THE CORPORATION OF THE TOWNSHIP OF SOUTHGATE BY-LAW NUMBER 2024-130 being a by-law to regulate traffic and parking on highways within the Township of Southgate road system Whereas the Municipal Act, 2001, Chapter 25, as amended, Section 5 (3), states that municipal power, including a municipality's capacity, rights, powers and privileges, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; and Whereas Section 8 of the Municipal Act, 2001, Chapter 25, as amended, provides that a municipality has the authority to govern its affairs as it considers appropriate and enables the municipality to respond to municipal issues; and Whereas Section 9 of the Municipal Act, 2001, Chapter 25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; and Whereas Section 11(1), Paragraph 3 of the Municipal Act, 2001 S.0. 2001, c. 25, provides municipalities the authority to pass by-laws respecting parking; and Whereas the Corporation of the Township of Southgate deems it expedient to provide that all parking throughout the Township of Southgate shall be monitored; and Whereas the provisions of this By-law shall be subject to the provisions of the Highway Traffic Act, Chapter H.8, R.S.O. 1990, as amended from time to time; and Whereas subsection 128 (2) of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended, authorizes the Council of a municipality to prescribe a rate of speed different from the rate set out in subsection 128 (1) for motor vehicles driven on a highway or portion of a highway under its jurisdiction; and Whereas Section 122 (7) of the Highway Traffic Act, R.S.0. 1990, chapter H.8, as amended, provides that the municipal corporation or other authority having jurisdiction over a highway may by by-law designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies; and Now therefore be it resolved that the Corporation of the Township of Southgate hereby enacts as follows: 1. Definitions In this by-law: "Authorized Sign" shall mean a sign approved by the Ministry of Transportation of the Province of Ontario or a sign approved by the Township which includes words or symbols which describe a permitted or prohibited act, and which have been erected by authorized agents of the Township pursuant to this By-law and without limiting the generality of the foregoing, includes a traffic control device and a traffic control signal. "Accessible Parking Permit" shall mean an unexpired accessible parking permit issued under O. Reg. 581 of the Highway Traffic Act. "Boulevard" shall mean that part of the Highway situated between the Shoulder and/or curb line of a Roadway and the property lines of the lots abutting the Highway but does not include a Sidewalk or a Shoulder. "By-law Enforcement Officer" shall mean a person appointed by the Municipality to enforce or carry out the provisions of this by-law or any part or parts thereof. "Chief Fire Official" shall mean the Fire Chief or their designate. "Coasting" shall mean moving easily without using power. "Conveyance" includes any or all a skateboard or longboard that carries a person or persons but does not include a bicycle or anything drawn by animals. "Council" shall mean the municipal Council elected for the Corporation of the Township of Southgate unless otherwise specified. "Crosswalk" shall mean that part of a highway at an intersection which is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or, in the absence of curbs, from the edges of the travelled portion of the highway or any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs including a Traffic Control Device or Traffic Control Signal or by lines or other markings on the road surface. "Currently Validated Permit" shall mean a permit issued for a Motor Vehicle pursuant to Section 7 of the Highway Traffic Act which is currently validated within the meaning of that section. "Detachment Commander" shall mean the Detachment Commander of the Police Service serving within the boundaries of the Township of Southgate. "Disabled Person" shall mean a person who has been issued a Disabled Person Parking Permit. "Disabled Person Parking Permit" shall mean a current disabled person parking permit issued by and displayed in accordance with the Highway Traffic Act. "Driveway" shall mean the improved land on a Highway that provides vehicular access from the Roadway to adjacent land. "Electric Vehicle (EV) Parking Space" shall mean a parking space designated for the use of EVs while plugged into an EV Charging Station, as indicated by authorized signs. "Emergency Vehicle" means a fire department vehicle, a vehicle used by a police officer while on duty, or an ambulance. "Fire Route" shall mean a public or private roadway or an access route for fire department vehicles to gain access to a building or a property in