BY-LAW NO. 7098-24 OF THE CORPORATION OF THE COUNTY OF SIMCOE A By-law to regulate traffic and parking in the County of Simcoe. Whereas the Municipal Act, 2001 section 11(3) designates the County as the upper tier municipality with the non-exclusive authority to pass by-laws for highways, including parking and traffic on highways; and Whereas the Municipal Act, 2001, sections 27 provides that the Council of the Corporation of the County of Simcoe may pass by-laws in respect of highways under the County's jurisdiction; and Whereas the Highway Traffic Act, R.S.O. 1990, c. H. 8 provides that a municipality may pass by-laws to regulate traffic; and Whereas the Council of the County of Simcoe did enact By-law No. 6609 Traffic By-law and various amending By-laws to By-law No. 6609; and Whereas in order to obtain greater efficiency in the administration of the traffic regulations on the County roads, Council of the County of Simcoe deems it expedient to repeal By-law No 6609 and its amending By-laws and consolidate all County traffic by-laws. Now therefore the Council of the Corporation of the County of Simcoe enacts as follows: 1.0 DEFINITIONS In this By-law: "Accessible Parking Permit" means a permit issued to an individual which entitles the vehicle in which it is displayed to be parked in a designated accessible parking space. "Accessible Permit Parking Sign" is a sign consisting of the international symbol of the Accessible Parking Permit to be used for the purpose of designating accessible parking spaces. "Accessible Parking Space" means a parking space specially designated and noted with appropriate signage. "Act" means the Highway Traffic Act, R.S.O. 1990, c. H.8 and regulations thereto, as amended. By-law No. 7098-24 Page 2 "Boulevard" means: a) that portion of the highway, paved or unpaved between the County property line and the curb line but does not include the sidewalk; b) any centre median strip or island separating two (2) roadways. "Chief Administrative Officer (CAO)" means the Chief Administrative Officer of the Corporation of the County of Simcoe. "Commercial Motor Vehicle" means a motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on a highway. "Corner" means the point of intersection of curbs or edges of the travelled portion of the highway. "County" means the Corporation of the County of Simcoe. "County Parking Lot" means land or structures which have been set apart, designated or established by the County for the parking of motor vehicles. "Community Safety Zone" means a highway or part of a highway designated as such by by-law of the County where public safety is of special concern on that part of the highway. "Crosswalk" means: a) that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface; c) but excludes pedestrian crossovers (PXO). "Curb Line" means the line of the curb, or, where no curb is constructed, the edge of the travelled portion of the highway. "Director, Transportation and Engineering" means the Director of Transportation and Engineering of the County or his/her designate. "Disability" has the meaning of "disability" in the Accessibility for Ontarians with Disabilities Act, 2001. "Enforcement Officer" includes a municipal police officer/contract police officer (OPP), municipal law enforcement officer, special constable and other persons designated specifically by by-law. By-law No. 7098-24 Page 3 "General Manger, Engineering, Planning and Environment" means the General Manger, Engineering, Planning and Environment of the Corporation of the County of Simcoe, a successor or equivalent position. "Heavy Truck" means a commercial motor vehicle having an unloaded vehicle weight in excess of four thousand five hundred (4,500) kilograms (9,925 lbs), but does not include an ambulance, bus, fire apparatus, a vehicle owned by or operated for the County or a local municipality within the County, the Ministry of Transportation (Ontario) or any utility. "Highway" includes a common and public highway, any part of which is intended for or used by the general public for the passage of vehicles and pedestrians and includes the area between the lateral property lines thereof. "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then the lateral boundary lines of two (2) or more highways that join one another at an angle, whether or not one highway crosses the other. "Manager, Transportation Construction" means the Manager, Transportation Construction of the Corporation of the County of Simcoe, a successor or equivalent position, or their designate. "Manager, Transportation Maintenance" means the Manager Transportation Maintenance of the Corporation of the County of Simcoe, a successor or equivalent position, or their designate. "Median Strip" means the portion of a highway so constructed as to separate traffic travelling in one direction from traffic travelling in the opposite direction by a physical barrier or an unpaved strip of ground. "Motor Vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Act and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other motor vehicles running upon rails, or a motorized snow vehicle, traction engine, farm tractor, self propelled implement of husbandry or road building machine within the meaning of the Act. "Municipal Act, 2001" means the Municipal Act, 2001, S.O. 2001, c.25, as amended. "Parking Lot Space" means a portion of the surface of a parking lot normally designated by lines painted or marked on the surface of the parking lot. "Park" or "Parking" means when prohibited, the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actively engaged in loading or unloading merchandise or passengers. By-law No. 7098-24 Page 4 "Parking Space" means: a) a portion or the surface of the travelled portion of the highway or of the shoulder forming part of a highway, designated by suitable markings; b) on private property an area designated by suitable markings. "Pedestrian" means a person who travels by foot (i.e. a person who walks) and includes a person using an assistive device and a child in a baby carriage. "Pedestrian Crossover (PXO)" means any portion of a roadway, designated by by-law of a municipality, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by a sign on the highway and lines or other markings on the surface of a roadway as prescribed by the regulations. "Private Roadway" includes a lane, ramp or other means of vehicular access to or egress from a building or structure and it may include part of a parking lot. "Roadway" means that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two (2) or more separate roadways, the term "roadway" refers to any one roadway separately and not to all roadways collectively. "School Bus" means a bus that: a) is painted chrome yellow, and b) displays on the front and rear thereof the words "school bus" and on the rear thereof the words "do not pass when signals flashing." "School Zone" means the portion of a highway that adjoins the entrance to or exit from a school and that is within 150 metres along the highway in either direction beyond the limits of the land used for the purposes of the school. "Shoulder" means the area adjacent to a roadway, where there is no curb, but does not include a sidewalk. "Sidewalk" means an improved portion of a highway between the curb line and the adjacent property line, intended for the use of pedestrians. "Sign" includes any sign, marking or other device erected or placed on a highway, private or County property for the purpose of regulating or guiding traffic and as may be specified in the Ontario Traffic Manual, the Act or as authorized by the County. By-law No. 7098-24 Page 5 "Stand" or "Standing" means when prohibited, the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging of passengers. "Stop" or "Stopping" means when prohibited, the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal. "Through Highway" means a highway or part of a highway designated as such by the Minister or by by-law of a municipality, and every such highway shall be marked by a stop sign or yield sign in compliance with the regulations of the Ministry. "Tow Away Zone Sign" means signage depicting an area designated by this by-law where a vehicle may be towed away forthwith. "Traffic Signal" or "Traffic Control Signal" means any device manually, electronically or mechanically operated for the regulation of traffic. "U-Turn" means to turn a vehicle within a roadway so as to proceed in the opposite direction. "Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road building machine, bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car. "Vehicle Weight" means the weight of the vehicle itself, as set out in the manufacturer's specifications. 2.0 GENERAL PROVISIONS 2.1 Words and Phrases Where words and phrases used in this by-law are defined in the Act, but not defined in this by-law, the definitions in the Act shall apply to such words and phrases. 2.2 Singular and Plural Use/Headings and Subheadings In this by-law, unless the context otherwise requires words importing the singular shall include the plural and use of the masculine shall include the feminine, where applicable. The headings and subheadings used in this by-law shall not form a part of the by-law but shall be deemed to be inserted for convenience of reference only. 2.3 Expression of Time Where, in this by-law, any expression of time occurs or when any hour or other point of time is stated, the time referred to or intended shall be By-law No. 7098-24 Page 6 reckoned as standard time except in periods when daylight savings time is declared to be in effect, then during such periods, the time referred to or intended shall be reckoned as daylight savings time. 2.4 Interpretation Where there is a conflict between the provisions of this by-law and the provisions of the Act, the provisions of the Act shall prevail. 