Disabled Parking - Signs - Displayed ................................................. 83 Article 1 Interpretation 1116.1.1 Actively Charging - defined "Actively Charging" means the period during which an Electric Vehicle is connected to an Electric Vehicle Charge Station and electricity is actively delivered to the Electric Vehicle's battery, as indicated by the Electric Vehicle Charge Station's network, display or visual indicators. By-law 142-25, 10 December, 2025. 1116.1.2 Administrative penalty - defined "administrative penalty" means an administrative penalty established by the Administrative Penalty By-law for contravention of this Chapter. By-law 27-17, March 27, 2017. 1116.1.3 Administrative Penalty By-law - defined "Administrative Penalty By-law" means the Town's By-law No. 69-16 establishing a system of administrative penalties enacted pursuant to section 102.1(1) of the Municipal Act, 2001, S.O. 2001 and O. Reg. 333/07, as amended. By-law 27-17, March 27, 2017. 1116.1.4 Authorized sign - defined "authorized sign" means any sign, curb or sidewalk marking or other de- vice placed or erected on a highway under the authority of this Chapter for the purpose of regulating, warning or guiding traffic. By-law 402-89, 6 November, 1989. 1116.1.5 By-law Enforcement Officer - defined "By-law Enforcement Officer" means any employee of the Town who is appointed as such by the Commissioner of Planning and Development of the Town. By-law 145-08, 14 July, 2008. 1116.1.6 Boulevard - defined "boulevard" means the area between the travelled portion of the highway and limit of the highway right-of-way, but does not include a gravel shoulder. CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 1116.1.7 Cul-de-sac - defined "cul-de-sac" means the area at the end of a closed ended street designed for vehicles to turn around and may include a decorative centre island. By-law 179-96, 15 July, 1996. 1116.1.8 Commissioner - defined "Commissioner" means the Commissioner of Engineering and Public Works or his or her authorized deputy or representative. By-law 31-07, 26 June, 2007. 1116.1.9 Designated disabled parking space - defined "designated disabled parking space" means a parking space clearly marked and identified with a sign or symbol and provided for the exclusive use of motor vehicles operated by or used for conveying a disabled person and displaying a permit in accordance with the requirements of the Highway Traffic Act, and the regulations made thereunder. By-law 311-90, 10 September, 1990. 1116.1.10 Director of Operations - defined "Director of Operations" means the individual occupying the position of the City's Director of Public Works Operations from time to time, or any successor position and includes any person designated to fulfill any of the Director of Operation's powers or duties under this by-law. By-law 107-19, July 9, 2019. 1116.1.11 Electric Vehicle - defined "Electric Vehicle" means a Motor Vehicle that is powered wholly or partially by electricity and is capable of being charged by an Electric Vehicle Charge Station and shall include battery electric vehicles and plug-in hybrid electric vehicles. By-law 142-25, 10 December, 2025. 1116.1.12 Electric Vehicle Charge Station - defined "Electric Vehicle Charge Station" means a device or group of devices installed for the purpose of transferring electricity to a battery in an Electric Vehicle through a connection between the station and the vehicle. By-law 142-25, 10 December, 2025. 1116.1.13 Electric Vehicle Charging Space - defined "Electric Vehicle Charging Space" means a parking space equipped with an Electric Vehicle Charge Station and signed for the purpose of charging an Electric Vehicle. By- law 142-25, 10 December, 2025. 1116.1.14 Engaged in a Charging Session - defined "Engaged in a Charging Session" means the period during which an Electric Vehicle remains physically connected to an Electric Vehicle Charge Station, whether or not electricity is actively being drawn, and the session remains open or ongoing on the Electric Vehicle Charge Station's network, display or visual indicators. CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 1116.1.15 Fire route - defined "fire route" means a private roadway providing vehicular access to or from a building or structure and designated as a fire route and shall include any part of a parking lot designated by visible markings or markers as a fire route. 1116.1.16 Hearing Officer - defined "Hearing Officer" has the meaning set out in the Administrative Penalty By-law. By-law 27-17, March 27, 2017. 1116.1.17 Highway - defined "highway" includes a common or public highway, street, avenue, boulevard, parkway, driveway, island, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of motor vehicles. 