## THE CORPORATION OF THE MUNICIPALITY OF SIOUX LOOKOUT
## BY-LAW NO. 01-26
## BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING WITHIN THE MUNICIPALITY OF SIOUX LOOKOUT
## 1.0 RECITALS
## Municipal Act Authority
WHEREAS Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25 (the "Municipal Act) provides that a municipal power shall be exercised by by-law; and
WHEREAS Section 8 of the Municipal Act provides that the powers of a municipality shall be interpreted broadly, and
WHERAS Section 9 of the Municipal Act provides that a municipality has the capacity, ghts, powers and privileges of a natural person for the purpose of exercising it authority under the Municipal Act or any other Act; an
WHEREAS Section 10(1) of the Municipal Act provides that a single-tier municipality may provide any service or thing that the municipality considers necessary or desirable for the public; and
WHEREAS Section 10(2)(6) and (8) of the Municipal Act provides that a single-tier municipality may pass by-laws respecting various matters, including the health, safety and well-being of persons, and the protection of persons and property; and
WHEREAS Sections 23.1, 23.2(1)(c), and 23.3(2) of the Municipal Act provide that a council may delegate administrative powers and legislative and quasi-judicial powers under the Municipal Act to an officer, empioyee or agent of the municipality; and
WHEREAS Section 27 of the Municipal Act provides that a municipality may pass bylaws in respect of a highway only if it has jurisdiction over the highway, unless otherwise provided in the Act, and
WHEREAS Section 63(1) of the Municipal Act provides that, if a municipality passes a by-law for prohibiting or regulating the placing, stopping, standing or parking of an object or vehicle on or near a highway, it may provide for the removal and impounding or restraining and immobilizing of any object or vehicle placed, stopped, standing or parking on or near a highway in contravention of the by-law, and Section 170(15) of the Highway Traffic Act (power of officer to remove vehicle) applies with necessary modifications to the by-law; and
WHEREAS Section 44(4) of the Municipal Act provides that the Minister of Transportation may make regulations establishing minimum standards of repair for highways and bridges or any class of them, and further, that those standards, set out in O.Reg. 239/02, Sections 11-14, relate to Regulatory and Warning Signs, and Traffic Control Signal Systems and Sub-systems; and
WHEREAS Section 100.1 of the Municipal Act authorizes a local municipality to regulate or prohibit the parking or leaving of motor vehicles on land not owned or occupied by the municipality, without the consent of the owner of the land; and
WHEREAS Section 101 of the Municipal Act provides thai, if a municipality passes a bylaw regulating or prohibiting the parking or leaving of a motor vehicle on land, it may provide for the removal and impounding or restraining and immobilizing of any vehicle, at the vehicle owner's expense, parked or left in contravention of the by-law and Section 170(15) of the Highway Traffic Act (power of officer to remove vehicle) applies with necessary modifications to the by-law; and WHEREAS Section 101(3) of the Municipal Act provides that, where signs are erected on land specifying conditions on which a motor vehicle may be parked or left on the land, or regulating or prohibiting such parking, a motor vehicle parked or left on the land contrary to the conditions or prohibition shall be deemed to have been parked or left without consent; and WHEREAS Section 102(1) of the Municipal Act provides that, if a municipality passes a by-law for establishing a system of accessible parking, the sole manner of identifying vehicles shall be an accessible parking permit issued and displayed in accordance with the Highway Traffic Act and the regulations made under it; and WHEREAS Section 425(1) of the Municipal Act (the Act), provides that a municipality may pass by laws providing that a person who contravenes a by-law of the municipality passed under the Act is guilty of an offence; and WHEREAS Section 426(1) of the Municipal Act (the Act) states that no person shall hinder or obstruct, or attempt to hinder or obstruct, any person who is exercising a power or performing a duty under the Act or under a by-law passed under the Act, and WHEREAS Sections 429(1), (2) and (3) of the Municipal Act provides that a municipality may establish a system and various types of fines for offences under a by-law passed under the Act, and WHEREAS Section 431 of the Municipal Act provides that, if a by-law passed by a municipality under the Act is contravened and a conviction entered, in addition to any other remedy and to any penalty imposed by the by-law, the court in which the conviction has been entered and any court of competent jurisdiction thereafter may make an order prohibiting the continuation or repetition of the offence by the person convicted; and
## Highway Traffic Act Authority
WHEREAS Sections 28(1) and (2) of the Highway Traffic Act provides for the inspection of an accessible parking permit, and that an officer can take possession of the permit;
WHEREAS Section 128(2) of the Highway Traffic Act (HTA) provides that the councii of a municipality may, for motor vehicles driven on a highway or portion of a highway under its jurisdiction, by by-law, prescribe a rate of speed different from the rate set out in Section 128(1) of the HTA that is not greater than 100 kilometres per hour and may
WHEREAS Section 170(15) of the Highway Traffic Act (HTA) empowers a police officer, police cadet, municipal law enforcement officer or an officer appointed for carrying out the provisions of the Highway Traffic Act, upon discovery of any vehicle parking or standing in contravention of a municipal by-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removal, care and storage of the vehicle, if any, are a lien upon the vehicle, which may be enforced in the manner provided under Part Ill of the Repair and Storage Liens Act.
## Community Safety and Policing Act Authority
WHEREAS Sections 55(1) and (2) of the Community Safety and Policing Act, provides that municipalities may appoint persons to enforce the by-laws of the municipality and that those appointed are considered peace officers for the purpose of enforcing municipal by-laws.
WHEREAS the Council of The Corporation of the Municipality of Sioux Lookout passed By-law No. 07-25 on January 15, 2025, making such appointments.
## Provincial Offences Act Authority
WHEREAS Section 61 of the Provincial Offences Act provides that every person who is convicted of an offence is liable for a fine of not more than $5,000, except where otherwise expressly provided by law.
## Repair and Storage Liens Act
WHEREAS the Repair and Storage Liens Act provides a process whereby all costs and charges for the removal, care, and storage of a vehicle may be recovered.
## Council Authority
WHEREAS the Council of The Corporation of the Municipality of Sioux Lookout has passed By-law No. 1071, and several amendments, to regulate traffic and parking in the Municipality of Sioux Lookout; and
WHEREAS Council deems it advisable, expedient, and in the public interest to repeal By-law No. 1071 and all amendments and replace it with a new by-law to regulate traffic and parking in the Municipality of Sioux Lookout;
NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY,OF SIOUX LOOKOUT, ENACTS AS FOLLOWS:

## 3.0 SHORT TITLE
This By-law may be cited as the "Traffic & Parking Control By-law".
## 4.0 SCOPE
This By-law applies to: (a) Highways under the jurisdiction of the Municipality; (b) Municipal Parking Lots; and (c) Private Property solely for the purposes of Section 10.6 (Parking on Private Property) and the related enforcement and towing provisions.
