THE CORPORATION OF THE TOWNSHIP OF SCUGOG
BY-LAW NUMBER 23-22
BEING A BY-LAW TO REGULATE VEHICULAR TRAFFIC ON
HIGHWAYS, FIRE ROUTES, PRIVATE AND MUNICIPAL
PROPERTY AND TO PROHIBIT THE INJURING OR FOULING
OF HIGHWAYS AND BRIDGES AND THE OBSTRUCTION OF
DITCHES AND CULVERTS.
WHEREAS pursuant to the provisions of the Municipal Act, S.O. 2001, as amended,
and the provisions of the Highway Traffic Act, R.S.O. 1990, as amended, by-laws may
be passed by the Councils of local municipalities;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SCUGOG enacts as follows:
1 .
DEFINITIONS
1.1
Except where provided in Section 2 hereof, the definitions included in the
Highway Traffic Act, as amended, shall apply to this By-Law.
2.
For the purposes of this By-Law:
2.1
Accessible Parking Space means a Parking Space with a minimum width of 4.1
metres, including aisle, designated solely for the use of persons with disabilities
and permitted by authorized sign, which includes the international disabled
symbol and is an area listed in Schedule "A" of this By-law or has been an area
designated by Site Plan Agreement on private lands or municipal property. The
term Disabled Parking Space shall be interchangeable with the term Designated
Parking Space as it applies to this By-Law.
2.2
Accessible Parking Permit means a permit issued by Ontario's Minister of
Transportation, to a person or organization that qualifies for such a permit as per
Reg. 581 of the Highway Traffic Act, R.S.O. 1990.
2.3
Authorized means authorized by the authority having jurisdiction, and
notwithstanding, the authority having jurisdiction shall include the Director of
Community Services or designate. The authority having jurisdiction shall also
include the Fire Chief or designate with respect to fire route determination and
signage on any lands, private or public.
2.4
Boulevard means all parts of the Highway except any roadway, Shoulder or
Sidewalk; and
(a) that part of the highway lying between any sidewalk and the traveled
portion of the highway or the near edge of the Shoulder where such exists;
and
(b) that part of the highway lying between the property line and the edge of
the sidewalk nearest to the property line, and where there is no sidewalk,
means that part of the highway lying between the property line and the
traveled portion of the highway or the edge of the Shoulder where such
exists, farthest from the traveled portion of the road.

2.5
Bus Stop means that part of a highway designated by Authorized signs where
buses will stop to take on or let off passengers.
2.6
Chief of Police means the Chief of Police of the Durham Regional Police
Service.
2.7
Clerk means the Clerk of the Corporation of the Township of Scugog.
2.8
Director means the Director of Public Works, Parks and Recreation for the
Corporation of the Township of Scugog or designate.
2.9
Council means the Council for the Corporation of the Township of Scugog.
2.10 Driveway means improved land on a highway which provides access from the
roadway to a Private Roadway or to adjacent land.
2.11 Fire Chief means the Chief of the Scugog Fire Department or his designate.
2.12 Fire Route means any Private Roadway marked as a Fire Route by Authorized
Fire Route signs as established by the Fire Chief. Authorized signs shall include
but are not limited to signs at all vehicular accesses to private property indicating
internal Driveways, aisles and roadways that are designated as Fire Routes. Any
Fire Route marked by Authorized signs where both sides of a Private Roadway
are not so designated the Fire Route shall be indicated as the side of the Private
Roadway as designated and shall be 9 m in width in accordance with the Ontario
Building Code, as amended, or any successor legislation.
2.13 Heavy Traffic means a commercial Vehicle, Trailer, other conveyance or any
combination used for, intended to be used for or designated to be used for the
moving of goods and loads, and having a combined gross weight of five (5)
tonnes or more.
2.14 Holiday means any Sunday, New Year's Day, Family Day, Good Friday, Easter
Monday, Victoria Day, Canada Day, August Civic Holiday, Labour Day,
Thanksgiving Day, Remembrance Day, Christmas Day, Boxing Day, any day
proclaimed as a civic holiday by the township, and any day fixed by proclamation
of the Governor General or by the Lieutenant Governor-in-Council as a public
holiday or for a general fast or thanksgiving, and when any holiday except
Remembrance Day falls on a Sunday, the next day following in lieu thereof.
