By-Law Number 24-151
Being A By-Law To Prohibit And Regulate
The Parking, Standing And Stopping Of
Vehicles In The City Of Quinte West.
Whereas
pursuant
to
the
provisions
of the Municipal Act, 2001,
S.O. 2001,
c.
25
as
amended and the provisions of the Highway Traffic Act, R.S.O. 1990, c. H.8 as amended,
the municipality may pass by-laws regulating or prohibiting matters such as regulating the
parking,
standing
or stopping
of vehicles on highways,
municipal property and
private
property, and parking lots;
And Whereas section
8
of the Municipal Act provides that Council may pass by-laws
regulating or prohibiting matters such as parking;
And Whereas section 101(1) of the Municipal Act authorizes municipalities to remove and
impound any illegally parked vehicle at the owner's expense;
And Whereas section
128
of the Municipal Act provides that
a local municipality may
prohibit and regulate with respect to public nuisances, including matters that, in the opinion
of Council are or could become public nuisances;
And Whereas
in the opinion of Council for the Corporation of the City of Quinte West, the
act
of parking, standing
or stopping
a vehicle on
a front yard
or side yard
is or could
become, a public nuisance;
And Whereas section 425
of the Municipal Act provides that a municipality may pass
by-laws providing that a person who contravenes a by-law of the municipality is guilty of an
offence;
And Whereas section 428 of the Municipal Act provides that the owner of a vehicle is guilty
of an offence even
if the owner is not the driver of the vehicle, where a vehicle has been left
parked, stopped or standing in contravention of a by-law;
And Whereas section 436 of the Municipal Act provides that a municipality has the power to
pass by-laws providing that the municipality may enter on land at any reasonable time for
the purpose
of carrying
out an inspection
to determine whether or not a by-law of the
municipality is being complied with;
Now Therefore Be It Enacted By The Council For The Corporation Of The City Of
Quinte West As Follows:
1.
Title:
1.1
That this by-law shall be entitled the "Parking By-Law".
2.
Definitions:
In this by-law,
"Accessible Parking Permit" means a valid permit issued under section 26 of the Highway
Traffic Act or a valid permit, licence plate or other marker or device bearing the international
symbol of access issued by a jurisdiction other than Ontario.
"Accessible Parking Space" means a designated parking space identified by prescribed
signage which
is reserved
for the exclusive use of persons with an accessible parking
permit.
"Active Transportation Lane" means a portion of highway which has been designated by
pavement markings and signage for the exclusive use and transport of people or goods,
through non-motorized means, based around human physical activity.

"Bicycle Lane" means
a portion
of highway which has been designated by pavement
markings and signage for the exclusive use of cyclists.
"Boulevard" means the untraveled portion of the road allowance, which is not intended for
use by vehicles, and includes
a center strip separating two roadways and any paved or
unpaved portion of the road allowance not intended for the normal use of vehicles, but does
not include a sidewalk.
"Bus" means a motor vehicle designed for carrying ten or more passengers, used for the
public transportation of persons, but does not include a vehicle licensed as a taxicab.
"Bus Stop" means a
part of a highway set aside as provided in this by-law with suitable
markings and/or signs for the loading or unloading of passengers.
"Clerk" means the Municipal Clerk for the Corporation and includes their designate.
"Commercial Motor Vehicle" means
a motor vehicle having attached
to
it a truck or
delivery body and includes an ambulance, a hearse, a casket wagon, a
fire apparatus, a bus
and a tractor used for hauling purposes on a highway.
"Corporation" means the Corporation
of the
City
of Quinte West, and Municipal and
Municipality have a similar meaning.
"Council" means the Council of the Corporation.
"Crosswalk" means:
(a)
the part of a highway at an intersection that is included within the connections of the
lateral lines of the sidewalks on opposite sides of the highway measured from the curbs,
or in the absence of curbs, from the edge of the roadway, or
(b)
any portion
of
a roadway
at an intersection
or elsewhere distinctly indicated
for
pedestrian crossing by signs or by lines or other markings on the surface.
"Cul-de-sac" means the part of the highway open at one end only, with special provisions
for turning around by a vehicle.
"Curb" means where a curb is constructed, the line thereof; where no curb is constructed
it
shall be constituted to mean the edge of the roadway.
"Derelict Vehicle" means
a vehicle that has been
left unattended, and that appears by
reason
of
its age, appearance
or mechanical condition
to
be abandoned
or that lacks
number plates, permit or identification numbers with current validation, so that the vehicle
cannot
be operated
on
a highway
in accordance with the Highway Traffic Act
or the
regulations made thereunder.
"Designated Parking Space" means
a parking space that has been set aside for the
parking of a particular vehicle or class of vehicles or for use by a particular person or class
of persons for the parking of a vehicle.
