THE CORPORATION OF THE TOWNSHIP OF SCHREIBER
BYLAW 49-2020
BEING A BYLAW TO REGULATE TRAFFIC AND PARKING
IN THE TOWNSHIP OF SCHREIBER
WHEREAS, Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, gives The
Corporation of the Township of Schreiber the power to pass Bylaws respecting its
highways, including parking and traffic on highways;
AND WHEREAS Section 11(3)(8) of the Municipal Act, 2001, S.O. 2001, c. 25, gives
The Corporation of the Township of Schreiber the power to pass Bylaws respecting
parking, except on highways;
NOW, THEREFORE, THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF SCHREIBER ENACTS AS FOLLOWS:
1. SHORT TITLE
That this Bylaw may be cited as the "Traffic and Parking Bylaw".
2. SCOPE OF THIS BYLAW
All provisions of this Bylaw are applicable to highways or parts of highways under the
jurisdiction of the Township.
3. DEFINITIONS
Except where terms are defined below, the definitions contained within the Highway
Traffic Act, R.S.O. 1990, c. H.8, as amended from time to time, or any successor
thereof, shall apply in the interpretation of this Bylaw. For purposes of this Bylaw:
a) "bus" means a motor vehicle designed for carrying ten (10) or more passengers
and used for transportation purposes;
b) "Municipal law enforcement officer" means a Municipal Law Enforcement Officer
of the Corporation of the Township of Schreiber;
c) "chauffeur" means a person who operates a motor vehicle and receives
compensation;
d) "commercial motor vehicle" means a motor vehicle that is registered as a
commercial vehicle having a minimum gross vehicle weight of 3,500 kilograms;
e) "corner" means the point of intersection of curbs or edges of the portion of the
highway used for vehicular traffic;
f) "crosswalk" means that part of a highway at an intersection which is included
within the connection of the lateral lines of the sidewalk on opposite sides of the
highway measured from the curbs, or in the absence of curbs, from the edges of
the roadway, or any portion of a roadway at an intersection or elsewhere
distinctly indicated for pedestrian crossing by signs or by lines or other markings
on the surface;
g) "driver" means a person who drives a motor vehicle on a highway;

h) "gross vehicle weight" means the combined weight of a vehicle and load;
i) "highway or street" means a public highway or public road under the jurisdiction
of either the Corporation of the Township of Schreiber or the Province of Ontario,
and includes any highway as defined in The Municipal Act, but does not include a
lane or private right-of-way;
j) "intersection" means that area embraced within the prolongation or connection of
the lateral curb lines, or if none, then of the lateral boundary lines of two (2) or
more highways which join one another any angle whether or not one crosses the
other;
k) "individual parking space" means a portion of the surface of the street of
sufficient length and depth to accommodate a vehicle, as may be designated by
signs or markings;
l) "lane" means any passageway or right-of-way shown on a registered plan other
than a street;
m) "park or parking" when prohibited, means the standing of a vehicle whether
occupied or not, except when standing temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers;
n) "pedestrian" means a person afoot and includes persons with disabilities and
children in wheeled carriages;
o) "person" shall mean and include every person, firm, co-partnership, association
and corporation;
p) "roadway" means that part of the highway that is improved, designed or ordinarily
used for vehicular traffic, but does not include the shoulder and where a highway
includes two (2) or more separate roadways, the term roadway refers to any one
(1) roadway separately and not to all of the roadways collectively;
q) "stand or standing" when prohibited means any stopping of a vehicle except
when necessary to avoid conflict with other traffic or in compliance with the
direction of a police officer or traffic control signal;
r) "sidewalk" means that portion of a street between the curb lines or the lateral
lines of a roadway and the adjacent property lines intended for the use of
pedestrians;
s) "stop" means the complete cessation of movement;
t) "stop or stopping when prohibited" means any stopping of a vehicle except where
necessary to avoid conflict with other traffic or in compliance with the direction of
a police officer or traffic control signal;
u) "signs, signals and markings" shall mean and include every sign, light, signal or
device, not inconsistent with this by-law or the Highway Traffic Act, placed or
erected by the authority of the Council or Works Superintendent or the Municipal
Law Enforcement Officer of the Township;
v) "stop when required" means a complete cessation of movement;
w) "street or highway" means a public highway or public road under the jurisdiction
of either the Corporation of the Township of Schreiber or the Province of Ontario,
and includes any highway as defined in The Municipal Act, but does not include a
lane or private right-of-way;
x) "Township" means the Corporation of the Township of Schreiber;
y) "traffic" includes pedestrians, ridden or herded animals, vehicles, and other
conveyances, either singly, or together while using any street for the purposes of
travel;
z) "traffic control device" means any sign or roadway curb or sidewalk marking, or
other device erected or placed under the authority of the Council of the

