Consolidated Traffic Control By-law
The Town of Saugeen Shores Traffic Control By-law is prepared by the Clerk's
Division. This online edition is prepared for the purposes of convenience only. For
accurate reference, recourse should be had to the original by-law and amendments
thereto.

Traffic Control By-law
A By-law to regulate and/or control traffic in the Town of Saugeen Shores
Whereas the Council of the Corporation of the Town of Saugeen Shores deems it
necessary and expedient to pass a new By-law to regulate and/or control traffic in the
Town of Saugeen Shores; and
Whereas the Municipal Act, 2001, as amended and the Highway Traffic Act R.S.O.
1990, Chapter H.8 as amended, authorizes municipalities to regulate traffic.
Now Therefore Be It Resolved that the Council of the Corporation of the Town of
Saugeen Shores enacts as follows:
Definitions:
1.
In this By-law
(a)
"All-Way Stop" means a stop controlled intersection where all users
must stop. Typically a 4-way or 3-way stop intersection.

(b)
"Authorized Sign" means any sign or roadway, curb or sidewalk
marking or device placed or erected anywhere under the authority of
the Municipal Council for the purpose of regulating, controlling, warning,
or guiding of traffic and includes official signs;
(c)
"Boulevard" means that part of the highway between the roadway and
the property lines of the lots abutting the highway and includes the
shoulder but does not include a sidewalk if any;
(d)
"Commercial Motor Vehicle" means a motor vehicle having a
permanently attached thereto a truck or delivery body, and includes an
ambulance, hearse, casket wagon, fire apparatus, buses and tractors
used for hauling purposes on the highways;
(e)
"Community Safety Zone" means a segment of the road that is in an
area deemed paramount to the safety of its children/citizens and is
demarked by signage and subject to increased fines. [By-law 68-2021]

(f)
"Construction Materials" means any article, item, debris, material, or
supply consumed or used in a construction project, with the exception
of Town of Saugeen Shores public utilities' approved capital projects;

(g)
"Council" means the Municipal Council of the Corporation of the Town
of Saugeen Shores;
(e)
"Crosswalk" means
i)
that part of the highway at an intersection that is included within
the connections of the lateral lines of the sidewalks on opposite sides
of
the highway measured from the edges of the roadway, or
ii)
any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs or lines or other
markings on the road surface;
(f)
"Designated" means designated by By-law of Council and included in
this By-law attached as a Schedule to this By-law;
(g)
"Driver" means a person who drives a vehicle;
(h)
"Enforcement Officer" means
i)
A Police Officer, or By-Law Enforcement Officer
ii)
A person appointed by Council to enforce the provisions of this By-
law or any provisions of this By-law, who is by virtue of their
appointment, a Provincial Offences Officer when enforcing the
provisions or provision of this By-law;
(i)
"Gross Weight" means the combined weight of a vehicle and its load;
(j)
"Heavy Truck" means a commercial motor vehicle larger than a truck
commonly identified as a half ton pickup truck or a van with a maximum
half ton cargo capacity, used for transportation of any material whether
animate or inanimate;
(k)
"Highway" means a common and public highway, street, avenue, public
lane, parkway, driveway, square, place, bridge, viaduct or trestle, any
part of which is intended for or used by the general public for the
passage of vehicles and includes the area between the lateral property
lines thereof;
(l)
"Human Transporter" means a self balancing, electric powered
transportation device designed for one person;
(m)
"Intersection" means the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then the lateral boundary
lines of two or more highways that join one another at an angle,
whether or not one highway crosses the other;
(n)
"Low Speed Vehicle" means a motor vehicle, other than trucks, that are
powered by an electric motor, designed to travel on four wheels.
(o)
"Minister" means the Minister of Transportation;
(p)
"Ministry" means the Ministry of Transportation;
(q)
"Motor Vehicle" includes an automobile, motorcycle, motor assisted
bicycle and any other vehicle propelled or driven otherwise than by
muscular power, but does not include the cars of an electric or steam
railway or other motor vehicles running only upon rails or a motorized
snow vehicle, traction engine, farm tractor, self-propelled implement of
husbandry or road building machine within the meaning of the Highway
Traffic Act;