2.15 Loading Zone means the part of a highway designated by signs where Vehicles
may load or unload goods.
2.16 Motor Vehicle includes an automobile, a motorcycle, a motor-assisted bicycle
unless otherwise indicated in this by-law, and any other Vehicle propelled or
driven otherwise than by muscular power, but does not include a streetcar or
other motor Vehicle running only upon rails, a power-assisted bicycle, a
motorized snow Vehicle, a traction engine, a farm tractor, a self-propelled
implement of husbandry or a road-building machine;
2.17 Municipal Law Enforcement Officer means an officer appointed to enforce the
By-Laws of the Township of Scugog.

2.18 Occupant means:
(a) the tenant of the property or part thereof who consent shall extend only
to the control of the land of which he is tenant and any Parking Spaces
allotted to him under his lease or tenancy agreement;
(b) the spouse of a tenant;
(c) a person or municipality, or a local board thereof, having an interest in
the property under an easement or right of way granted to or
expropriated by the person, municipality or local board whose consent
shall extend only to the part of the property that is subject to the
easement or right of way; and
(d) a person authorized in writing by an Occupant as defined in sub-
subclause (a), (b) and (c) to act on the Occupant's behalf for
requesting the enforcement of this By-Law.
2.19 Officer, means a Municipal Law Enforcement Officer appointed by Council
and/or any Peace Officer described by the Criminal Code of Canada and shall
include a Police Officer and a Provincial Offences Officer.
2.20 Owner, when used in relation to real property means:
(a) the registered owner of the property;
(b) the registered owner of a condominium unit, whose consent shall
extend only to the control of the unit of which he is owner and any
Parking Spaces allotted to him by the Condominium Corporation or
reserved for his exclusive use in the declaration or description of the
property;
(c) the spouse of a person described in subclause (a) or (b);
(d) where the property is included in a description registered under the
Condominium Act S.O 1998, c.19, the Board of Directors of the
Condominium Corporation; and
(e) a person authorized by the property owner as defined in sub-subclause
(a), (b), (c) or (d) to act on the owner's behalf for requesting the
enforcement of this By-Law.
2.21 Park or Parking When Prohibited means the standing of a Vehicle, whether
occupied or not, except when standing temporarily for the purpose of and while
actually engaged in the loading or unloading of merchandise or passengers.
2.22 Parking Space means that part of the surface of a roadway designated by signs,
painted lines or other markings, for the purpose of parking a Vehicle.
2.23 Pedestrian means a person on foot or in a wheeled chair or perambulator.
2.24 Permit means a permit issued by the Clerk to authorize parking on certain
streets or areas and shall include a temporary Permit, obtained from an
electronic dispensing device authorized for use by Council.
2.25 Private Roadway means any private road, laneway, or ramp or other means of
vehicular access to or egress from a building or structure and it may include part
of a parking lot.
2.26 Public Parking Area means any open area or portion of a structure other than a
street or highway, intended for the temporary parking of Vehicles whether an

invitation to park is implied or expressed and on which there are designated
Parking Spaces, whether or not a fee is paid for the use.
2.27 Raised Curb means a vertical or sloping member along the edge of a pavement
forming part of a gutter, and clearly defines the pavement edge to Vehicle
operators, and is designated as a non-mountable or straight curb which is not
intended to provide for the passage of Vehicles from the traveled portion of the
roadway to the Shoulder and/or private property.
2.28 School Bus Loading Zone means the part of a highway designated as such by
Authorized signs.
2.29 School Purpose Vehicle means:
(a) a school bus as defined in the Ontario Highway Traffic Act, as
amended;
(b) a station wagon, van or bus, operated by or under contract with a
school board or other authority in charge of a school; and
(c) a bus or van operated on a highway;
i.
for the purpose of transporting, for compensation, physically
disabled persons; or
ii.
by, for or on behalf of any person, club or agency or
organization that holds itself out as providing a transportation
service to physically disabled persons, for compensation or
otherwise.
2.30 Shoulder means the part of the highway immediately adjacent to the traveled
portion of the roadway and having a surface which has been improved for the
use of Vehicles.
