## CORPORATION OF THE TOWNSHIP OF PRINCE
## BY-LAW 2025-38
Being a By-law to amend By-law 2024-32, the Property Standards By-law, To Provide for Fees and Cost Recovery
WHEREAS the Council of The Corporation of the Township of Prince enacted By-law 2024-32, being a By-law prescribing standards for the maintenance and occupancy of property within the Township and considers it desirable to amend By-law 2024-32 to impose fees for certain services and to provide for the recovery of unpaid fees and costs by adding them to the tax roll;
AND WHEREAS Section 391 of the Municipal Act, 2001 authorizes a municipality to impose fees or charges for services or activities provided or done by or on behalf of it;
AND WHEREAS section 15.3(1) of the Building Code Act, 1992 requires a municipality that has passed a property standards by-law to establish a Property Standards Committee to hear appeals, and Council has established such a committee by resolution;
NOW THEREFORE the Council of The Corporation of the Township of Prince enacts as follows:
1. That By-law 2024-32 is hereby amended by adding Schedule "A" - Fees, attached hereto and forming part of this by-law, as amended from time to time.
2. This by-law shall come into force and take effect on the date of its passing.
READ A FIRST, SECOND AND THIRD TIME AND PASSED this 17th day of September 2025.

## Fees and Cost Recovery Charges:
## Collection of Fees
Any unpaid fee or charge imposed under this Schedule shall be added to the tax roll for the subject property and collected in the same manner as municipal taxes, pursuant to section 398 of the Municipal Act, 2001.

| Inspections where owner fails to comply with an Order - Owner who failed to comply with an Order shall pay the fee for each inspection to determine if contraventions of this By-law observed on an initial inspection have been corrected, where the contraventions have not been remedied by the time provided for in the inspection said Order. | $100.00 for each - additional |
| Order has been registered and requires discharge - Where a property standards order has been registered, an owner or occupant may apply for an inspection of the property in respect of the order and shall pay a fee at the time of application; this $150.00 fee includes the registration of a discharge where compliance with the order is found. | |
| Municipality undertakes to complete the work - Where the Municipality undertakes to complete the work required to comply with any order, for the cost of all work performed, plus an administrative fee. | Work Cost up to $600.00 = $150.00 fee Work Cost over $600.00 = 25% of overall costs. |
