loading zones between the hours of 7:00 a.m. till 5:00 p.m. from Monday to Friday inclusive, during school operations:
- a) On the north side of James Street between Edward Street and the eastern property boundary of the school;
- b) On the north and south side of Jessup Street for a distance of forty-five (45) metres east of Zaire Street and Jessup Street and for a distance of nine (9) metres west of Zaire Street on Jessup Street;
- c) On the east side of Boundary Street for a distance of one-hundred (100) metres north of Churchill Road; and
- d) On the north side of McAuley Road for a distance of one-hundred (100) metres east of Woodland Drive.
- 6) No commercial vehicle weighing in excess of 10,000 Ibs. per axle shall be permitted to use King Street through Prescott except:
- a) Commercial vehicles in excess of 10,000 Ibs. per axle having a destination inside the Town and the destination is related to commercial use of the vehicle; and
- b) During times of an emergency as declared by Council, police or municipal designate or when King Street is in use as an Emergency Detour Route
## 5.2 COMMUNITY SAFETY ZONE
- 1) Highways within the Town that are designated community safety zones pursuant to the Highway Traffic Act are set out in Schedule "D" of this by-law.
## SECTION 6 - INTERSECTION CONTROL - STOP SIGNS - SCHEDULE "A"
- 1) The following intersections as listed on Schedule "A" of this by-law as indicated in column one (1) are designated as intersections where stop signs shall be erected
such that traffic travelling in the direction(s) indicated in column two (2) on streets indicated in column three (3) must stop before proceeding into the intersection as per the Highway Traffic Act.
## SECTION 7 - PARKING AND STOPPING
## 7.1 METHOD OF PARKING
- a) Parallel - No person shall park a vehicle on any street, other than a one-way street, unless on the right-hand side of the street having regard for the direction in which the vehicle had been proceeding and unless the right front and right rear wheel or runners of the vehicle are parallel to and distant respectively not more than fifteen (15) cm away from such curb.
- b) No curb or rolled curb - Parking shall be on the right side of the highway having regard to the direction in which the vehicle was travelling, with the right front and rear wheels parallel to and as near to the right hand limit of the highway that is practicable without stopping over any part of a highway which is landscaped or which is not intended for the use of vehicles.
- c) Angle - Where angle parking is permitted, no person shall park a vehicle except at an angle as marked, consistent with the line markings.
- d) One-way streets - Where parking is permitted on a one way street a person may park a vehicle facing only in the direction in which it as proceeding and with the right front and right rear wheels parallel to and not more than fifteen (15) cm from the edge of the roadway, providing that this provision shall not apply where parking on the left-hand side of a one-way street is specifically authorized by by-law.
- e) Motorcycle parking - A maximum of three (3) motorcycles shall be permitted per parking space.
## 7.2 PARKING PROHIBITED AT ANY TIME
No person shall park a vehicle in any of the following places;
- a) On a sidewalk;
- c) Within an intersection;
- b) In front of a public or private driveway;
- d) Within a distance of three (3) metres from any fire hydrant and for the purpose of this section, such distance shall be defined as being measured longitudinally along the curb or edge of the traveled road as the case may be, from the vehicle to a point on a line at right angles to the roadway and passing through the centre of the hydrant; provided that where a vehicle is properly parked in a designated parking area marked on a highway, the three (3) metres distance shall not apply;
- e) On a crosswalk;
- f) Within six (6) metres of a crosswalk at an intersection;
- 9) On private property without the consent of the owner or occupant of such property;
2. On any bridge, or the approaches thereof;
3. On any street in such a manner as to obstruct traffic;
4. ]) In such a position as will prevent the convenient removal of any other vehicle previously parked or standing;
- k) On Town owned or controlled lands, except designated parking area, without the consent of the Town;
- 1) On a boulevard;
- m) In front of the entrance to any place where goods or merchandise are regularly delivered or removed when properly worded signs have been erected; and
- n) On any roadway for an unreasonable time having regard for the traffic requirements for such roadway and in no case for a longer period than twenty-four (24) hours.