response to an emergency. "Heavy Vehicle" shall mean a commercial vehicle having a total rated vehicle weight when unloaded of two (2) tonnes or more according to the Highway Traffic Act registration permit number relating thereto, but does not include an ambulance, or police, or fire department vehicle, or public utility vehicle or a school bus engaged in transporting children to or from school functions. "Highway" has the same meaning as in the Highway Traffic Act, R.S.O. 1990, c. H.8. "Highway Traffic Act" shall mean the Highway Traffic Act, R.S.O. 1990 c. H.8, as amended, and all versions thereafter and the regulations thereunder. "Intersection" shall mean the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more Highways that join one another at an angle, whether one Highway crosses the other. "Loading and Unloading Berth" shall mean a space designated for the loading or unloading or both of goods and materials for delivery of same. "Motor Vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other Motor Vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act. "Municipality" shall mean The Corporation of the Township of Southgate. "Municipal Parking Lot" shall mean an off-street parking area owned by the Township or operated by the Township pursuant to an agreement with the owner thereof. "Official Sign" shall mean a sign approved by the Ministry of Transportation of the Province of Ontario or the Township. "Park, Parking or Parked" shall mean the standing or stopping of a Vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. "Parking Space" shall mean that part of the Highway, the use of which is designated for the purpose of Parking a Vehicle. "Pedestrian" shall mean any person afoot, children in wheeled carriages, a person operating a wheelchair, or any person upon roller skates, or riding in or by means of any coaster, toy sleigh, sleigh, cart, express wagon or similar device. "Person with a Disability" shall mean a Person with a Disability as defined under O. Reg. 581 of the Highway Traffic Act. "Police Officer" shall mean a member of the Ontario Provincial Police or member of any Police Service providing policing for the Township. "Provincial Offences Act" shall mean the Provincial Offences Act, R.S.O. 1990 c. P.22, as amended, and all versions thereafter and the regulations there-under. "Provincial Offences Officer" shall mean a provincial offences officer within the meaning of the Provincial Offences Act. "Public Lane" shall mean land adjacent to the Highway that provides access from the Highway to a Parking area on adjacent land that is used by the general public. "Repair and Storage Liens Act" shall mean the Repair and Storage Liens Act R.S.O. 1990, Chapter R.25 and all versions thereafter. "Roadway" shall mean the part of the Highway that is improved, designed, or ordinarily used for vehicular traffic, but does not include the Shoulder, and where a Highway includes two or more separate Roadways, the term Roadway refers to any one Roadway separately and not to all of the Roadways collectively. "Set Fine" shall mean the set fine as defined in the Provincial Offences Act. "Short Term Parking" shall mean Parking during the Hours of Enforcement for less than or equal to two hours of permitted parking time within a Parking Space. "Shoulder" shall mean that portion of the Highway lying adjacent to the Roadway that is improved with granular or paved surface and is not intended for the passage of vehicular traffic. "Sidewalk" shall mean that portion of a Highway between the curb line and the property line of the lot abutting the Highway improved for the use of Pedestrians. "Sign" shall mean a Sign erected under the authority of a by-law of County of Grey for the purpose of guiding and directing traffic. "Stand" or "Standing", when prohibited, shall mean the halting of a Vehicle, whether occupied or not, except for the purpose of and while engaged in receiving or discharging passengers. "Stop or Stopping", when prohibited, shall mean the halting of a Vehicle, even momentarily whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a Police Officer or a Traffic Control Device or a Traffic Control Signal. "Township" shall mean the Corporation of the Township of Southgate. "Traffic" includes Pedestrians, ridden or herded animals, buses and other conveyances either singly or together while using any Highway for the purpose of travel. "Through Highway" shall mean a Highway or part of a Highway designated as such by by-law of the Municipality, and every such Highway shall be marked by a Stop Sign or yield right-of-way Sign in compliance with the regulations of the Highway Traffic Act. "Time" means, whenever certain hours are named herein, Standard Time or Daylight-Saving Time, which ever