"Driveway" means an unobstructed passageway used to provide vehicular access to a
lot
from a street or lane.
"Electric Vehicle" means,
(a)
a battery electric vehicle that runs only on a battery and an electric drive train, or
(b)
a plug-in hybrid that runs on a battery and an electric drive train, and also uses an
internal combustion engine;
"Electric Vehicle Charging Station" means a publicly-owned or privately owned parking
space that provides access to equipment that supplies a source of electricity for charging
electric vehicles;
"Fire Route" means any highway, lane, ramp or other means of vehicular access to or
egress from a
building or structure, and
it may include any part of a municipal or private
property including parking lots, and a "Fire Lane" is a Fire Route.
"Heavy Vehicle" means any commercial motor vehicle having
an unloaded weight
in
excess of 3,400 kilograms, but does not include ambulances, fire apparatus and vehicles
owned or operated for the Corporation.
"Highway" includes
a common and public highway, street, avenue, parkway, driveway,
square, place, bridge, viaduct or trestle, any part of which
is intended for or used by the
general
public
for the passage
of vehicles and includes the area between the
lateral
property lines thereof.
"Intersection" means the area embraced within the prolongation
or connection
of the
lateral curb lines or if none, then the lateral boundary lines of two or more highways that join
one another at an angle, whether or not one highway crosses the other.
"Laneway" means improved land adjacent to the highway which provides access from the
highway to a parking area on the adjacent land.
"Loading Zone" means an area or place on
a highway established by authority of this
By-law for accommodation of commercial vehicles and the loading and unloading of goods,
wares, or merchandise.
"Lot Line", "Lot Line, Front', "Lot Line, Exterior Side", "Lot Line, Rear', and "Lot
Line, Side" have the meanings ascribed to them in the City of Quinte West Comprehensive
Zoning By-law as amended.
"Motor Vehicle" includes an automobile,
a motorcycle,
a motor assisted bicycle, and any
other vehicle propelled or driven otherwise than by muscular power, but does not include a
streetcar
or other motor vehicle
running
only upon
rails,
a
power-assisted
bicycle,
a
motorized snow vehicle,
a traction engine,
a farm tractor,
a self-propelled implement of
husbandry or a road-building machine.
"Municipal Property" means property owned or occupied by the Corporation.
"Occupant" when used in relation to property, means:
(a) the tenant of the property or part thereof whose consent shall extend only to the
control of the land of which they are a tenant and any parking spaces allotted to
them them under their lease or tenancy agreement;
(b) the spouse of a tenant;
(c)
a person
or the Corporation, or the local board thereof, having an interest in the
property
under
an easement
or right-of-way granted
to
or expropriated
by the
person, municipality or local board whose consent shall extend only to the part of
the property that is subject to the easement or right-of-way;
(d) a person authorized in writing by an occupant as defined in clause (a), (b) or (c) or
act on the occupant's behalf from requesting the enforcement of this by-law.
"Officer"
includes
a
Municipal
Law
Enforcement
Officer
or
a
Police
Officer,
for the
corporation or any person appointed by the Corporation for the purposes of carrying out the
enforcement of part or all of this by-law but does not include a Private Property Officer.
"Official Sign" means any sign or roadway, curb or sidewalk markings or other devices
placed or erected on a highway under the authority of this by-law, or which
is authorized
pursuant to the Highway Traffic Act, or the regulations passed thereunder, for the purposes
of regulating, warning, guiding traffic and/or parking of vehicles.
"Operator" means any person who drives or operates or who has the care and control of a
vehicle.
"Oversized
Vehicle"
means
any
motor vehicle
having
a weight
in excess
of 3,400
kilograms
including
tractors
used
for
hauling
purposes,
buses,
recreational
trailers,
recreational vehicles, boats and trailers.
"Owner" when used in relation to property, means:
(a) the registered owner of the property;
(b) the registered owner of a condominium unit, whose consent shall extend only to the
control of the unit of which he or she is owner and any parking spaces allotted to
him or her by the condominium corporation or reserved for his or her exclusive use
in the declaration or description of the property;
(c) the spouse of a person described in (a) or (b);
\
(d) where the property
is included
in a description registered under the Condominium
Act, the board of directors of the condominium corporation; or
(e) a person authorized in writing by the property owner as defined in (a), (b), (c) or (d)
to act on the owners' behalf for requesting the enforcement of this By-law.
"Owner" when used
in relation to a vehicle means that registered name on file with the
Ontario Ministry of Transportation.
"Parked,
Park
or Parking" means
to
allow
a vehicle
to remain stationary except
in
obedience to traffic regulations, signs, or signals, or while actually engaged in taking on or
discharging passengers, or loading or unloading of merchandise.