## 7.3 PARKING PROHIBITED WHERE AUTHORIZED SIGNS ARE ON DISPLAY
Where authorized signs prohibiting parking are on display, no person shall park a vehicle at any time in the following places;
- a) On any highway or parts thereof named or described in Schedule "B" to this by-law;
- b) In a fire access route;
- c) On any highway in front of the entrance to a theatre, auditorium, office building or apartment building;
- d) On any highway in front of an entrance to any place where goods or merchandise are regularly delivered or removed;
- On any highway within fifteen (15) metres of the termination of a dead-end highway;
- e) In a cul-de-sac within the turnaround;
- g) On a public lane;
- i) On any highway within fifty (50) metres or less of an intersection;
- h) On both sides of a highway within thirty (30) metres of a pedestrian crossover;
- j) On any highway within fifty (50) metres of a level railway crossing;
- k) In a reserved parking area;
## 7.4 FIRE ACCESS ROUTE
Fire access route signs shall be permanently legible signs approved by the Fire Chief and shall be placed at intervals of not more than twenty (20) metres along a fire access route and shall display the following information:
- a) Fire access route;
- b) Parking prohibited;
- c) Motor vehicles will be tagged and towed; and
- d) Such signs shall be a minimum size of .300 metres by 450 metres.
## 7.5 PARKING PROHIBITED - SIGNS ERECTED
In addition to the foregoing provisions of this by-law, the parking of vehicles is prohibited when properly worded signs have been erected:
- a) On both sides of a street having a pavement width of less than 7.4 metres;
- b) On one side of any street having a pavement width of less than 7.4 metres and in excess of 4.9 metres where such street has been designated by-law as a one-way street;
- c) On one (1) side of any street having a pavement width of not less than 7.4 metres nor more than 11.6 metres; or
- d) On any highway or part thereof listed in Schedule "B" attached hereof, from the location listed and during the times set out in said schedule.
## 7.6 PARKING ON PRIVATE PROPERTY
- a) No person shall park or leave any motor vehicle on private property without the consent of the owner or occupant of the property:
- b) The owner of a motor vehicle parked or left on private property is liable for all costs and penalties to have the motor vehicle removed from such property or impounded under this part of the by-law upon the written complaint of the owner or occupant of the property given to a Police Officer or By-law Enforcement Officer appointed for the carrying out of the provisions of this bylaw;
- c) When an owner or occupant of property affected by this part of the bylaw has posted signs stating conditions on which a motor vehicle may be parked or left on the property or prohibiting the parking or leaving of a motor vehicle on the property, a motor vehicle parked or left on the property contrary to such conditions or prohibition shall be deemed to have been parked or left without consent;
- d) A Police Officer or By-law Enforcement Officer shall be deemed to have the written authority of the owner or occupant of the property to enforce this part of the by-law and is not required to receive a written complaint before enforcing this part of the by-law.
## 7.7 EMERGENCY PROHIBITION OF PARKING
- a) Prohibited parking and procedures - Notwithstanding anything to the contrary contained herein, the Ontario Provincial Police, Fire Chief or his/her designate, or Bylaw Enforcement Officer, during any emergency or special circumstance may:
- i. Prohibit any or all parking on a highway within the area affected by the emergency or special circumstances;
- ii.Authorize the erection of "No Parking" traffic control devices and traffic signals; or
- ili. Declare that any vehicle already parked is parked illegally regardless of the time permitted for parking such vehicle under the provision of this bylaw.
- b) Notification - Where possible, the owner or driver of a vehicle declared to be illegally parked shall be notified by a Police Officer or Bylaw Enforcement Officer that such has been prohibited.
- Removal - Where:
- i The owner or driver so notified to remove the vehicle does not do so. All costs and charges for removing, care and storage of any vehicle removed or impounded shall be at the owner's expense.
- ii Where the owner or driver cannot immediately be located, then the said vehicle may be moved to a safe location or removed and impounded forthwith by an order of the Ontario Provincial Police, Fire Chief or designate, or a Bylaw Enforcement Officer. This shall be without cost to the vehicle owner.