(r)
"Motor Assisted Bicycle (Mopeds)" means a bicycle fitted with pedals
that can operate at all times to propel the bicycle by an attached motor
and includes Power-Assisted/Electric Bicycles;
(s)
"Motorized Snow Vehicle" means a self propelled vehicle designed to
be driven primarily on snow;
(t)
"Motorized or Electric Scooter" means a two wheeled device with an
upright hand bar meant for one person;
(u)
"Official Sign" means a sign approved by the Ministry of Transportation;
(v)
"One-way Street" means a street upon which vehicular traffic is limited
to movement in one direction only;
(w)
"Pedestrian" includes a person on foot and an invalid or child in a
wheelchair or carriage;
(x)
"Pedestrian Crossover" means any portion of a roadway, designated by
By-law of a municipality at locations described in Schedule "G" attached
and forming part of this By-law at an intersection or elsewhere, distinctly
indicated for pedestrian crossing by signs on the highway and lines or
other markings on the surface of the roadway as prescribed by the
regulations under the Highway Traffic Act;
(y)
"Personal Mobility Device" means a motorized wheelchair or medical
scooter;
(z)
"Power Assisted Device" means any device or bicycle that operates at a
low speed, including a Segway, motorized or electric scooter, human
transporters, motor-assisted bicycles, power assisted/electric bicycles
or pocket bikes; [By-law 67-2018]
(aa)
"Private Property" includes the Town owned property, Church property
and School Board property;
(bb)
"Regulations" means regulations made under the Highway Traffic Act;
(cc)
"Roadway" means that portion of a highway that is improved, designed
or ordinarily used for the passage of vehicles, but does not include the
shoulder and where a highway includes two or more separate roadways
the term "roadway" refers to any one roadway separately and not to all
of the roadways collectively;
(dd)
"Roundabout" means a raised island or pavement-marking island
located in the center of an intersection, which requires vehicles to travel
the intersection in a circular, counter-clockwise direction around the
island; [By-law 67-2018]
(ee)
"Self-Propelled Device" means a device or bicycle that is self-propelled
by muscular power. [By-law 67-2018]
(ff)
"Sidewalk" means that portion of a highway between the curb line or
edge of a roadway and the adjacent property line that is designed and
intended for the use of pedestrians;
(gg)
"Through Highway" means a highway or part of a highway designated
as such by the Minister or by By-law of the Municipality and every such
highway shall be controlled by stop signs or yield right-of-way signs in
compliance with the regulations;
(hh)
"Traffic" includes pedestrians, ridden or herded animals, vehicles and
any other conveyances either singly or together, while using any
highway for the purpose of travel;

(ii)
"Traffic Control Signal" means any device manually, electrically or
mechanically operated for the regulation or control of traffic;
(jj)
"U-turn" means the turning of a vehicle within a highway so as to
proceed in the opposite direction;
(kk)
"Vehicle" includes a motor vehicle, motor assisted bicycle, trailer,
traction engine, farm tractor, road-building machine and any vehicle
drawn, propelled or driven by any kind of power, including muscular
power, but does not include a motorized snow vehicle;
(ll)
"Wheelchair" means a chair mounted on wheels driven by muscular or
any other kind of power and used for the carriage of a person who has
a physical defect or disability;
(mm) "Words" where any word or expression used in this By-law is not
defined herein reference shall be made to the Highway Traffic Act; the
Municipal Act or the Interpretation Act, as amended or re-enacted from
time to time or generally accepted dictionary and the interpretation that
best reflects the spirit and intent of this By-law shall be accepted.
The provisions of this By-law are subject to the provisions of the Highway Traffic Act
as amended or re-enacted from time to time and the regulations made thereunder.
REGULATION AND/OR CONTROL OF TRAFFIC
2.
TURNS
2.1
When authorized signs have been erected and are on display or are applied to
the surface of the roadway no person shall make a turn in disobedience to the
said signs.
2.2
No driver of a vehicle in an intersection shall turn left across the path of a
vehicle approaching from the opposite direction unless the driver has afforded
a reasonable opportunity to the driver of the approaching vehicle to avoid a
collision.
2.3
The driver of a vehicle upon a highway, before turning to the left or right at any
intersection or into a private driveway or from one lane for traffic to another
lane for traffic or to leave the roadway, shall first see that such movement can
be made in safety and if the operation of any other vehicle may be affected by
such movement shall give a signal, in accordance with the Highway Traffic
Act, plainly visible to the driver of such other vehicle of the intention to make
such movement.
2.4
No driver of a vehicle shall turn the vehicle within a roadway so as to proceed
in the opposite direction when,
(a) authorized sign is on display prohibiting U turns, or
(b) when such movement cannot be made in safety, or
(c) on High Street - from the intersection of Victoria Street westerly to the
intersection of Huron Street.
3.
ONE WAY STREETS
3.1
Highways or parts of highways described in Schedule "A" and/or Schedule "B"
attached to and forming a part of this By-law are one-way streets and restrict
vehicular traffic to the direction of travel designated.
3.2
Where a highway has been designated for the use of one-way traffic only and
official signs have been erected accordingly, no person shall drive a vehicle on
the highway except in the direction so designated.
4.