1116.1.18 Interfere with winter operations - defined "Interfere with Winter Operations" means to require the change of course, or to prevent the continuance on a course, or to in any way limit the effectiveness of materials and/or equipment used for winter operations. By-law 107-19, July 9, 2019. 1116.1.19 Intersection - defined "intersection" means the travelled portion of a highway embraced by the extension of the curb lines to where such lines intersect or, where no curbs exist, the travelled portion of a highway embraced by lines extended 4.25 metres (14 feet) on either side, and parallel to, the centerline of a highway. 1116.1.20 Motor vehicle - defined "motor vehicle" means any vehicle drawn, propelled or driven by any kind of power, except muscular power, and includes a trailer, motorcycle, traction engine, farm tractor and road-building machine. 1116.1.21 Motor vehicle owner - defined "motor vehicle owner" means the registered owner of a motor vehicle as registered with the Ministry of Transportation of Ontario. By-law 179-96, 15 July, 1996. 1116.1.22 Municipal By-law Enforcement Officer - defined "Municipal By-law Enforcement Officer" means all persons who are appointed under section 15 of the Police Services Act, R.S.O. 1990, c. P.15, as amended by the Commissioner of Planning and Development of the Town to enforce the provisions of this Chapter in specific areas as designated. By-law 145-08, 14 July, 2008. 1116.1.23 Non-municipal property - defined "Non-municipal property" means land that is not a Highway and is not owned or occupied by the City and shall include private property. By-law 18-22, 13 April, 2022. 1116.1.24 Occupant - defined CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 "occupant" means: the tenant of the property or part thereof whose consent shall extend only to the control of the land of which he or she is tenant, and any parking spaces allotted to him or her under his or her lease or tenancy agreement; the spouse of a tenant; a person or a municipality or a local board thereof, having an interest in the property under an easement or right-of-way granted to or expropriated by the person, municipality or local board whose consent shall extend only to the part of the property that is subject to the easement or right-of-way; or a person authorized, in writing, by an occupant as defined in Section 1116.1.11 (a), (b) or (c), to act on the occupant's be- half for requesting the enforcement of a provision of this Chapter. 1116.1.25 Officer - defined "officer" means a Municipal By-law Enforcement Officer or a police officer employed by York Regional Police, Ontario Provincial Police or the Royal Canadian Mounted Police. By-law 27-17, March 27, 2017. 1116.1.26 Owner - defined "owner," when used in relation to property, means: the registered owner of the property; the registered owner of a condominium whose consent shall extend only to the control of the unit of which he or she is the owner, and any parking spaces allotted to him or her by the condominium corporation, or reserved for the owner's exclusive use in the declaration or description of the property; the spouse of a person described in Section 1116.1.12 (a) and (b); where the property is included in a description registered under the Condominium Act, the board of directors of the condominium corporation; or a person authorized, in writing, by the property owner as de- fined in Section 1116.1.12 (a), (b), (c) or (d) to act on the owner's behalf for requesting the enforcement of any provision of this Chapter. 1116.1.27 Park or parking - defined "park or parking" means the halting of a motor vehicle, whether occupied or not, except when halting temporarily for the purpose of, and while actually engaged in, loading or unloading goods or passengers. By-law 402-89, 6 November, 1989. 1116.1.28 Parking infraction - defined "parking infraction" means any unlawful parking, standing, or stopping of a vehicle in contravention of this Chapter. By-law 8-19, February 11, 2019. 1116.1.29 Repealed: By-law 27-17, 27 March, 2017 1116.1.30 Parking space - defined "parking space" means any area of a highway designated under this Chapter for motor CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 vehicle parking. 1116.1.31 Pay Parking Area - defined "Pay Parking Area" means any part of a roadway or any area specifically set aside for the parking of vehicles for a fee, as set out in Schedule 'H'. 1116.1.32 Pay Parking Device - defined "Pay Parking Device" means a device designed and installed to accept tender in consideration for parking and includes a parking meter, pay and display machine, pay by plate machine, and other similar devices. 1116.1.33 Repealed: By-law 179-96, 15 July, 1996 1116.1.34 Repealed: By-law 17-23, 8 February, 2023 1116.1.35 Pedestrian crossover - defined "pedestrian crossover" means any portion of a highway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the highway. By-law 17-23, 8 February, 2023. 