"Parking Infraction" means any parking, standing or stopping of a vehicle that constitutes
an offence under this By-law.
"Parking Lot" means a parking area to which the public has access whether on payment of
a fee or otherwise.
"Parking Space" means a portion of highway or a municipal or private parking lot that is
designated for the parking of a vehicle by suitable markings to distinguish one space from
another
"Passenger Loading Zone" means an area or place on a highway established by authority
of this By-law for loading and unloading of passengers.
"Pedestrian" means a person travelling on foot and includes a person in a wheelchair and
a child in a baby carriage.
"Pedestrian Crossover" means any portion of a roadway designated by this By-law, at an
intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on a highway
and lines or other markings on the surface of the roadway as prescribed by the regulations
within the Highway Traffic Act.
"Permit" when used in respect of parking means a permit issued by the Corporation under
this By-law for the purpose of parking on highways or municipal parking lots.
"Permit Holder" means the person in whose name a permit is issued.
"Private Property" means any property other than highways and Municipal Property, but
includes the property of a local board.
"Private Property Officer' means an agent of the property owner who
is appointed by
by-law
as
a
Municipal
Law Enforcement
Officer
for the purpose
of enforcing parking
infractions on a specified private property and such appointment is subject to conditions of
the appointment by-law and/or any section of this by-law.
"Private Roadway" means a roadway or laneway on private property.
"Public Building" means
any
building
or enclosed
space
in which
persons may
be
expected to congregate in large numbers and includes but is not limited to a church, hotel,
hospital, nursing home, theatre, auditorium or arena.
"Recreational
Trailer, Vehicle
or Boat" means any vehicle that
is suitable for being
attached to a motor vehicle for the purpose of being drawn or is self-propelled, and may be
capable
of being used
on
a short term recreational basis for living, sleeping
or eating
accommodations of human beings and includes a
travel trailer,
pick-up camper, motorized
camper, boat trailer, or tent trailer.
"Road Maintenance" includes municipal services such as road repairs, snow plowing or
snow removal, that are already in progress or are to be commenced as indicated by work in
progress, appropriate signs, barriers, pylons or other such indicators.
"Roadway" means
that part of the highway that is improved, designed or
ordinarily used
for vehicular traffic, but does not include the shoulder and, where a highway includes two or
more separate roadways, the term "roadway" refers to any one roadway separately and not
to all of the roadways collectively.
"Roundabout"
means
a
form
of
intersection
that accommodates
traffic
flows
in
a
counterclockwise circular direction around a central island.
"Safety Island" means that part or area of the highway at an intersection that is between
two roadways in the same or opposite directions and such area is raised or is delineated by
markings on the highway so as to indicate that the area is not intended for use by vehicles.
"Safety Zone" includes
a safety island and the whole of the road allowance within

metres of the ends of the island.
"School Bus Loading Zone" means
an area
or place on
a highway established
by
authority of this By-law for accommodation of school buses for the purpose of loading and
unloading passengers.
"Sidewalk" means the portion of a highway between the curb lines or lateral lines of a
roadway and the adjacent property lines intended for the use of pedestrians. "Sidewalk"
shall also include a public walkway and/or footpath designed for and intended to be used by
the public for the passage of pedestrians and which is maintained by the Corporation.
"Signage" includes one or more signs, markings and any other appropriate devices that
provide notice of parking conditions under the authority of this by-law.
"Stand" or "Standing" where prohibited means the halting of a vehicle whether occupied
or not, except for the purpose of and while actively engaged
in receiving or discharging
passengers.
"Stopped" or "Stopping" when prohibited, means the halting of a vehicle, even momentarily,
whether occupied or not, except when necessary to avoid conflict with a pedestrian or other
traffic or in compliance with the directions of an Officer or a traffic control sign or signal.
"Trailer" means a vehicle that is any any time drawn upon a highway by a motor vehicle,
except an implement of husbandry, a mobile home, another motor vehicle or any device or
apparatus not designed to transport persons or property that is temporarily drawn, propelled or
moved upon such highway. A
trailer shall be considered a separate vehicle and not part of the
motor vehicle by which
it is drawn.
"Hitched Trailer" means a Trailer as defined in this By-law, that is hitched to a licenced and
plated Motor Vehicle appropriate for the towing of the attached Trailer and its intended
contents attached
(e.g. boat),
"Unhitched Trailer" means a Trailer defined in this By-law, that is not hitched to a licenced
and plated Motor Vehicle appropriate for the towing of the Trailer and its intended contents,
This definition included a Trailer with or without its intended contents attached (e.g. boat).
"Unauthorized Area" means:
(a) a front yard, side yard or exterior side yard, except as otherwise permitted under the City
of Quinte West Comprehensive Zoning By-law as amended, or
(b) an unsurfaced area, or
(c) a vacant lot
"Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building machine,
bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular
power, but does not include a motorized snow vehicle or a street car.