shall be in official use in the Municipality. "Traffic Control Device" shall mean a Sign, marking or other device on a Highway for the purpose of controlling, guiding or directing Traffic and/or Parking in the Municipality. "Traffic Control Signal" shall mean any device, manually, electronically or mechanically operated for the regulation of Traffic and/or Parking in the Municipality. "U Turn" shall mean to turn a Vehicle within a Roadway to proceed in the opposite direction. "Vehicle" or "Vehicles" includes a Motor Vehicle, trailer, traction engine, farm tractor, road building machine, motorcycle, trailer, bicycle and any vehicle drawn, propelled, or driven by any kind of power including muscular power, but does not include a motorized snow vehicle or streetcar. "Village" includes Dundalk, Holstein, Swinton Park, Dromore, Cedarville and Proton Station. "Well Head Protection Area" shall mean a vulnerable area that surrounds a municipal drinking water groundwater well. WHPA "A" is the 100 metre circle around the municipal well as outlined in the Clean Water Act, 2006. 2. Obedience to Parking and Traffic Regulations 2.1 Enforcement of By-law a) All Police Services serving the municipalities within the boundaries of the Township of Southgate may enforce the provisions of this by-law. b) Notwithstanding Subsection 2.1(a), Municipal By-law Enforcement Officers appointed by the Township of Southgate within the geographical boundaries of Southgate for that purpose are authorized to enforce the provisions of the by-law. 2.2 Obedience to Police Officers a) In the event of road construction, repairs or maintenance, the erection or placement of Traffic Control Devices, or in the event of a fire or other emergency or during a parade or other procession, Parking may be temporarily regulated by any Police Officer or by Signs erected or placed at the direction of the Detachment Commander having jurisdiction as conditions may require, and no person shall disobey or refuse to comply with the orders, signal or direction of such Police Officer or such Sign. 2.3 Notwithstanding any other provisions of the By-law, if a Motor Vehicle is parked contrary to the By-law, in addition to any other remedy, a Police Officer or By-law Enforcement Officer may remove such motor vehicle or cause same to be removed to and be stored in a suitable place, and all costs and charges for removal or storage thereof shall be a lien upon such motor vehicle. 3. Erection of Traffic Control Devices 3.1 The Southgate Public Works Manager, or their designate, is authorized to place or to erect and to maintain such Signs as may be necessary to give effect to the provisions of this by-law. 3.2 No person shall place, maintain or display upon, or in view of, any Highway, any Sign, signal, marking or device which purports to be or is an imitation of or resembles any Sign, signal, marking or device or which conceals from view or interferes with the effectiveness of any Sign, signal, marking or device erected, placed or maintained pursuant to this by-law. 3.3 No person shall willfully move, alter, deface or otherwise interfere with any Sign or marking erected, placed or maintained pursuant to the provisions of this by-law. 4. Regulated Parking, Standing and Stopping 4.1 Method of Parking a) Where there is no curb on a Highway, no person shall Park a Vehicle on a Highway unless such Vehicle is Parked on the right- hand side of the Highway, with the right front and right rear wheels of the Vehicle as near to the right hand limit of the Highway as is practicable without Stopping or Parking on a Side-walk or footpath or any part of the Highway where grass is grown or which is not intended for the use of Vehicles. 4.2 No Parking Where Authorized Sign is on Display Except by Accessible Parking Permit a) When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle in any Parking Space or area described in Schedule "G" provided however that the provisions of this Section shall not apply to a Motor Vehicle used for the purpose of transporting persons who hold, and have on display, a valid Accessible Parking Permit issued pursuant to the Highway Traffic Act as amended from time to time. 4.3 No Parking for Restricted Times During Winter Season a) When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of a Highway during the hours specified and, on the days, set out on Schedule "H". 4.4 Removal of Vehicles a) Where any Vehicle is Parked in contravention of this by-law, a Provincial Offences Officer, or By-law Enforcement Officer may cause it to be moved or taken to and placed in storage, and all costs for removing and storing the Vehicle shall be a lien upon the Vehicle which may be enforced in the manner provided for in the Repair and Storage Liens Act. The provisions of this sub-section do not apply to the driver or operator of a Vehicle that is so disabled while on a Highway that it is impossible to avoid a contravention of the provisions of this by-law on a temporary basis. 