4.1
For the purposes of this section "designated" means designated by the
Minister or by any person authorized by the Minister to make such designation
or designated by By-law of the Town of Saugeen Shores.
4.2
Where a highway has been divided into clearly marked lanes for traffic:
(a) a vehicle shall be driven as nearly as may be practicable entirely within a
single lane and shall not be moved from such lane until the driver has
first ascertained that such movement can be made in safety;
(b) in the case of a highway that is divided into three lanes, no person shall
drive a vehicle in the centre lane except when overtaking and passing
another vehicle where the roadway is clearly visible and the centre lane
is clear of traffic within a
reasonable distance, or in preparation for a left turn, or where such
centre lane is at the time designated for the use of traffic moving in the
direction in which the vehicle is proceeding and official signs are erected
to indicate such designation;
(c)
any lane may be designated for slow moving traffic, traffic moving in a
particular direction, or classes or types of vehicles, provided that official
signs are erected to indicate such designation. Where a highway is so
designated, every driver of a vehicle shall obey the instructions on the
official signs, but this does not apply to a motor vehicle or road building
machine operated by, or on behalf of, the Town of Saugeen Shores while
the vehicle or machine is engaged in construction, marking or
maintenance activities on a highway including the removal of snow from
the highway.
5.
STOP SIGNS
5.1
Stop signs are erected and maintained at locations described in Schedule "C"
to this By-law for the purpose of regulating traffic as described in Schedule
"C".
5.2
Every driver approaching a stop sign at an intersection:
(a) shall stop the vehicle at a clearly marked stop line or if none, then
immediately before entering the nearest crosswalk, or if none, then
immediately before entering the intersection, and
(b) shall yield the right-of-way to traffic in the intersection or approaching the
intersection on another highway so closely that to proceed would
constitute an immediate hazard and having so yielded the right-of-way
may proceed.
5.3
Every driver approaching on another highway, at an intersection referred to in
Section 5.2 shall yield the right-of-way to every driver who has complied with
the requirements of Section 5.2.
6.
THREE WAY AND 4 WAY STOP SIGNS AT INTERSECTIONS
THREE WAY AND ALL WAY STOP SIGNS AT INTERSECTIONS [By-law

6.1
The intersection on highways set out in Schedule "D" & "E" attached and
forming part of this By-law are designated as intersections where stop signs
shall be erected at the locations shown in Column 1 & Column 2 of the said
Schedules "D" & "E".
6.2
The designations made in Section 6.1 shall not become effective until stop
signs have been erected pursuant to regulations of the Highway Traffic Act.