2.31 Sidewalk means the part of the highway set aside for the use of Pedestrians or
used by the general public for the passage of Pedestrians.
2.32 Stand or Standing When Prohibited means the halting of a Vehicle, whether
occupied or not, except for the purpose of and while actually engaged in
receiving or discharging passengers.
2.33 Stop or Stopping When Prohibited means the halting of a Vehicle even
momentarily, whether occupied or not, except when necessary to avoid conflict
with other traffic or in compliance with the directions of a constable or other
police officer or a traffic control sign or signal.
2.34 Township means the Corporation of the Township of Scugog.
2.35 Trailer means but is not limited to any Vehicle or other conveyance on wheels, or
skis that is drawn or intended to be drawn by a Motor Vehicle but does not
include another Motor Vehicle.
2.36 Traffic means and includes Pedestrians, ridden or herded animals, Vehicles and
other conveyances, either single or together, while using any highway for
purposes of travel.

2.37 Traffic Control Signal means any device, manually, electrically or mechanically
operated for the regulation or control of traffic.
2.38 U-Turn means the turning of a Vehicle within a roadway so as to proceed in the
opposite direction.
2.39 Vehicle means and includes a motor assisted bicycle, Motor Vehicle, a
commercial Vehicle, Trailer, traction engine, farm tractor, road-building machine
and any Vehicle drawn, propelled or driven by any kind of power, including
muscular power, but does not include a motorized snow vehicle or the cars of
electric or steam railways running only upon rails.
2.40 Vending Vehicle, means a Motor Vehicle licensed by the Township from which
tobacco products and refreshments are sold or offered for sale to the public and
is meant to travel from place to place.
3.
GENERAL PROVISIONS (SIGNS, EXPRESSIONS)
3.1
Where any expression of time occurs or where any hour or other period of time is
stated, the time referred to shall be standard time except in periods when
daylight savings time is in effect, in which period shall be daylight savings time.
3.2
The word "Person" as used in this By-Law shall be construed where the context
requires to mean and includes an individual, firm, society, association and
corporation; the singular shall be construed to include the plural and the
masculine shall be construed to include the feminine.
3.3
The Director or designate, is authorized to place or erect and to maintain such
signs as are required to give effect to the provisions of this By-Law and any such
sign erected under his authority shall be deemed an Authorized sign.
3.4
The Fire Chief or designate, is authorized to determine the location of any Fire
Route on public or private lands and to require proper signs as determined by
him and sufficient signs to be placed to clearly mark any such Fire Route to give
effect to the provisions of this By-Law and any such sign erected under his
authority shall be deemed an Authorized sign.
3.5
The maintenance, repair or replacement of any Authorized sign placed on any
property under the authority of this By-Law shall be the responsibility of the
Owner of such property and any such sign shall be maintained in good repair so
as to maintain the proper effectiveness of the provisions of this By-Law.
3.6
The Director or designate is authorized to issue permits for the movement on
highways under the jurisdiction of the Township of heavy Vehicles, loads, objects
or structures which are in excess of the dimensional limits set out in Section 92 of
the Ontario Highway Traffic Act, as amended or the weight limits set out in Part
VII of the Ontario Highway Traffic Act, as amended.
3.7
The Chief of Police or designate, and the Director or designate are hereby
authorized to erect or place temporary "No Parking" and/or "No Stopping" signs
on any highway under the jurisdiction of the Township pursuant to Sections 8.2.
and 9.2 of this By-Law.

3.8
The schedules referred to in this By-Law shall form part of this By-Law and each
entry in a column of such schedule shall be read in conjunction with the entries
across therefrom and not otherwise.
4.
ADMINISTRATION AND ENFORCEMENT
4.1
This By-Law shall be administered by the Municipal Law Enforcement Officer.
4.2
This By-Law shall be enforced by the Municipal Law Enforcement Officer or any
Officer.
4.3
Schedules "A" through "T" are attached and form part of this By-Law.
5.
GENERAL PROVISIONS
5.1
No person shall drive a Vehicle upon a Sidewalk or footpath on a highway except
for the purpose of directly crossing the Sidewalk or footpath at a Driveway. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
5.2
No person shall on any highway drive any Vehicle over any Raised Curb. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
5.3
Where U-Turns are not prohibited under the provisions of this By-Law, no person
shall make such turn unless it can be made safety and without interfering with
other Traffic. Any person who contravenes this provision is guilty of an offence
and on conviction is liable to a fine.
