OFFICE CONSOLIDATION
BY-LAW 2000- 53
THE CORPORATION OF THE TOWNSHIP OF RIDEAU LAKES
BEING a By-Law to regulate traffic and parking on highways.
WHEREAS various Provincial Acts provide that municipalities may, by by-law, regulate traffic and
parking on certain highways within the municipal jurisdiction and on other land,
NOW THEREFORE the Council of the Corporation of the Township Rideau Lakes enacts as
follows:
PART I
DEFINITIONS AND INTERPRETATIONS
1. DEFINITIONS
In this By-Law:
1.
"area municipality" means The Township of Rideau Lakes.
2.
"bicycle" includes and device which has two tandem wheels and is propelled by
human power and upon which any person may ride, and a tricycle.
3.
"boulevard" means all the parts of the highway save and except any roadway, shoulder
or sidewalk and
a)
"outer boulevard" means that part of the highway lying between any sidewalk and
the traveled portion of the highway or the near edge of the shoulder where such
exists;
b) "inner boulevard" means that part of the highway lying between the prope1ty line
and the edge of the sidewalk nearest to the property line and where there is no
sidewalk, it means that part of the highway lying between the property line and
the traveled portion of the highway of the edge of the shoulder, where such
exists, furthest from the traveled portion of the highway.
4.
"By-Law Enforcement Officer" means the person(s) appointed for the purpose of
enforcing the by-laws of the Township of Rideau Lakes.
5.
"Ontario Provincial Police" means any officer of the detachment of the Ontario
Provincial Police providing services in the Township of Rideau Lakes.
6.
"comer" with reference to a highway intersection means the point of intersection of the
prolongation of the lateral curb lines or in the absence of curbs the prolongation of the
edges of the roadways.
7.
"Corporation" means The Corporation of the Township of Rideau Lakes.
8.
"crosswalk" means :
a) that part of a highway at an intersection that is included within the connections of
the lateral lines of the sidewalks on the opposite side of the highway measured
from the curbs or, in the absence of curbs, from the edges of the roadway; or
b) any portion of a roadway at an intersection or elsewhere distinctly indicated for
pedestrian crossing by signs or by lines or other markings on the surface.

9.
"driveway" means a part of a highway improved to provide vehicular access from
the roadway to a laneway or a parking area on adjacent land.
10.
"engineer" means the Engineer or Road Superintendent of the Corporation of the
Township of Rideau Lakes.
11.
"gross weight" means the combined weight of vehicle and load.
12.
"disable person parking permit" means a parking permit issued to a disabled person
by the Minister of Transportation in accordance with the Highway Traffic Act and
its Regulations.
13.
"highway" includes the entire right-of-way of a common and public highway,
street, avenue, parkway, driveway, square, place, bridge, viaduct, or trestle, designed
and intended for, or used by, the general public for the passage of vehicles.
14.
"highway, one-way" means a highway upon which the movement of vehicular
traffic is limited to one direction .
15.
"holiday" includes Sunday, New Years Day, Good Friday, Easter Monday,
Victoria Day, Canada Day, the Day proclaimed as a Civic Holiday by the
Corporation, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day,
Boxing Day, the Day proclaimed as the Birthday or day fixed by proclamation of
the Governor General for the celebration of the birthday of the Reigning Sovereign,
and any day appointed by proclamation of the Governor General or the Lieutenant
Governor-in-Council as a public holiday or for a general fast or thanksgiving, and
the next following day when such holiday falls on a Sunday.
16.
"intersections" mean the area embraced within the prolongation of connection of
the lateral curb lines or, in none, then of the lateral boundary lines of two or more
highways which join one another at an angle, whether or not one highway crosses
the other.
17.
"King's Highway" means a highway designated under The Public Transportation
and Highway Improvement Act.
18.
"Janeway" means improved land adjacent to the highway which provides access
from the highway to a parking area on adjacent land.
19.
"loading zone" means the part of a highway set apart for the exclusive purpose of
parking a vehicle to load or unload the same.
20.
"motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless
otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or
d1iven otl1erwise than by muscular power, but does not include the cars of electric
or steam railways, or other motor vehicles running only upon rails, or a motorized
snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry
or road building machine within the mean of The Highway Traffic Act.
21.
"park" or "parking" when prohibited means the standing of a vehicle, whether
occupied or not, except when standing temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers.
22.
"parking space" means that part of the surface of the roadway the use of which is
designated for the purpose of vehicle parking.
23.
"pedestrian" means:
a)
a person on foot; or
b)
an invalid, child or other person in a wheeled chair, baby carriage, or play
vehicle.
24.
"pedestrian crossover" as defined in The Highway Traffic Act means any portion of a
roadway, designated by this By-Law, at an intersection or elsewhere, distinctly