1116.1.36 Pedestrian crosswalk - defined "pedestrian crosswalk" means any portion of a highway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs on the highway or by lines or other markings on the surface of the highway. By-law 17-23, 8 February, 2023. 1116.1.37 Penalty notice - defined "penalty notice" means a notice in relation to a parking infraction issued pursuant to the Administrative Penalty By-law. By-law 27-17, March 27, 2017. 1116.1.38 Physically disabled person - defined "physically disabled person" means a person who is physically disabled in such a way that his or her mobility is seriously restricted either permanently or temporarily including, without limiting the generality of the foregoing, a person who uses a wheelchair, crutches, braces or other mobility-assisting devices. 1116.1.39 Private roadway - defined "private roadway" means any private road, private driveway, lane, ramp, or other means of motor vehicle access to or egress from a building or structure and it may include part of a parking lot. By-law 402-89, 6 November 1989. 1116.1.40 Roundabout or traffic circle - defined "roundabout" or "traffic circle" means an intersection of two or more highways with a raised circular island located in the centre. By-law 32-11, 28 March, 2011. 1116.1.41 School bus loading zone - defined "school bus loading zone" means an area marked by signs indicating such area to be for CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 the sole use of school buses engaged in receiving or discharging passengers. 1116.1.42 Screening Officer - defined "Screening Officer" has the meaning set out in the Administrative Penalty By-law. By- law 27-17, March 27, 2017. 1116.1.43 Sidewalk - defined "sidewalk" means that portion of a boulevard which is paved, bricked or otherwise hard surfaced and intended for the use of pedestrians. 1116.1.44 Stop or stopping - defined "stop or stopping" means the halting of a motor vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict or in compliance with the directions of a police officer or of a traffic control sign or signal. 1116.1.45 Town - defined "Town" means The Corporation of the Town of Richmond Hill. By-law 402-89, 6 November, 1989. 1116.1.46 Winter event - defined "Winter Event" means an icefall or an accumulation of snow that is likely to exceed 5 cm is likely to occur within the next 24 hours, as declared by the Director of Operations in accordance with the provisions of this by-law. By-law 107-19, July 9, 2019. 1116.1.47 Winter operations - defined "Winter Operations" means the use of equipment and/or materials to ensure that roadways remain relatively clear of snow and ice, whether prior to or subsequent to any snowfall, including, but not limited to, the application of salt, sand, or like materials and the use of a plow for the removal of snow and ice. CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 Article 2 Traffic Sign - Signal 1116.2.1 Erected - by Commissioner - purpose The Commissioner of Planning and Infrastructure is authorized to place or erect and maintain such authorized signs and traffic control signals as are required to give effect to the provisions of this Chapter or as are required to warn or guide traffic for the safety or convenience of the public. By-law 31-07, 26 February, 2007; By-law 89-19, 11 June, 2019. 1116.2.2 Authorized sign - imitation of - prohibited No person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles an authorized sign or traffic control signal, or which conceals from view or interferes with the effectiveness of an authorized sign or traffic control signal. 1116.2.3 Yellow paint - on curb - declared an authorized sign Yellow paint applied to a curb is hereby declared to be an authorized sign indicating that parking is prohibited where the curb is so marked. CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 Article 3 General Stopping - Parking Regulations 1116.3.1 Highway - parking on - location - direction of travel No person shall park a motor vehicle on any highway unless on the right hand side of the highway having regard for the direction in which the motor vehicle had been proceeding, but this provision shall not apply to pre- vent the parking of a motor vehicle on the left hand side of a designated one-way highway unless prohibited by sign. 1116.3.2 Curb - parking - distance from - exception No person shall park a motor vehicle on any highway unless the motor vehicle is parallel to and not more than 30 centimetres (12 inches) from the curb or boundary of the highway, but this Section shall not apply where angle parking is permitted under Sections 1116.3.3 through 1116.3.5 inclusive. 