## 5.0 DEFINITIONS
- 5.1 Definitions of words, phrases and terms used in this By-law that are not included in the list of Definitions shall have the meanings which are commonly assigned to them in the context in which they are used in this By-law.
- 5.2 The words, phrases, and terms defined hereinafter have the following meaning for the purpose of this By-law:
- 5.2.1 9.2 Accessible Parking Space means a Parking Space designated under Section and Schedule 2(P-AC) of this By-law for the exclusive use of a Vehicle displaying an Accessible Parking Permit issued in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder.
- 5.2.2 Accessible Parking Permit means an Accessible Parking Permit issued pursuant to the Highway Traffic Act (HTA) o any Regulation enacted thereunder or a permit, numbered plate or other marker or device issued by another jurisdiction and recognized under the HTA as an "Accessible Parking Permit" to authorize Parking in a designated Accessible Parking Space.
- 5.2.3 Angle Parking means a method of parking a Vehicle at an angle to the curs or parking space lines.
- Boulevard means the portion of a Highway located between the Roadway and the adjacent property line, including any Shoulder, ditch, Sidewalk, grassed or landscaped area, or utility area, but excluding the Roadway.
- 5.2.5 Building & Compliance Supervisor (BCS) means the Building & Compliance Supervisor appointed by the Municipality, or his or her designate, or any successor positions.
- 5.2.6 Bus means a Motor Vehicle designed for carrying 10 or more passengers and used for the transportation of persons and their luggage, and freight.
- 5.2.7 Bus Loading Zone means a designated and signed portion of a Highway, measuring no less than 12 metres in length, adjacent to the Curb, reserved for the exclusive use of Buses during Loading/Unloading, and where a Bus can pull into so as not to obstruci traffic.
- 5.28 Bus Stop means a designated and signed point on a Highway for the use of Buses as a space for Loading and unloading passengers
- 5.2.9 Checkerboard Sign means a type of traffic warning sign/hazard marker used to alert motorists to a significant change in road conditions, i.e. an abrupt direction change, or the termination of a road.
- 5.2.10 Consent means express permission of the owner and includes permission evidenced by: (a) compliance with posted terms and conditions, with signage erected on the Private Property; and/or (b) a permit or other authorized document issued by or on behalf of the owner, displayed on or in the vehicle so as to be readily readable by an Officer.
- 5.2.11 Council means the Council of The Corporation of the Municipality of Sioux Lookout.
## 5.2.12 Crosswalk means
- (a) that part of a highway at an Intersection that is included within the connections of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the Curbs or, in the absence of Curbs, from the edges of the Roadway, or
- (b) any portion of a Roadway at an Intersection or elsewhere distinctly indicated for Pedestrian Crossing by signs or by lines or other markings on the surface.
- 2.13 Curb means the raised edge of the outer limits of the traveled portion of tr /here no Curb has been constructed, means the edde of th Roadway.
- 5.2.14 Downtown Core means the area within the east-west borders of Third Avenue to Seventh Avenue, inclusive, and the north-south borders of Front Street to Queen Street, inclusive.
- 5.2.15 Driveway means a vehicular way providing access between a public Roadway and an adjoining building, parking facility, or other off-street area. The portion of the Driveway between the property line and the Roadway/Curb is part of the Highway and is public property but is, generally, maintained and "occupied" by the property owner. The portion of the Driveway from the property line and extending onto the property is privately-owned.
- 5.2.16 Emergency Vehicle means a vehicle of the police or fire department, civil defense, a public utility, or an ambulance, while actively engaged in responding to an emergency, or, in the case of the police, while enforcing this By-law.
- 5.2.17 Fire Chief means the Fire Chief appointed by the Municipality, or his or her designate, or any successor positions.
- 5.2.18 Fire Route means any road, lane, driveway, alley, parking area, ramp or parcel of land regardless of ownership, which has been designated as a Fire Route by the placing or erecting of Official Signs indicating such.
- 5.2.19 Highway includes a common and public Highway, street, avenue, road, Back Lane, parkway, under the jurisdiction of the Municipality, any part of which is intended for or used by the general public for the passage of Vehicles and includes the area between the lateral property lines thereof. Highway includes the Roadway, the Shoulder, the Boulevard, and the Sidewalk.
- 5.2.20 Highway Traffic Act (HTA) means the Ontario Highway Traffic Act, and all Regulations thereunder, as amended from time to time, or any successor legislation.
- 5.2.21 Intersection means the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then of the lateral boundary lines of two or more Highways that join one another at an angle, whether or not one Highway crosses the other.
- 5.2.22 Lane generally means a narrow public thoroughfare or Roadway generally providing secondary access to properties, often to the rear of buildings. Back Lane has a similar meaning.
- 5.2.23 Loading means the physical activity of passengers entering or departing a Vehicle, and the physical activity of moving goods or merchandise from or to a property or another Vehicle.
- .2.24 Loading Zone means a designated and signed portion of a highway adjacent t he Curb, reserved for the exclusive use of Motor Vehicles during Loading
## 5.2.25 Motor Vehicle (also see Vehicle)
- Includes: automobiles; motorcycles; and other vehicles powered by a motor, including motor-assisted bicycles; and any other vehicle propelled or driven, other than by muscular power, unless otherwise indicated in the Highway Traffic Act.

- For clarity - Motor Vehicle is a subset of Vehicle, specifically self-propelled machines like cars and motorcycles. The key difference between Vehicle and Motor Vehicle is power source, i.e. Vehicle covers everything; Motor Vehicle is specifically mechanically (engine) powered, but with some statutory exclusions.
- 5.2.26 Municipal Act means the Ontario Municipal Act, and all Regulations thereunder, as amended from time to time, or any successor legislation.
- 5.2.27 Municipal Law Enforcement Officer/By-law Enforcement Officer means a person appointed by the Municipality of Sioux Lookout to enforce its by-laws.
- 5.2.28 Municipal Parking Lot means land that's owned by the Municipality and has · been designated for Parking of Vehicles.
- 5.2.29 Municipal Traffic Control Plan (MCP) means a general plan developed by the Municipality containing standardized measures, e.g. signage, lane closures, flagging operations, detours, notification to the public, etc.) that Contractors undertaking construction projects in the Municipality must adhere to. The MCP outlines how traffic-vehicles, cyclists, and pedestrians--will be safely managed around the work zone to protect workers, maintain safe traffic flow, and comply with regulations while work is being carried out on, adjacent to, or affecting Municipal roads. The MTCP does not replace or supersede the Contractor's Traffic Protection Plan as required by the Occupational Health and Safety Act, R.S.O. 1990, c.O.1 and will be in addition to the Contractor's Plan.
- 5.2.30 Municipality means The Corporation of the Municipality of Sioux Lookout and refers to either the corporate entity or the geographic entity of Sioux Lookout, depending on the context.