"Vard", "Yard, Front", "Yard, Rear", "Yard, Side", "Yard, Exterior Side" and "Yard,
Interior" have the meanings ascribed to them in the City of Quinte West Comprehensive Zoning
By-law as amended.
3.
Interpretation:
3.1.
This By-law applies to all highways, public lanes, municipal parking lots and all other
property owned or occupied by the City of Quinte West.
3.2
This by-law applies to private property where signs have been posted stating
conditions.
3.3.
This by-law applies to private property on the front and side yards, as defined here-in.
3.4
The attached Schedules form part of this by-law
3.5
Except as otherwise provided in section 2, the words and terms used in this by-law
have the same meaning as in the Highway Traffic Act.
3.6
The use of includes in section 2 of this by-law is not to be interpreted as limiting the
meaning of a word or term to the phrases or descriptions that follow.
4.
General Parking and Stopping Regulations:
Two-Way Traffic
4.1
No person shall park or stop any vehicle on any highway or portion thereof except as
follows:
(a) On highways carrying two-way traffic, where there is a raised curb, on the right
hand side of the roadway, having regard to the direction such vehicle was
proceeding, not including a roundabout, with both the front and rear wheels on the
right side of the vehicle parallel to and not more than 30 centimeters out from such
curb.
(b) On highways carrying two-way traffic, where there is no curb or a rolled curb, on
~
the right hand side of the roadway, having regard to the direction such vehicle was
proceeding, with both the front and rear wheels on the right side of the vehicle
parallel to and as near to the right hand limit of the highway as is practicable
without stopping or parking over a sidewalk or footpath or over any part of the
highway where grass is grown or which is not intended for the use of vehicles.
One-Way Traffic
4.2
No person shall park or stop any vehicle on any highway or portion thereof except as
follows:
(a) On highways carrying one-way traffic, where there is a raised curb, on the
roadway, having regard to the direction such vehicle was proceeding, with both the
front and rear wheels on the same side of the vehicle parallel to and not more than
30 centimeters out from such curb.
(b) On highways carrying one-way traffic, where there is no curb or rolled curb, having
regard to the direction such vehicle was proceeding, with both a front and a rear
wheel on the same side of the vehicle parallel to and as near to the outside limit of
the roadway as is practicable without stopping over a sidewalk or footpath or over
any part of a highway where grass is grown or which is not intended for the use of
vehicles.
Angle Parking
4.3.
No person shall park or stop any vehicle on any highway or portion thereof except as
follows:
(a) Where angle parking is permitted, no person shall stop or park any vehicle except
at an angle of 45 or 90 degrees, from the curb or boundary of the roadway with the
front of the vehicle at such curb or boundary.
(b) Where angle parking spaces are designated by lines painted on the roadway, no
person shall stop or park any vehicles except within an area designated as a
parking space.
(c) Angle parking in accordance with the provisions of section 4.3 is permitted on the
roadways at the side and between the limits set out respectively in Columns 1, 2
and 3 of Schedule "A" to this By-law.
Parking - General
4.4
No person shall on any highway park any vehicle:
(a) that is a derelict vehicle, including any derelict vehicle that is placed, stored,
transported or carried on a trailer or any other device that may be used to place,
store, transport or carry a vehicle.
(b) where the highway has an overall width of less than 6 meters.
(c) within 3 meters of any fire hydrant measured from a point on the curb or edge of
the roadway adjacent to the fire hydrant.
(d) for the purpose of washing, greasing or repairing the vehicle, except for such
repairs as have been necessitated by an emergency.
(e) that is a heavy vehicle, except at the side where such highway abuts property
zoned industrial in accordance with the City of Quinte West Comprehensive Zoning
By-law as amended and all other sections of this by-law apply.
(f)
improperly in a parking space; every vehicle shall be parked entirely within an area
designated by lines which identify that individual parking space.
(g)
in front or within 1.5 metres of a driveway or laneway so as to obstruct the use of a
driveway or laneway.
(h) within 9 metres of the intersection street lines on all approaches and on both sides
of each approach on a
stop street.
(i)
within 15 metres of the termination of
a dead-end street.
(j)
within 9 metres of any lot that a Fire Hall is located on the side of the highway in
which the Fire Hall is located.
(k) within 30 metres of any lot that a Fire Hall is located on the opposite side of the
highway.
(l)
within a turning basin of a cul-de-sac.
(m) that is an oversized vehicle on any Residential Street at any time.
(n)
in front of the main entrance to, or any emergency exit from a public building.
(o) that is an un-hitched trailer.
Stopping - General
4.5
No person shall on any highway stop any vehicle:
(a)
in such a position as will prevent the removal of any other vehicle previously
parked or standing.