4.5 Disabled or Unlicensed Vehicles and Trailers a) No person shall park a Motor Vehicle on a Highway unless such Motor Vehicle has evidence of a currently Validated Permit displayed in accordance with the requirements of the Highway Traffic Act. b) No person shall park or store a disabled vehicle, boat, trailer or travel trailer for a period exceeding 72 hours unless such vehicle is stored in an enclosed accessory building or garage. c) No person shall park or store an unlicensed vehicle unless such vehicle is stored in an enclosed accessory building or garage, except one boat and one unoccupied travel trailer may be stored in a side or rear yard. 4.6 Parking and Stopping Prohibited a) No person shall Park or Stop a Vehicle on a Highway in any of the following places: i. on or overhanging a Sidewalk, Curb or Boulevard; ii. a motor vehicle in, or within six metres from a crosswalk; iii. in front of or within 1 meter of a Driveway or to prevent ingress or egress to or from such Driveway; iv. in front of or within a public lane; v. in such a position as to prevent the removal of any other Parked Vehicle; vi. in front of the entrance to any emergency exit from a hospital, theatre, auditorium, or other commercial, industrial, institutional or other places of public assembly; vii. within 9 metres of an intersection; viii. within 3 meters from any fire hydrant; ix. on the front lawn of a residence within a village; x. on any bridge, or on the approaches thereto; xi. on any Highway in such a manner as to obstruct Traffic; xii. on any Highway in such a manner as to obstruct road repair; xiii. on any highway between the hours of 12:00 a.m. and 7:00 a.m. during the period of November 15 to April 15; or b) No person shall park or stop a commercial vehicle overnight within a 100- meter radius of a Well Head Protected Area (WHPA "A") c) Parking Spaces Where Parking Spaces are designated on a Highway, no person shall Park a Vehicle in such manner as to infringe upon or take up more than one Parking Space. d) Parking is Prohibited where an Authorized Sign is on display. When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of Highway set out in Schedule "C". e) No Parking for Restricted Times When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of a Highway for a longer period than specified as the Parking limit within the hours and on the days set out on Schedule "C". f) Stopping Prohibited Where Authorized Sign is on Display When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of Highway set out in Schedule "E". g) Electric Vehicle Charging Parking Spaces No Vehicle shall be parked in an EV parking space unless the vehicle is an EV and is plugged in to the station's charging equipment as per the Reserved Parking for Electric Vehicle Charging Act, 2019, S.O. 2019, c. 18, as set out in Schedule "I". 5. Designated Fire Routes 5.1 Fire Routes may be located upon a highway, public parking lot or private property where authorized signs are erected. 5.2 Fire Routes are designated and regulated in accordance with Township of Southgate By-law No. 2023-027 and administered by the Chief Fire Official. 5.3 No person shall stop, stand or park within a designated fire route. 5.4 Fire Routes established on public highways and public property in the Municipality are identified on Schedule "F", forming part of this by-law. 6. Traffic Regulations 6.1 Delegated Authority a) The Public Works Manager, or their designate, the Chief Fire Official, or their designate, and Police Officers shall have the authority to close any highways and/or parts of any Highways within the Municipality. 6.2 Through Highways, Stop Signs and Yield Signs a) Through Highways - Stop i. The designation of a Highway or part of a Highway as a Through Highway shall not include any Intersection thereon, where the road intersected is a King's Highway or where Traffic Control Signals are installed. ii. Stop Signs shall be erected at the Intersections of all Highways entering a Through Highway as designated in Column 1 of Schedule "K" to this by-law facing the direction of Traffic specified in Column 2 of said Schedule on the Highways named in Column 3 of said Schedule. b) Yield Signs Yield right-of-way Signs shall be erected at the Intersections set out in Column 1 of Schedule "L" to this by-law facing the direction of Traffic specified in Column 2 of said Schedule, on Highways named and/or described in Column 3 of said Schedule. 