Corporation of the Township of Schreiber, for the purpose of guiding or directing
traffic;
aa) "traffic signal" means any device manually, electrically, or mechanically operated
for the regulation of traffic;
bb) "U-turn" means to turn a vehicle within the roadway so as to proceed in the
opposite direction;
cc) "unlicensed vehicle" means a means vehicle that does not have a number plate
displayed or does not have current validation of a vehicle permit affixed to the
number plate, in the manner prescribed in the Highway Traffic Act;
dd) "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-
building machine, and any vehicle drawn, propelled, or driven by any kind of
power including muscular power, but does not include a motorized snow vehicle,
or an off-road vehicle.
4. HIGHWAY TRAFFIC ACT
The provisions of this by-law shall be subject to the provisions of the Highway Traffic
Act, R.S.O.1990, c.H.8 and any amendments thereto. The definitions contained
within the Highway Traffic Act shall apply in the interpretation of this Bylaw except
where inconsistent or defined herein, in which case the definition under this Bylaw
shall apply.
5. AUTHORITY TO INSTALL SIGNS
a) The Director or designate is hereby authorized to place, erect and maintain
or cause to be placed, erected and maintained such traffic control devices
and traffic control signs that are required to give effect to the provisions of
this Bylaw and/or which are authorized by the Schedules to this Bylaw.
b) The Director or designate, notwithstanding the other provisions of this
Bylaw, is further authorized for the duration of the situation to place, erect
or maintain such traffic control devices, including signs, and traffic control
signals that are not authorized by this Bylaw but are required for safety,
construction and/or emergency reasons.
c) Unless otherwise permitted, no person shall place, maintain or display
upon any highway any sign, signal, marking or device which purports to
be or is an imitation of or resembles any traffic control device or traffic
control signal, without prior approval of the Director, Transportation
Services or designate.
6. AUTHORITY TO ENFORCE
A police officer may enforce all provisions of this Bylaw. A municipal law enforcement
officer may enforce all provisions of this Bylaw except those pertaining to a moving
vehicle.

7. OPERATION OF VEHICLES
a) No driver of a vehicle shall make a U-turn upon any street unless it can be made
safely and without interfering with other traffic. No U-turn will be allowed on
portions of streets as listed on Schedule A to this Bylaw.
b) When properly worded signs to that effect have been erected and are properly on
display, no person operating a vehicle in the direction hereinafter named, shall
turn such vehicle to the left at the following intersection:

c) No person shall intersect or interfere with a funeral or other procession, while it is
in motion, except under the direction of a Municipal Law Enforcement Officer or
police officer.
d) The driver of a vehicle in a funeral or other procession shall drive as near to the
right-hand edge of the roadway as is practical and safe.
e) The driver of a vehicle shall not drive upon any sidewalk, or on a curb or
improved boulevard except at a permanent or temporary driveway, as authorized
by the Township.
f) No person shall park any vehicle on a highway for the purpose of advertising, or
use a loudspeaker on or from any vehicle on the highway unless authorized by
the Township.
8. OBJECTS ON A ROADWAY
Unless otherwise authorized, no person shall place or store any object or
accumulation of material, including snow or ice, upon a roadway.
9. LOADING ZONES
a) Loading zones are hereby authorized for the sole purpose of loading or
unloading merchandise from clearly marked vehicles between the hours of 8 AM
and 8 PM daily, except Sundays and statutory holidays, in such places as
described in Schedule B to this Bylaw.
b) School bus loading zones are hereby authorized for the sole purpose of loading
and unloading school children from clearly marked school buses between the
hours of 8 AM and 8 PM daily, except Sundays and statutory holidays, in such
places as described on Schedule C to this Bylaw.
10. PARALLEL PARKING
a) No person shall park a vehicle on a highway except on the right-hand side of the
highway having regard for the direction which the vehicle was proceeding and
unless:

