The Corporation of the Town of South Bruce Peninsula By-Law Number 43-2024 Being a By-Law to Designate Community Safety Zones in the Town of South Bruce Peninsula Whereas Subsection 214.1(1) of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, authorizes the council of a municipality to designate by by-law part of a highway under its jurisdiction as a community safety zone, if in council's opinion public safety is of special concern on that part of the highway; And whereas the Council of the Corporation of the Town of South Bruce Peninsula deems it expedient and necessary to designate parts of highways in its jurisdiction as community safety zones. Now therefore the Council of the Corporation of the Town of South Bruce Peninsula enacts as follows: 1. Definitions For the purpose of this by-law, the following definitions shall apply: 1.1. "Council" means the Council of the Corporation of the Town of South Bruce Peninsula. 1.2. "Highway" means a highway as defined in the Highway Traffic Act of Ontario, R.S.O. 1990, Chapter H.8, as amended from time to time. 1.3. "Motor Vehicle" means a motor vehicle as defined in the Highway Traffic Act of Ontario, R.S.O. 1990, Chapter H.8, as amended from time to time. 1.4. "Official Signs" means a sign approved by the Ministry of Transportation and placed or erected on a highway or elsewhere pursuant to the provisions of this by-law. 2. Designation 2.1. Where official signs are erected or placed on highways in accordance with the regulations of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended from time to time. The highways set out in Column 1 and limits as defined in Column 2 and Column 3 of Schedule "A" are hereby designated as Community Safety Zones and shall be enforced during the period of times, days, or months as set out in Column 4 to the said Schedule "A". 3. Penalty 3.1. Every person who commits an offence under specified sections of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, on part of a highway designated as a community safety zone when it is in effect is liable on conviction to the fines set out in Section 214 of the Highway Traffic Act. 4. Severability 4.1. Should any section, sub-section, clause, paragraph or provision of this by-law including any part of Schedule "A" be declared by a court of competent jurisdiction to be ultra vires, invalid, or illegal for any reason, the same shall not affect the validity of the by-law as a whole. 5.