YIELD AND RIGHT-OF-WAY SIGNS AT INTERSECTIONS

7.1
The driver of a vehicle approaching a yield right-of-way sign shall slow down
to a speed reasonable for the existing conditions or shall stop if necessary as
provided in Section 5 of this by-law and shall yield the right-of-way to traffic in
the intersection or approaching on the intersecting highway so closely that it
constitutes an immediate hazard and having so yielded may proceed with
caution.
7.2
The intersections of highways set out in Schedule "F" attached and forming
part of this By-law are designated as intersections where "yield right-of-way"
signs shall be erected.
7.3
The designations made in Section 7.1 shall not become effective until "right-of-
way" signs have been erected pursuant to regulations of the Highway Traffic
Act.
7.4
Every driver entering a highway from a private road or driveway shall yield the
right-of-way to all traffic approaching on the highway so closely that to enter
would constitute an immediate hazard. This section does not apply to private
roads or entrance ways controlled by traffic signals.
8.
PEDESTRIAN CROSSOVERS
8.1
Pedestrian crossovers are established in accordance with regulations at
locations described in Schedule "G" attached to and forming part of this By-
law.
8.2
When a pedestrian or a person in a wheelchair crossing a roadway within a
pedestrian crossover:
(a) is upon the half of the roadway upon which a vehicle is traveling, or
(b) is upon half of the roadway and is approaching the other half of the
roadway on which a vehicle is approaching so closely to the pedestrian
crossing as to endanger the pedestrian, the driver of such vehicle shall
yield the right of way to the pedestrian or person in a wheelchair by
slowing down or stopping if necessary.
8.3
When a vehicle is stopped at a pedestrian crossover, the driver of any other
vehicle overtaking the stopped vehicle shall bring the vehicle to a full stop
before entering the crossover and shall yield the right-of-way to a pedestrian
or person in a wheelchair:
(a) who is within the crossover upon the half of the roadway upon which the
vehicle is stopped, or
(b) who is within the crossover and is approaching such half of the roadway
from the other half of the roadway so closely to the vehicle that the
pedestrian is in danger if the vehicle were to proceed.
8.4
When a vehicle is approaching a pedestrian crossover and is within 30 metres
thereof the driver of any other vehicle approaching from the rear shall not
allow the front extremity of the vehicle to pass beyond the front extremity of
the other vehicle.
8.5
No pedestrian or person in a wheelchair shall leave the curb or other place of
safety at a pedestrian crossover and walk, run or move the wheelchair into the
path of a vehicle approaching so closely that it is impracticable for the driver of
the vehicle to yield the right-of-way.
8.6
No person shall drive a vehicle on a sidewalk, crosswalk or pedestrian
pathway or crossover except to cross any of these pedestrian areas.
9.
PEDESTRIANS
9.1
Where sidewalks are provided and maintained along a highway no person
shall walk along the roadway.

9.2
Where sidewalks are not provided on a highway, a pedestrian walking along
the highway shall walk on the left side thereof facing oncoming traffic and,
when walking along the roadway, shall walk single file as close to the left edge
of the roadway as possible.
10.
BICYCLES, ROLLER SKATES & SKATEBOARDS AND OTHER DEVICES
10.1 No person shall take part in any unauthorized game or sport on a roadway.
10.2 No person on roller skates, roller blades, riding in, or on, a coaster,
skateboard, toy vehicle, bicycle or similar self propelled device shall go upon
any sidewalk except when crossing the sidewalk.
10.3 No person shall operate a Low Speed Vehicle, Segway, Motorized or Electric
Scooters, Human Transporters, Motor-Assisted Bicycles, Power
Assisted/Electric Bicycles or Pocket Bikes on any sidewalk.
10.4 Personal Mobility Devices are exempt from restrictions listed in Sections 10.1,
10.2, 10.3 and 10.5 of this by-law.
10.5 Every person operating a bicycle on a roadway shall:
(a) operate the bicycle in single file, and
(b) ride as near on the right edge of the roadway as is practicable and
possible.
10.6 That no person shall operate a bicycle on any path or trail system owned by
the town of Saugeen Shores that is posted "No Bicycle" or posted with similar
wording restricting the use of bicycles. [By-law 53-2017]
11. TRAFFIC CONTROL SIGNALS
11.1 In this section:
(a) "emergency vehicle" means:
i) a fire department vehicle, as defined in clause 43(b) of the Highway
Traffic Act, while proceeding to a fire or responding to, but not while
returning from, a fire or other emergency call;
ii)
a vehicle while used by a person in the lawful performance of their
duties as a police officer;
iii) an ambulance while responding to an emergency call or being used to
transport a patient or injured person in an emergency situation; or
iv) a cardiac arrest emergency vehicle operated by or under the authority
of a hospital;
All on which a siren is continuously sounding and from which intermittent
flashes of red or red/blue lights are visible from all directions.
(b) "intersection" includes any portion of a highway indicated by markings on
the surface of the roadway as a crossing place for pedestrians;
(c)
"pedestrian" includes a person in a wheelchair.
11.2 A driver who is directed by a traffic signal erected at an intersection described
in Schedule "H", attached hereto and forming a part of this By-law, to stop his
vehicle, shall stop:
(a) at a stop sign or marking, immediately before entering the nearest
crosswalk, or if there is no sign or marking, immediately before entering
the nearest crosswalk, or
(b) if there is no sign, marking or crosswalk, immediately before entering the
intersection.
11.3 A driver who is directed by a traffic signal erected at a location described in
Schedule "H" attached hereto and forming a part of this by-law other than an
intersection, to stop his vehicle shall stop:

(a) at a stop sign or road marking indicating where the stop is to be made;
(b) if there is no sign or marking, immediately before entering the nearest
crosswalk; or
(c)
if there is no sign, marking or crosswalk, not less than 5 metres before
the nearest traffic control signal.
11.4 When under this section a driver is permitted to proceed, the driver shall yield
the right-of-way to pedestrians lawfully within the crosswalk.
11.5 When under this section a driver is permitted to proceed, he shall yield the
right-of-way to traffic lawfully using the intersection or where traffic signals are
located other than at an intersection, lawfully using the area controlled by the
signals.
11.6 The provisions of this section are subject to any sign, prescribed by the
regulations, prohibiting a left turn, right turn, through movement or combination
thereof, that is posted at an intersection and every driver shall obey every
such sign.
11.7 Every driver shall obey every traffic control signal that applies to the lane the
driver is in.
11.8 A driver approaching a traffic control signal showing a circular green indication
and facing the indication may proceed forward or turn right or left unless
otherwise directed.
11.9 A driver approaching a traffic control signal showing a circular flashing green
indication or a solid or flashing left turn arrow indication in conjunction with a
circular green indication and facing the indication may proceed forward or turn
left or right unless otherwise directed.
11.10 Every driver approaching a traffic control signal showing one or more green
arrow indications only or in combination with a circular red or circular amber
indication and facing the indication may proceed only to follow the direction
shown by the arrow.
11.11 Every driver approaching a traffic control signal showing a circular amber
indication and facing the indication shall stop the vehicle if the vehicle can be
stopped safely, otherwise the driver may proceed with caution.
11.12 Every driver approaching a traffic control signal showing an amber arrow
indication only or in combination with another indication and facing the
indication, shall stop the vehicle if the vehicle can be stopped safely,
otherwise the driver may proceed with caution to follow the direction shown
by the amber arrow indication.
11.13 Every driver approaching a traffic control signal showing a circular red
indication and facing the indication shall stop the vehicle and shall not proceed
until a green indication is shown.
11.14 Notwithstanding Section 11.13 and subject to Section 11.10 a driver, after
stopping the vehicle and yielding the right-of-way to traffic lawfully
approaching so closely that to proceed would constitute an immediate hazard
may:
(a) turn to the right, or
(b) turn to the left from a one-way street onto a one-way street, without a
green indication being shown.
11.15 Notwithstanding Section 11.13, the driver of an emergency vehicle, after
stopping the vehicle, may proceed without a green indication being shown if it
is safe to do so.

11.16 Every driver approaching a traffic control signal and facing a flashing circular
red indication shall stop the vehicle, shall yield the right-of-way to traffic
approaching so closely that to proceed would constitute an immediate hazard
and having so yielded the right-of-way, may proceed.
11.17 Where portions of a roadway are marked for pedestrian use, no pedestrian
shall cross the roadway except within a portion so marked.
11.18 Subject to Sections 11.19 and 11.22 a pedestrian approaching a traffic control
signal showing a circular green indication or a straight ahead green arrow
indication and facing the indication, may cross the roadway.
11.19 No pedestrian approaching a traffic control signal and facing a flashing circular
green indication or a solid indication or a solid or flashing left turn in
conjunction with a circular green indication shall enter the roadway.
11.20 No pedestrian approaching a traffic control signal and facing a red or amber
indication shall enter the roadway.
11.21 Where pedestrian control signals are installed and show a "walk" indication,
every pedestrian facing the indication may cross the roadway in the direction
of the indication, notwithstanding Sections 11.19 and 11.20.
11.22 No pedestrians approaching control signals and facing a solid or flashing
"don't walk" indication shall enter the roadway.
11.23 Every pedestrian who lawfully enters a roadway in order to cross may continue
the crossing as quickly as reasonably possible notwithstanding a change in
the indication they are facing and, for the purpose of crossing, has the right-of-
way over vehicles.
11.24 The "walk" or "don't walk" pedestrian control indicators referred to in this
section may be shown as symbols as prescribed by the regulations.
11.25 No traffic control signal system or traffic control signals used in conjunction
with a traffic control system shall be erected or installed except in accordance
with an approval obtained from the Minister or an official of the Ministry
authorized by the Minister in writing to grant such approval.
12.
RATE OF SPEED
12.1 When a highway or portion of a highway, as set out in Schedule "I" attached
and forming part of this By-law is signed pursuant to regulations of the
Highway Traffic Act, the maximum rate of speed thereon shall be the rate of
speed set out in Column 3 of the said Schedule "I".
12.2 The speed limits established under this section do not apply to:
(i) A fire department vehicle as defined in Section 61 of the Highway Traffic
Act while proceeding to a fire or responding to, but not returning from, a fire
alarm or other emergency call; or
(ii) A motor vehicle while used by a person in the lawful performance of his or
her duties as a police officer; or
(iii) An ambulance as defined in Section 61 of the Highway Traffic Act while
responding to an emergency call or being used to transport a patient or
injured person in an emergency situation.
13. OVER SIZED LOADS
13.1 Subject to Subsection 110(4) of the Highway Traffic Act, no person shall move
a motor vehicle, load, object or structure in excess of the dimensional limits set
out in Section 109 or the weight limits set out in Part VIII of the Highway Traffic
Act, on any highway in the Town of Saugeen Shores, except under the
authority of a permit issued by a person appointed by Council.