5.4
No person shall, except under the direction of a police officer, drive a Vehicle on
a highway between the Vehicles comprising a funeral or other procession
recognizable as such by the display of pennants or other identifying insignia,
while the Vehicles comprising such procession are in motion. Any person who
contravenes this provision is guilty of an offence and on conviction is liable to a
fine.
5.5
Unless Authorized by the municipality, no person shall drive any Vehicle on
municipal property except upon the roadways therein designed for vehicular use.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
5.6
No person shall obstruct, encumber, injure or foul any highway or bridge by any
means whatsoever. Any person who contravenes this provision is guilty of an
offence and on conviction is liable to a fine in addition to the cost of restoring the
highway or bridge.
5. 7 No person shall obstruct any ditch or any culvert upon any highway by any
means whatsoever. Any person who contravenes this provision is guilty of an
offence and on conviction is liable to a fine in addition to the cost of restoring the
ditch or culvert.
5. 8 No person shall place, maintain or display on any highway, any sign, marking or
device, which purports to be or is an imitation of or resembles an Authorized or

official sign. Any person who contravenes this provision is guilty of an offence
and on conviction is liable to a fine.
5.9
No person shall without proper authorization destroy or remove any Authorized
sign or obstruct any sign's content or intended information in any way. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
6.
ACCESSIBLE PARKING AND PARKING PROVISIONS
6.1
No person shall park or leave a Vehicle in an Accessible Parking Space unless
that person is in lawful possession of an Accessible Parking Permit. Any person
who contravenes this provision is guilty of an offence and on conviction is liable
to a fine.
6.2
Notwithstanding any of the provisions of this By-Law, the driver and owner of a
Vehicle operated by or for a disabled person in respect of which person an
Accessible Parking Permit has been issued, are exempt from the following
provisions of this By-Law:
(a) Section 9.1 (i) (parking in excess of 3 hours) provided that such
Vehicle shall not be parked for a period exceeding 24 hours; and
(b) Section 11 (Parking Restrictions and Prohibitions) provided that such
Vehicle shall not be parked for a period exceeding 24 hours.
6.3
Nothing in this By-Law is meant to negate any provision of any other By-Law or
Statute in relation to disabled persons and the By-Law or Statute carrying the
most severe provision shall prevail.
6.4
Where Authorized signs and pavement markings establish any parking area on a
highway as a designated area for accessible parking and described in Schedule
"A" in columns 1, 2 and 3, that area shall only be occupied by a Vehicle
authorized by this By-Law to do so.
6.5
Requirements for every Public Parking Area shall comply with O. Reg. 191/11:
Integrated Accessibility Standards under Accessibility for Accessibility for
Ontarians with Disabilities Act, as amended, and:
(a) every Accessible Parking Space shall be surfaced with asphalt,
concrete or other material that shall permit easy unhindered movement
of a disabled person, and shall also be level;
(b) Accessible Parking Spaces shall be located in the most practical
locations as to permit the clearest, shortest, easiest and least
obstructed path to Sidewalks, ramps, entrances and the like;
(c) Accessible Parking Spaces shall be kept clean and free of all
obstructions and not withstanding shall include the clearing of ice,
snow and other debris, which may render the space unusable; and
(d) no additional fee for an Accessible Parking Space shall be paid in
excess of any fee paid for the general use of a parking lot area by all
other persons using the parking lot.

7.