- 5.2.31 Obstruct - means to hinder, mislead, provide false information or make a false claim or statement, or to prevent or attempt to prevent the execution of a power or duty, and, without limiting the foregoing, includes:
- a) providing false or misleading information;
- c) preventing, barring or delaying or attempting to prevent, bar or delay any person, including an Officer, from carrying out his or her duties or exercising his or her powers under this By-law;
- b) failing to identify oneself when asked during enforcement activities;
- d) failing to provide, upon requesi by an Officer, any information, documents or things relevant to an infraction.
- 5.2.32 Officer means a Municipal Law Enforcement Officer, By-law Enforcement Officer, or Police Officer, depending on the context.
- 5.2.33 Official Sign means a sign approved by the Ministry of Transportation or contained in or consistent with the Ontario Traffic Manual and installed by the Municipality under the authority of this By-law for the purpose of regulating, warning, or guiding traffic or Parking.
- 5.2.34 One-way Street means a Highway upon which vehicular traffic is limited to movement in one direction. One-way Traffic has a related meaning.
- 5.2.35 Park, Parking or Parked, when prohibited, means the standing of a Vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
- 5.2.36 Parking Space means that part of a Roadway that is designated by the Municipality for the purpose of Parking one Vehicle.
- 5.2.37 Pedestrian means any person afoot, any person in a wheelchair, any child in a wheeled carriage, and any person riding a non-motorized bicycle with wheels less than 50 centimetres in diameter.
- 5.2.38 Pedestrian Grossover/Crossover means any portion of a Roadway distinctly indicated for Pedestrian crossing by signs, pavement markings, Traffic Control Device or Traffic Control Signal, as prescribed by the regulations under the Highway Traffic Actor as contained in or consistent with Ontario Traffic Manuals, as applicable.
- 5.2.39 Police Officer means a member of the Ontario Provincial Police, or a Special Constable.
- 5.2.40 Private Property means land not owned or occupied by the Municipality, including parking areas, Driveways, and Private Roads.
- 5.2.41 Private Road means a road, Lane, Driveway, access route, or other way located on Private Property, including (without limitation) an unassumed subdivision road and a road maintained by a road association or similar private entity.
- 5.2.42 Public Works Manager means the Public Works Manager appointed by the Municipality, or his or her designate, or any successor positions.
- 5.2.43 Roadway means the travelled portion of a Highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a Highway includes two or more separate Roadways, the term 'Roadway' refers to any one Roadway separately and not to all of the Roadways collectively.
- 5.2.44 Roundabout means a form of intersection that accommodates traffic flow in a circular direction around a central island, or similar configuration.
- 5.2.45 Shoulder means a paved or unpaved area alongside and contiguous with the Roadway.
- 5.2.46 Sidewalk means that portion of a Highway between the Curb line and the property line of the lot abutting the Highway improved for the use of Pedestrians, but does not include Crosswalks, medians, Boulevards, Shoulders, or trails.
- 5.2.47 Stand or Standing, when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers, but not goods or materials. standing ep for the lurt ods of
- 5.2.48 Stop, Stopping or Stopped, when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, for any purpose, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or of a Traffic Control Sign or Signal.
- 5.2.49 Through Highway means a Highway or part of a Highway designated as such by the Minister or by by-law of a municipality, and every intersecting Highway shail be marked by a stop sign or yield right of way sign in compliance with the regulations of the Highway Traffic Act.
- 5.2.50 Time means, where any expression of time occurs or where any hour or other period of time is stated, Standard Time or Daylight-Saving Time, whichever is in effect in the Municipal of Sioux Lookout, pursuant to the Time Act.
- 5.2.51 Traffic Control Device includes the following: a sign; Roadway, Curb, or Sidewalk marking; or other device erected or placed under the authority of this By-law for the purpose of guiding or directing traffic.
- 5.2.52 Traffic Control Signal means any device, manually, electrically or mechanically operated for the regulation or control of traffic.
- 5.2.53 Turning Basin means the area of an intersection marked for the purpose of collecting Vehicles which are making a left or right turn.
## 5.2.54 Vehicle (also see Motor Vehicle)
- Includes: motor vehicles, trailers, traction engines, farm tractors, roadbuilding machines, bicycles and anything else drawn, propelled or driven by any kind of power, including muscular power.
- For clarity - Vehicle is a broad term including anything propelled by any power (even human). The key difference between Vehicle and Motor Vehicie is power source, i.e. Vehicle covers everything; Motor Vehicle is specifically mechanically (engine) powered, but with some statutory exclusions.
- Excludes: motorized snow vehicles or the cars of electric or steam railways running only upon rails.
## 6.0 GENERAL PROVISIONS
## 6.1 Authority to Install Official Sians. Traffic Control Devices, Traffic Control Signals, Pavement Markings, Etc.
- 6.1.1 The Public Works Manager is hereby authorized and directed to place, erect, install and maintain such Official Signs and traffic control devices as may be necessary to give effect to the provisions of this By-law and/or that are authorized by the Schedules of this By-law.
- 6.1.2 Notwithstanding other provisions of this By-law, the Public Works Manager is hereby authorized and directed to place, erect, maintain and move and remove such traffic control devices and traffic control signals as are required for reasons of emergency, construction, repair, painting, or community events, for the safety of the public.
## 6.2 Conflict with Other Legislation/By-laws
- 6.2.2 If a provision of this By-law conflicts with Provincial or Federal legislation, the more restrictive Federal or Provincial provision shali prevail.
- 6.2.3 Where any provision of this By-law conflicts with a provision in another By-law, the more restrictive provision shall prevail.
## 6.3 Exemptions
The provisions of this By-law prohibiting Stopping or Parking shall not apply to:
- a) police services, emergency medical services, and fire services Vehicles while responding to and/or actively engaged in providing their respective services;
- b) public utility Vehicles while actively engaged in maintaining or making repairs
- c) Municipal By-law Enforcement Vehicles while actively engaged in carrying out their duties.
## 6.4 Headings
The headings used in the body of this By-law form no part of the By-law but are inserted for convenience and reference only.
## 6.4 Highways Within the Municipality of Sioux Lookout
The provisions of this By-law shall apply only to Highways in the Municipality of Sioux Lookout.
## 6.5 Safe and Responsible Driving
Notwithstanding any other provisions in this By-law, all Municipal, Provincial, and Federal laws with respect to traffic and parking provisions shall be followed at all times.
## 6.6 Schedules
The Schedules attached to this By-law are hereby made a part of this By-law.
## 6.7 Severability
if any Section or Sections of this By-law, or parts thereof, are found by any court of law to be illegal or beyond the power of the Municipality to enact, such Section or Sections or parts thereof shall be deemed to be severable and all other Sections or parts of this By-law shall be deemed to be separate and independent thereof, and have been enacted as such.
## 7.0 GENERAL PROHIBITIONS
## 7.1 Activities Prohibited on a Municipal Highway
- 7.1.1 No person shall, on a Highway:
- 7.1.1.1 abandon a Vehicle.