2.5 Severability If a court of competent jurisdiction declares any section or part of this by- law invalid, it is the intention of Council that the remainder of the by-law shall continue in force. 2.6 Schedules The schedules in this by-law shall form part of this by-law. Each entry in a column of a schedule shall be read in conjunction with the entries across from that entry and not otherwise. 3.0 PARKING, STOPPING AND STANDING 3.1 Method of Parking No person shall park a vehicle on a highway or portion thereof, except as follows: a) Where there is a raised curb or rolled curb, parking shall be limited to the right side of the roadway, having regard to the direction which the vehicle had been proceeding, and with its right front and right rear wheels or runners parallel to and distant respectively not more than fifteen (15) centimeters from such curb; b) Where there is no curb or rolled curb, parking shall be limited to the right side of the roadway, having regard to the direction which the vehicle had been proceeding, and with its right front and right rear wheels or runners parallel to and near to the right-hand limit of the highway as is practical without parking on the sidewalk or boulevard. 3.2 Parking Prohibited in Certain Places Unless specifically permitted by other provisions of this by-law, no persona shall park a vehicle on a highway; a) On any portion of a sidewalk; b) within three (3) metres of a point on the curb or edge of the roadway opposite any fire hydrant; c) in front of any portion of a public or private driveway or laneway; d) within an intersection or within fifteen (15) metres of an intersection; e) in such a manner as to obstruct traffic; f) on any portion of a boulevard, except the area designated as the shoulder of the road; By-law No. 7098-24 Page 7 g) in such a position as will prevent the convenient removal of any other vehicle previously parked or left standing; h) on any portion of a crosswalk; i) on a highway for a period longer than three (3) hours; j) where parking spaces are designated by lines painted on the roadway, except within the area designated as a parking space; k) on a highway between the hours of 2:00 a.m. and 6:00 a.m.; l) on any portion of a school bus loading zone; m) within fifteen (15) metres of a pedestrian crossover (PXO). 3.3 Parking or Stopping Prohibited in Specified Places Where Signs are Displayed 3.3.1 Where a sign is displayed, no persons shall park a vehicle on a highway: a) within thirty (30) metres of any point designated as a bus or coach stop, as measured on the approach side of such stop or within twenty-four (24) metres of said stop as measured on the leaving side of said stop; b) within eight (8) metres of the lot on which a fire hall is located, in front of or on the side of the highway on which the fire hall is located, or within thirty (30) metres of such lot on the opposite side of the highway; c) within thirty (30) metres of an intersection; d) within thirty (30) metres of a railroad level crossing; e) within fifteen (15) metres of a school crossing 3.3.2 Where a sign is displayed, no person shall stop a vehicle on a highway: a) within thirty (30) metres of any point designated as a bus or coach stop, as measured on the approach side of such stop or within twenty-four (24) metres of said stop as measured on the leaving side of said stop; b) within eight (8) metres of the lot on which a fire hall is located, in front of or on the side of the highway on which the fire hall is located, or within thirty (30) metres of such lot on the opposite side of the highway; c) within thirty (30) metres of an intersection; d) within thirty (30) metres of a railroad level crossing; e) within fifteen (15) metres of a school crossing. 3.4 Parking or Standing Interfering with Snow Removal Notwithstanding any other provision of this by-law which permits the parking of a vehicle on a highway, no person shall park or stand a vehicle on a highway in such a manner as to interfere with the clearing of snow from the highway. By-law No. 7098-24 Page 8 3.5 Fire Routes Following the designation of a fire route by the Chief Fire Official of a local municipality on property owned by the County made under section 7.1(1)(c) of the Fire Protection and Prevention Act, S.O. 1997, c.4, as amended: a) the County shall erect signs marking private roadways thereon as fire routes; b) before erecting signs as required, the County shall obtain direction from and the approval of the Chief Fire Official or the person designated by him to give such direction and approval, for all such signs, the wording thereon and the location thereof; c) each private roadway which is located on a property of which the municipal address or location is listed in Schedule 1 of this by-law, and beside or near where there are signs marking it as a fire route is hereby designated as a fire route; d) property of the County upon which there is a private roadway that has been designated as a fire route, the County: i. Shall maintain the signs marking it as a fire route; and ii. Shall keep such private roadway: 1. in good repair; 2. clear of snow and ice; 3. free of obstructions. e) no person shall park or leave a vehicle at any time on or along any part of a private roadway designated as a fire route; and f) upon the discovery of a vehicle parked or standing in contravention of the provisions of this section, the County may cause it to be moved or taken to and placed or stored in a suitable place, at the owners expense, and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, as amended. 