## 7.8 ANGLE PARKING
Where pavement markings or other devices are on display, angle parking is permitted on any highway or parts thereof named or described in Schedule "B" of this by-law.
## 7.9 BOULEVARD PARKING
Where authorized signs permitting boulevard parking are on display, boulevard parking is permitted on any highway or parts thereof.
## 7.10 STOPPING PROHIBITED - UNSIGNED
No person shall at any time stop a vehicle in the following places, unless otherwise posted:
- a) Within three (3) metres of a fire hydrant;
- b) In such a position so as to obstruct any pedestrian passageway;
- c) Adjacent to any median strip or island;
- d) On either side of a highway that is divided by a median strip;
- e) On or within one-hundred (100) metres of a bridge, over, under or across which the highway passes;
- g) On or within three (3) metres of a railway crossing.
- f) Within a school bus loading zone, excepting school buses; or
## 7.11 STOPPING PROHIBITED - SIGNED
Where authorized signs prohibiting stopping are on display, no person shall at any time stop a vehicle in the following places:
- a) within fifty (50) metres or less, of an intersection of a highway;
- b) On the side of a roadway abutting any school property;
- d) in front of or within fifteen (15) metres of either side of any Fire Hall on the same side of the highway as the Fire Hall, or within forty-five (45) metres from a point in the curb or edge of roadway directly opposite the centre point of the Fire Hall on the opposite side of the highway from the Fire Hall; and
- c) On the side of a roadway abutting any park or playground;
- e) On any highway or parts thereof named or described in Schedule "A" to this by-law.
## 7.12 LOADING ZONES
Where properly worded signs identifying a loading zone have been erected and are on display, no person shall stand or park any vehicle, except as may be provided for on the signs identifying the loading zone, other than a commercial vehicle in any area designated as a loading zone. Those areas listed in Schedule "B" are hereby designated as loading zones. Commercial vehicles shall not be parked in a loading zone for a period exceeding twenty (20) minutes.
## 7.13 OVERNIGHT PARKING PROHIBITED
Except for authorized emergency vehicles, no person shall park on any highway in the Town between the hours of 11:00 p.m. and 7:00 a.m. during the months of November through March inclusive.
## 7.14 TOWING
Vehicles parked or stopped in contravention of Section 7.1, 7.2, 7.3, 7.4, 7.5, 7.6, 7.7, 7.8, 7.11, 7.12, 7.13, and 7.14 may be tagged and towed away upon the order of any Police Officer or Bylaw Enforcement Officer at the owner's expense.
- 7.15 DISABLED VEHICLES - Section 7.12 does not apply to the driver or operator of a vehicle that is disabled while on a highway such that it is impossible to avoid temporarily a contravention of such provisions.
- 7.16 DAMAGING SIGNS - No person shall damage, deface or tamper with any parking control sign and no unauthorized person shall move the same.
## SECTION 8 OFFENCES AND PENALTIES
## 8.1 VOLUNTARY PAYMENT OF PENALTIES
- a) Form of notice - Where a vehicle is found to be in contravention of the parking or stopping provision of this by-law, the Issuing Officer may issue and place on the vehicle a serially numbered Parking Infraction Notice in the form prescribed by the Provincial Offences Act.
The serially numbered Parking Infraction Notice shall state;
- a) the license number and description of the vehicle;
- b) the nature of the alleged infraction:
- c) the date, time and place of the alleged infraction;
- d) the minimum fee provided herein for the violation; and
- e) that the owner thereof may within seven (7) days to pay the minimum fee provided for the infraction by taking it or forwarding it to the Town office between 8:30 a.m. and 4:30 p.m., exclusive of Saturdays, Sundays and holidays.
- b) Copies of forms - The Parking Infraction Notice mentioned in Subsection 8.1 (a) above shall be prepared as required and the Issuing Officer shall attach one copy to the vehicle and deliver the other copy or copied to the Bylaw Enforcement Office of the Town.
- c) Recovery - If voluntary payment is not made in accordance with the procedure set out on the Parking Infraction Notice provided for in Subsection 8.1 (a) above, the Provincial Offences Act, as amended shall apply.