GENERAL STOPPING AND PARKING REGULATIONS
7.1
No person shall park any Vehicle on any highway except as follows, or under the
provision of Section 7.2 of this By-Law:
(a) where there is a curb, on the right side of the traveled portion of the
highway with its right front and rear wheels parallel to and not more
than 15 centimeters (6 inches) distant from such curb; or
(b) where there is no curb, with the right front and rear wheels parallel to
and as near to the right hand limit of the highway as is practicable
without stopping or parking on or over a Sidewalk, footpath or
Boulevard.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
7.2
Where parking is permitted on the left hand side of the traveled portion of a
highway designated for one-way Traffic, no person shall park any Vehicle on the
left side of the highway except as follows:
(a) where there is a curb, on the left side of the traveled portion of the
highway, with its left front and rear wheels parallel to and not more
than 15 centimeters (6 inches) distant from such curb; or
(b) where there is no curb, with the left front and rear wheels parallel to
and as near to the left hand limit of the highway as is practicable
without stopping or parking on or over a Sidewalk, footpath or
Boulevard.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
7.3
Any person who operates a Vending Vehicle shall not stop the Vehicle on any
part of the highway lying between any two intersecting highways for more than
ten minutes at any one location. Any person who contravenes this provision is
guilty of an offence and on conviction is liable to a fine.
7.4
No person shall stop or permit to remain stopped a Vending Vehicle on any
highway unless parking is permitted, and the person shall be governed by the
regulations specified in relation to the location. Any person who contravenes this
provision is guilty of an offence and on conviction is liable to a fine.
7.5
No person shall sell or offer for sale anything from a Vending Vehicle on a
highway except from the side of such Vehicle facing a Boulevard. Any person
who contravenes this provision is guilty of an offence and on conviction is liable
to a fine.
7.6
Where Parking Spaces are designated by lines painted on the roadway, no
person shall:
(a) park any Vehicle except wholly within an area designated as a Parking
Space; or
(b) park any Vehicle so as to occupy more than one Parking Space;
(c) park any Vehicle in such a manner as will prevent other motorists from
utilizing spaces or obstruct the flow of Traffic; or

(d) park any Vehicle in a taxi stand.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
8.
STOPPING OFFENCES
8.1
No person shall on any highway stop any Vehicle:
(a) on or over a Sidewalk or footpath;
(b) within an intersection or crosswalk;
(c) in such a manner as to interfere with the movement of Traffic or the
clearing of snow from the highway;
(d) in such a manner as to interfere with highway cleaning operations;
(e) on the roadway, alongside of any stopped or parked Vehicle;
(f) upon any bridge or elevated structure or within any tunnel or
underpass;
(g) on any median strip separating two roadways or adjacent to either side
or ends of such median strip; or
(h) alongside or across the highway from any excavation or obstruction in
the roadway whereby the free flow of Traffic would be impeded.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
8.2
Where Authorized signs are displayed, no person shall on any highway stop any
Vehicle:
(a) within 30 m of a Pedestrian crossover;
(b) other than a School Purpose Vehicle in a School Bus Loading Zone;
(c) other than a bus in a designated Bus Stop;
(d) any time or between the hours and on the days set out on the official
signs on one or both sides of a highway or portion of a highway which
is immediately adjacent to a school.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
9.
PARKING OFFENCES
9.1
No person shall on any highway park any Vehicle:
(a) in front of or within 1 m of a Driveway or Private Roadway or so as to
obstruct Vehicles in the use of a Driveway or Private Roadway;
(b) within 3 m of a point of the curb or edge of the roadway adjacent to any
fire hydrant;
(c) subject to paragraph (I) within 10 m of an intersecting roadway;
(d) for the purposes of displaying the Vehicle for sale;
(e) for the purpose of washing, greasing or repairing the Vehicle;
(f) within a distance of 4 m of the tracks of any railway other than a street
railway;
(g) within 15 m of the nearest rail of a level railway crossing;
(h) in such a position as will prevent the removal of any other Vehicle
previously parked;

(i) for a period in excess of three (3) hours unless otherwise indicated by
Authorized signs;
(j) on or over any Boulevard;
(k) on the traveled portion of a roadway where the roadway within is 6m or
less;
(l) within 15 m of an intersection controlled by a signal light traffic control
system;
(m) on or within 100 m of a bridge over, under or across which a highway
passes;
(n) within 6 m of a point at the edge of the roadway and nearest to a public
entrance to:
i.
a hotel;
ii.
a theatre, while the theatre is open to the public; or
iii.
a public hall while the hall is open to the public.
(o) between the hours of 2:00 a.m. and 6:00 a.m. from the 1st day of
November to the 15th day of April, inclusive.