- 7.1.1.2 direct traffic unless approved by the OPP or the Municipality, or, in an emergency, direct traffic around the scene of an accident, obstacle, debris, glass or other hazard.
- 7.1.1.3 display or advertise a Vehicle for sale.
- 7.1.1.4 solicit, buy or sell goods and/or services, unless otherwise permitted by Municipal By-law.
- 7.1.1.5 store a Vehicle or any other item.
- 7.1.1.6 wash, grease, or repair a Vehicle except for immediate repair due to an emergency.
## 7.2 Closed/Barricaded Highways
No person shall drive a Vehicle on any Highway that has been roped off, barricaded, or marked by an authorized sign prohibiting its use, except an emergency services Vehicle or a Vehicle authorized by the appropriate authority to have access.
## 7.3 Driving Prohibited
- 7.3.1 No person shall drive a Motor Vehicle upon a Sidewalk, footpath or trail except for the purpose of directly crossing the Sidewalk or footpath, or trail.
- No person shall drive a Motor Vehicle over a raised Curb except at a place where there is a ramp or Curb cut.
- 7.3.3 No person shall drive any Vehicle on any beach owned or operated by the Municipality, with the exception of emergency services Vehicles or while actively engaged in providing services, or a Municipal Vehicle while actively engaged in providing maintenance services or programming services.
- 7.3.4 No person shall drive any Vehicle in a cemetery owned or operated by the Municipality, other than on the roads and access points into and within the cemetery, with the exception of emergency services Vehicles, funeral services Vehicles, or Municipal Vehicles while actively engaged in providing their respective services.
- 7.3.5 No person shall drive a Vehicle over or across any hose laid by the Fire Department, unless specifically allowed, directed, or guided to do so by emergency services personnel.
## 7.4 Fire Routes
Where Official Signs are erected and are on display, no person shall Stop a Vehicle on any Highway designated as a Fire Route as set out in Schedule 7(FR) to this By-law.
## 7.5 Oversized or Heavy Loads/Vehicles
- 7.5.1 Subject to the Municipality's Reduced Load Restriction By-law, no person shall drive a Vehicle or combination of Vehicles on a Highway through or within the Municipality that is in excess of the dimensions and weight set out in the HTA without first having obtained written permission or a permit from the Public Works Manager.
- 7.5.2 The operator of the Vehicle and the Public Works Manager shall determine the route through or within the Municipality that is the most expeditious and least disruptive to traffic, among other criteria established by the Public Works Manager.
- 7.5.3 This Section shall also apply to an oversized or heavy truck making a delivery to or a collection from a premises that cannot be reached by any route other than a Highway where such Vehicles are prohibited by this or any other By-law.
- 7.5.4 This Section shall not apply to the use of Municipal Highways or parts thereof by ambulances, Police, Fire Department, or public utility Vehicles while actively engaged in responding to an emergency, or to Municipal Vehicles.
## 7.6 Parking Spaces
Where a Parking Space is designated by Official Signs or pavement markings on a Highway, no person shall Park or Stand a Vehicle other than within the confines of the Parking Space unless the Vehicle cannot be accommodated in one Parking Space.
## 7.7 Roundabouts/Traffic Circies
No person shall drive, move or operate a Vehicle opposite to the flow of traffic or contrary to traffic control measures on any Roundabout or Traffic Control Circle as designated on Schedule 17(RTC) of this By-law.
## 7.8 Sidewalks - Use of
- 7.8.1 Every person shall utilize sidewalks wherever they are provided adjacent to a Highway.
- 7.8.2 No person shall use any Sidewalk for any purpose other than pedestrian traffic, except as specifically permitted by this or any other By-law.
## 7.9 Signs - Interference with Signs. Barricades, Traffic Control Devices or Signals, or Pavement Markings
- 7.9.1 No person shall alter, deface, remove, destroy, change the position of, tamper o interfere with or drive over, or attempt to drive on or over any Official Sign barricade, Traffic Control Device, Traffic Control Signal, erected on a Highway by the Municipality.
- 7.9.2 No person shall alter, deface, remove or attempt to remove any existing pavement markings on any Highway.
- 7.9.3 No person shall drive, or attempt to drive on or over, or tamper with, or walk on any newly-painted pavement markings on any Highway.
## 7.10 Sians - Unauthorized
- 7.10.1 No person shall place, maintain, or display upon any Highway, or adjacent thereto, any sign, signal, marking or device which purports to be or is an imitation of or resembles an Official Sign, a traffic control device, or a traffic control signal, or any other sign, without prior written approval of the Municipaiity.
- 7.10.2 The Public Works Manager is hereby authorized and directed to remove or cause to be removed, without notice, any sign, signal, marking or device found on a Highway, or adjacent thereto, which purports to be or is an imitation of or resembles an Official Sign, but which is not an Official Sign.
- 7.10.3 The Public Works Manager is hereby authorized and directed to remove or cause to be removed, without notice, any other type of sign that is installed on a Highway, or adjacent thereto, without prior written permission from the Municipality.
## 7.11 Speed Limits
- 7.11.1 No person shall drive a Motor Vehicle at a greater rate of speed than 50 kilometres per hour on any Highway under Municipal jurisdiction, unless otherwise posted.
- 7.11.2 Where the posted speed is less than 50 kilometres per hour on a Highway, по person shall drive a Motor Vehicle on the Highway under Municipal jurisdiction at a greater rate of speed than posted.
- 7.11.3 See Schedule 15(RS) for Reduced Speed areas.
## 8.0 GENERAL REGULATIONS FOR PARKING OR STOPPING ON HIGHWAYS SIGNED AND UNSIGNED
- 8.1 See Table 1 for definitions and further clarification of "Parking", "Standing" and "Stopping" as applied in this By-law.
- 8.2 This By-law identifies Municipal roads or sections of Municipal roads where Parking, Standing, or Stopping is not permitted. Some roads/areas are signed. Other roads/areas are not signed. The absence of an Official Sign does not
necessarily mean that Parking is permitted in that area. The applicable restrictions are still enforceable.
- 8.3 Every person shall Park or Stand a Vehicle on a Highway or portion thereof only as follows:
- 8.3.1 where there is a raised Curb, on the right side of the Roadway, having regard to the direction such Vehicle. was proceeding, with its right front and rear wheels parallel to and not more than .15 metres out from such Curb; or
- 8.3.2 where there is no Curb or a roiled Curb, with the right front and rear wheels parallel to and as near to the right-hand limit of the Highway as is practicable without Stopping or Parking on a Sidewalk or footpath or on any part of the Highway where grass is grown or which is not intended for the use of Vehicles.
