THE CORPORATION OF THE TOWNSHIP OF SABLES-SPANISH RIVERS
BY-LAW NUMBER 2002-23
Being a by-law to licence hawkers and peddlers within the
Township of Sables-Spanish Rivers
WHEREAS Section 257 of the Municipal Act, R.S.O. 1990 as amended authorizes
municipalities to enact by-laws for the licensing of persons who go from place to
place or to a particular place with goods, wares or merchandise for sale, or who carry
and expose samples, patterns or specimens of any goods, wares or merchandise that
are to be delivered in the municipality afterwards;
AND WHEREAS the Council of the Corporation of the Township of Sables-Spanish
Rivers deems it necessary to enact such a by-law;
NOW THEREFORE the Council of the Corporation of the Township of Sables-
Spanish Rivers enacts as follows:
1. A licence shall be obtained by every person who goes from place to place or to a
particular place with goods, wares or merchandise for sale, or who carries and
exposes samples, patterns or specimens of any goods, wares or merchandise
which are to be delivered within the Township of Sables-Spanish Rivers
afterwards.
2. No licence shall be required for a person who hawks, peddles or sells goods,
wares or merchandise :
i)
to wholesale or retail dealers;
ii)
if the goods, wares or merchandise are grown, produced or
manufactured in Ontario and are hawked, peddled or sold by the
grower, producer or manufacturer or his agent or employee having
written authority to do so in the Township of Sables-Spanish Rivers,.
iii)
If such goods, wares or merchandise are grown or produced by a
farmer resident in Ontario who offers for sale or sells produce of his
own farm;
iv)
If the goods, wares or merchandise are hawked, peddled or sold by an
agent of the grower, producer or manufacturer acting on behalf of a
dealer who pays commercial tax in the Township of Sables-Spanish
Rivers.
3. To obtain a licence under this By-law, the applicant shall:
a) file with the Clerk an application in writing on forms supplied by the
Corporation of the Township of Sables Spanish Rivers for that purpose;
b) pay all applicable fees as prescribed in Schedule "A" attached hereto and
forming part of this By-law;
4. Unless otherwise authorized in writing by Council, no person licensed under this
By-law shall engage in or carry on their respective business by passing from
house to house or along any street in the Township of Sables-Spanish Rivers
except during the time between sunrise and sunset of any day.
5. All licences issued under this By-law shall expire on December 31st of the year of
issuance.
6. The holder of a licence issued under this By-law shall at all times while conducting
any business for which such licence is issued, carry such licence upon his or her
person and shall upon demand, exhibit same to any agent as designated by the
Council of the Corporation of the Township of Sables-Spanish Rivers.
7. The holder of a licence issued under this By-law shall be required to keep the site
where his/her business is being conducted free of garbage, waste and litter and
shall provide for appropriate waste receptacles for the disposal of refuse resulting
from the said business and further shall make arrangements for the emptying of
such containers.
8. Vendors who have rented or leased space within the property under the care and
control of the Massey Agricultural Society are exempted from the provisions of
this By-law during the time of the annual fall fair exhibition only.
9. This By-law shall repeal By-law 2000-19 and any other By-law respecting this
matter.
10. Any persons violating the provisions of this By-law is guilty of an offence and
liable to a penalty exclusive of cost, and such penalty shall be recoverable under
the Provincial Offences Act.
11. The provisions of this By-law shall be enforced by the By-law Enforcement
Officer, upon direction by Council or the Clerk or her designate.