indicated for pedestrian crossing by signs on the highway and lines of other markings
on tl1e surface of the roadway as prescribed by regulations made under The Highway
Traffic Act.
25.
"special constable" means a person so appointed in accordance with Section 53(1) of
the Police Services Act.
26.
"roadway" means that part of the highway which is improved, designed or ordinarily
used for vehicular traffic, but does not include the shoulder, and, where a highway
includes two or more separate roadways, the term "roadway" refers to any one roadway
separately and not to all of the roadways collectively.
27.
"roadway, laned" means a highway which has been divided into separate lanes for
vehicular traffic which lanes are indicated by lines or other markings on the surface of
the roadway or in any other manner.
28.
"safety zone" means the area established within a roadway for the exclusive use of
pedestrians, protected or so marked or indicated as to be plainly visible at all times.
29.
"shoulder" means that part of the highway immediately adjacent to the traveled portion
of the roadway and having a surface which has been improved for the use of vehicles
with asphalt, concrete or gravel.
30.
"side approach" means the side of a part of a highway to which vehicular traffic may
lawfully approach.
31.
"side, leaving" , means the side of a part of a highway opposite the approach side.
32.
"sidewalk" includes all such parts of a highway as are set aside by an area
municipality, or the regional municipality for the use of pedestrians or used by the
general public for the passage of pedestrians.
33.
"sign, authorized" means any sign or roadway, curb or sidewalk marking or other
device placed or erected on a highway under the authority of this By-Law for the
purpose of regulating, warning or guiding traffic.
34.
"sign, official" means a sign approved by the Ministry of Transportation Ontario.
35.
"sign, point" means a point on the curb or edge of the roadway opposite a sign

"stand" or "standing" when prohibited, means the halting or a vehicle, whether
occupied or not, except for the purpose of and while actually engaged in receiving or
discharging passengers.
37.
"stop" or "stopping" when prohibited, means the halting of a vehicle, even
momentarily, whether occupied or not, except when necessary to avoid conflict with
other traffic or in compliance with the directions of a traffic control sign or signal.
38.
"through highway" means any highway or part of a highway so designated by this
By-Law.
39.
"traffic" includes pedestrians, animals which are ridden, led or herded, vehicles, and
other conveyances either singly or together while using a highway for the purposes
of travel.
40.
"traffic control device" means any sign, signal or other roadway, curb, or sidewalk
marking, or any other device erected or placed under the autho1ity of this By-Law
for the purpose of warning, regulating, guiding or directing traffic.
41.
"vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-
building machine and any vehicle drawn, propelled or driven by any kind of power,
including muscular power, but does not include a motorized snow vehicle, or the
cars of elect1ic or steam railways running only upon rails.
2. INTERPRETATIONS - GENERAL