6.3 Turns a) Prohibition i. U-Turns Where a U-Turn sign, or a sign to that effect is on display, no person operating a Vehicle shall make a U-turn on any Highway or part of any Highway under the jurisdiction of the Municipality. ii. Temporary Signs A Police Officer or the Public Works Manager, or their designate may authorize temporary signs prohibiting turns at any Intersection and while such a sign is on display, no person operating a Vehicle shall turn that Vehicle in any direction contrary to the sign. 6.4 Rates of Speed a) Highway Speed Limits i. Not Within Built-Up Areas The rate of speed shall be 80 km/hr on a Highway not within a built-up area, unless otherwise posted with a Sign. ii. Within Built-Up Areas The rate of speed shall be 40 km/hr on a Highway within a built-up area, unless otherwise posted with a Sign. iii. When Signs, marked in compliance with the regulations under the Highway Traffic Act, are on display, no person shall drive a Motor Vehicle upon the Highways named and/or described in Column 1 of Schedule "N" to this by-law from the location or Highway named and/or described in Column 2 of the said Schedule to the location or Highway named and/or described in Column 3 of the said Schedule at a greater rate of speed than is described in Column 4 of the said Schedule. iv. When Signs, marked in compliance with the regulations under the Highway Traffic Act, are on display in a school zone, no person shall drive a Motor Vehicle upon the Highways named and/or described in Column 1 of Schedule "O" to this by-law at the locations described in Column 2, at the rate of speed set forth in Column 3 and during the Times set forth in Column 4 of the said Schedule. b) Construction Zones i. The Southgate Public Works Manager, or their designate, may designate a highway or portion of a highway under the Municipality's jurisdiction as a Construction Zone. ii. The Southgate Public Works Manager, or their designate, may set a lower rate of speed for motor vehicles driven in the designated Construction Zone. iii. The designated construction zone or lower rate of speed for motor vehicles shall not be effective until the affected highway or portion of a highway under the Municipality's jurisdiction is marked by signs in accordance with the regulations of the Highway Traffic Act. c) Community Safety Zone Pursuant to the provisions of the Highway Traffic Act, the Municipality hereby deems that public safety is of a special concern on the Highways as set forth in Column 1 of Schedule "P", at the locations described in Column 2, from a point set out in Column 3 to a point set out in Column 4 anytime. 6.5 Limited Loads on Highways a) No Heavy Vehicle Route - Anytime When signs are posted prohibiting heavy vehicles, no one shall drive or operate a heavy vehicle on the designated highways, except for the routes listed in Column 1 of Schedule "Q" These vehicles may only travel between the locations listed in Columns 2 and 3 of the schedule, at any time. b) No one shall drive, stop, park, or operate a heavy vehicle on a prohibited highway during the times specified in Schedule "R" of this by-law. c) No one shall allow a heavy vehicle to be driven, stopped, parked, or operated on a prohibited highway during the times specified in Schedule "R." d) The restrictions in sections 6.4(b) and 6.4(c) do not apply to heavy vehicles making deliveries or collections to locations that can only be reached via the prohibited highway. In such cases, the vehicle may use the prohibited highway only as far as necessary to reach and depart from the premises. e) Detours posted for section 6.4(a) do not apply to heavy trucks if following the detour is impractical unless the detour is officially established. f) This section does not apply to any Vehicle owned or operated by the Municipality. 6.6 Limited Loads on Highways - Restricted Times (Half Load Season) a) When signs are displayed as indicated, the rules under Subsections 1, 2, 3, and 4 of Section 122 of the Highway Traffic Act apply to the highways listed in Column 1 of Schedule "S" from March 1st to April 30th each year. b) No one shall operate a heavy vehicle with a load exceeding 5 tonnes per axle on a roadway during restricted times. c) The Township of Southgate Public Works Manager, or their designate, may adjust the load restriction period to start earlier than March 1st or extend it beyond May 1st if necessary. d) The Township of Southgate Public Works Manager, or their designate, may lift the load restriction before May 1st if appropriate. e) The Township of Southgate Public Works Manager, or their designate, may grant exemptions allowing loads exceeding 5 tonnes per axle on a case-by- case basis, depending on the specific day and road. f) Heavy vehicles are permitted on highways with no load restrictions between March 1st and April 30th each year, as listed in Column 1 of Schedule "S". These vehicles are permitted to travel from the location or highway listed in Column 2 to the location or highway listed in Column 3 of the schedule. g) This section does not apply to any Vehicle owned or operated by the Municipality. 