1116.3.3 Angle parking - conditions - set out Angle parking shall be permitted in those areas designated as such under Schedule 'F' to this Chapter subject to the conditions set out in Sections 1116.3.4 and 1116.3.5. 1116.3.4 Angle parking - front facing curb - 45 degree angle No person shall park any motor vehicle except at an angle of 45 degrees from the curb or boundary of the travelled portion of a highway with the front end of the motor vehicle at such curb or boundary. By-law 402-89, 6 November, 1989. 1116.3.5 Parking - lines - painted - vehicle within space Where parking spaces are designated by lines painted on the highway or a parking lot, no person shall park any motor vehicle so as to infringe upon or take up more than one parking space. By-law 402-89, 6 November, 1989. 1116.3.9 Disabled parking - permit - required No person shall park or stop a motor vehicle in a designated disabled parking space unless that person is the driver of a motor vehicle on which a handicapped permit is properly displayed and which is being driven by or is carrying one or more physically disabled persons. (By-law 18-22, 13 April, 2022. 1116.3.12 Private property - parking - when deemed without consent For the purposes of Section 3.11, where an owner or occupant of Non-municipal property has posted signs stating conditions on which a motor vehicle may be parked or left on the property, a motor vehicle parked or left on the Non-municipal property contrary to such conditions or prohibition shall be deemed to have been parked or left without consent. By-law 402-89, 6 November, 1989. 1116.3.15 Municipal property - parking - continuous - limited Subject to posted signs stating otherwise, no person shall leave any motor vehicle on property owned or occupied by the Town or a local board thereof for a continuous period of twenty-four hours. By-law 95-05, 25 September, 2005. 1116.3.16 Exemption - emergency - public works vehicles This Chapter shall not apply to ambulances, police and fire department motor vehicles, public utility motor vehicles and motor vehicles actually engaged in works undertaken for the Town if compliance herewith would seriously interfere with the function which the motor vehicle is performing. 1116.3.17 Time - Eastern Standard - Daylight Savings Where any hour or other period of time is stated, the time referred to shall be Eastern Standard Time except in periods when Daylight Saving Time has been declared in effect, in which periods it shall be Daylight Saving Time. By-law 402-89, 6 November, 1989. 1116.3.18 Time - parking permitted - days limited - Schedule 'G' Notwithstanding anything in this Chapter to the contrary, parking shall be permitted at those places designated in Schedule 'G' for the period specified therein and during the days and time specified therein. By-law 402-89, 6 November, 1989; By- law 179-96, 15 July, 1996. 1116.3.20 Pay Parking Area - Authorized permit - required No person shall park a vehicle in a Pay Parking Area without first obtaining an authorized parking permit form the City. 1116.3.21 Parking - Pay Parking Area - space occupied No person shall park a vehicle in a Pay Parking Area unless that person parks the vehicle wholly within one parking pace. If a person cannot so park because of the vehicle's length or width, that person may park the vehicle within more than one space, CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 but shall pay the required fee for each space partly or wholly occupied. 1116.3.22 Pay parking device - payment No person shall deposit or cause to be deposited in any Pay Parking Device anything other than and accepted credit or debit card or legal tender of the Dominion of Canada. 1116.3.23 Winter Event - Declaration by Director of Operations - Public Notice The Director of Operations may declare a winter event at any time the Director of Operations, in the Director of Operation's sole and absolute discretion, determine s that a winter event is occurring or is likely to occur within the next 24 hours by arranging for public notice by a minimum of the following means: (a) the issuance of a media advisory; and (b) posting notice of the same on the City's public website. The Director of Operations may arrange for any additional notice that has a reasonable likelihood of coming to the attention of affected persons. The Winter Event shall commence immediately upon the giving of the notice. The Winter Event shall end upon the giving of a further notice by the Director of Operations by the same means listed above. Article 4 Permit Parking 1116.4.1 Area designated - Schedule 'E' The area described in Schedule 'E' is designated for permit parking only. 1116.4.2 Parking - designated hours - permit displayed - only Where properly worded signs have been erected and are on display, no person