In this By-Law:
1.
words importing the singular number or the masculine gender only, include more
persons, parties or things of the same kind than one and females as well as males
and the converse.
5
2.
a word interpreted in the singular number has a corresponding meani ng when used
in the plural.
3.
where a distance is used in this By-Law as part of a prohibition of parking or
stopping within a specified distance of an object, structure, land or a part of a
highway, such distance shall be measured.
b)
along the curb or edge of the roadway for a point in such curb or edge of
roadway opposite such object, structure, land or part of a highway unless the
context otherwise requires, and
c)
from such object, structure, land, or part of a highway in all directions.
4.
Cumulative Effect
The various prohibitions of this By-Law are cumulative and not mutually self
exclusive.
5.
Severability
It is declared that if any section, subsection or part or parts thereof be declared by
any Court of Law to be bad, illegal or ultra vires, such part or parts shall be deemed
to be severable and all parts hereof are declared to be separate and independent and
enacted as such.
PART II
PARKING AND STOPPING
3. GENERAL REGULATIONS
Two-Way Highways and Right Side of One-Way Highways.
1.
Subject to subsections 2 and 3, no person shall park or stop any vehicle or permit a
vehicle to remain parked or stopped on any highway except as follows:
a)
where there is a raised curb, on the tight side of the traveled portion of the
highway, having regard to the direction in which the vehicle was travelling,
with its right front and rear wheels parallel to and not more than fifteen (15)
centimeters away from such curb; or
b)
where there is no curb or rolled curb, on the right side of the highway having
regard to the directions in which the vehicle was travelling with the right
front and rear wheels parallel to as near to the right hand limit of the
highway as is practicable without stopping over any part of a highway which
is not intended for the use of vehicles.
2.
Subject to subsection 3 where parking is permitted on the left side of a highway
designated for one-way traffic a person may park or stop any vehicle provided the
vehicle is parked:
a)
where there is a raised curb, on the left side of the traveled po1tion of a
highway having regard to the direction in which the vehicle was travelling,
with its left front and rear wheels parallel to and not more than fifteen (15)
centimeters away from such curb;
b)
where there is no curb or a rolled curb, on the left side of the highway having
regard to the direction in which the vehicle was travelling, with the left front
and rear wheels parallel to and as near to the left hand limit of the highway as
is practicable without stopping over any part of a highway which is landscaped
or which is not intended for the use of vehicles.

3.
Subsections 1 and 2 do not apply where angle parking is permitted under this by-
law.
4. VENDING VEHICLES
1. No person who is selling or offering for sale goods or produce from a stationary vehicle on
a highway shall park the vehicle or permit the vehicle to remain parked in such a manner
as to obstruct traffic.
2. No person shall offer for sale or sell goods or produce from a vehicle on a highway except
from the side of such vehicle facing an inner or outer boulevard.
3. No person shall stop or permit to remain stopped a mobile canteen on any highway, at the
side, and between the limits set out respectively in Schedule II to this By-Law during the
times or days set out in the said Schedule.
4. Subsection 3 shall not apply to a mobile canteen vehicle having only three (3) wheels.
5. PARKING PROHIBITED WITH SIGNS
1. When official signs have been erected no person shall park a vehicle or permit a vehicle to
remain parked on any highway:
1. in front of or within eight (8) meters of a lot on which there is a fire hall, on the side of
the highway on which the fire hall is located;
2. on the opposite side of a highway from that, on which a fire hall is located and within
thirty (30) meters of the projected lot lines of the lot on which such fire hall is located;
3. within nine (9) meters of an intersection;
4. in front of the main entrance to, or any emergency exit from any hotel or other building
or enclosed space in which persons may be expected to congregate in large numbers;
5. within fifteen (15) meters of the end of the roadway on a dead end highway;
6. in a handicapped parking space displaying an official sign, unless said vehicle displays
appropriate sticker or license plate.
6. PARKING PROHIBITED WITHOUT SIGNS
No person shall park a vehicle or permit a vehicle to remain parked on any highway
1. a) on fire hall property so as to obstruct the movement or exit of fire vehicles;
b) within three (3) meters of a fire hydrant;
2. in front of or within one and one half (l.5m) meters of a laneway or driveway;
3. so as to obstruct a vehicle in the use of any Janeway or driveway;
4. in such a position that will prevent the convenient removal of any other vehicle previously
parked or standing;
5. for the purpose of displaying the vehicle for sale;
6. for the purpose of greasing, or repairing the vehicle except for such repairs as have been
necessitated by an emergency;
7. on the traveled portion of the roadway
8. on a driveway within one (1) metre of a sidewalk or footpath , or if there is no sidewalk or
footpath, within three (3) meters of the roadway;
9. on property of the Area Municipality without permission of The Corporation;

10. on any street in such a manner so as to obstruct traffic;
11. in front of the pedestrian entrance to any hall or other building while an assembly is being held
there.

