CORPORATION OF THE TOWN OFSMITHS FALLS BY-LAW# 10667-2026 By-law to Amend By-Law 8712-2014 being a By-law to Establish and Regulate the Maintenance, Operations and Management of the Water System for the Town of Smiths Falls, and to Establish the Rates and Other Service Charges for Use of the System WHEREAS pursuant to the Municipal Act, 2001 as amended, a municipality may impose fees and charges on any class of persons for services or activities provided or done by or on behalf of the it, and WHEREAS Section 12 of Ontario Regulation 244/02 establishes the terms and conditions under which a municipality may impose fees or charges for the use of a water system or the consumption of water, and WHEREAS the municipality has met all the conditions listed in Section 12 of Ontario Regulation 244/02, and WHEREAS the Municipal Act, 2001 as amended provides for the imposition of interest charges and other penalties, including collection costs for fees and charges that are due and unpaid; discounts for early payment; fees and charges that vary on any basis the municipality considers appropriate and specifies in the by-law; the establishment of different classes of persons and gives authority to deal with each class in a different way; and the exemption in whole or in part of any class of persons from all or any part of the by-law, and WHEREAS Section the Municipal Act, 2001 as amended allows the municipality to add unpaid fees and charges to the taxes for the property and collect them as if they were outstanding taxes, and WHEREAS the Municipal Act, 2001 as amended gives authority to municipalities for the establishment of various policies and procedures for the operation and maintenance of the water system. NOW THEREFORE the Council of the Corporation of the Town of Smiths Falls enacts as follows: 1. THAT the fees and charges outlined in Schedule "B " Water Service Rates and Schedule "C" Additional Charges form part of this By-law. 2. THAT the fees and charges outlined in Schedule "B " Wastewater Service Rates form part of this By-law. 3. THAT By-laws 8712-2014 and 10604-2025 be hereby amended. 4. THAT the water and wastewater rates be effective as of January 1, 2026 5. THAT the provisions of this by-law shall come into force and take effect upon the passing thereof.