shall park a motor vehicle in an area designated for permit parking only, during the hours designated therein, except a motor vehicle issued a parking permit by the Town on which such parking permit is readily and openly displayed upon the front windshield. Article 5 Electric Vehicle Designated Parking 1116.5.1 Electric Vehicle Charging Space Restrictions No person shall park or stop a Motor Vehicle in an Electric Vehicle Charging Space unless: By-law 142-25, 10 December, 2025. Any Motor Vehicle found in contravention of this Section may be issued a Penalty Notice and be subject to overstay charging fees and removal overstay charging fees and removal in accordance with this Chapter. By-law 142-25, 10 December, 2025. 1116.5.2 Exemptions to Timed Parking Restriction Notwithstanding anything in this Chapter to the contrary, where an Authorized Sign has been erected in connection with an Electric Vehicle Charging Space permitting parking and stopping for the purpose of Actively Charging, an Electric Vehicle may remain parked in an Electric Vehicle Charging Space: By-law 142-25, 10 December, 2025. (a) for more than 3 hours, provided the Electric Vehicle is Actively Charging; and By-law 142-25, 10 December, 2025. (b) overnight between 11:30p.m and 7a.m., provided the Electric Vehicle is Actively Charging or Engaged in a Charging Session. By-law 142-25, 10 December, 2025. 1116.5.3 Payment of Charging Fees (a) The operator or owner of an Electric Vehicle parked in an Electric Vehicle Charging Space shall pay all applicable user fees as prescribed by the City's Tariff of Fees By-law, as amended. By-law 142-25, 10 December, 2025. (b) All charging fees shall be paid by a City accepted credit or debit card or legal tender of the Dominion of Canada. By-law 142-25, 10 December, 2025. (c) Where an Electric Vehicle remains parked in an Electric Vehicle Charging Space after it has ceased Actively Charging, an overstay fee may apply in accordance with the time increments and associated amounts and conditions set out in the City's Tariff of Fees By-law, as amended. (d) Overstay fees shall not apply between the hours of 11:30p.m. and 7a.m. provided that the Electric Vehicle remains Engaged in a Charging Session, and the Vehicle is not parked for more than ten consecutive hours. (e) The payment of Electric Vehicle charging fees, where applicable in any pay parking area, shall be in addition to any pay parking fee, except where a person holds a valid resident or facility parking permit granting exemption from the parking fee. CHAPTER 1116 PARKING - REGULATION RICHMOND HILL 1116 December 2025 Article 6 Penalty 1116.6.1 Penalty notice- issue - for contravention An officer, upon discovery of any motor vehicle parked or left in contravention of this chapter may issue a penalty notice, which must be served in accordance with the requirements of the Administrative Penalty By-law. By-law 27-17, March 27, 2017. 1116.6.2 Parking penalty notice- payment Upon issuance of a Penalty Notice, the owner of the motor vehicle shall be liable to pay to the Town an administrative penalty in the amount specified in Schedule "A" to the Administrative Penalty By-law. By-law 27-17, March 27, 2017. 1116.6.3 Penalties - - review - Screening Officer - Hearing Officer A person who is served with a Penalty Notice may request a review of the Administrative Penalty by a Screening Officer in accordance with the timelines and process set out in the Administrative Penalty By-law. A person may further request a review by a Hearing Officer of the decision of a Screening Officer in accordance with the timelines and process set out in the Administrative Penalty By-law. By-law 27-17, March 27, 2017. 1116.6.4 Vehicle - on private property - removal - storage In addition to any other penalty provided for in this Chapter, a Police Officer, or Municipal By-law Enforcement Officer upon written complaint of an owner or occupant of Non-municipal property, may cause a motor vehicle that is parked in contravention of this Chapter to be removed and taken to and stored in a safe place. By-law 18-22, 13 April, 2022. 1116.6.5 Vehicle - removal - storage - authority In addition to any other penalty provided for in this Chapter, an agent of the Town may cause a motor vehicle that is parked on property owned or occupied by the Town, in contravention of this Chapter, to be removed and taken to and stored in a suitable place. 1116.6.6 Vehicle - removal - storage - charge to owner Where a motor vehicle is removed and stored pursuant to Section 1116.5.4 or 1116.5.5, all costs and charges for removing, care and storage of the motor vehicle shall be paid by the motor vehicle owner and shall be a lien on the motor vehicle which may be enforced in the same manner as provided for in the Repair and Storage Liens Act.