(p) within the turning basin of a cul-de-sac.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
9.2
Where Authorized signs are displayed no person shall on any highway park any
Vehicle:
(a) on one or both sides of a highway or portion of a highway which is
immediately adjacent to property on which a fire hall is located and/or
within a distance of 30 m of such property on one or both sides of the
highway;
(b) anytime on one or both sides of a highway or portion of a highway
which is immediately adjacent to a park or playground;
(c) within 15 m of the end of a roadway on a dead end highway.
Any person who contravenes this provision is guilty of an offence and on
conviction is liable to a fine.
9.3
Parking on Municipal Property
(a) Where authorization to park on a temporary basis is offered by
obtaining a permit, such permit shall be displayed in the front
windshield of the parked Vehicle in a manner so as to make the permit
readily and clearly read from the exterior of the Vehicle. No display
shall be required if a permit is purchased through an approved third
party mobile device application.
(b) Where one or more Authorized signs have been posted on municipal
property, stating conditions or prohibition on which a motor vehicle may
be parked or left on the property, any persons who contravenes such
conditions or prohibition is deemed to have parked without consent
and is guilty of an offence and on conviction is liable to a fine.
9.4
Parking on Private Property
(a) No person shall park or leave any Vehicle on private property without
the consent of the Owner or Occupant of such property.

(b) Where an owner or occupant of a property has posted one or more
signs stating conditions or prohibition on which a motor vehicle may be
parked or left on the property, any person who contravenes such
conditions or prohibition is deemed to have parked without consent
and is guilty of an offence and on conviction is liable to a fine.
9.5
Parking in Fire Routes
Where Authorized signs are displayed, no person shall park any Vehicle in any
Fire Route. Any person who contravenes this provision is guilty of an offence and
on conviction is liable to a fine.
9.6
Parking Commercial Vehicles
No person shall park a commercial Motor Vehicle which exceeds 2.5 m in width
or 6.5 m in length or having a Vehicle weight of 4500 kilograms or more on any
highway, except in an industrial area, unless such Vehicle is actually engaged in
the loading or unloading of goods, wares, merchandise or passengers to
adjacent premises and is operating under the provisions of a permit under the
authority of a Road Occupancy Permit issued by the Director. Any person who
contravenes this provision is guilty of an offence and on conviction is liable to a
fine.
10.
STOPPING RESTRICTIONS AND PROHIBITIONS
10.1 Where Authorized signs are displayed, no person shall stop a Vehicle on any
highway at the side and between the limits set out in Columns 1, 2 and 3 of
Schedule "B" to this By-Law during the times or days set out in Column 4. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
11.
PARKING RESTRICTIONS AND PROHIBITIONS
11.1 Where Authorized signs are displayed, no person shall park a Vehicle on any
highway at the side and between the limits set out in Columns 1, 2 and 3 of
Schedule "C" to this By-Law during the times or days set out in Column 4 for a
longer period than set out in Column 5. Any person who contravenes this
provision is guilty of an offence and on conviction is liable to a fine.
12.
STANDING RESTRICTIONS AND PROHIBITIONS
12.1 Where Authorized signs are displayed, no person shall stand a Vehicle on any
highway at the side and between the limits set out in Columns 1, 2 and 3 of
Schedule "D" to this By-Law during the times or days set out in Column 4. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
13.
ANGLE PARKING
13.1 Notwithstanding the provisions of subsection 7.1 of Section 7 where Authorized
signs are displayed, angle parking in accordance with the provisions of
subsections 13.2, and 13.3 of this section is permitted on highways at the sides
and between the limits set out in Columns 1, 2 and 3 of Schedule "E" to this
By-Law.

13.2 Where angle parking is permitted on a highway and Parking Spaces are not
designated by lines on the roadway, no person shall park any Vehicle except at
an angle of not less than 40 degrees and not more than 50 degrees from the
curb or edge of the roadway. Any person who contravenes this provision is guilty
of an offence and on conviction is liable to a fine.
13.3 Where angle parking is permitted on a highway, no person shall park any Vehicle
except with the front of the Vehicle at the curb or edge of the roadway. Any
person who contravenes this provision is guilty of an offence and on conviction is
liable to a fine.
14.