(b) so as to interfere with the formation of a funeral procession, or parade.
(c) on or over a sidewalk or footpath.
(d) within an intersection, including a roundabout, or crosswalk.
(e) on a pedestrian crossover or within 9 metres of a pedestrian crossover.
(f)
within
9 metres of a crosswalk or within 9 metres of a crosswalk at an intersection.
(g)
in a safety zone.
(h) alongside or opposite any excavation or obstruction on any street in any manner so
as to impede or obstruct traffic flow.
(i)
upon any bridge or elevated structure or within any tunnel or underpass.
(j)
on any boulevard, including the highway adjacent to either side or ends of a center
strip.
(k) for the purpose of selling or offering for sale any goods or produce from a vehicle.
(l)
within 15 meters of a roundabout or an intersection with a Signal Light Traffic
Control System installed.
(m) within 15 metres of the nearest rail of a level railway crossing.
(n) on or partially over any bicycle lane.
(0) on or partially over any active transportation lane.
Parking Prohibited at Specified Times and Places
4.6
Where official signs to that effect are displayed, no person shall park a vehicle where
prohibited on any highway:
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2 and 3 of Schedule "B" to this By-law.
(b) being a municipal parking lot, where such signs have been posted.
(c)
in a parking space designated for Police vehicles.
4.7
Where official signs to that effect are displayed, no person shall park a vehicle when
prohibited on any highway:
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2 and 3 of Schedule "C'" to this Bylaw during the prohibited times and/or days set
out in Column 4
of the said Schedule.
4.8
Where official signs to that effect are displayed, no person shall park a vehicle on any
highway:
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2 and 3 of Schedule "D' to this By-law during the times and/or days set out in
Column 4 of the said Schedule for a period of time longer than the 2 hours as set
out in Column 5
of the said Schedule.
(b) at the side of the highway and between the limits set out respectively in Columns 1,
2 and 3 of Schedule "E" to this By-law during the times and/or days set out in
Column 4
of the said Schedule for a period of time longer than the fifteen (15)
minutes as set out in Column 5 of the said Schedule.
(c) in a school bus loading zone, unless the vehicle is a school bus, at the sides of the
highway and between the limits as set out respectively in Columns
1 and 2 of
Schedule "F" to this by-law, during the times and days set out in Column 3 of the
said Schedule.
(d)
in a passenger loading zone, at the side of the highway and between the limits set
out respectively in Columns
1 and 2 of Schedule "G'" to this by-law during the times
and/or days set out in Column 3 when not actively loading or unloading a
passenger.
(e)
in a commercial loading zone at the side of the highway and between the limits set
out respectively in Columns
1 and 2 of Schedule "H" to this by-law during the times
and/or days set out in Column 3
or for longer than the period set out in Column 4.
Stopping Prohibited at Specified Times and Places
4.9
Where official signs to that effect are displayed, no person shall stop a vehicle where
prohibited on any highway
(a) other than a bus in a bus stop, at the side of the highway set out respectively in
Column
1 and 2 of Schedule "I" to this by-law or within 10 metres of each side of
the location.
(b) at the side of the highway and between the limits sent out respectively in Columns
1, 2 and 3 of Schedule "J" to this by-law.
4.10 Where official signs to that effect are displayed, no person shall stop a vehicle when
prohibited on any highway
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2 and 3 of Schedule "kK" to this by-law during the prohibited times and/or days set
out in Column 4
of the said Schedule.
Standing Prohibited at Specified Times and Places
4.11
Where official signs to that effect are displayed, no person shall stand a vehicle where
prohibited on any highway
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2, 3, and 4 of Schedule "L" to this by-law;
(b) Subsection 4.11(a) does not apply to those vehicles or class of vehicles as set out
in Column 5 of said Schedule "L" to this by-law.
4.12 Where official signs to that effect are displayed, no person shall stand a vehicle when
prohibited on any highway
(a) at the side of the highway and between the limits set out respectively in Columns 1,
2, 3, and 4 of Schedule "M" to this by-law during the prohibited time and/or days
set out in Column 5
of the said Schedule;
(b) Subsection 4.12(a) does not apply to those vehicles or class of vehicles as set out
in Column 6 of said Schedule "M" to this by-law.
5.
Parking of Vehicles on Private Property
5.1
5.2
5.3
5.4
No person shall park or leave a vehicle on private property without the consent of the
owner or occupant of such property.
No person shall park or leave a motor vehicle or an un-hitched trailer on property
owned or occupied by the Corporation or any local board thereof without the consent
of the Corporation or local board, as the case may be.