7. PARKING REGULATIONS - SPECIAL CIRCUMSTANCES
1. If the Municipal Council or Local Board is of the opinion that for some
temporary period to ensure the safety of the public, the proper movement of
traffic, the parking of vehicles, or the proper and safe performance of some
vital function of the Municipality, special regulations are required for the
movement of parking of vehicles on a highway under the jurisdiction of the
Municipality, it is authorized to make special regulation for the movement or
parking of vehicles on such highway during such times and days as it deems
improper and necessary and it shall erect official signs and otherwise cause
reasonable notice to indicate such special regulations.
2. When official signs have been erected or notice has otherwise been given
under subsection I, no person shall park, move, or operate a vehicle contrary
to such special regulations. A vehicle already parked when such notice has
been given shall be forthwith removed.
3. Areas designated by signs as "Reserved Parking" and "Unreserved Parking"
shall be "Fee Parking Areas" and shall require parking permits.
4. Council shall from time to time establish and publish the current fees charged
for parking in a Fee Parking Area.
5. All vehicles, including trailers, shall at all times display a valid parking permit
when parked in a "Fee Parking Area" to avoid prosecution.
8. PARKING REGULATIONS -HIGHWAY CLEARING, SNOW REMOVAL,
AND HIGHWAY CLEANING
No person shall park a vehicle or permit a vehicle to remain parked on any highway

so as to inte1fere in any manner with the work of removing snow or ice
therefrom or the clearing of snow therefrom;
2.
in such manner so as to interfere with highway cleaning operations.
9. PARKING PROHIBITED -SPECIFIED TIMES AND PLACES - SIGNS
1. When official signs have been erected, no person shall park a vehicle or permit
a vehicle to remain parked on any highway at the side and between the limits set
out respectively in Schedule II to this By-Law during the times or days set out
in the said Schedule.
2. No person shall park a vehicle or permit a vehicle to remain parked on any part
of any highway barricaded and marked by signs showing that its use for the
time is prohibited or restricted.
10. STOPPING PROHIBITED IN SPECIFIED PLACES -NO SIGNS
No person shall stop or park a vehicle or permit a vehicle to remain stopped or
parked on any highway
1. on or partly on or over a sidewalk or footpath;
2. within an intersection or crosswalk;
3. between the hours of 7:00 o'clock in the forenoon and 7:00 o'clock in the
afternoon of the same day along the curb or edge of roadway within thirty (30)
meters of the approach side or leaving side of a school crosswalk, designated
by markings and authorized school crosswalk signs;
4. adjacent to or across from any excavation or obstruction in the roadway when
the free flow of traffic would thereby be impeded;

5. on the roadway side of any stopped or parked vehicle;
6. upon any bridge or elevated structure within thirty (30) meters of either end of
any such structure except where parking in these locations is otherwise
permitted by this By-Law;
7. on any outer boulevard except when parking in this location is otherwise
pe1mitted by this By-Law.
11. STOPPING PROHIBITED WITH SIGNS
When official signs have been erected, no person shall stop a vehicle or pennit a
vehicle to remain stopped on a highway;
1. on either side of a highway adjacent to a school, park or playground between
the hours of 7:30 o'clock in the forenoon and 7:00 o'clock in the afternoon of
the same day,
2. within a pedestrian crossover, or along the curb or edge of roadway
a)
within thirty (30) meters of the approach side of a pedestrian crossover;
or
b)
within fifteen (15) meters of the leaving side of a pedestrian crossover;
or
3. at the end of a dead end highway.
12. STANDING AND PEAK HOUR PARKING PROHIBITIONS -
SPECIFIED PLACES - SIGNS
When official signs have been erected no person shall park a vehicle or permit a
vehicle to remain parked on any of the streets or parts of streets set out in Schedule
II.
13. PARKING, STANDING AND STOPPING EXEMPTIONS - FUNERAL
CORTEGES AND BUSES
The provisions of this By-Law relating to parking, standing and stopping do not
apply to prevent the parking, standing or stopping:
1. of passenger motor vehicles fanning part of any funeral cortege in a restricted
or prohibited parking area listed in Schedule II, provided that all such vehicles
are parked or stopped on only one side of a highway at one time, or,
2. of passenger motor vehicles fanning part of a wedding procession providing
that such provision shall apply to those vehicles parked or stopped on one side
only of the side of a highway on which the church is located and only for a
maximum length of eighty (80) meters.
14. MAXIMUM PARKING LIMIT
General Limit
1.
Subject to the other provisions of this By-Law, no person shall park a
vehicle or permit a vehicle to remain parked on a highway or any
Municipal Parking Lot for a period of time longer than forty-eight
consecutive hours.
Overnight Winter Parking Prohibition
2.
No person shall park a vehicle or permit a vehicle to remain parked on a
highway between l :00 o'clock in the forenoon and 7:00 o'clock in the
forenoon of the same day from November 15th to April 1st.
PART lll