LOADING ZONES
14.1 Where Authorized signs are displayed, no person shall park any Vehicle other
than a commercial Vehicle, in a Loading Zone on any highway between the
hours of 8:30 a.m. and 9:00 p.m., Monday to Saturday inclusive, except Holidays,
at the side and between the limits set out respectively in Columns 1, 2 and 3 of
Schedule "F" to this By-Law. It shall be lawful however, for the driver of a Vehicle
to stop in a Loading Zone while actually engaged in loading or unloading
passengers so long as such stopping does not interfere with any commercial
Vehicle about to enter such Loading Zone. Any person who contravenes this
provision is guilty of an offence and on conviction is liable to a fine.
15.
ONE-WAY HIGHWAYS
15.1 Where Authorized signs are displayed, no person operating a Vehicle shall travel
on any highway or portion thereof set out in Column 1 of Schedule "G" to this By-
Law between the limits set out in Column 2 of the said Schedule, during the
times or days set out in Column 3 of the said Schedule and only in the direction
set out in Column 4 of the said Schedule. Any person who contravenes this
provision is guilty of an offence and on conviction is liable to a fine.
16.
TURNING MOVEMENTS PROHIBITED
16.1 Where Authorized signs are displayed, no person operating a Vehicle in any
Intersection or portion of highway set out in Column 1 of Schedule "H" to this By-
Law proceeding in the direction or emerging from a property set out in Column 2
of the said Schedule, shall make the turning movement set out in Column 3 of
the said Schedule, during the times or days set out in Column 4 of the said
Schedule. Any person who contravenes this provision is guilty of an offence and
on conviction is liable to a fine.
16.2 Where Authorized signs are displayed, no person operating a Vehicle shall at
any time make a U-Turn at the locations set out in Column 1 of Schedule "I" to
this By-Law while traveling in the direction set out in Column 2 of the said
Schedule. Any person who contravenes this provision is guilty of an offence and
on conviction is liable to a fine.
17.
THROUGH HIGHWAYS
17.1 The highways set out in Column 1 of Schedule "J" to this By-Law between the
limits set out in Column 2 of the said Schedule are, except as provided in
Page 13 of 40
subsection 17.2 of this Section, hereby designated as through highways for the
purpose of the Highway Traffic Act.
17.2 The designation in subsection 17.1 of this section of a highway or portion of
highway as a through highway shall not include any intersection thereon where
the highway intersected is a King's Highway or where Traffic Control Signals are
installed.
18.
STOP SIGNS
18.1 The erection of stop signs is hereby Authorized at each of the intersections set
out in Column 1 of Schedule "K" of this By-Law facing Traffic as set out in
Column 2 of the said schedule.
18.2 The erection of new all-way stops shall not be implemented without satisfying the
criteria set out in the Township's All-Way Stop Warrant Policy.
19.
YIELD SIGNS
19.1 The erection of yield right-of-way signs is hereby Authorized at each of the
intersections set out in Column 1 of Schedule "L" of this By-Law facing Traffic as
set out in Column 2 of the said schedule.
20.
RATE OF SPEED
20.1 Where any highway or portion of highway set out in Schedules "M", "N", "O", "P",
or "Q" of this By-Law, is signed in compliance with the regulations under the
Highway Traffic Act, the maximum rate of speed thereon shall be the rate of
speed prescribed in the said schedule.
20.2 Community Safety Zones are established where an Official Sign to that effect has
been posted on any Highway set out in Schedule "U".
21.
PEDESTRIAN CROSSOVERS
21.1 The roadways set out in Column 1 of Schedule "R" to this By-Law, at the
locations set out in Column 2 of the said schedule, are designated as Pedestrian
crossovers and shall be indicated as such as prescribed by the regulations made
under the Highway Traffic Act.
22.
HEAVY TRAFFIC
22.1 Where official signs to that effect are displayed, Heavy Traffic is prohibited on
highways or parts of highways set out in Column 1 of Schedule "S" to this By-
Law between the limits set out in Column 2 of the said Schedule during the times
or days set out in Column 3 of the said Schedule. Any person who contravenes
this provision is guilty of an offence and on conviction is liable to a fine.
22.2 The provisions of subsection 22.1 of this section shall not apply to the use of said
highways or parts of highways for deliveries to or removals from any premises
abutting thereon which cannot be reached except by way of a highway or portion
of highway referred to in the said section or to prohibit the use of such Vehicles
for such purposes, provided that in making such delivery or collection, the said

highway or portion of highway is traveled only insofar as unavoidable in getting to
and from such premises.