Where the owner or occupant of property has posted signs stating conditions on which
a motor vehicle may be parked or left on a property or prohibiting the parking or
leavings of a motor vehicle on the property, a motor vehicle parked or left on the
property contrary to such posted conditions or prohibitions shall be deemed to have
been parked or left on the property without the owner's or occupant's consent.
The enforcement of parking infractions under sections 5.1 and 5.2 shall be carried out
by Private Property Officers subject to exemptions under section 18.8 and section 19.
6.
Parking of Vehicles on Municipal Parking Lots
6.1
6.2
6.3
The lands acquired or established for the parking of vehicles shall be deemed to be a
municipal parking lot and designated as municipal parking lots under the names set
out in Schedule "N" to this by-law.
Where official signs to that effect are displayed, no person shall park a vehicle on any
municipal parking lot:
(a)
in the location(s) set out respectively in Columns
1 and 2 of Schedule "N" to this
By-law during the times/days set out in Column 3 of the said Schedule for a period
of time longer than twenty-four (24) hours as set out in Column 4
of the said
Schedule. Any vehicle parking for more than the maximum permitted time limit may
be towed from the lot at the owner's expense.
No person shall park a motor vehicle or permit a motor vehicle to remain parked in a
parking space on a municipal parking lot unless such motor vehicle is parked entirely
within an area designated as a parking space.

No person shall park a motor vehicle or permit a motor vehicle to remain parked on a
municipal parking lot in an area that is not designated as a parking space.
No person shall park or leave an un-hitched trailer on property owned or occupied by
the Corporation thereof without the consent of the Corporation, as the case may be.
Any vehicle parked on any parking lot in contravention of this By-law or any vehicle,
which may present some hazard to persons or property, may be towed or otherwise
removed from the parking lot or moved to some other location on the parking lot at the
expense of the owner.
Fire Routes

Fire Routes and Fire Lanes shall be set out in Schedule "O" to this By-law.
A designated Fire Route shall be approved by the Chief Building Official or the Fire
Chief or their designate and where applicable as provided for in the Corporation Site
Plan Control Guidelines, or any Act of the Province of Ontario pertaining to Fire
Routes.
A Fire Lane is a Fire Route that requires special consideration due to size, location or
exceptional circumstances, and must be approved and designated as such by the Fire
Chief or their designate.
Signs for Fire Routes and Fire Lanes on private property shall be provided in
accordance with sections section 17.2, 17.3, 17.4 and 17.6.
Despite sections 4.4(j) 4.4(k) and 7.1 the following, on the direction of the Fire Chief,
may be deemed to be Fire Routes or Fire lanes and included in Schedule "O" to this
by-law;
(a) within 9 metres of any lot that a Fire Hall is located on the side of the highway in
which the Fire hall is located.
(b) within 30 metres of any lot that a Fire Hall is located on the opposite side of the
highway.
(c) any highway, private property or municipal property or any portion of them.
Where official signs to that effect are displayed no person shall;
(a) park or stand a vehicle on a Fire Route.
(b) stop, stand or park a vehicle on a Fire Lane.
Overnight Parking Prohibition
8.1.
No person shall park a vehicle on any highway or boulevard adjacent thereto, or any
municipal parking lot between the hours of 11:00 p.m. pm any day to 6:00 a.m. of the
following day and during the inclusive period of the 1st day of December in any year to
the 31st day of March of the following year.
Public Works
9.1
No person shall park a vehicle in such a manner as to interfere with necessary
municipal services or road maintenance such as repairs, snow plowing or snow
removal that is already in progress, nor park a vehicle at any place where signs have
been placed indicating that snow removal or other municipal operations are to be
commenced.

10. Accessible Parking

10.1 Accessible Parking Spaces
(a) are designated on highways at the side and between the limits set out respectively
in Column 1, 2 and 3 of Schedule "P'" to this by-law.
(b) are designated on the Municipal Parking Lots set out in Schedule "Q" to this by-law
and are located as established by the Corporation.
(c) are designated and located on municipal property, as established by the
Corporation.
(d) are designated and located on private property.
10.2 A designated accessible space shall be identified in accordance with the requirements
of the Highway Traffic Act, as amended, and the regulations made thereunder.
10.3 Where official signs to that effect are displayed, no owner or driver of a vehicle shall
park, stop or leave standing or permit the parking, stopping or standing of a vehicle in
an accessible parking space except with a valid permit issued, displayed and used in
accordance with the Highway Traffic Act, as amended and the regulations made
thereunder.
Electric Vehicle Charging Spaces
11.1
No person shall park a vehicle in an electric vehicle charging space that is identified by
a sign that satisfies the prescribed requirements if the Highway Traffic Act, as
amended, unless the vehicle is an electric vehicle and is attached to the station's
charging equipment.