i)
where there are curbs at the edge of the roadway the right front and right
rear tires of runners of the vehicle are parallel to and distanced
respectively not more than 15 centimetres (6 inches) from the curb;
ii)
where there are no curbs and there are paved shoulders, the right front
and right rear tires or runners of the vehicle are parallel to the outer edge
of the paved shoulder and the vehicle shall be entirely removed from the
travelled portion of the roadway; or
iii)
where there are no curbs or paved shoulders and where there are gravel
shoulders, the left front and left rear tires or runners of the vehicle are
parallel to the travelled portion of the roadway and the vehicle shall be
entirely removed from the travelled portion of the roadway, provided that
this section shall not apply where angle parking is specifically authorized
in this Bylaw.
11. ANGLE PARKING
Where angle parking is permitted, no person shall park a vehicle except at an angle
of ninety degrees to the edge of the roadway and so that the front end or rear of the
vehicle is nearest to the edge of the roadway and/or the bumper or rear of any
vehicle so parked shall not extend or project over a sidewalk. When properly worded
signs have been erected and are on display, no person shall park a vehicle on the
street or part of a street, more particularly set forth in Schedule C attached hereto,
except as closely as is practicable to the angle, with reference to the edge of the
roadway specified, in the said Schedule.
12. PARKING PROHIBITED
a) No person shall park a vehicle:
i)
on a sidewalk;
ii)
in front of a public or private driveway or municipal lane;
iii)
within an intersection;
iv)
within 3 meters of a fire hydrant;
v)
on a crosswalk;
vi)
within 8 meters of the intersection of the street lines or the streets forming
an intersection;
vii)
on any street in such a manner as to obstruct traffic;
viii)
in such a manner as to prevent the convenient removal of any other
vehicle previously parked or standing;
ix)
in any lane, except while loading or unloading merchandise;
x)
in front of the entrance to any hotel, hospital or the entrance to any
theatre, church, auditorium or school where large assemblages are being
held in such theatre, church, auditorium or school;
xi)
on any highway longer than 72 hours;
xii)
in specified places, where signs are on display, no person shall park a
vehicle at any time, upon any highway or portion of a highway, except as
set forth in Schedule D to this Bylaw;
xiii)
in specified places, where signs are on display, no person shall park a
vehicle at any time, upon any highway or portion of a highway, as set
forth in Schedule E to this Bylaw.

b) No person shall park or stop a vehicle on a highway in such a manner as to
interfere with the movement of traffic or the clearing of snow from the highway.
c) No person shall park an unhitched trailer on any highway, street or lane for more
than seventy-two (72) consecutive hours.
d) No person shall park or stop a vehicle, without authorization, on private property,
as set forth in Schedule F to this Bylaw.
e) No person shall park a bus on a highway.
f) No person shall park a commercial vehicle on a highway except when actively
engaged in loading or unloading.
g) No person shall park an unlicensed vehicle, or a vehicle leaking fluids on a
highway.
h) No person shall park a vehicle in a loading zone.
i) No person shall park or stop a vehicle in a school bus loading zone.
13. SNOW REMOVAL
No person shall park a vehicle on any highway in the Township between the hours of 2
AM and 7 AM from the 15th day of November in each year to the 15th day of April in each
year, inclusive.
14. TEMPORARY RESTRICTIONS ON PARKING AND STOPPING
When properly worded signs have been placed on display indicating parking restrictions
in order to facilitate snow removal, street cleaning, street maintenance or repairs, or to
prevent the obstruction of parade routes, or in order to facilitate the control of an
emergency or hazard to the users of the street, no person shall park or stop a vehicle on
the street in a manner contrary to the directions on such signs.
15. UNLAWFUL PARKING
No person shall park or stand a vehicle upon any highway for the purposes of:
a)
displaying it for sale; or
b)
washing or repairing such vehicle except where repairs are necessitated by an
emergency and carried out immediately.
16. TAXI CABS
(a) Subject to the provisions of this Section, no owner or operator of a taxi shall park
their vehicle on a street except for a reasonable time while picking up or
delivering a passenger.