3.6 No Parking Where a sign is displayed, no person shall park a vehicle on a highway at the side and between the limits set out respectively in Columns 1, 2, 3, and 4 of Schedule 3 of this by-law during the prohibited times or days set out in Column 5 of the said Schedule 3. 3.7 No Stopping Where a sign is displayed, no person shall stop a vehicle on a highway at the side and between the limits set out respectively in Columns 1, 2, 3, and 4 of Schedule 4 of this by-law during the prohibited times or days set out in Column 5 of the said Schedule 4. 3.8 No Standing Where a sign is displayed, no person shall stand a vehicle on a highway at the side and between the limits set out respectively in Columns 1, 2, 3, and 4 of Schedule 5 of this by-law during the prohibited times or days set out in By-law No. 7098-24 Page 9 Column 5 of the said Schedule 5. 3.9 Tow Away Zones 3.9.1 The highways set out in Column 1 of Schedule 6 of this by-law at the side and between the limits set out in Columns 2 and 3 of the said Schedule 6 are hereby designated as tow-away zones. 3.9.2 Nothing in the provisions of subsection 3.9.1 shall preclude an enforcement officer from causing to be removed a vehicle found obstructing traffic or snow clearing on a highway not designated as a tow-away zone. 3.10 No Parking on County Property or County Parking Lots Where a sign is displayed, no person shall use any property owned by the County or a County parking lot: a) for the purpose of parking a vehicle while repairs are being made to such vehicle, unless such repairs are of an emergency nature and are required to be made so that the vehicle can be moved from the property owned by the County or the County parking lot; b) for the purpose of storing or keeping a vehicle or vehicles; c) for any purpose other than parking purposes, unless permission to do so is granted by the County. 4.0 ACCESSIBLE PARKING REGULATIONS Accessible parking regulations apply to property owned by the County. 4.1 Requirements for Accessible Parking Spaces Every designated accessible parking space shall meet the following criteria: a) 3.4 metres in width; b) 5.79 metres in length; c) hard surfaced; d) level; e) located so as to be readily accessible to a person with a disability, whether via ramps, depressed curbs or other means and, where the public parking area is intended to serve a particular building or complex, located within easy access of said building or complex; f) identified by an accessible permit sign conforming to the requirements of the regulations made under the Act; g) kept free from obstruction, kept clear of snow, ice and slush, and be otherwise maintained to the same standards as all other parking spaces in the same parking area. 4.2 Signage 4.2.1 An accessible permit parking sign shall be mounted on a permanent post one (1) metre in height to the bottom, which post is to be located at the end of the designated accessible parking space and shall not be located so as By-law No. 7098-24 Page 10 to block vehicular access to the designated accessible parking space. 4.2.2 Every owner or operator of each public parking area in which signs are located pursuant to this by-law shall be responsible for the procurement, installation and maintenance of said signs, and for ensuring that said signs conform to the regulations made under the Act. 4.3 Use of Accessible Parking Spaces 4.3.1 No person shall park a vehicle in a designated accessible parking space in a County parking area, as described and set out in Schedule 2 of this by- law, unless a valid accessible parking permit is properly displayed upon the vehicle. 4.3.2 No County official shall authorize a person to park a vehicle which does not properly display a valid accessible parking permit in a designated accessible parking space. 5.0 TRAFFIC REGULATIONS 5.1 U-Turns Where a sign is displayed, no person operating a vehicle shall make a U- turn on a highway or portion of a highway set out in Column 1 of Schedule 7 of this by-law between the limits set out in Column 2 of Schedule 7. 5.2 Through Highways 5.2.1 A highway or portion of a highway set out in Column 1 of Schedule 8 of this by-law between the limits set out in Column 2 of said Schedule 8, are, except as provided in subsection 5.2.2, hereby designated as through highways. 