By-Law Number 42-2024
Being a By-Law to Regulate and Control Speed
on Municipal Highways Within the Town of
South Bruce Peninsula
Whereas Section 128 (2) of the Highway Traffic Act, Chapter H. 8 R. S. 0. 1990,
as amended, authorizes the council of a municipality to prescribe by by-law a
speed limit not greater than 100 kilometers per hour for motor vehicles driven on
any highway or portion of highway under its jurisdiction;
And whereas it is deemed expedient by Council to restrict the speed of motor
vehicles on certain highways in the Corporation of the Town of South Bruce
Peninsula.
Now therefore the Council of the Corporation of the Town of South Bruce
Peninsula enacts as follows:
1.
Definitions
For the purpose of this by-law, the following definitions shall apply:
Built Up Area shall mean an area adjacent to any highway where there is an
intensification of dwellings, buildings used for business purposes, schools or
churches.
Highway shall mean any road, allowance, lane, street, avenue, drive or any other
area intended for the passage of motor vehicles.
Motor Vehicle shall mean an automobile, a motorcycle, a motor-assisted bicycle
and any other vehicle propelled or driven otherwise than by muscular power, but
does not include a street car or other motor vehicle running only upon rails, a
power-assisted bicycle, a motorized snow vehicle, a traction engine, a farm
tractor, a self-propelled implement of husbandry or a road-building machine

Speed Limit Designation (20 km/hr)
When any highway or portion of highway as set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be twenty kilometers per hour (20 km/hr)
for motorized vehicles.

Speed Limit Designation (30 km/hr)
When any highway or portion of highway as set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be thirty kilometers per hour (30 km/hr)
for motorized vehicles.

4.
Speed Limit Designation (40 km/hr)
When any highway or portion of highway as set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be forty kilometers per hour (40 km/hr)
for motorized vehicles.

When any highway or portion of highway as set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be fifty kilometers per hour (50 km/h) for
motorized vehicles.

Speed Limit Designation (60 km/hr)
When any highway or portion of highway as set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be sixty kilometers per hour (60 km/h)
for motorized vehicles.

Speed Limit Designation (70 km/hr)
When any highway or portion of highway set forth in this section is marked in
compliance with the regulations contained in the Highway Traffic Act, the
maximum rate of speed thereon shall be seventy kilometers per hour (70
km/hr) for motorized vehicles.

Speed Limit Designation (80 km/hr)
Where any highway or portion of highway is not within a built-up area and having
not been previously mentioned in this by-law, it is assumed that the rate of speed
for motorized vehicles will be eighty kilometers per hour (80 km/hr) in
accordance with Section 128 1 (b) of the Highway Traffic Act.
9.
The penalties provided in Section 128 (14) of the Highway Traffic Act shall
apply to offences under this by-law.
10.
Any by-law inconsistent with this by-law is hereby rescinded.
11.
This by-law shall come into full force and effect upon the final passing
thereof.