Parking Permits
12.1
The Corporation may issue permits authorizing parking for a specified time period in a
municipal parking lot as designated in Schedule "R" to persons who meet the eligibility
criteria, make an application, and pay the applicable fee, as set out in the Fees and
Charges By-law.
12.2 Every permit issued under 12.1 shall be valid for a specific municipal parking lot and
shall be subject to the terms and conditions established by the City for the use of that
permit.
12.3 The Corporation may reserve or assign any area or parking space in a municipal
parking lot or portions of them as provided in Schedule "S" for the exclusive use of a
particular permit holder or vehicle, or class of permit holders or class of vehicles.
12.4
All permits for any area or space shall be issued on the basis of order of receipt of
valid application.
12.5 Every permit shall be considered invalid, except if when being used;
(a)
it has acurrent validation date, and
(b)
itis being used only for the area and/or space for which the permit is issued.
12.6 Every vehicle parked without a valid permit shall be deemed to be parked without a
permit.

12.7 No person shall park a vehicle in an area or space without a permit when official signs
requiring a permit are displayed.
Reserved Parking
13.1
No person shall park a vehicle in a reserved space or area on any highway, municipal
parking lot or municipal property when official signs to the effect are displayed unless
that space is reserved for that person or vehicle.
Temporary Parking Regulations
14.1 Temporary parking regulations may be established by the City for any highway,
municipal parking lot or other municipal property to permit essential work to be carried
out, civic function or to deal with an emergency or with special circumstances.
14.2 Temporary parking regulations established in accordance with section 14.1 take effect
when signage has been installed in appropriate locations which provide public notice,
and cease to be in effect when the signage is removed.
Short Term Parking Permits
15.1
The Corporation may, upon application, issue temporary permits authorizing parking
for a specified time on a highway for a short term basis to persons who meet the
eligibility criteria and pay the applicable fee, as set out in the Fees and Charges
By-law.
15.2 Every temporary permit made under section 15.1 shall be subject to the terms and
conditions as established by the Corporation for the use of those spaces.
15.3 Every temporary permit shall be considered invalid, except if when being used;
(a)
it has a current validation date, and
(b)
it is being used only for the area and/or space for which the temporary permit is
issued.
15.4 No person shall park a vehicle in an area or space without a temporary permit on a
highway that is identified by appropriate means.
Unauthorized Area Parking
16.1
No person shall park a vehicle in an unauthorized area
Sign Installation and Placement
17.1
All signs shall be authorized by the Corporation subject to the Highway Traffic Act and
regulations thereunder.
17.2 The Director of Public Works and Environmental Services or designate shall have the
authority;
(a) to install, place or maintain any sign required to give effect to this By-law as
approved by Council;
(b) To place or erect and to maintain, pursuant to the Highway Traffic Act and
regulations thereof, temporary signs, to prohibit parking, standing or stopping of
vehicles as required for road maintenance or emergencies.

The Ontario Provincial Police Detachment Commander, or Fire Chief for the
Corporation or their designates may authorize the placement of temporary signs, to
prohibit parking, standing or stopping of vehicles as required, for emergencies.
The Clerk or Director of Public Works and Environmental Services may authorize the
placement of temporary signs, to prohibit parking, standing or stopping of vehicles as
required, for emergencies, civic functions or special circumstances that are deemed to
be sufficient for the placement of such signs.
Signs on private property shall be provided by and at the expense of the property
owner and shall be installed and maintained in good condition by the owner, as
required by the Corporation.
No person shall place, maintain, or display upon or in view of any road or upon private
property, any sign, signal, marking or device, which purports to be, or is an imitation of,
or resembles an official sign or traffic control signal, or which conceals from view or
interferes with the effectiveness of an official sign or traffic control signal, unless the
Corporation has expressly consented to the placement.
Exemptions

The requirements of this By-law shall not apply to;
(a) ambulances, police or fire department vehicles or public utility emergency vehicles
while said vehicles are responding to an emergency call, or
(b) vehicles actually engaged in works undertaken for or on behalf of the Corporation
and such work is being done at a place subject to this By-law.
Parking, stopping and standing provisions in subsections; 4.4(g), 4.5(f), 4.6(a), 4.7(a),
4.8(a), 4.10(a), 4.11(a), 4.12(a) do not apply to:
(a) a school bus when the school bus is parked, stopped or standing in a school bus
loading zone;
(b) a bus when the bus is parked, stopped or standing in a bus stop.
Standing and stopping provisions for fire routes and fire lanes in section 7.6(a) and (b)
do not apply to a school bus when the school bus is standing or stopped in order to
actively load or unload students, provided that the operator of the school bus is in
attendance on the bus during all of the time the bus is standing or stopped.
Parking and standing provisions of sections 4.6(a), 4.8(a), 4.11(a) do not apply to a
parking space reserved for a specific person or purpose when official signs to that
effect are displayed.