(b) Upon application being made to the Township, Council may establish a taxi stand
on the street for one (1) vehicle only for each licensed taxi owner, provided that
such stand shall only be established on a street in front of the places of business
of such owner and shall be designated by proper signs.
(c) For the purpose of the Section, a group of licensed owners operating under one
(1) name shall be considered as one (1) licensed taxi owner.
(d) A taxi while parked on or at a taxi stand shall, at all times, be in the personal
charge of a licensed taxi driver.
(e) All operators of taxicabs shall permit the passenger to leave from the curbside of
the vehicle only and shall take every precaution to see that all passengers are
clear of the taxicab before driving away.
(f) No person shall stop, stand or park a vehicle other than a taxi-cab in a taxi stand
when such stand has been officially designated and appropriately signed, except
that a driver of a passenger vehicle may temporarily stop therein for the purpose
of and while actually engaged in loading or unloading passengers when such
stopping does not interfere with any taxi-cab waiting to enter or leave, or about to
enter or leave such taxi stand.
17. PENALTIES
Any person who contravenes any of the provisions of this Bylaw, except a
Designated Provision, is guilty of an offence and upon conviction is liable to a penalty
as provided for in the Provincial Offences Act, R.S.O. 1990, c P. 33, as amended
from time to time, or any successor thereof.
18. AUTHORITY TO TOW VEHICLES
a) In addition to any other penalties provided for in this Bylaw, a police officer or a
municipal law enforcement officer employed by the Township, may, where a
vehicle is parked or stopped in contravention of any portion of Parts IV, V or VI of
this Bylaw, cause it to be moved or taken to and place or stored in a suitable
place.
a) All costs and charges incurred for removing, caring for and storing a vehicle
pursuant to subsection a) of this section, shall be a lien upon the vehicle, which
lien may be enforced in the manner provided for the Repair and Storage Liens
Act, R.S.O. 1990, Chapter R. 25, as amended.
19. EXEMPTIONS
A police officer or municipal law enforcement officer actively engaged in enforcing
the provisions of this or other municipal Bylaws, or laws is exempt from such
provisions of this Bylaw as reasonably necessary for the performance of such
enforcement.
20. VEHICLE OWNER RESPONSIBLE

Where a vehicle has been left parked, stopped or standing in contravention of this
Bylaw, the owner of the vehicle is guilty of an offence, even though the owner was
not the driver of the vehicle at the time of the contravention of the Bylaw, and is liable
to the applicable fine unless, at the time of the offence, the vehicle was in the
possession of another person without the owner's consent.
21. CONFLICT
In the event of any conflict between this Bylaw and any other Bylaw of the Township,
the more restrictive shall prevail unless the context requires otherwise.
22. VALIDITY
Should any Section, Clause or provision of this Bylaw be declared invalid by a court
of competent jurisdiction, the same shall not affect the validity of the Bylaw as a
whole or any part thereof, other than the part which was declared to be invalid.
23. BYLAW REPEALED
Bylaw 88-26, as amended, as well as all Bylaws amending the same, are hereby
repealed as of the effective date set out in section 24 of this Bylaw.
24. EFFECTIVE DATE
This Bylaw takes effect on the date of passing.