## 8.4 "No Stopping" Regulations - Signage Not Required
- 8.4.1 No person shall, on a Highway, Stop a Vehicle in any of the following places:
| 8.4.1.1 | on, over or blocking a Sidewalk. |

| 8.4.1.5 | within an Intersection. |
| 8.4.1.6 | within nine (9) metres of an Intersection without Traffic Control Signals. |
| 8.4.1.7 | within 15 metres of an Intersection controlled by Traffic Control Signals. |
| 8.4.1.8 | within 15 metres of a Roundabout or Traffic Circle. |
| 8.4.1.9 | on the Roadway alongside of any Stopped or Parked Vehicle. |
| |8.4.1.10 | in such a position as will prevent the exit of any other Vehicle previously Parked. |
| 8.4.1.11 | on a two-way Highway on the left-hand side in the opposite direction of traffic. |
| 8.4.1.12 | on a One-way Street on either side in the opposite direction of traffic. |
| 8.4.1.13 | on any Roadway having an overall width of less than 6.1 metres. |
| 8.4.1.14 | within a Turning Basin. |
| 8.4.1.15 | within a Crosswalk, or in such a manner as to obstruct a Crosswalk. |
| |8.4.1.16 | within a designated Pedestrian Crossover. |
| 8.4.1.17 | within nine (9) metres of a Pedestrian Crossover. |
| 8.4.1.18 | in the Downtown Core between midnight and 7:00 a.m., November 1st of one year and April 15ü of the following year. |
| 8.4.1.19 | in the Municipality other than the Downtown Core, between midnight and 7:00 a.m., November 1st of one year and April 15' of the following year. |
| 8.4.1.20 | in such a manner as to interfere with the clearing of snow from a Highway. 12 |
- 8.4.1.21 upon any bridge, or within any tunnel, or any underpass.
- 8.4.1.22 alongside or across the Highway from any excavation or obstruction in the Roadway when the free flow of traffic would thereby be impeded.
- 8.4.1.23 within 90 metres of the scene of a fire in progress.
- 8.4.1.24 alongside the tracks of any railway, with the exception of railway maintenance Vehicies while actively doing maintenance work.
- 8.4.1.25 within 15 metres of any railway or level crossing, with the exception of railway maintenance Vehicles while actively doing maintenance work
## |8.5 "No Stopping" Regulations - Signage Required
- 8.5.1 Where Official Signs are erected and are on display, No person shall, on a Highway, Stop a Vehicle in any of the foilowing places:
- 8.5.1.1 at any designated Bus Stop.
- 8.5.1.2 in any area designated as a Bus Loading Zone, except for a Bus engaged in Loading or unloading passengers, luggage, or freight.
- 8.5.1.3 in any area designated as an Accessible Loading Zone without an Accessible Parking Permit.
- 8.5.1.4 within 7.5 metres of any Fire Hall on the side of the Highway on which the Fire Hall is located.
## 8.6 "No Parking" Regulations - Signage Not Required
- 8.6.1 No person shall on a Highway Park a Vehicle:
- 8.6.1.1on the same side of a Highway within the Downtown Core, for longer than three hours, between the hours of 7:00 a.m. and 7:00 p.m., unless posted otherwise and set out in Schedule 16(P-R).
- 8.6.1.2 in front of the entrance to any place where goods or merchandise are regularly delivered or removed, unless actively engaged in delivering or removing goods or merchandise. However, such Vehicle cannot Park in such a manner as to interfere with the movement of traffic.
- 8.6.1.3 in such a manner as to obstruct or interfere with traffic.
- 8.6.1.4 in such a manner as to interfere with the clearing of snow from a Highway.
## 8.7 "No Standing" Regulations - Signage Not Required
- 8.7.1 No person shall, on a Highway, Stand a Vehicle:
- 8.7.1.1 in front of the entrance to a medical centre, clinic, or hospital, with the exception of emergency services Vehicles.
- 8.7.1.2 in front of an entrance to or exit from any building or enclosed space in which people may be expected to congregate in large numbers.
- 8.7.1.3 in such a manner as to obstruct or interfere with traffic
## 9.0 SCHEDULES - SPECIFIC REGULATIONS FOR TRAFFIC AND PARKING CONTROL
## 9.1 SCHEDULE 1(LZ-AC) -- ACCESSIBLE LOADING ZONE
Where Official Signs are erected and are on display, no person shall Park a Vehicle on any Highway in an Accessible Loading Zone as designated in Schedule 1(LZ-AC) to this By-law without displaying a valid Accessible Parking Permit in accordance with the HTA and regulations thereunder, or use such a Loading Zone for any purpose other than to load or unload passengers with a disability.
## 9.2 SCHEDULE 2(P-AC) -- ACCESSIBLE PARKING SPACES
- 9.2.1 Where Official Signs are erected and appropriate pavement markings are on display, no person shall Park a Vehicle in an Accessible Parking Space as designated in Schedule 2(P-AC) to this By-law without displaying a valid Accessible Parking Permit in accordance with the HTA and regulations thereunder.
- Designated Accessible Parking Spaces shall be demarcated by Official Sign(s) and pavement marking with the universal Interational Symbol of Access (ISA).
- 9.2.3 Construction and maintenance of Accessible Parking Spaces shall follow Provincial guidelines, as may be amended from time to time.
## 9.3 SCHEDULE 3(P-AN) - ANGLE PARKING
- 9.3.1 Where Official Signs are erected and are on display, Angle Parking in accordance with the provisions of Sections 9.3.3 and 9.3.4 below is permitted in the location(s) set out Schedule 3(P-AN) to this By-law.
- 9.3.2 Exceptions
- 9.3.2.1 The provisions of Section 8.3 do not apply where Angle Parking is permitted under Section 9.3 of this By-law.
- 9.3.3 Where Angle Parking is permitted on a Highway, no person shall Park or Stand any Vehicle except at an angle of not less than 40 degrees and not more than 50 degrees from the Curb or boundary of the Roadway with the front end of the
- 9.3.4 Where Angle Parking spaces are designated by lines painted on the Roadway, no person shall Park or Stand any Vehicle except within an area designated as a Parking Space.
## 9.4 SCHEDULE 4(LZ-B) - BUS LOADING ZONES
/here Official Signs are erected and are on display, no person shall Park a Vehicle ny Highway in a Bus Loading Zone as designated in Schedule 4(LZ-B) to this By-la or use such a Bus Loading Zone for any purpose other than to load or unload Bus passengers.
## 9.5 SCHEDULE 5(B) - BUS STOPS
Where Official Signs are erected and are on display, no person shall Stand or Park Vehicle, other than a Bus, on a portion of a Highway designated as a Bus Stop as set out in Schedule 5(B).
## 9.6 SCHEDULE 6(C) - CHECKERBOARD SIGNS
Where Official Signs are erected and are on display on any Highway, no person shall disregard a Checkerboard Sign as set out in Schedule 6(C) to this By-law so as to cause an unnecessary and potentially hazardous driving situation or an accident.
## 9.7 SCHEDULE 7(FR) - FIRE ROUTES
- 9.7.1 Where Official Signs are erected and are on display, no person shall Stop a Vehicle on any Highway designated as a Fire Route as set out in Schedule 7(FR) to this By-law.
