The Corporation of the Municipality of South Huron By-Law 52-2025 Being a By-Law to Prescribe a Rate of Speed for Motor Vehicles Driven within Settlement Areas in the Municipality of South Huron Whereas The Municipal Act S.0. 2001, Section 27 (1) provides that a municipality may pass by-laws in respect of a highway only if it has jurisdiction over the highway; and Whereas The Highway Traffic Act R.S.0. 1990, c. H. 8 Section 128 (2) provides that the council of a municipality may, for motor vehicles driven on a highway or portion of a highway under its jurisdiction, by By-law prescribe a rate of speed different from the rate set out in subsection (1); and Whereas The Highway Traffic Act R.S.0. 1990, Section 1 (1) definition for "highway" includes a common and public highway, street, avenue; parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof; and Whereas the Council of the Municipality of South Huron deems it expedient to ensure the safety of the public by reducing the speed limit on all urban areas and streets that are under the Jurisdiction of the Municipality of South Huron. Now therefore be it resolved that the Council of the Corporation of the Municipality of South Huron enacts as follows: 1. That the rate of speed be set at 40 kilometres per hour for motor vehicles driven on all streets located within a settlement area, as set out in the Municipal Official Plan, that are under the jurisdiction of the Municipality of South Huron, save and except for a. Community Safety Zones as set out in Schedule "A" be set at 30 kilometres per hour b. Huron Street East, heading towards Morrison Line (1km west from Morrison Line), be set at 50 kilometres per hour; and c. Goshen Line, 400 meters North of Crediton Road, be set at 60 kilometres per hour. d. Huron Street West, from Main Street to William Street, to be set at 20 kilometres per hour. 2. That this bylaw does not apply to any streets within a settlement area, as set out in the Municipal Official Plan, that fall under the jurisdiction of the Ministry of Transportation or Huron County. 3. That penalties provided in the Highway Traffic Act Section 128 (14) shall apply to every person who contravenes this by-law. 4. This by-law takes effect upon the date that the highway or portion thereof affected by it is signed in accordance with the Highway Traffic Act, R.S.O. 1990 and its regulations.