5.2.2 The designation in subsection 5.2.1 of a highway or part of a highway as a through highway shall not include any intersection thereon where the highway intersects a King's Highway or where traffic control signals are installed. 5.3 Stop Signs The intersections on the highways set out in Column 1 of Schedule 9 of this by-law are designated as intersections where stop signs shall be erected facing traffic in the direction as set out in Column 2 of said Schedule 9. 5.4 Yield Signs The intersections on the highways set out in Column 1 of Schedule 10 of this by-law are designated as intersections where yield right-of-way signs shall be erected facing traffic in the direction set out in Column 2 of said Schedule 10. By-law No. 7098-24 Page 11 5.5 Designated Turning Lanes Where a sign is displayed the highways set out in Column 1 of Schedule 11 of this by-law having been divided into clearly marked lanes for traffic within the limits set out in Column 2 of the said Schedule 11, the lane identified in Column 3 of the said Schedule 11 is hereby designated only for turns in the direction indicated in Column 5 of the said Schedule 11 made by a vehicle proceeding in the direction specified in Column 4 of said Schedule 11 and the driver of a vehicle shall turn only in the direction indicated on the sign. 5.6 Prohibited Turns Where a sign is displayed, a person operating a vehicle in the intersection or portion of the highway set out in Column 1 of Schedule 12 of this by-law proceeding in the direction set out in Column 2 of said Schedule 12, shall not turn such vehicle in the direction set out in Column 3 of said Schedule 12 during the times or days set out in Column 4 of the said Schedule 12. 5.7 School Bus Loading Zones 5.7.1 A highway or portion of a highway set out in Column 1 of Schedule 13 of this by-law on the side set out in Column 2 of the said Schedule 13 between the limits set out in Column 3 of the said Schedule 13 and at the school or institution set out in Column 4 of the said Schedule 13 are hereby designated as school bus loading zones. 5.7.2 Each of the designations referred to in Schedule 13 shall not become effective unless and until the highway or portion thereof affected is marked to comply with the provisions of the Act. 5.8 Rate of Speed In accordance with Section 128 of the Act, a) The maximum rate of speed on a County Road shall be 80 kilometres per hour, except as set out in Subsection 5.8(b), and where a sign has been erected and is on display in accordance with the maximum rates of speed prescribed in Subsection 5.8(c). b) In the Town of Innisfil, the Town of New Tecumseth, and in the Town of Bradford West Gwillimbury, as per section 128(1)(a) of the Act, the maximum rate of speed shall be 50 kilometres per hour, except where a sign has been erected and is on display in accordance with the maximum rates of speed prescribed in Subsection 5.8 (c). c) Where a sign to that effect is displayed on a highway or portion of a highway set out in Column 1 of Schedule 14 of this by-law between the limits set out in Column 3 of the said Schedule 14, the maximum rate of speed in kilometres per hour shall be that set out in Column 2 of the said Schedule 14. 5.9 Axle Load Weight Restrictions By-law No. 7098-24 Page 12 5.9.1 A highway or portion of a highway listed in Column 1 of Schedule 15 of this by-law is subject to a reduced load restriction for the reduced load period set out in Column 2 of said Schedule 15. 5.9.2 Schedule 15 of this by-law will not become effective on a highway or portion thereof except during the periods in which a sign has been erected in accordance with the regulations under the Act. 5.9.3 During a reduced load restriction period, no commercial motor vehicle or trailer, other than a public vehicle, or a vehicle referred to in subsection 5.9.4 shall be operated or drawn upon a highway or portion thereof that is part of the County's road system where the weight upon an axle exceeds 5,000 kilograms. 5.9.4 Notwithstanding subsection 5.9.3, during a reduced load restriction period none of the following shall be operated upon a highway designated in Schedule 15 of this by-law where the weight upon axle exceeds 7,500 kilograms: a) no two-axle tank truck, while used exclusively for the transportation of liquid or gaseous heating fuel; b) no two-axle truck, while used exclusively for the transportation of stock feed; c) no vehicle transporting live poultry. 5.9.5 Notwithstanding subsection 5.9.3, during a reduced load restriction period a commercial motor vehicle or trailer may be operated or drawn upon a highway or portion thereof as designated in Schedule 15 of this by-law where a valid permit has been issued by the County. 5.9.6 An owner of operator of a commercial motor vehicle or trailer may file an application for a permit with the Director, Transportation and Maintenance, Manager Transportation Maintenance and/or the Manager Transportation Construction for the County. 