Parking provisions for heavy vehicles of section 4.4(e) do not apply to agricultural
vehicles when engaged in agricultural practices.
Despite sections 4.4(c),(g), and (h) and, 4.5(f), and (I) parking spaces may be
established and marked out by the Corporation, as necessary.
Temporary parking regulations established in accordance with section 14.1 take
precedence over the provisions of this by-law in the event of a conflict.
Section 5.4 does not prohibit an officer from enforcing parking infractions on private
property.
Despite Section 5.4, an Officer may enforce parking infractions on private
property.

18.9 Parking provisions for oversized vehicles do not apply when parked for the purposes of
delivery or while such vehicles are being used in conjunction with construction,
maintenance or repair which necessitates the parking of the vehicle on the highway.
19. Vehicle Towing

Despite any other penalty imposed by this By-law an Officer issuing a Parking
Infraction Notice may have the vehicle moved or removed and/or impounded at the
owner's expense.
Despite any other penalty imposed by this By-law an Officer may, without having
issued a Parking Infraction Notice, cause a vehicle to be moved or removed and/or
impounded at the owner's expense:
(a)
if such vehicle is parked so as to interfere with road maintenance, emergency
services or is blocking access to property, or;
(b)
if such vehicle is parked or left contrary to any provision of this by-law, or
(c)
if the vehicle is a derelict vehicle.
A Corporation Fire Department Officer upon discovery of a vehicle parked so as to
interfere with the carrying out of emergency fire procedures may cause the vehicle to
be moved or removed and/or impounded at the owner's expense, without a Parking
Infraction Notice having been issued.
Despite section 19.1, no Officer or Private Property Officer may impound or remove a
vehicle parked or left on private property except:
(a) where a vehicle is blocking access to the private property and upon written request
from the owner of the property delivered to the Officer issuing the Parking Infraction
Notice, or
(b) where a vehicle is parked in a Fire Route or stopped in a Fire Lane in
contravention to section 7.6.
Section 19.4 does not apply to allow towing under this By-law, by private property
owners or their employees or agents who have been appointed as Private Property
Officers for the purposes of enforcement of this By-law on private property, unless the
appointment so specifies.
All vehicle removal, moving or impounding charges and costs for removing, care and
storage, or moving thereof, if any, incurred under this by-law shall become a
lien upon
the vehicle and may be enforced pursuant to the Repair and Storage Lien Act R.S.O.
1990, c.
R 25 as amended or any successor legislation.
20. Offences and Penalties
20.1
20.2
Any person who contravenes the provisions of this By-law is guilty of an offence and,
upon conviction, is subject to a penalty and all such penalties shall be recoverable
pursuant to the provisions as provided in the Provincial Offences Act.
If
a vehicle has been left parked, stopped or standing in contravention of this by-law,
the owner of the vehicle, even though the owner was not the driver of the vehicle at the
time of the contravention of the by-law, is guilty of an offence and, upon conviction, is
subject to a fine as provided in the Provincial Offences Act unless, at the time of the

offence, the vehicle was in the possession of some person other than the owner
without the owner's consent.
20.3 Each day a vehicle is parked, stopped or standing, in contravention to this by-law, is a
separate offence except that of the time period of 11:00 PM to 6:00 AM in section 8.1
shall be considered as the same day.
20.4 Every person to whom a Parking Infraction Notice has been issued alleging that a
provision of this By-law has been contravened, may pay a voluntary reduced penalty
for that offence to the Corporation within 10 days of the date that the parking infraction
notice was issued.
20.5 Despite section 20.1, any person who contravenes this by-law with respect to parking
a vehicle in an accessible parking space without displaying a valid accessible parking
permit is guilty of an offence and, upon conviction, is liable to a fine, as required by
section 427 of the Municipal Act.
21. Validity
21.1
If a court of competent jurisdiction declares any provision, or any part of a provision, of
this by-law to be invalid, or to be of no force or effect, the provision or part is deemed
severable from the remainder of the By-law, and
it is the intention of Council in
enacting this By-law that the remainder of the By-law be applied and enforced in
accordance with its terms to the extent possible according to law.
22. Repeals
22.1
That By-law Numbers 12-124, 13-20, 13-82, 13-129, 13-142, 14-24, 14-61, 15-037,
15-143, 16-006, 16-030, 16-039, 16-043, 16-079, 16-144, 17-059, 17-107, 17-135,
18-040, 21-009, 21-032, 21-067, 21-068 and 21-115 shall be repealed upon this
~~By-law coming into force and effect.
23. Commencement
23.1
This bylaw comes into force upon receipt of the approval of set fines and voluntary
early payments from the Regional Senior Justice for offences created by this By-law.