Subject to Subsection 110(1) of the Highway Traffic Act, no person shall move
a motor vehicle, load, object or structure in excess of the dimensional limits set
out in Section 109 or the weight limits set out in Part VIII of the Highway Traffic
Act, on any highway in the Town of Saugeen Shores, except under the
authority of a permit issued by the Director, Infrastructure & Development
Services. [By-law 68-2021]
13.2 The permit referred to in Section 13.1 may be general, or may limit the time
and the particular highways that may be used, and may contain conditions
relating to the protection of persons and/or property from injury or damage and
may require a bond or other security sufficient to cover the cost of repairing
any possible damage to the highway.
13.3 The application for a permit referred to in Sections 13.1 and 13.2 shall be in
writing and the permit may be issued by the person appointed by the Council
after approval by the Chief of Police and/or any other approvals deemed
necessary by the person appointed by Council to issue the permit.
The application for a permit referred to in Sections 13.1 and 13.2 shall be in
writing and the permit may be issued by the Director, Infrastructure &
Development Services after approval by the Chief of Police and/or any other
approvals deemed necessary by the person appointed by the Director,
Infrastructure & Development Services Council to issue the permit.

13.4 The owner, operator or mover of a heavy vehicle, load, object or structure in
respect of which a permit is granted under this section, is nevertheless
responsible for all damages that may be caused to the highway by reason of
the driving, operating or moving of such a heavy or over size vehicle, load,
object or structure.
The owner, operator or mover of an over-dimension vehicle, over-size load,
object or structure in respect of which a permit is granted under this section, is
nevertheless responsible for all damages that may be caused to the highway
by reason of the driving, operating or moving of such a heavy or over size
vehicle, load, object or structure. [By-law 68-2021]
13.5 It is a condition of every permit issued under this section that the original of the
permit be carried in the vehicle for which the permit was issued and be
produced when demanded by a Police Officer or an officer appointed for
carrying out the provisions of the Highway Traffic Act.
13.6 Every person who fails to obtain a permit as required by this section or violates
or permits the violation of any condition of a permit issued under this section,
is guilty of an offence and on conviction is liable to a fine of not less than
$100.00 and not more than $500.00 and in addition, if the condition
contravened is in respect of any weight allowed under the permit, a fine shall
be imposed as if the person had not been convicted of an offence under
Section 116, 117 or 118 of the Highway Traffic Act in respect to any gross
vehicle weight, axle weight or axle group weight in excess of the maximum
allowable weights permitted under the Highway Traffic Act or the Regulations.
13.7 Where authorized signs indicating "No Heavy Trucks" are on display, no
person shall operate a vehicle having a carrying capacity in excess of 1,000
kilograms on any such highway.
14.
MOTORIZED SNOW VEHICLES
14.1 No Person shall operate motorized snow vehicles on highways, with the
exception that motorized snow vehicles may operate between 07:00 hours
and 23:00 hours upon highways approved by the Council of the Town of
Saugeen Shores. [By-law 67-2018]

