THE CORPORATION OF THE TOWNSHIP OF SEVERN
BY-LAW NO. 2017-28
BEING A BY-LAW TO REGULATE TRAFFIC AND SPEED LIMITS ON HIGHWAYS
WITHIN THE CORPORATION OF THE TOWNSHIP OF SEVERN
WHEREAS the Municipal Act, S.O. 2001, Chapter 25, Section 11.(3), provides that a
municipality may pass By-laws respecting highways, including parking and traffic on
highways;
AND WHEREAS the Highway Traffic Act, R.S.O. 1990, Chapter H.8, Section 128.-
Paragraph (2), provides for the prescribing of rates of speed;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SEVERN HEREBY ENACTS AS FOLLOWS:
1.
Definitions
For the purpose of this By-law:
"Crosswalk"
means
i)
that part of a highway at an intersection that is
included within the connections of the lateral
lines of the sidewalks on opposite sides of the
highway measured from the curbs or, in the
absence of curbs, from the edges of the
roadway, or
ii)
any portion of a roadway at an intersection or
elsewhere distinctly indicated for pedestrian
crossing by signs or by lines or other markings
on the surface;
"Driver"
means a person who drives a vehicle on a highway;
"Highway"
includes a common and public highway, street,
avenue, parkway, driveway, square, place, bridge,
viaduct or trestle, any part of which is intended for or
used by the general public for the passage of vehicles
and includes the area between the lateral property
lines thereof;
"Intersection"
means the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of
the lateral boundary lines of two or more highways
that join one another at an angle, whether or not one
highway crosses the other;
"Motor Assisted
means a bicycle
Bicycle"
i)
that is fitted with pedals that are operable at all
times to propel the bicycle,
ii)
that weighs not more than 55 kilograms,
iii)
that has no hand or foot operated clutch or
gearbox driven by the motor and transferring
power to the driven wheel,
iv)
that has an attached motor driven by electricity
or having a piston displacement of not more
than 50 cubic centimetres, and

v)
that does not have sufficient power to enable
the bicycle to attain a speed greater than 50
kilometres per hour on level ground within a
distance of 2 kilometres from a standing start;
"Motor Vehicle"
includes an automobile, motorcycle, motor assisted
bicycle and any other vehicle propelled or driven
otherwise than by muscular power, but does not
include a street car, or other motor vehicles running
only upon rails, or a motorized snow vehicle, traction
engine, farm tractor, self-propelled implement of
husbandry or road building machine;
"Motorcycle"
means a self-propelled vehicle having a seat or
saddle for the use of the driver and designed to travel
on not more than 3 wheels in contact with the ground,
and includes a motor scooter, but does not include a
motor assisted bicycle;
"Official Sign"
means a sign approved by the Ministry of
Transportation;
"Police Officer"
means a member of the police force of the Ontario
Provincial Police;
"Roadway"
means the part of the highway that is improved,
designed or ordinarily used for vehicular traffic, but
does not include the shoulder, and, where a highway
includes two or more separate roadways, the term
"roadway" refers to any one roadway separately and
not to all of the roadways collectively;
"Stop"
means a complete cessation of movement;
"Through Highway"
means a highway or part of a highway designated as
such by the Minister or by By-law of a Municipality,
and every such highway shall be marked by a stop
sign or a yield right-of-way sign in compliance with the
regulations of the Ministry;
"Vehicle"
includes a motor vehicle, trailer, traction engine, farm
tractor, road-building machine, bicycle and any
vehicle drawn, propelled or driven by any kind of
power, including muscular power, but does not
include a motorized snow vehicle or a street car.
2.
Traffic Control Devices or Signals
2.1
That every person shall promptly obey all signals given by Police Officers
or by any official sign.
2.2
That no person shall place, maintain or display upon or in view of any
roadway any sign, signal, marking or device which purports to be or is an
imitation of or resembles any official sign.
3.
Miscellaneous Driving Rules
3.1
That the driver of a vehicle emerging from a driveway, laneway, building,
or bus stop onto a roadway shall bring the vehicle to a full stop
immediately before driving onto a sidewalk or footpath and upon
proceeding shall yield the right-of-way to pedestrians on the sidewalk or
footpath.

3.2
That no person shall, except under the direction of a Police Officer, drive a
vehicle on a road between the vehicles comprising of a funeral or other
procession recognizable as such by the display of pennants, lights or
other identifying insignia while the vehicles in such procession are in
motion.
3.3
That no person shall drive a motor vehicle:
(a)
upon a sidewalk or footpath or roadway except for the purpose of
directly crossing such sidewalk or footpath;
(b)
over a raised curb except at a place where there is a ramp, or
(c)
over any unprotected hose of the Fire Department when laid down
on any roadway, street, private driveway or lane to be used at any
fire or alarm of fire.
3.4
That exemptions to the provisions of Section 3.3 above shall apply to
Police Vehicles, Fire Department Vehicles, Ambulances, and vehicles
registered to the Corporation of the Township of Severn when such
vehicles are suitably marked and are actually being used for or on behalf
of the Township of Severn.
4.
Speed of Vehicles
4.1
That no person shall drive a motor vehicle upon any highway or portion of
a highway (including bridges) at a greater rate of speed than the limits
referred to in Schedule "A" attached hereto and forming part of this By-
law.
5.
Stop Signs & Yield Signs
5.1
That the erection of stop signs and yield signs at intersections under the
jurisdiction of the Township of Severn shall be placed as authorized by
Council.
6.
Roller Skates, etc.
6.1
That no person upon roller skates or riding in or by means of a coaster,
toy vehicle or similar device, shall go upon the roadway except while
crossing the street on a crosswalk.
7.
General
7.1
That the Schedule referred to in this By-law shall form part of this By-law
and each entry in a column of such Schedule shall be read in conjunction
with the entry or entries across therefrom and not otherwise.
7.2
That all sections of this By-law shall be deemed to be separate and
independent and the invalidity of any section or provision hereof shall not
affect the remaining sections.
8.
Penalties
8.1
That it is an offence for any person to do any act forbidden, or fail to
perform any act required in this By-law.
8.2
That any person violating any of the provisions of this By-law shall be
subject to a penalty provided for in the Highway Traffic Act and all such
penalties shall be recoverable under the Provincial Offences Act.
9.
Enforcement
9.1
That the Ontario Provincial Police and Township By-law Enforcement shall
enforce the provisions of this By-law.

10.
Obstruction
10.1 In accordance with the provisions of the Municipal Act S.O. 2001, c. 25, as
amended, Section 426(1), no person shall hinder, interfere with or
otherwise obstruct, either directly or indirectly, an officer, employee of the
Township of Severn and/or agent in the lawful exercise or power or duty
under this by-law.
11.
Township not liable
11.1 The Township assumes no liability for property damage, personal injury
resulting from remedial action, remedial work and enforcement undertaken
with respect to any person, or property that is subject of this by-law.
12.
Validity and Severability
12.1 Should any section, subsection, clause, paragraph or provision of this
bylaw be declared by a Court of competent jurisdiction to be invalid or
unenforceable, the same shall not affect the validity of the enforceability of
any other provision of this by-law, or of the by-law as a whole.
13.
Separate Offence
13.1 For the purpose of this by-law, each day of a continued offence shall be
deemed to be a separate offence.
14.
Effect
14.1 That this By-law shall come into force and effect on the date of passing
thereof.
15.
Repeal
15.1 That By-law No. 2012-64, as amended, be and it is hereby repealed.
By-law read a first, second, and third time and finally passed this 6th day of September,
2023.