## 8.2 MINMUM AND MAXIMUM PENALTIES
- a) Amount - For any contravention of those infractions set out in Schedule "C" to this by-law the minimum penalty shall be set out and the set fine shall be the amount approved under the Provincial Offences Act, as amended.
- b) General penalty - Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, R.S: O. 1990, c P33.
- c) Owner penalties - The owner of any vehicle which is found in contravention of any of the parking or stopping provisions of this by-law is guilty of the offence and is liable to the penalty or fines provided by law for such contravention unless at the time of such contravention the vehicle was in the possession of some person other than the owner without the owner's consent.
## SECTION 9 APPLICATION AND ADMINISTRATION
## 9.1 ENFORCEMENT
This by-law may be enforced by Ontario Provincial Police and Bylaw Enforcement Officers of the Town.
## 9.2 PARKING CONTROL DEVICES
- a) The Ontario Provincial Police, Fire Chief, Provincial Offences Officer or designates are hereby authorized to place, erect and maintain such authorized signs as may be necessary to give effect to the provisions of this by-law or which are authorized by the schedules to this by-law.
- b) The Ontario Provincial Police, Fire Chief, Provincial Offences Officer or designates are further authorized for a temporary period not exceeding thirty (30) days to place, erect and maintain such authorized signs as are not otherwise authorized by this bylaw, but are required for safety reasons.
- c) All parking control signs erected and/or on display as of the effective date of this bylaw whether identified in any schedule to this by-law or not shall be deemed to be authorized signs for the purpose of this by-law.
4. 9.3 UNAUTHORIZED SIGNS - Unless otherwise permitted, no person shall place, maintain, or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles any parking control device.
## 9.4 EFFECTIVE DATE OF BY-LAW IN FORCE
This by-law shall come into force on the date of passage.
## 9.5 REVOCATION

## SECTION 1 - PARKING SPECIFIC AND SIGNED
Where appropriate signs are erected and are on display no person shall park a vehicle on any highway at the side of and between the limits set out below. If parking is restricted during certain times only, such times are also noted below.
- 1) On any highway or lot designated as a Fire Route or Fire Zone including both sides of Henry Street West from Centre Street South to Edward Street;
- 2) On the south side of King Street from St. Lawrence Street to the westerly Town limits;
- 3) On the north side of King Street from St. Lawrence Street to the westerly Town limits;
- 4) On the north side of King Street for a distance of sixty-six (66) metres east of its intersection with West Street;
- 5) On the east side of George Street South of Water Street;
- 6) On the north side of Water Street from its intersection with George Street to the intersection at Edward Street;
- 7) On the south side of Water Street beginning twenty-three (23) metres east of George Street and extending easterly to Centre Street;
- 8) On the south side of Water Street starting at the Lighthouse easterly to East Street two (2) hour parking only;
- 9) On the south side of King Street for a distance of thirty-nine (39) metres westerly from the westerly limit of Edward Street;

- 35) Within a Taxi Stand Authorized by the Town;
- 36) On the west side of Edward Street from its intersection with Park Street northerly for a distance of thirty-four (34) metres and southerly for a distance of fifty-five (55) metres;
- 37) On the east side of Edward Street from its intersection with Wood Street southerly for a distance of thirty-five (35) metres;
- 38) On the south side of Water Street from its intersection with George Street westerly;
- 39) On the east side of Boundary Street from King Street West to the Canadian National Railway Lines;
- 40) On the south side of King Street for a distance of twenty-four (24) metres westerly from the westerly limit of Centre Street;
- 41) On the north side of King Street for a distance of twenty (20) metres easterly from the easterly limit of Centre Street;
- 42) On the north side of Roberta Crescent for a distance of fifty-eight (58) metres and on the south side of Roberta Crescent for a distance of sixty-four (64) metres from the easterly intersection of Victor Road;
- 43) In the area of the public boat launch off Mary Street, no overnight parking is permitted;
- 44) On west side of Susan Street;
- 45) On east side Florence Street;
- 46) One (1) reserved parking spot on George Street for clergy in front of the United Church;
- 47) On the following Municipal parking lots between the hours of 11 p.m. and 7 a.m. of the following morning:
- i. The municipal parking lot situated between Dibble Street West and James Street West and east of the municipal building.