14.2 Notwithstanding Section 14.1 above, a person may operate a motorized snow
vehicle between 07:00 hours and 23:00 hours on a highway within the
boundaries of Saugeen Shores for the purpose of traveling from his/her
residence to a trail approved by the Town and to return from such trail to
his/her residence or for the purposes of obtaining food, gas or lodgings.
14.3 Notwithstanding Section 14.1 and 14.2 above, no person shall operate a
motorized snow vehicle on the highways as set on Schedule "J" attached
hereto.
14.4 That nothing in this By-law shall prohibit the operation of a motorized snow
vehicle across any of the highways provided that the driver or operator shall
enter or cross at an angle of approximately 90 degrees to the direction of the
highway.
14.5 That no person shall operate a motorized snow vehicle on any sidewalk or trail
system that is posted "No Motorized Vehicles" in the Town of Saugeen
Shores.
14.6 That no person shall operate a motorized snow vehicle on private property
within the limits of the Town of Saugeen Shores except if authorized to do so
by the owner of the private property concerned.
14.7 Operators of motorized snow vehicles must keep machines away from
churches and funeral homes when services are in progress and completely
away from hospitals and nursing homes unless absolutely necessary.
14.8 That the speed limit for motorized snow vehicles shall be 20 km/hr when
travelling on the authorized highways with a posted limit of 50km/hr and
50km/hr when travelling on the authorized highways with a posted limit of
80km/hr.
14.9 That the provisions of this By-law shall not apply to motorized snow vehicles
operated for emergency purposes by the Town of Saugeen Shores Police
Service, Saugeen Shores Fire Department, the Ontario Provincial Police,
County of Bruce Ambulance and any employees or agents performing their
duties under the Town of Saugeen Shores, and includes all hydro, cable, gas
and telephone utilities companies.
15. MISCELLANEOUS
15.1 No person shall willfully remove, damage or interfere with any authorized
traffic sign or marking.
15.2 Every driver shall obey the directions on authorized signs erected for
regulating or controlling traffic.
15.3 No person shall operate a vehicle on a highway or parts thereof which has
been closed to vehicular traffic due to construction, repairs or emergency
situations provided the highway or parts thereof have been adequately marked
by properly worded and authorized signs or barricades or both.
15.4 No person, while operating a vehicle, shall intersect a funeral or other properly
authorized procession while it is in motion, except under the direction of a
police officer.
15.5 No person shall drive a vehicle over a raised curb except at a place where the
curb is ramped.
15.6 No person shall operate a vehicle on any part of a median strip.
15.7 No person shall place, maintain or display upon or in view of any highway, any
sign, signal, marking or device which purports to be or is an imitation of or

resembles an authorized or official sign, or which conceals from view or
interferes with the effectiveness of an authorized or official sign.
15.8 No person shall throw or deposit or cause to be deposited any debris,
construction materials, snow or ice upon a sidewalk or on, along or adjacent to
any highway. The provisions of this section do not apply to the Town or utility
company, or a contractor hired by the Town or utility company. [By-law 67-

15.9 No person shall operate a vehicle over and along any beach within the Town
of Saugeen Shores save and except for those beach areas so designated for
travel and parking. The provisions of this section does not apply to vehicles
operated for emergency purposes by the Town of Saugeen Shores Police
Service, Saugeen Shores Fire Department, the Ontario Provincial Police,
County of Bruce Ambulance and any employees or agents performing their
duties under the Town of Saugeen Shores and includes hydro, cable, gas and
telephone utility companies.
15.10 Notwithstanding any of the provisions contained in this By-law, the Chief of
Police or other police officers may, during an emergency or unusual or
unforeseen circumstance, prohibit the movement of any or all pedestrian or
vehicular traffic on any highway or parts thereof, by adequate sign, barricades
or other traffic devices and further, may require the removal of any or all
vehicles already parked, whether legally or not, during such periods and any
person who disobeys a police officer or traffic device commits an offence.
15.11 No person shall drive, move or operate any vehicle or animal other than in a
counter-clockwise direction on any roundabout identified in Schedule "K". [By-
law 67-2018]
15.12 No person shall store or place construction materials upon a sidewalk, or on, a
roundabout, along or adjacent to any highway. The provisions of this section
do not apply to the Town or utility company, or a contractor hired by the Town
or utility company. [By-law 67-2018]
15.13 Reduced Load Period to be in effect from March 1 to April 16 unless otherwise
posted on the Town website. Weight is limited to 5 tonnes per axle. Exception
is granted Concession 10 from Highway 21 easterly 830m. [By-law 68-2021]
16.
COMMUNITY SAFETY ZONES [By-law 68-2021]
16.1 Designated Community Safety Zones are listed in Schedule "L".
16.2 Designated Community Safety Zones shall be applicable during hours, days
and months as indicated in Schedule "L".
16.3 Signs shall be erected in accordance with the Act.
16.4 Every person who commits an offence under HTA section 128 in a community
safety zone when it is in effect is liable, on conviction, not to the fines set out
in subsection 128 (14), but, where the rate of speed at which the motor vehicle
was driven;
i) is less than 20 kilometres per hour over the speed limit, to a fine of double
the fine set out in clause 128 (14) (a) for each kilometre per hour that the
motor vehicle was driven over the speed limit;
ii) is 20 kilometres per hour or more but less than 30 kilometres per hour over
the speed limit, to a fine of double the fine set out in clause 128 (14) (b) for
each kilometre per hour that the motor vehicle was driven over the speed
limit;
iii) is 30 kilometres per hour or more but less than 50 kilometres per hour over
the speed limit, to a fine of double the fine set out in clause 128 (14) (c) for
each kilometre per hour that the motor vehicle was driven over the speed
limit; and

