THE CORPORATION OF THE MUNICIPALITY OF RED LAKE BY-LAW NO. 1235-09 BEING A BY-LAW TO REGULATE THE SPEED OF MOTOR VEHICLES AND ERECTION OF MUNICIPAL STREET SIGNS WHEREAS Section 128(2) of the Highway Traffic Act, S.O. 1990, as amended, enables the council of a municipality to prescribe the rate of speed for motor vehicles driven on a highway or portion of a highway under its jurisdiction. WHEREAS Section 214.1(1) of the Highway Traffic Act, S.O. 1990, as amended, enables the council of a municipality to designate a part of a highway under its jurisdiction as a community safety zone if, in the council's opinion, public safety is of special concern on that part of the highway. WHEREAS Section 10(1) of the Municipal Act, S.O. 2001, as amended, provides that a single-tier municipality may provide any service or thing that the municipality considers necessary or desirable for the public. WHEREAS Section 10(2) of the Municipal Act, S.O. 2001, as amended, provides that a single-tier municipality may pass by-laws respecting the health, safety and well-being of persons; and may pass by-laws respecting structures, including fences and signs. NOW THEREFORE the Council of The Corporation of the Municipality of Red Lake HEREBY ENACTS AS FOLLOWS: SECTION 1 - DEFINITIONS 1.1 "By-Law Enforcement Officer" means an officer appointed by the Municipality for enforcing or carrying out the provisions of this By-Law. 1.2 "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle designed and intended for, or used by, the general public for the passage of vehicles. 1.3 "Motor Vehicle" includes an automobile, motorcycle and any other vehicle propelled or driven otherwise than by muscular power; but does not include a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road-building machine within the meaning of The Highway Traffic Act. 1.4 "Municipality" means The Corporation of the Municipality of Red Lake. 1.5 "Signs, Signals, Markings" shall include every sign, light signal or device consistent with this By-Law or The Highway Traffic Act (Ontario), placed or erected by the authority of the Municipality for the purpose of regulating, warning or guiding traffic. 1.6 "Temporary Signs" means any portable sign, signal, or device placed under the authority of the Planning Administrator or Operations Superintendent for the purpose of regulating traffic. 1.7 "Vehicle" means a motor vehicle, motorized snow vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power. SECTION 2 - TRAFFIC SIGNS AND SIGNALS 2.1 Signal light traffic systems as referred to in the Highway Traffic Act shall be installed at the intersection of the streets as designated in Schedule "A" to this by-law. SECTION 3 - MOVEMENT OF TRAFFIC 3.1 No person shall make a U-Turn: a) upon any highway unless it can be made in safety without interfering with other traffic; b) at any intersection where a "No U-Turn" Sign has been erected. 3.2 The Provisions of Schedule "B" hereto shall apply to and govern the directions of traffic on those highways more particularly set forth in Schedule "B" hereto, except that where specifically provided for in the said schedule, the provision of the by-law shall otherwise govern traffic on such highways. SECTION 4 - RATES OF SPEED 4.1 No person shall drive a motor vehicle at a greater rate of speed than forty (40) kilometers per hour on any highway under the jurisdiction of the Municipality of Red Lake. SECTION 5 - PROVISIONS REGULATING TRAFFIC AT INTERSECTIONS 5.1 Where prescribed signage is erected on a highway facing traffic as set out in Column 1 of Schedule "C" to this by-law, no vehicle shall turn in the direction set out in Column 2 of the said schedule during the times or days set out in Column 3 of said schedule. 5.2 Where officially prescribed signs under the authority of the Highway Traffic Act, RSO 1990 and Regulations have been erected, the intersections set out in Column 1 of Schedule "D" are hereby designated as "Stop Intersections" for traffic as set out in Column 2 of the said Schedule. 5.3 When officially prescribed signs under the authority of the Highway Traffic Act, RSO 1990 and Regulations have been erected, the intersections set out in Column 1 of Schedule "E" are hereby designated as "Yield Intersection" for traffic as set out in Column 2 of the said schedule. 5.4 Where prescribed signs have been erected and are on display, no person operating a vehicle on a highway as set out in Column 1 of Schedule "F" to this by-law shall enter into a highway as set out in Column 2 of said Schedule in the direction as set out in Column 3 of said Schedule. SECTION 6 - COMMUNITY SAFETY ZONES 6.1 The areas listed in Schedule "G" of this By-Law are designated Community Safety Zones. SECTION 7 - LIST OF SCHEDULES 7.1 Schedule "A" Signal Light Traffic System Schedule "B" One-Way Streets Schedule "C" Prohibited Turning Movements Schedule "D" Stop Signs at Intersections Schedule "E" Yield Intersections Schedule "F" Do Not Enter Schedule "G" Community Safety Zones SECTION 8 - ENFORCEMENT AND PENALTIES 8.1 Notwithstanding this by-law, persons are subject to the Highway Traffic Act and any other applicable legislation. SECTION 8 - ENFORCEMENT AND PENALTIES - Continued 8.2 If a court of competent jurisdiction declares any provision, any part of a provision, in the by-law to be invalid, or to be of no force and effect, it is the intention of Council in enacting this by-law that each and every provision in this by-law authorized by by-law that be applied and enforced in accordance with the terms to the extent possible according to law. 8.3 Everyone who contravenes any provision of this by-law is guilty of an offence, and on conviction is liable to punishment as provided for under the Highway Traffic Act. SECTION 9 - REPEAL 9.1 By-law No. 1039-08 of the Corporation of the Municipality of Red Lake is hereby repealed. 9.3 That this By-law shall come into force and take effect on the final passing thereof.