- ii. The Community Centre parking lot situated behind the Leo Boivin Community Centre at the south east corner of Prince Street and James Street East.
- ili. The Prescott Health Centre parking lot situated on the south side of King Street West to the east of the Health Centre Building.
- iv. Marina Parking Lot located on Water Street East and King Street East boat trailer parking permitted by permit only, see Schedule "E".
- v. Municipal parking lot, 197 Water Street, situated on east side of Centre Street at St. Lawrence River.
- vi. Municipal parking lot situated behind Walker House.
- 48) Within a Loading Zone authorized by the Town, two (2) hour limit;
- i. North side of Water Street from Edward Street to George Street.
- ili. South side of Water Street at Prescott Place.
- ii. King Street South side at 125/131 King Street East.
- iv. King Street north side at 206 King Street West.
- 49) Under no circumstances are tractor trailer or tandem trucks to park in any municipal parking lots at any time or on any highways between the hours of 11 p.m. and 7 a.m. the next day during the months of January, February, March, November and December.
## SECTION 2 - ACCESSIBLE PARKING AREAS
- 1) Where appropriate signs are erected, accessible parking spaces are designated and shall be reserved for the exclusive use of those so qualifying.
- 2) Spaces shall be reserved as follows:
- i. One (1) signed space in the municipal town hall parking lot identified as parking space number 32;
- ii. Two (2) signed spaces on King Street West south side directly in front of Prescott Health Centre;
- iv. Two (2) signed spaces at the Community Centre parking lot on the south side;
- ili. One (1) parking space east side Mary Street south of King Street at Prescott Health Centre;
- v. St. Mark Catholic School two (2) parking spaces;
- vii. Two (2) signed spaces at the Clock Tower parking lot.
- vi. Two (2) signed spaces on Water Street between Edward Street and the Rotary Lighthouse;
- vili. One (1) signed space on King Street West between George St. and
8. ix One (1) signed space on King Street West between Centre St. and Edward Steet.
## SECTION 3 - PARKING PERMITS
- 1) No person shall park or stop any vehicle at Prescott Place and Water Street parking spaces or on portion thereof except as follows;
- i. There are a total of eleven (11) available spaces at this location and they will be allocated using the following criteria;
- a) Preference will be given to a person with a disability for parking permit holders issued under the Highway Traffic Act;
- c) Non-disabled applicants will be considered if spaces are available;
- b) The duration and fees for parking permits shall be as specified in Schedule "E" to by-law XX-2017,
- d) Non-disabled applicants will not be renewed if a request from a resident with a disability has been received;
- e) That the holder of the parking permit is responsible for their own snow removal;
- ii. Permits will be issued at the discretion of the Director of Public Works and Infrastructure or designate;
- ili. Permit holders are not permitted to sublease their parking space.
- 2) No person shall park any vehicle overnight at the Marina Parking lot off East Street parking spaces or portion thereof except as follows:
- i. That owner or driver of the vehicle obtain a parking permit from the Marina Operator;
- ii. That the parking at the Marina Parking lot is for the exclusive use of marina patrons and persons wishing to park vehicles and trailers related to the use of the boat launch;
- ili. That the purchaser of the parking permit pay the prescribed fee for the permit as per Schedule "E";
- iv. That the parking permit be placed on display in the front window driver's side of the vehicle for the duration of the parking permit.
- 3) Reserved parking spaces at the King Street municipal parking lot are provided by parking permit only, subject to the following conditions:
- i. There are a total of six (6) reserved parking spaces available on the south row against Water Street;
- ii. The owner/operator of the vehicle shall obtain a parking permit from the municipal office;
- lil. That the purchaser of the parking permit pay the prescribed fee for the permit as per Schedule "E";
- v. That the holder of the parking permit is responsible for their own snow removal;
- iv. That the parking permit be placed on display in the front window driver's side of the vehicle for the duration of the parking permit;
- vi. Permit holder is not permitted to sublease the parking permit.