iv) is 50 kilometres per hour or more over the speed limit, to a fine of double
the fine set out in clause 128 (14) (d) for each kilometre per hour that the
motor vehicle was driven over the speed limit. 2005, c. 26, Schedule. A,

v) Every person who commits an offence under section 128 in a community
safety zone, when it is in effect, that is also a construction zone designated
under subsection 128 (8) or (8.1), when there is a worker in the
construction zone, is liable, on conviction, to the penalties set out in
subsection (6) and not to an additional penalty under subsection 128
(14.1). 2005, c. 26, Schedule. A, s. 32 (2).
vi) Every person who commits an offence under section 130 or 172 in a
community safety zone when it is in effect is liable, on conviction, not to
the penalty set out in those sections, but to a fine of not less than double
the minimum fine set out in those sections and not more than the
maximum fine set out in those sections or to imprisonment for a term of
not more than six months, or to both, and in addition his or her licence or
permit may be suspended for a period of not more than the maximum
period for which his or her licence could be ordered suspended by a court
under section 130 or 172, as the case may be. 1998, c. 6, s. 1; 2007,
c. 13, s. 23.
vii) Every person who commits an offence in contravention of any of sections
132 to 164, inclusive (except subsections 140 (4) and (6) and subsections
144 (22) to (29), inclusive), section 166, 167, 168 or 169, subsection 176
(3) or section 182 in a community safety zone when it is in effect is liable,
on conviction, not to the penalty otherwise applicable, but to a fine of not
less than double the minimum fine otherwise applicable and not more than
the maximum fine otherwise applicable. 1998, c. 6, s. 1.

16. EMERGENCIES
16.1 Notwithstanding other provisions of this By-law, the Chief of Police or other
police officer during an emergency may prohibit the movement of any or all
pedestrian or vehicular traffic on any highway or parts thereof within the Town
boundaries, by adequate signs, barricades or other traffic devices, and further,
may require the removal of any or all vehicles already parked, whether legally
or not, on any of the highways or parts thereof during such emergency.
17. OFFENCE AND PENALTY
17.1 The provisions of this by-law shall be enforced by the Enforcement Officer.

17.2 An Enforcement Officer who has reasonable grounds to believe that a person
has contravened any provisions of this by-law may require that person to
provide identification of themselves, and every person who is required by an
Enforcement Officer to provide identification under this section, shall identify
themselves to the Enforcement Officer and shall provide their correct name,
date of birth and current address.
a) Providing such information shall constitute sufficient identification.
b) Failure to provide such information shall constitute obstruction of the
Enforcement Officer. [By-law 67-2018]
17.3 Enforcement - Provincial Offences Act
Any person who violates a provision of this by-law is guilty of an offence an on
conviction is liable to pay a penalty provided in Section 61 of the Provincial
Offences Act R.S.O. Chapter P 33 as amended or re-enacted from time to
time. [By-law 67-2018]
17.4 Enforcement - Municipal Act
Where any person is directed or required by this by-law to do any matter or
thing, such matter or thing may be done in default of its being done by the

person directed or required to do it at that person's expense, and such
expense may be recovered by action or as municipal taxes in the manner
prescribed by the Municipal Act. [By-law 67-2018]
18. TRANSITION
18.1 The provisions of this By-law affecting traffic on a highway designated as a
connecting link pursuant to the Public Transportation and Highway
Improvement Act shall not become effective until approved by the Ministry of
Transportation.
18.2 Notwithstanding Section 18.1, this By-law shall come into force and take effect
upon the final passage thereof.
18.3 That any other By-laws inconsistent with the terms of this By-law are hereby
repealed.