- 9.7.2 Signs designating a Fire Route shall be installed at intervals of not more than 30.5 metres.
- 9.7.3 The Municipal Fire Chief has the authority to designate Fire Routes.
## 9.8 SCHEDULE 8(LZ) - LOADING ZONES
Where Official Signs are erected and are on display, no person shall Park or Stand a Vehicle on any Highway in the locations designated as Loading Zones as set out ir Schedule 8(LZ) to this By-law, unless such Vehicle is being loaded or unloaded and the entire Vehicle is located within the designated Loading Zone.
## 9.9 SCHEDULE 9(NE) - NO EXIT
Where Official Signs are erected and are on display on any Highway, no person shall disregard a No Exit Sign as set out in Schedule 9(NE) to this By-law so as to cause an unnecessary and potentially hazardous driving situation, an accident, or backing-up manoeuvres.
## 9.10 SCHEDULE 10(P-N) - NO PARKING (Also see Table 1)
- 9.10.1 Where Official Signs are erected and are on display, no person shall Park a Vehicle on any Highway as set out in Schedule 10(P-N).
- 9.10.2 Where Official Signs or barricades are erected and are on display, no person shall Park a Vehicle at Farlinger Park/Town Beach where prohibited during an
## 9.11A SCHEDULE 11A(NoStand) - NO STANDING (Also see Table 1)
Where Official Signs are erected and are on display, no person shall Stand a Vehicle on any Highway except as set out in Schedule 11A(NoStand)
## 9.11฿ SCHEDULE 11(NoStop) - NO STOPPING (Also see Table 1)
No person shall Stop a Vehicle on any Highway as set out in Schedule 11B(NoStop).
## 9.12 SCHEDULE 12(OW) - ONE-WAY STREETS
- 9.12.1 Where Official Signs are erected and on display, any Highway named or described in Schedule 12(OW) of this By-law is designated as a One-Way Street in the direction of travel stated therein.
- 9.12.2 No person shall drive a Vehicle on a One-Way Street in a direction opposite to that stated on the Official Sign.
- 9.12.3 The provisions of Section 8.3 do not apply to Parking a Vehicle on the left-hand side of the Roadway of a Highway designated for One-Way Traffic.
- 9.12.4 Notwithstanding Section 8.3, where Parking is also permitted on the left-hand side of the Roadway of a Highway designated for One-way Traffic, every person shall Park a Vehicle on the left-hand side of the Highway or portion thereof as follows:
- 9.12.41 where there is raised Curb, on the left-hand side of the Roadway, having regard to the direction such Vehicle was proceeding, with its left front and rear wheels parallel to and not more than 15 metres out from such Curb;
- 9.12.42 where there is no Curb or a rolled Curb, with the left front and rear wheels parallel to and as nearto the left-hand limit of the Highway as is practicable without Parking on a Sidewalk or footpath or on any part of the Highway where grass is grown or which is not intended for the use of Vehicles.
## 9.13 SCHEDULE 13(P-O) - OVERNIGHT PARKING - MUNICIPAL PARKING LOTS
- 9.13.1 The premises owned by the Municipality and described in Schedule 13(P-O) are designated Municipal Parking lots.
- 9.13.2 No person shall allow a Vehicle to remain in a Municipal Parking Lot, including parking lots available to the public to access Municipal facilities, outside of regular hours of operation.
- 9.13.3 Exceptions - Section 9.13.2 does not apply:
- 9.13.2.1 where Official Signs allowing overnight parking are erected and are on display.
- 9.13.2.2 to Vehicles of Fire Fighters parked in the Fire Hall Parking Lot while responding to a fire.
- 9.13.2.3 to Vehicles of Municipal employees while working a night shift.
- 9.13.4 No person shall use a Municipal Parking lot for anything but Parking a Vehicle.
- 9.13.5 No person shail use a Municipal Parking lot for overnight accommodations.
## 9.14 SCHEDULE 14(PC) - PEDESTRIAN CROSSOVERS
- 0,141 Testated 9.14.1 The portions of Roadway and locations set out in Schedule 14(PC) are designated as Pedestrian Crossovers. Such designation of a Pedestrian Crossover shalt be effective upon Official Signs, Traffic Control Devices, Traffic Contral Signals, and/or pavement markings being posted/installed in accordance with the Regulations of the Highway Traffic Act or as contained in or consistent with Ontario Traffic Manuals, as applicable.
- 9.14.2 When Official Signs, Traffic Control Devices, Traffic Control Signals, and/or pavement markings are posted, installed or on display, every driver of a Vehicle approaching the Crossover shall, when a Pedestrian is crossing on the Roadway within a Pedestrian Crossover:
- (a) stop before entering the Crossover;
- (c) not proceed into the Crossover until the Pedestrian is no longer on the Roadway. (Highway Traffic Act, Section 140(1))
- (b) not overtake another Vehicle already Stopped at the Crossover; and
## 9.15 SCHEDULE 15(RS) - REDUCED SPEED
Where Official Signs are erected and on display, the maximum permissible rate of speed on a Highway named or described in Schedule 15(RS) of this By-law shall be that rate of speed set out therein. See Section 7.11.2 for offence.
## 9.16 SCHEDULE 16(P-R) - RESTRICTED PARKING; SCHEDULE 16.1(P-R-DTCS), AND 16.2(P-R-DTC-Map)
- 9.16.1 Where Official Signs are erected and are on display, No person shall Park a Vehicle on any Highway contrary to the provisions sei out in Schedule 16(P-R) to this By-law.
- 9.16.2 No person shall permit a Motor Vehicle to remain Parked on a Highway between the hours of midnight and 7:00 a.m. from November 1st of one year to April 15* of the following year. (Winter Parking Restrictions)
## 9.16.3 Downtown Core - Three-Hour Parking and Winter Parking Restrictions Signage Not Required
- 9.16.3.1 The Downtown Core in Sioux Lookout is established as: Front Street to King Street, inclusive, and Third Avenue to Seventh Avenue, inclusive.
- 9.16.3.2 No person shall Park any Vehicle on the same side of a Highway within. the "Downtown Core" as established in this By-law, for a period longer than three hours between the hours of 7:00 a.m. and 7:00 p.m., unless posted otherwise and set out in Schedule 16(P-R).
- 9.16.3.3 No person shall Park any Vehicle on any Highway within the "Downtown Core" as established in this By-law, between the hours of midnight and 7:00 a.m. between November 1st of one year and April 15üh of the following year, unless posted otherwise. (Winter Parking Restriction)
## 9.17 SCHEDULE 17(RTC) - ROUNDABOUTS; TRAFFIC CIRCLES
Roundabouts, Traffic Circles, and associated traffic control measures are designated on Schedule 17(RTC) of this By-law. (See Section 7.7 for offence.)
## 9.18 SCHEDULE 18(P-SC) - SENIOR CITIZENS PARKING
This Schedule is currently blank as there are no Senior Citizens Parking Spaces designated in the By-law.