LOADING ZONES - SCHOOL BUSES
15. LOADING ZONES
Establishment
1.
The parts of highways at the side having the length and between the limits
set out respectively in the Schedule are hereby established as loading zones
during the times or days set out in the said Schedule.
Regulation of Use
2.
When auth01ized signs have been erected, no person shall park or stop a
vehicle or permit a vehicle to remain parked or stopped in a loading zone
except for the purpose of, and while actually engaged in, loading thereon or
unloading therefron1, passengers, freight or merchandise.
16. SCHOOL BUS LOADING ZONES
Designation
1.
The Area Municipality is hereby authorized to establish school bus loading
zones on highways, adjacent to schools, museums or other public buildings,
upon the passing of a resolution. A school bus loading zone shall be
conclusively deemed to have been established when an official sign or
marker has been erected in accordance with The Highway Traffic Act and
regulations passed thereunder.
Stopping Prohibited
2.
No person shall stop a vehicle or permit a vehicle to remain stopped, other
than a school bus, in an area designated as a school bus loading zone.
PART IV
DRIVING AND RELATED RULES
17. COASTING ON ROADWAY
No person shall coast on a roadway, whether on a sleigh, skateboard, roller-skate,
cart, children' s wagon or toboggan.
18. EMERGENCY AND SPECIAL REGULATIONS
1.
Notwithstanding any provisions of this By-Law to the contrary, a Police
Officer, Fire Department Officer, By-Law Enforcement Officer, or the
Road Superintendent may, during any emergency or special circumstances,
by the erection of appropriate signs or signals, prohibit or regulate the
movement of vehicles on any highway or part of a highway and no person
shall drive or operate a vehicle in contravention of any such sign or signal.
19. VEHICLES CROSSING SIDEWALKS, BOULEVARDS AND CURBS
Vehicles on Sidewalks Prohibited
1.
No person shall drive a vehicle or ride a skateboard or bicycle on a
sidewalk or footpath, except for the purpose of directly crossing the
sidewalk or footpath.
Curb and Sidewalk Depressions
2.
No person shall drive a vehicle over a raised curb or sidewalk except at a
place where there is a ramp, rolled curb or depressed curb.
Vehicles on Boulevards Prohibited
3.
No person shall drive a vehicle on a boulevard except for the purpose of
directly crossing a boulevard at a driveway or other designated vehicular
crossing.
Exemptions
4.
Subsections 1, 2 and 3 shall not apply to invalid chairs, baby carriages,
tricycles or children's wagons.

Pedestrian Obligation
5.
Nothing in this section shall relieve the pedestrian from obligation of taking
all due care to avoid an accident.
20. MUNICIPAL VEHICLES PERFORMING WORK ON HIGHWAYS
EXEMPTION
The provisions of this By-Law do not apply to vehicles of the Township of Rideau
Lakes while such vehicles are engaged in the performance of cleaning, clearing,
maintenance, repair, construction or other work on any highways.
21. EMERGENCY VEHCILES - EXEMPTION
The provisions of this By-Law shall not, in the case of emergency, apply to an
ambulance, police vehicle, fire vehicle, or vehicles acting under Peacetime
Emergency Plan.
PART V SIGNS
22. ERECTION OF SIGNS, TRAFFIC SIGNALS, ETC.
The Road Superintendent is hereby authorized and directed to erect and maintain
such signs, markings, barricades, traffic control devices, other structures, plants and
equipment as are required to give effect to this By-Law and as are required to
regulate, direct, warn or guide pedestrian and vehicular traffic for the safety and
convenience of the public.
23. SIGNS BY ONTARIO PROVINCIAL POLICE
The Ontario Provincial Police may erect, place and maintain such official and
authorized signs as are required to give effect to the provisions of this By-Law
coming within their jurisdiction.
24. OFFICIAL SIGNS
For the purpose of The Highway Traffic Act, "official signs" shall be those approved
in the regulations of the Ministry of Transportation and Communication.
25. CONFLICTING PRIVATE SIGNS
No person shall place, maintain or display upon, or visible from, any highway, any
sign, signal, marking or device which,
1. conceals a traffic control device from view;
2. interferes with the effectiveness of a traffic control device;
3. purports to be or is an imitation of or resembles any official or authorized sign.
PART VI
OFFENCES AND PENALITES
VOLUNTARY PAYMENT OF PARKING PENALTIES
26. VOLUNTARY PAYMENT OF PARKING PENALTIES
Any person may, upon presentation of a fine at the office listed on the Certificate of
Parking Offence issued alleging commission of an offence contrary to this By Law,
other than sections 4, 17, 19, or 25, pay out of court within five (5) days (exclusive
of Sundays, Saturdays and Public Holidays) from the date of issue of the said fine,
the penalty listed in Schedule I, and no fu11her proceedings shall be taken under this
By-Law in respect of the said offence alleged in the fine. The receipt for payment
signed by the person assigned to the duty of receiving payments shall be evidence of
payment of the penalty provided for the violation.