6.7 Limited Loads on Bridges a) When Signs have been erected and are on display and so indicate, the provisions of Subsections 1 of Section 123 of the Highway Traffic Act apply to the Highways named in Column 1 of Schedule "T" to this by-law, at the bridge structure named and/or described in Column 2 of the said Schedule, for the restrictions described in Column 3 of the said Schedule. b) This section does not apply to any Vehicle owned or operated by the Municipality. 6.8 Coasting a) No person upon a conveyance shall go upon a highway, other than on the sidewalk, except for the purposes of crossing a highway in a perpendicular direction to its lateral property lines. b) Without limiting the generality of subsection 6.8 a), every person upon a conveyance shall, always: i. Exercise due care and attention to their safety; ii. Travel in a manner and at a speed appropriate to the surface being travelled upon; iii. Exercise due care and attention to the safety of all other users of the sidewalk and shall yield to pedestrians; and iv. Adhere to the provisions of the Highway Traffic Act, R.S.O. 1990, c. H.8, where applicable. c) No person shall coast or ride upon a conveyance in such a manner so as to cause any damage to public or private property. d) No person shall coast or ride upon a conveyance in such a manner to obstruct or interfere with vehicular and bicycle traffic or riders on horseback, and horse & buggies. e) No person shall coast or ride upon a conveyance in an aggressive or dangerous manner including speeding and racing. 7. Exemptions 7.1 All Emergency Vehicles are exempt from Sections 4, 5 and 6 of this by-law. 8. Offences and Penalties 8.1 Any person who contravenes any provision of this by-law is guilty of an offence and upon conviction, shall be liable to a fine as provided for under the Provincial Offences Act. 8.2 Every person who contravenes any of the provisions of Sections 6.2(a)(i),6.3 (a), 6.3(c), 6.4(a) and or 6.7(a) of this by-law is guilty of an offence and upon conviction, shall be subject to penalties prescribed by the Highway Traffic Act. 8.3 The owner of a Vehicle that is Parked or Stopped in contravention of this by- law is guilty of an offence and upon conviction is liable to the fine stated in this by-law unless such owner proves to the satisfaction of the court that at the Time of the offence the Vehicle was in the possession of another person without that owner's consent, express or implied. 9. Conflict 9.1 In the event that a provision of this by-law is inconsistent with the Highway Traffic Act, the Municipal Act, their respective regulations, or any other Act or regulation, the provision of the Act or regulations shall prevail. 10. Validity and Severability 10.1 Should any section, subsection, clause, paragraph or provision of this bylaw be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of this by-law as a whole or any part thereof, other than the part so declared to be invalid. 11. Indemnification 11.1 The applicant shall indemnify and save harmless the Township of Southgate from any and all claims, demands, causes of action, loss, costs or damages that the Township of Southgate may suffer, incur or be liable for resulting from the performance of the applicant as set out in the bylaw, whether with or without negligence on the part of the applicant, or the applicant's employees, directors, contractors and agents. 12. General 12.1 This By-law may be referred to as the "Traffic and Parking By-law". 12.2 The schedules referred to in this by-law shall form and become part of this by-law and each entry in the columns of such schedules shall be read in conjunction with the entry or entries across horizontally and not otherwise. 12.3 Except as specified in Section 12.4 below, By-Laws No. 77-2007, 51-2015, 09-2016, 2020-005, 2021-007, 2021-103, 2021-124, 2021-160, 2022-168, 2023-037 and all by-laws pertaining to the regulation of Traffic and Parking on Highways in the Municipality that are inconsistent with the terms of this by-law, be and the same are hereby repealed. 12.4 The by-laws referred to in Section 12.3 above shall continue to apply as if not repealed with respect to any prosecution thereunder commenced prior to the date referred to in Section 12.5 below. 12.5 That this By-law shall come into force and take effect on the 20th day of November 2024 save and except for those offences under Set Fine Schedule "A" which will take effect on the date of provincial approval of Set Fine Schedule "A" of this by-law.