## 9.19 SCHEDULE 19(SS) - STOP SIGNS
Where Official "Stop" Signs are erecied and on display on Highways as set out in Schedule 19(SS) to this By-law, every driver or operator of a Vehicle shall comply with the traffic control measure.
## 9.20 SCHEDULE 20(TS) - THROUGH HIGHWAYS/STREETS (Also see Table 2)
Any Highway named or described in Schedule 20(TS) of this By-law is designated as "Through Highway" or "Through Street" except at an intersection where there is a Traffic Control Device such as an Official Stop Sign or an Official Yield Sign. For any Highway designated as a Through Highway/Through Street, a Stop Sign or a Yield sign shall be erected facing approaching Highway/Through Street.
## 9.20.1 Stop Signs on Roads Intersecting with Through Streets
Official Stop Signs shall be erected at the intersections named or described in Schedule 20(TS) of this By-law facing approaching traffic on any roadway intersecting the Through Highway/Through Street.
## 9.20.2 Yield Signs on Roads Intersecting with Through Streets
Official Yield Signs shall be erected at the intersections named or described in Schedule 20(TS) of this By-law facing approaching traffic on any roadway intersecting the Through Highway/Through Street.
## 9.20.3 King's Highways and Connecting Links Intersecting with Through Streets
The designation as a Through Highway in this Section and on Schedule 19(TS) shall not include any Intersection thereon where the road intersected is a King's Highway or Connecting Link Highway or where Traffic Control Signals/Devices are installed.
## 9.21 SCHEDULE 21(TLR) - TURNING LANES/TURN RESTRICTIONS
- 9.21.1 Where Official signs are erected and on display, every driver or operator of a Vehicle shall comply with the signed traffic control measures.
- 9.21.2 The Turn Restrictions Schedule is currently blank as there are no Tum Restrictions designated in the By-law.
## 9.22 SCHEDULE 22(YS) - YIELD SIGNS
Where Official "Yield" Signs are erected and on display, every driver or operator of a Vehicle shall comply with the signed traffic control.
## 10.0 SPECIAL PROVISIONS
- 10.1 Airport Parking - Airport Parking is governed by the Airport Parking By-law and is not subject to the provisions of this By-law.
- 10.2 Boat Launch/Municipal Access Points Parking - Parking at Municipal Access Points/Boat Launches is governed by the Municipal Access Points By-law but may also be subject to the provisions. of this By-law, as applicable.
- 10.3 Municipal Traffic Control Plans - The Municipality may develop temporary or emergency Traffic Control Plans for its own or private construction and maintenance projects taking place on, adjacent to, or affecting Municipal Highways, for or emergencies. Private Contractors undertaking construction projects in the Municipality shall adhere to such Traffic Control Plans. The MCP does not replace or supersede the Coniractor's Traffic Protection Plan as required by the Occupational Health and Safety Act, R.S.O.1990, c.O.1 and will be in addition to the Contractor's own Plan.
- 10.4 Parades/Marches/Walks, Etc. - The Municipality may pass By-laws, policies, and procedures, including the requirement for permits, etc., with regard to parades, marches, walks, or similar events on Munícipal Highways.
- 10.5.1 Consent Required - No person shall Park, Stand, or Stop a Vehicle on Private Property without the Consent of the owner of the Private Property.
- 10.5.2 Indicators of Consent - The following are indicators that the owner of Private Property has consented to the Parking, Standing, or Stopping of Vehicles:
- (a) signs have been posted on the Private Property indicating the terms and conditions under which members of the public may Park, Stand, or Stop Vehicles, provided the terms and conditions are complied with, and/or
- (b) the owner has issued a permit or other authorization to the owner or operator of the Vehicle in question, and the permit/authorization is displayed on or in the Vehicle so as to be readily readable by an Officer.
- 10.5.3 Deemed Without Consent - Where signs are erected on Private Property specifying conditions on which a Vehicle may be Parked or left on the land, or regulating or prohibiting Parking or leaving of a Vehicle on the land, a Vehicle Parked of left contrary to the conditions or prohibition shall be deemed to have been Parked or left without Consent.
- 10.6 Reduced Loads - Reduced load restrictions are governed by the Reduced Load Restriction By-law.
## 11.0 ENFORCEMENT
- 11.1 This By-law shall be jointly enforced by the Municipality and the Ontario Provincial Police (OPP) in accordance with this By-law and the Highway Traffic Act, as applicabie.
- 11.2 Where a Motor Vehicle is found parked in contravention of the provisions of this By-law, the Officer finding the Vehicle shall attach to the Motor Vehicle a parking infraction notice in the form of a serially-numbered notice stating:
- The Motor Vehicle licence piate number, province of numbered plate issuance and validation expiry date of the plate;
- The date and time of the alleged offence; and
- That the Vehicle is unlawfully parked, providing the wording of the offence;
- The amount of the fine for the offence.
- The infraction notice shall be placed in a conspicuous place on the Vehicle.
- 11.3 No person shall hinder or obstruct, or attempt to hinder or obstruct, any person who is exercising a power or performing a duty under the Municipal Act or under a by-law passed under the Act.
## 12.0 PENALTIES
- 12.1. Every person who contravenes any provision of this By-law is guilty of an offence and, upon conviction, is liable to a fine as provided for in the Provincial Offences Act, as amended.
- 12.2 Each day on which a person contravenes any provision of this By-law shall be deemed to constitute a separate offence under this By-law as provided for ir Section 429(2) of the Municipal Act.
- and charges for care, storage, and removal thereof, if any, are a lien upon the Vehicle, collection of which may be enforced in the manner provided under Part Ill of the Repair and Storage Liens Act.
- The owner of a Vehicle may be charged and convicted of an offence under this By-law for which the driver of the Vehicle is subject to be charged unless, at the time of the offence, the Vehicle was in the possession of some person other than the owner without the owner's consent, and upon conviction, the owner is liable for the penalty described or provided for the offence.
## 13.0 EARLY VOLUNTARY PAYMENT OF PARKING PENALTIES
- 13.1 Notwithstanding all other provisions of this By-law in respect of penalties for violations of the provisions of this By-law, any person may, upon presentation of a violation tag issued alleging commission of such an offence under this By-law, pay out of Court within seven days from the date of said tag, a penalty, as determined by the Municipality and approved by the Attorney General, and upon such payment, no further proceedings shall be taken under this By-law in respect of the said offence alleged in the violation tag.
- ||13.2 In accordance with Section 432 of the Municipal Act, Early Voluntary Payment for offences under Part 1 of the Provincial Offences Act is not allowed.
- 13.3 As per Section 434.1 of the Municipal Act, and subject to legislative requirements, the Municipality, in its sole discretion, may implement Administrative Monetary Penalties in relation to this By-law, at any time.