22.3 Where authorized signs are displayed and subject to the provisions of the
Highway Traffic Act, as amended, there shall be a reduced load period in effect
from the 1st day of February to the 31st day of May inclusive, in each and every
year and no person shall on any highway or part of a highway affected, operate
or draw any Vehicle having a weight which is in contravention of the provisions of
the Highway Traffic Act, as amended. Any person who contravenes this provision
is guilty of an offence and on conviction is liable to a fine.
23.
SCHOOL BUS LOADING ZONES
23.1 Where official signs to that effect are displayed, the highways or portions of
highways set out in Column 1 of Schedule "T" to this By-Law on the side of the
highway set out respectively in Columns 3 and 4 of the said Schedule are hereby
designated as School Bus Loading Zones.
24.
BUS STOP ZONES
24.1 Bus Stop zones are hereby established where authorized signs to that effect are
displayed.
24.2 Where authorized signs are displayed, no person shall on any highway stand any
Vehicle other than a bus within a distance of 18m of any point designated by an
authorized sign or signs as a Bus Stop. Any person who contravenes this
provision is guilty of an offence and on conviction is liable to a fine.
25.
PENALTIES
25.1 Every person who contravenes any of the provisions of this By-Law is guilty of an
offence and upon conviction is liable to a fine or penalty, as prescribed by the
Provincial Offences Act, R.S.O. 1990, c. P.33, as amended.
25.2 For the purposes of this By-Law, where a number plate issued pursuant to the
Highway Traffic Act is exposed on a Vehicle, the holder of the permit
corresponding thereto shall be deemed to be the owner of that Vehicle, and if
said Vehicle is stopped, parked or standing in contravention of this By-Law, the
owner shall be guilty of an offence, unless he can prove to the satisfaction of the
court, that the number plate was exposed thereof without his consent, express or
implied.
25.3 A Police Officer, or Municipal Law Enforcement Officer appointed for carrying out
the provisions of this By-Law, upon discovery of any Vehicle stopped, standing or
parked in contravention of this By-Law, may cause said Vehicle to be moved or
taken to or stored in a suitable place, and all costs and charges for removing,
care and storage thereof, if any, are a lien upon the Vehicle, which may be
enforced in the manner provided by Part III of the Repair and Storage Liens Act,
R.S.O. 1990, c. R.25, as amended.
26.
APPLICATION

26.1 This By-Law applies to all highways under the jurisdiction of the Corporation of
the Township of Scugog, and where applicable, to municipal and private
property.
26.2 This By-Law shall not, if compliance therewith would be impracticable, apply to:
(a) emergency Vehicles or public utility Vehicles responding to public utility
emergencies; or
(b) Vehicles actually engaged in works undertaken for or on behalf of any
municipal corporation; or
(c) Vehicles actually forming part of a funeral procession for as long as
may reasonably be required for the purpose of such funeral; or
(d) any Vehicle stopped or parked when directed by a Police Officer; or
(e) any Vehicle stopped due to a Statutory requirement or due to
Pedestrian or other vehicular Traffic; or
(f) any Vehicle used by Township staff while in performance of their
duties.
27.
REPEAL OF BY-LAWS
27.1 By-Law 05-20, as amended and any predecessor By-Laws and all amendments
thereto are hereby repealed.
28.
SEVERABILITY
28.1 If a court of competent jurisdiction should declare any section or part of any
section of this By-Law to be invalid, such section or part thereof shall not be
construed as having persuaded or influenced Council to pass the remainder of
this By-Law and it is hereby declared that the remainder of this By-Law shall be
valid and shall remain in force.
29.
SHORT TITLE
29.1 This By-Law may be referred to as the Traffic By-Law.
30.
EFFECTIVE DATE
30.1 This By-Law shall come into full force and effect on the date of its passing by the
Council of the Corporation of the Township of Scugog and where applicable,
where Authorized signs are erected and the Chief Justice for the Ontario Court of
Justice has Authorized any Short Form Wordings applied for by the Council of
the Corporation of the Township of Scugog in respect of any provision of this By-
Law.