5.9.7 The Director, Transportation and Maintenance, Manager Transportation Maintenance and/or the Manager Transportation Construction may issue a permit and may impose such terms and conditions as deemed appropriate. 5.9.8 During a reduced load period, no vehicle having a carrying capacity in excess of 1,000 kilograms, other than a motor vehicle or trailer, shall be operated upon a highway or portion thereof that is part of the County's road system where the weight upon any millimeter in the width of a tire exceeds 5 kilograms. 5.9.9 The provisions of this section do not extend to the use of a highway or a part of a highway by an ambulance, police vehicle, fire department vehicle, waste removal vehicle, public utility emergency vehicle and a vehicle used By-law No. 7098-24 Page 13 exclusively for the transportation of milk, or to a vehicle actually engaged in works undertaken for or on behalf of the County. 5.9.10 Any person who contravenes any of the provisions of this section is guilty of an offence and upon conviction is liable to a fine as provided pursuant to Section 110 of the Act and all such penalties shall be recoverable under the Provincial Offenses Act, R.S.O. 1990, c. P33. 5.10 Heavy Trucks 5.10.1 Except as provided in subsection 5.10.2, when a sign is displayed, no person shall move, drive or operate a heavy truck on the highways set out in Column 1 of Schedule 16 of this by-law between the limits set out in Column 2 of the said Schedule 16 during the times, days or months set out in Column 3 of the said Schedule 16. 5.10.2 Subsection 5.10.1 shall not apply to a heavy truck actually engaged in making delivery to or a collection from premises which cannot be reached except by way of a highway or a portion of highway referred to in the said Schedule 16 or to prohibit the use of such heavy truck, for such purposes, provided that, in making such delivery or collection, the said highway or portion of highway is travelled only insofar as is unavoidable in getting to and from such premises. 5.11 Bridge Weight Limits 5.11.1 The gross vehicle weight of a vehicle or combination of vehicles passing over a bridge described and set out in Columns 1 and 2 of Schedule 17 of this by-law, shall be limited to the weights set out in Column 2 of said Schedule 17. 5.11.2 Any person who contravenes any of the provisions of this section is guilty of an offence and upon conviction is liable to a fine as provided pursuant to Section 125 of the Act and all such penalties shall be recoverable under the Provincial Offenses Act, R.S.O. 1990, c. P33. 5.12 Obstruction of Highways, Ditches and Culverts 5.12.1 No person shall obstruct, encumber, or foul a highway under the jurisdiction of the County by any means whatsoever. 5.12.2 Without limiting the generality of subsection 5.12.1 the obstruction or fouling of a highway includes, but is not limited to: a) the building or maintaining of a fence on a highway; b) the depositing of snow or ice on a highway; c) the depositing of large refuse containers or bulk containers on a highway; By-law No. 7098-24 Page 14 d) the depositing of construction or landscaping materials on a highway. 5.12.3 No person shall obstruct a ditch or culvert which is under the jurisdiction of the County. 5.12.4 No person shall throw, place, deposit or permit to be blown or escape from premises occupied by him or dropped from a vehicle, paper, hand-bills, garbage, ashes, rubbish, tires, appliances, soil, construction material, the carcass of an animal, or any other refuse or waste material on a highway under the jurisdiction of the County. 5.12.5 Any person employing or using a vehicle in making excavations for building purposes, and in conveying earth, rubbish or other material from such excavations or from any other place along a public highway of the County, or in any operation involving the passage of such a vehicle to and from any site, whether for building purposes or otherwise, shall at once remove from pavements and sidewalks, or from any public place where the same may be deposited, all earth, rubbish or other material that may fall from the wheels of or from such truck, grader or loader, and shall employ and keep employed a sufficient number of sweepers or workers or use such means as may be necessary to keep all such pavements and sidewalks in a clean condition and free from earth or other material. 5.12.6 The Director, Transportation and Maintenance, Manager Transportation Construction and/or the Manager Transportation Maintenance may give to any person found to have obstructed or fouled a highway contrary to the provisions of this by-law, a notice in writing delivered by hand or posted on the obstruction, requiring the removal from such highway any and all refuse, articles or materials. 5.12.7 In the event that such person does not comply with the direction in a notice provided under subsection 5.12.6, the County may perform the work, or cause the work to be done, and the cost thereof may be recovered from such person by court action. 