## CORPORATION OF THE TOWNSHIP OF RIDEAU LAKES BY-LAW NO. 2019-60 ## BEING A BY-LAW TO REGULATE BACKYARD CHICKENS IN RESIDENTIAL AREAS WHEREAS the Municipal Act, R.S.O. 2001, C.25 authorizes Council to pass By-laws for prohibiting or regulating the keeping of animals or any class thereof within the municipality or defined area thereof: NOW THEREFORE the Council of The Corporation of the Township of Rideau Lakes enacts as follows: ## SECTION 1: DEFINITIONS 1. For the purposes of this By-law the following definitions shall apply: - a. "Hen" shall mean a female chicken kept for its eggs or meat. - b. "Rooster" shall mean a male chicken kept for its meat or fertilization purposes - c. "Chicken run" shall mean a secure enclosure that allows chickens access to outdoors. - d. "Coop" shall mean a fully enclosed weatherproof building where chickens are kept and which the interior includes nest boxes for egg laying (if applicable), perches for the chickens to sleep on, and food and water containers. - e. "At Large" shall mean a chicken being outside of a coop or chicken run ## SECTION 2: GENERAL PROVISIONS 1. The following policies apply to residential properties within zones that permit residential use in the Township's Zoning By-law (2005-6). - a. The By-Law shall not apply to properties zoned Rural or Agricultural that are more than 1 hectare in size. - b. A maximum of 10 chickens are permitted. - c. The maximum size of all coops on the property shall not exceed 10sqm. - a. In rental situations tenants must obtain permission from the property owner to keep chickens on the owner's property. - e. Coops and runs must be kept clean and shall be maintained on a weekly basis. - f. Feed shall be stored in a container, secure from mice, rats, and other vermin. - g. Manure must be stored and managed in a manner which will not cause an adverse effect, as defined by the Environmental Protection Act (1990) in Subsection 14(1) (or any amendments hereto). - h. Stored manure shall be kept in an enclosed structure such as a compost bin and no more than three cubic feet shall be stored at any one time. - i. At the end of use of the stored manure, it shall be composted or moved to an off-site disposal area. - i. If negative conditions arise as a result of manure storage, the storage must be emptied forthwith and all manure be disposed of to an appropriate off-site disposal area. - k. The following additional provisions shall apply to properties designated Village and Hamlet in the Township's Official Plan: - i. Roosters are prohibited - ii. Coops and runs shall be constructed to contain hens at all times and to provide protection from predators - iv. Hens must be in their coops from dusk to dawn - ili. Hens must be in their runs when not in their coop - v. No owner shall cause or permit their hens to be at large ## SECTION 3: SETBACKS 1. Chicken coops and runs shall be a minimum of: - a. 15m from a waterbody - b. 15m from all wells - c. 6m from rear and interior side lot lines - d. In accordance with Section 3.23 Street and Private Right-of-Way Setbacks of Zoning By-law 2005-6 or any related section of a future Zoning By-law. 2. Chicken coops and runs must not be located in any front or exterior side yard, however shall be a minimum of 10m from these yards ## SECTION 4: ENFORCEMENT 1. This By-law shall be enforced by the Municipal By-Law Enforcement Officer. This By-law shall come into force and take effect immediately upon the day of final passing thereof.