27. VEHICLES SUBJECT TO REMOVAL WHEN ILLEGALLY PARKED
In addition to any other penalties provided by the By-Law, upon discovery of any
vehicle parked, stopped or standing on any highway or municipal parking lot in
contravention of the provisions of this By-Law, a Constable, Provincial Offenses
Officer, or By-Law Enforcement Officer may cause such vehicle to be removed or
taken to and placed or stored in a suitable place and all costs and charges for the
removing, care and storage, thereof, if any, are a lien upon the vehicle being released
and may be enforced in the manner provided by Section 4 of The Repair and Storage
Liens Act.
LIABILITY OF OWNER
28. The owner of a vehicle shall incur the penalties provided for any contravention of
this By-Law unless at the time of contravention, the vehicle was in the possession of
some person other than the owner or his chauffeur without the owner's consent and
the driver or operator of a vehicle not being the owner shall also incur the penalties
provided for any such contravention.
29. Any person who contravenes a provision of this By-Law is guilty of an offence and
on conviction is liable to a fine.
PART VII
APPLICATION AND ADMINISTRATION
30. ENFORCEMENT
This By-Law shall be enforced by the By-Law Enforcement Officer and/or Ontario
Provincial Police.
31. APPLICATION OF BY-LAW
This By-Law applies to all highways under the jurisdiction of the Township of Rideau
Lakes.
32. BY-LAW SUBJECT TO THE HIGHWAY TRAFFIC ACT
The provisions of this By-Law are subject to the provisions of the Highway Traffic
Act.
33. SCHEDULES ADOPTED
The schedules referred to in this By-Law shall form part of this By-Law and each entry
in a column of such a schedule shall be read in conjunction with the entry or entries
across therefrom, and not otherwise.
34. FORMER BY-LAWS REPEALED
All previous By-Laws, including By-Law Number 94-19 of the fonner Township of
South Crosby, and any other parking or traffic regulation By-Laws of the former
municipalities, which are in contravention of this By-Law are hereby repealed.
PART VIII
PARKING ON PRIVATE PROPERTY
35. In this part:
1.
"owner" , when used in relation to property, means:
a) the registered owner of this property
b) the spouse of a person desc1ibed in subparagraph (1)
c) a person authorized in writing by the property owner as defined in
subparagraph( a) or (b) hereof to act on the owner's behalf for requesting the
enforcement of this part of the By-Law;