5.13 Signs and Traffic Signals 5.13.1 The Chief Administrative Officer, the General Manger Engineering, Planning and Environment, the Director, Transportation and Maintenance, the Manager Transportation Construction or the Manager Transportation Maintenance are authorized to place, erect or maintain a sign or traffic control signal as required to give effect to the provisions of this by-law or as required to warn or guide traffic for the safety or convenience of the public. 5.13.2 No person shall place, maintain or display upon or in view of a highway a sign, signal, marking or device which purports to be or is an imitation of or resembles a sign or traffic control signal or which conceals from view or By-law No. 7098-24 Page 15 interferes with the effectiveness of a sign or traffic control signal. 5.13.3 The Chief Administrative Officer, the General Manger Engineering, Planning and Environment, the Director, Transportation and Maintenance, the Manager Transportation Construction or the Manager Transportation Maintenance are authorized to erect Emergency No Parking signs: a) when in their opinion an emergency has arisen making it desirable to prohibit parking on a highway, b) to facilitate the removal of snow, ice or debris from a highway, c) to facilitate the construction or repair of roads, curbs, gutters, sewers and water mains. 5.13.4 Emergency No Parking signs shall be erected before an event commences and shall be removed within one hour of the termination of the event. 5.13.5 No operator of a vehicle approaching a green signal light at an intersection shall enter the intersection unless traffic in front of him is moving in a manner that would reasonably lead him to believe he can clear the intersection before the signal light turns red. 5.13.6 Subsection 5.13.5 does not apply to the operator of a vehicle who enters an intersection for the purpose of turning to the right or left into an intersecting highway and signals his intention to make such turn prior to entering the intersection. 5.14 Community Safety Zones Where a sign is erected or placed on a highway in accordance with the Act, the highways set out in Column 1 of Schedule 18 of this by-law and limits as defined in Column 2 of said Schedule 18 shall be designated as Community Safety Zones during the prohibited times or days as set out in Column 3 of said Schedule 18. 5.15 School Zones Where a sign is erected or placed on a highway in accordance with the Act, the highways set out in Column 1 of Schedule 19 of this by-law and limits as defined in Column 2 of said Schedule 19 shall be designated as a School Zone during the prohibited times or days as set out in Column 3 of said Schedule 19. A School Zone shall have a prescribed speed of 40 kilometres per hour when a traffic control device to that effect is displayed. 5.16 Sale of Goods on a Highway No person shall sell or offer for sale by retail any goods if the place of offering or sale is on a highway. 6.0 PENALTIES AND ENFORCEMENT By-law No. 7098-24 Page 16 6.1 This by-law may be enforced by an enforcement officer or an enforcement officer appointed by a local municipality within the County. 6.2 If compliance therewith would be impractical, the provisions of this by-law shall not apply to an ambulance, police vehicle, fire department vehicle, public utility emergency vehicle and a vehicle actually engaged in works undertaken for or on behalf of the County, a local municipality within the County, the federal or provincial government, or any utility. 6.3 An enforcement officer upon the discovery of a vehicle parked or standing in contravention of the provisions of this by-law, may cause it to be removed or taken to and placed or stored in a suitable place, at the owner's expense, and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O.1990, as amended. 6.4 Any person who contravenes any of the provisions of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990 c.P33, as amended, and such fine is recoverable under the Provincial Offences Act, R.S.O. 1990 c. P33, as amended. 6.5 Where a Certificate of Offense has been issued under Part 2 of the Provincial Offences Act, R.S.O. 1990 c. P33, as amended, alleging that the provisions of this by-law have been contravened, the person charged may voluntarily pay a penalty to the County within seven (7) days from the date of the alleged contravention, and such payment shall be accepted in full satisfaction of the fine, and no further proceedings shall be taken. 7.0 APPLICATION OF BY-LAW 7.1 This by-law applies to all highways, parts of highways and property under the jurisdiction of the County. 8.0 BY-LAW SUBJECT TO THE HIGHWAY TRAFFIC ACT 8.1 The provisions of this by-law are subject to the provisions of the Act. 9.0 REPEAL 9.1 By-laws 6609, 6646, 6682, 6683, 6761, 6794, 6826, 6827, 6843, 6862, 6891, 6919, 6927, 6937, 6973, 6982, 7062-24, 7089-24 and any other by- law(s) previously enacted to regulate traffic and parking on a County road are hereby repealed.