## 14.0 SIGNS - STANDARDS, INVENTORY, INSPECTION
- 14.1 All Official Signs for traffic and parking control shall comply with the Highway Traffic Act, where applicable, and/or be consistent with the Ontario Traffic Manual.
- 14.2 All Official Signs shall comply with retroreflectivity requirements no later than January 1, 2029.
- 14.3 The Public Works Manager shall maintain an inventory of all Official regulatory and warning Signs and shall inspect signs as set out in O:Reg. 239/02 - Minimum Maintenance Standards.
## 15.0 SET FINE SCHEDULE
- 15.1 Council may, by Resolution, approve and/or amend the Set Fines under this Bylaw at any time. Any amendment made to the Set Fines by Resolution of Council will come into force and be effective upon approval of the Attorney General or his/her designate.
- | 15.2 Notwithstanding the above Section 15.1, Municipal Staff is authorized to make changes to this By-law or to the Set Fine Schedule without amendment to the Bylaw or Resolution of Council, if so required in order for the Set Fines to be approved by the Ministry of the Attorney General.
- 15.3 The Set Fine Schedule, ance approved by the Ministry of the Attorney General shall be atiached to this By-law for convenience and reference, but shall not forn part of the By-law.
## 16.0 ADMINISTRATIVE CORRECTIONS AND MINOR REVISIONS BY-LAW AND SCHEDULES
## 16.1 Administrative Corrections and Minor Revisions
Subject to the limitations and provisions of this Section, the Clerk is authorized to make minor, administrative, technical, or housekeeping corrections and revisions to this Bylaw and its Schedules without further amendment by Council
## 16.1.1 Scope of Permitted Revisions
- 16.1.1.1 Substantive regulatory changes to this By-law require an amendment passed by Council.
- 16.1.1.2 Administrative corrections may include, but are not limited to:
- a. correcting grammatical, typographical, formatting, or punctuation errors;
- b. correcting numbering, cross-references, headings, table of contents entries, or internal inconsistencies;
- c. correcting inconsistencies between a Schedule and a Council-approved amending by-law;
- updating references to statutes, regulations, standards, policies. departments, or job titles to reflect current names, citations, or terminology;
- e. correcting street names, addresses, legal descriptions, mapping references, or GPS coordinates to conform to registered plans or approved naming changes;
- updating Schedule formatting or layout for clarity, provided the intent and effect of the Schedule is not altered;
- consolidating amendments previously approved by Council for the purpose of administrative accuracy;
- h. consolidating amendments previousiy enacted by Council for the purpose of producing an updated version of this By-law and/or an Office Consolidation and/or a version of this By-law to be made available to the public.
## 16.1.2 Administrative Schedule Revisions
- 16.1.2.1: The Clerk may make minor administrative revisions to the Schedules attached to and forming part of this By-law without further amendment by Council, provided the adjustments are:
- a. necessary to correct errors or omissions;
- b. reflect field measurements or GPS coordinates that differ slightly from mapped or described distances;
- C. adjust distances by a minor amount to align with physical infrastructure (e.g. driveway edges, curb retums, utility poles, signage placement);
- d. clarify limits described as "from" and "to" where the intent is evident;
- e. required to reflect field conditions consistent with Council's approved intent;
- f. required to implement a control previously approved by Council but inaccurately described in the Schedule;
- g. required to reflect addressing changes/renumbering, street renaming, or minor geometric changes that do not alter the substance of the regulation; or
- h. implement a regulation previously approved by Council but inaccurately transcribed into a Schedule.
## 16.1.3 Limitations
- 16.1.3.1 No correction or revision made under this section shall:
- a. alter the intent, legal effect, scope, substance, legal effect of any provision, or application of this By-law;
- b. create a new regulatory requirement;
- C. remove, reduce, or expand an existing regulatory requirement;
- d. add, remove, or relocate a regulatory control listed in a Schedule unless previously authorized by Council resolution or by-law.
## 16.1.4 Record of Changes
All corrections and revisions made under this section shall be documented and retained by the Clerk.
## 16.2 Sign Installation/Relocation/Removal Authority
- 16.2.1 Upon written authorization by the Clerk or CAO, the Public Works Manager (or designate) may relocate a traffic or parking control device installed pursuant to this By-law where:
- a. the relocation does not change the type of regulation authorized by the Schedule;
- b. the relocation remains within the limits described in the Schedule; and
- C. relocation is necessary due to visibility, safety, grading, snow storage, construction, driveway access, or physical obstruction.
## 16.2.2 Relocation of a sign shall not:
- a. extend the limits of a restriction beyond those described in the Schedule;
- b. reduce the limits of a restriction in a manner that alters its intent;
- C. substitute orie type of restriction for another.
4. 16.2.3 For certainty, minor relocation of a sign within the regulated limits does not require amendment to the Schedule.
5. 16.2.4 Any signs installed must be Official Signs and/or in compliance with applicable Ontario Traffic Manuals.
## 16.3 Mapping/GIS
- 16.3.1 The Schedules to this By-law may be in written, tabular, or mapped form, including Geographic Information System (GIS) mapping maintained by the Municipality.
- 16.3.2 Where a Schedule is maintained as a map or in GIS format:
- a. the GIS map forms part of this By-law;

- the most current consolidated version maintained by the Clerk is the official version for reference purposes.
- 16.3.3 On authorization from the Clerk, the Finance Department/GIS Specialist may update mapping to reflect administrative corrections authorized under this
- 16.3.4 In the event of a conflict between a mapped Schedule or a provision on a mapped Schedule, and a written description, the written description approved by Council prevails.
## 17.0 ENACTMENT AND EFFECTIVE DATE; REPEAL OF PREVIOUS BY-LAWS
This By-law shall come into force and take effect on May 15, 2026, and thereupon will repeal By-law No. 1071 and any and all amendments thereto, and any previous traffic control by-laws not previously repealed.

## Controlling traffic with these measures:
- improves traffic flow, especially on busy curb lanes; and
- helps allocate curb space effectively for bus stops, taxi zones, loading zones, etc.

## TABLE?
## CLARIFICATION OF "THROUGH STREETS"
- A "Through Highway" or "Through Street" is a road that gives traffic on it the right-ofway at intersection. Traffic on intersecting roads is required to stop or yield before entering it, as signed. The term applies to the entire width of the public way, not just a single lane.
- Vehicles on a "Through Highway" or "Through Street" have the right-of-way and can proceed without stopping or yielding at intersections, unless signed otherwise.
- The system is designed to allow major traffic arteries to flow more freely by reducing interruptions from cross traffic.
- The formal designation of a "Through Highway" or "Through Street" by Municipal Bylaw legally establishes right-of-way control under the Highway Traffic Act (HTA) and gives legal force to Stop Signs and Yield Signs on side streets, meaning that drivers who fail to stop can be lawfully charged under the HTA.
- Having to stop or yield on a "Through Highway/Through Street" does not negate the "Thraugh Highway/Through Street" designation.