2.
"occupant" means,
a) the tenant of the property or part thereof whose consent shall extend only to
the control of the land of which he is tenant and any parking spaces allotted
to him under this lease or tenancy agreement,
b) the spouse of a tenant,
c) a person or area municipality or a local board thereof having an interest in
the property under easement or right-of-way granted to or expropriated by
the person, area municipality or local board whose consent shall extend only
to the part of the property that is subject to the easement of right-of-way.
d) a person authorized in writing by an occupant as defined in subparagraph
(a), (b) or (c) to act on the occupant's behalf for requesting the
enforcement of this part of the By-Law.
36.
1. The driver of a motor vehicle, not being the owner, is liable to any penalty
provided under this part of the By-Law and the owner of a motor vehicle is also
liable to such a penalty, unless at the time the offense was committed, the motor
vehicle was in the possession of a person other than the owner, without the
owner's consent;
2. Subject to subsection 4, the driver or owner of a motor vehicle parked or left on
private property is not liable to any penalty or to have the motor vehicle removed
from such property or impounded under this part of the By-Law, except upon the
complaint of the owner or occupant of the property given to a Constable or
Officer appointed for the carrying out of the provisions of this part of the By-
Law;
3. Where an owner or occupant of property affected by this part of the By Law has
posted signs stating conditions on which a motor vehicle may be parked or left
on the property or prohibiting the parking or leaving of a motor vehicle on the
property, a motor vehicle parked or left on the property contrary to such
conditions pr prohibition shall be deemed to have been parked or left without
consent;
4. A By-Law Enforcement Officer appointed under The Police Services Act, in
respect of a particular property, to enforce this part of the By-law shall be
deemed to have the authority of the owner or occupant of the property to enforce
this part of the By-Law and such By-Law Enforcement Officer is not required to
receive a written complaint before enforcing this part of the By-Law.
37. No person shall pai-k or leave any motor vehicle on p1ivate property without the consent
of the owner or occupant of the property.
38. Whenever a motor vehicle is parked or left on private property without the express
authority of the owner or occupant of such property, a Constable or any Municipal
By-Law Enforcement Officer appointed under Section 15 of the Police Services Act,
upon the written complaint of the owner or occupant of the property, shall cause the
said motor vehicle to be moved or taken to and placed or stored in a suitable place
and all costs and charges for removing, care and storage thereof, if any, shall be paid
by the owner of the said motor vehicle and such costs and charge shall be a lien upon
the said motor vehicle which may be enforced in the manner provided by Section 4
of the Repair and Storage Liens Act.
39. No person shall park or leave any motor vehicle on property of the Township of
Rideau Lakes where parking is by sign designated as an area in which parking is
prohibited.
40. No person shall park or leave any motor vehicle on property of the Township of
Rideau Lakes where an area is by sign designated Reserved, unless the area is
reserved for such person.

41. No person shall park or stop a motor vehicle or permit a motor vehicle to remain
parked or stopped on property of the Township of Rideau Lakes in an area
designated by sign as a loading zone, except for the purpose of and while actually
engaged in loading thereon or unloading thereon from passengers, freight or
merchandise.
42. Whenever a motor vehicle is parked or left in an unauthorized area on property of the
Township of Rideau Lakes and is in contravention of Sections 39 or 40 of this By-
Law, a Constable or any Municipal By-Law Enforcement Officer appointed under
Section 15 of the Policies Services Act, upon the written complaint of an authorized
employee of the Township of Rideau Lakes shall cause the said motor vehicle to be
moved or taken to and placed or stored in a suitable place and all costs and charges for
removing, care and storage thereof, if any, shall be paid by the owner of the said motor
vehicle and such costs and charges shall be a lien upon the said motor vehicle, which
may be enforced in the manner provided by Section 4 of the Repair and Storage Liens
Act.
43.
1. Except where otherwise expressly provided in this By-Law, every person who is
convicted of an offence contrary to this By-Law is liable to a fine of not more than
$500.
2. A By-Law Enforcement Officer or Police Officer who believes that a person has
committed an offence contrary to Sections 4, 17, 19 or 25, may issue, by completing
and signing, a certificate of offence certifying that
a)
An offence notice indicating the set fine for the offence;
b)
A summons,
Pursuant to Part I of the Provincial Offences Act.
3. A By-Law Enforcement Officer or Police Officer who believes that an offence has
been committed contrary to Sections 3,5, 6,7,9,10,11, 12,14, 16,37,40 or 41 may issue,
by completing and signing, a certificate of parking offence certifying that an offence
has been committed and
a) Serving the parking offence notice on the owner of the vehicle by affixing it to the
vehicle in a conspicuous place at the time of the offence, or
b) Serving the parking offence notice on the owner of the vehicle by delivering it
personally to the person having care and control of the vehicle at the time of the
offence
BY-LAW IN FORCE
This By-Law shall come into force and take effect on the day of its final passing thereof.
Read a first and second time this 29th day of August, 2000.
